第二条（経過措置）

The employment insurance separation slip under before amendment (hereinafter referred to as the "Former Ordinance"), the employment insurance insured person's certificate under of the Former Ordinance, the employment insurance qualified recipient's certificate under of the Former Ordinance, the written notice of extension of the benefit period under of the Former Ordinance, the employment insurance elderly qualified recipient's certificate under of the Former Ordinance, the employment insurance specially qualified recipient's certificate under of the Former Ordinance, and the insurance record book for insured day workers under of the Former Ordinance that are actually issued on the day on which this Ministerial Order comes into effect (hereinafter referred to as the "Effective Date") are deemed to be, respectively, the employment insurance separation slip under Article 7, paragraph (2) of the Ordinance for Enforcement of the Employment Insurance Act after amendment (hereinafter referred to as the "New Ordinance"), the employment insurance insured person's certificate under of the New Ordinance, the employment insurance qualified recipient's certificate under of the New Ordinance, the written notice of extension of the benefit period under of the New Ordinance, the employment insurance elderly qualified recipient's certificate under of the New Ordinance, the employment insurance specially qualified recipient's certificate under of the New Ordinance, and the insurance record book for insured day workers under of the New Ordinance.

この省令の施行の日（以下「施行日」という。）において、現に交付されている改正前の雇用保険法施行規則（以下「旧規則」という。）の規定による雇用保険被保険者離職票、の規定による雇用保険被保険者証、の規定による雇用保険受給資格者証、の規定による受給期間延長通知書、の規定による雇用保険高年齢受給資格者証、の規定による雇用保険特例受給資格者証及びの規定による日雇労働被保険者手帳は、それぞれ改正後の雇用保険法施行規則（以下「新規則」という。）第七条第二項の規定による雇用保険被保険者離職票、新規則第十条第一項の規定による雇用保険被保険者証、新規則第十七条の二第一項の規定による雇用保険受給資格者証、新規則第三十一条第三項の規定による受給期間延長通知書、新規則第十七条の二第一項の規定による雇用保険高年齢受給資格者証、新規則第十七条の二第一項の規定による雇用保険特例受給資格者証及び新規則第十七条の二第一項の規定による日雇労働被保険者手帳とみなす。

The written application for exclusion from the application of employment insurance under of the New Ordinance, the employment insurance notification of loss of insured status under of the New Ordinance, the employment insurance written application for reissuance of an insured person's certificate under of the New Ordinance, the employment insurance notification of transfer out of an insured person under of the New Ordinance, the employment insurance notification of change of name under of the New Ordinance, the written declaration for recognition of unemployment under of the New Ordinance, the certificate of attendance at public vocational training, etc. under of the New Ordinance, the notification of designation of the desired financial institution for payment under of the New Ordinance, the notification of change of the desired financial institution for payment under of the New Ordinance, the specially qualified recipient's written declaration for recognition of unemployment under of the New Ordinance, the employment insurance written application for voluntary enrollment as an insured day worker under of the New Ordinance, the notification of acquisition of insured status as an insured day worker under of the New Ordinance, the written application for authorization to continue insured status as an insured day worker under of the New Ordinance, the written application for re-employment allowance under of the New Ordinance, the written decision on payment of relocation expenses under of the New Ordinance, and the certificate of relocation under of the New Ordinance may, for the time being, continue to be in the corresponding forms of the Former Ordinance.

新規則第五条第一項の雇用保険適用除外申請書、新規則第七条第一項の雇用保険被保険者資格喪失届、新規則第十条第三項の雇用保険被保険者証再交付申請書、新規則第十三条第一項の雇用保険被保険者転出届、の雇用保険被保険者氏名変更届、新規則第二十二条第一項の失業認定申告書、新規則第二十七条の公共職業訓練等受講証明書、新規則第四十五条第二項の払渡希望金融機関指定届、新規則第四十五条第三項の払渡希望金融機関変更届、新規則第六十九条第一項の特例受給資格者失業認定申告書、新規則第七十一条第一項の雇用保険日雇労働被保険者任意加入申請書、新規則第七十二条第一項の日雇労働被保険者資格取得届、新規則第七十四条第一項の日雇労働被保険者資格継続認可申請書、新規則第八十二条の四第一項の再就職手当支給申請書、新規則第九十三条の移転費支給決定書及び新規則第九十四条第二項の移転証明書は、当分の間、なお旧規則の相当様式によることができる。

For the application of the provisions of of the New Ordinance to an employer that employs an insured person who reached the age of 60 before the Effective Date, in paragraph (1) of that Article, "insured person it employs" is deemed to be replaced with "insured person aged 60 or older whom it has continued to employ from a day before the Effective Date and employs on a day after the Effective Date", and "reaches the age of 60, within 10 days counting from the day following the day of that fact," is deemed to be replaced with ", by July 31, 1995, prepared on the basis of the wages before the Effective Date pertaining to that insured person"; in , "the day in a month subject to payment prescribed in Article 61, paragraph (2) of the Act that corresponds to the day on which that insured person reached the age of 60 (in a month with no corresponding day, the last day of that month)" is deemed to be replaced with "a day after the Effective Date", "pursuant to the preceding paragraph" with "the provisions of the preceding paragraph as applied by replacing terms under (Order of the Ministry of Labour No. 1 of 1995)", "the day on which that insured person reached the age of 60" with "the Effective Date", and "on the day on which the person reached the age of 60" with "on the Effective Date".

施行日前に六十歳に達した被保険者を雇用する事業主に対する新規則第十四条の二の規定の適用については、同条第一項中「雇用する被保険者」とあるのは「施行日前の日から引き続き施行日後の日において雇用する六十歳以上の被保険者」と、「が六十歳に達したときは、当該事実のあつた日の翌日から起算して十日以内に、」とあるのは「について、平成七年七月三十一日までに当該被保険者に係る施行日前の賃金を基礎として作成した」と、中「当該被保険者が法第六十一条第二項に規定する支給対象月において六十歳に達した日に応当する日（その日に応当する日がない月においては、その月の末日）」とあるのは「施行日後の日」と、「の規定による」とあるのは「において読み替えて適用するの規定」と、「当該被保険者が六十歳に達した日」とあるのは「施行日」と、「六十歳に達した日において」とあるのは「施行日において」とする。

For the application of the provisions of of the New Ordinance to an employer that employs an insured person who commenced the leave prescribed in before the Effective Date, in of the New Ordinance, "within 10 days counting from the day following the day on which that leave commenced" is deemed to be replaced with "by July 31, 1995".

施行日前にに規定する休業を開始した被保険者を雇用する事業主に対する新規則第十四条の三の規定の適用については、同条第一項中「当該休業を開始した日の翌日から起算して十日以内に」とあるのは、「平成七年七月三十一日までに」とする。

The provisions of of the New Ordinance apply to the payment of the employment adjustment grant pertaining to leave, educational training, or secondment implemented on or after the Effective Date, and with regard to the payment of the employment adjustment grant pertaining to leave, educational training, or secondment implemented before the Effective Date, the provisions then in force continue to govern.

新規則第百二条の三第二項の規定は、施行日以後に行われた休業、教育訓練又は出向に係る雇用調整助成金の支給について適用し、施行日前に行われた休業、教育訓練又は出向に係る雇用調整助成金の支給については、なお従前の例による。

With regard to the payment of the industrial employment stabilization incentive under of the Former Ordinance pertaining to vocational training under commenced before the Effective Date, the change of assignment accompanying business conversion under (b), (2) of carried out before the Effective Date, and hiring through secondment or the arrangement of re-employment under (c), (1) of on a day before the Effective Date, the provisions then in force continue to govern.

施行日前に開始されたイ（２）の職業訓練、施行日前に行われたロ（２）の事業転換に伴う配置転換及び施行日前の日におけるハ（１）の出向又は再就職のあつせんによる雇入れに係るの産業雇用安定奨励金の支給については、なお従前の例による。

With regard to the payment of the grant for employment development of specified job seekers under of the Former Ordinance pertaining to hiring on a day before the Effective Date, the provisions then in force continue to govern.

施行日前の日における雇入れに係るの特定求職者雇用開発助成金の支給については、なお従前の例による。

With regard to the payment of the regional employment incentive under of the Former Ordinance pertaining to an employer that, on a day before the Effective Date, submitted the plan under , and the payment of the regional employment incentive under pertaining to an employer that, on a day before the Effective Date, submitted the plan under , the provisions then in force continue to govern.

施行日前の日においてロの計画を提出した事業主に係るの地域雇用奨励金の支給及び施行日前の日においてロの計画を提出した事業主に係るの地域雇用奨励金の支給については、なお従前の例による。

With regard to the payment of the ability development benefit under of the Former Ordinance pertaining to eligible vocational training under commenced before the Effective Date, and the self-development subsidy benefit under pertaining to paid educational training leave under commenced before the Effective Date, the provisions then in force continue to govern.

施行日前に開始されたイの対象職業訓練に係るの能力開発給付金及びイの有給教育訓練休暇に係るの自己啓発助成給付金の支給については、なお従前の例による。

With regard to the payment of the ability development benefit for business conversion, etc. of small and medium-sized enterprises under of the Former Ordinance pertaining to eligible vocational training under and paid educational training leave under , each commenced before the Effective Date, the provisions then in force continue to govern.

施行日前に開始されたイの対象職業訓練及びイの有給教育訓練休暇に係るの中小企業事業転換等能力開発給付金の支給については、なお従前の例による。

With regard to the payment of the benefit for dispatch to authorized training, etc. under of the Former Ordinance pertaining to authorized training under commenced before the Effective Date, the provisions then in force continue to govern.

施行日前に開始されたの認定訓練に係るの認定訓練派遣等給付金の支給については、なお従前の例による。

With regard to the payment of the grant for employment development of specified job seekers under before amendment pertaining to hiring on a day before the Effective Date, the provisions then in force continue to govern.

施行日前の日における雇入れに係る改正前のの特定求職者雇用開発助成金の支給については、なお従前の例による。
