Supplementary Provisions

This Ministerial Order comes into effect as of the date of promulgation; provided, however, that the provisions set forth in the following items come into effect as of the dates specified respectively in those items.

The programs specified by Order of the Ministry of Health, Labour and Welfare under Article 6, paragraph (1), item (iv) of the Supplementary Provisions of the Act Partially Amending the Employment Insurance Act, etc. (Act No. 30 of 2007; hereinafter referred to as the "Amending Act") are those listed in the following items, and the periods specified by Order of the Ministry of Health, Labour and Welfare under item (iv) of that paragraph are, for the programs listed in the following items, respectively the periods listed in the relevant items.

The provisions of Articles 101-2-5 and 101-2-6 of the Ordinance for Enforcement of the Employment Insurance Act as amended by the provisions of Article 1 (hereinafter referred to as the "new Employment Insurance Ordinance") apply starting with a person who commenced, on or after the day of enforcement of the provisions listed in Article 1, item (ii) of the Supplementary Provisions, the educational training prescribed in Article 60-2, paragraph (1) of the Employment Insurance Act (Act No. 116 of 1974), and for a person who commenced the educational training prescribed in that paragraph before that day, the provisions then in force continue to govern.

The amending provisions in Article 1 to Article 102-5, Article 103, Article 104, Article 110-2, Article 110-3, Article 112, Article 116, Article 117, Article 118, paragraphs (1), (6) and (8), Articles 119 through 120-2 and Article 125 of the Ordinance for Enforcement of the Employment Insurance Act and to Articles 15-6 through 15-8 of the Supplementary Provisions of that Ordinance, the amending provision adding one Article after Article 15-8 of the Supplementary Provisions of that Ordinance, and the amending provisions to Articles 17-2 through 17-6 of the Supplementary Provisions of that Ordinance, the provisions of Article 11, and the amending provisions in Article 14 to Article 21, paragraphs (3), (4) and (8) through (10) of the Ministerial Order on Business Operations, Finance and Accounting of the Employment and Human Resources Development Organization of Japan, Independent Administrative Agency and to Article 3 of the Supplementary Provisions of that Ministerial Order apply as from April 1, 2007 (referred to as the "application date" in the following Article).

①With regard to the payment of the support benefit for job-seeking activities, etc. to an employer that came to be able to receive payment of that support benefit for job-seeking activities, etc. pursuant to Article 102-5, paragraph (2) of the former Employment Insurance Ordinance before the application date, the provisions then in force continue to govern.

②With regard to the payment of the re-employment support benefit to an employer that came to be able to receive payment of that re-employment support benefit pursuant to Article 102-5, paragraph (3) of the former Employment Insurance Ordinance before the application date, the provisions then in force continue to govern.

③With regard to the payment of the settlement course support benefit to an employer that came to be able to receive payment of that benefit pursuant to Article 102-5, paragraph (4) of the former Employment Insurance Ordinance before the application date, the provisions then in force continue to govern.

④With regard to the payment of the continuous employment system incentive and the grant for continuous employment of many persons to an employer that, before the application date, came to fall under Article 104, paragraph (2), item (i), (a) and (d) of the former Employment Insurance Ordinance or item (ii), (b) and (d) of that paragraph, the provisions then in force continue to govern.

⑤With regard to the payment of the grant for support for introducing employment securing measures to an employer that, before the application date, took the measure under Article 104, paragraph (6), item (i), (a) of the former Employment Insurance Ordinance, the provisions then in force continue to govern.

⑥With regard to the payment of the grant for creating joint employment opportunities for elderly persons, etc. to an employer that, before the application date, completed the registration of the establishment of the juridical person under Article 110-2, paragraph (2), item (i) of the former Employment Insurance Ordinance, the provisions then in force continue to govern.

⑦With regard to the payment of the trial employment incentive under Article 110-3, paragraph (1) of the former Employment Insurance Ordinance to an employer that, before the application date, carried out the hiring under item (i) of that paragraph, the provisions then in force continue to govern.

⑧With regard to the payment of the year-round employment stabilization benefit to an employer that came to be able to receive payment of that benefit pursuant to Article 113 of the former Employment Insurance Ordinance before the day of enforcement of the provisions listed in Article 1, item (i) of the Supplementary Provisions, the provisions then in force continue to govern.

⑨With regard to the payment of the grant for securing core caregiving human resources under Article 118, paragraph (6) of the former Employment Insurance Ordinance to an employer that, before the application date, applied for certification of an improvement plan under Article 8, paragraph (1) of the Act on Improvement of Employment Management and Other Matters for Care Workers, the provisions then in force continue to govern.

⑩With regard to the payment of the career formation promotion grant to an employer that came to be able to receive payment of that grant pursuant to Article 125, paragraph (2) or (5) of the former Employment Insurance Ordinance before the application date, the provisions then in force continue to govern.

⑪With regard to the payment of the career formation promotion grant under Article 125, paragraph (3) of the former Employment Insurance Ordinance to an employer for which the first day of the period prescribed in item (ii), (c) through (f) of that paragraph is before the Effective Date and which falls under item (i) of that paragraph within that period, the provisions then in force continue to govern.

⑫With regard to the payment of the grant for support for smooth labor mobility in the construction industry to an employer or a certified association that came to be able to receive payment of that grant pursuant to Article 17-6 of the Supplementary Provisions of the former Employment Insurance Ordinance before the application date, the provisions then in force continue to govern.

①The employment insurance notification of loss of insured status and the employment insurance notification of change of name under Form No. 4 of the former Employment Insurance Ordinance are deemed to be the employment insurance notification of loss of insured status and the employment insurance notification of change of name under Form No. 4 of the new Employment Insurance Ordinance.

②The employment insurance separation slip under Form No. 6 of the former Employment Insurance Ordinance that is actually issued at the time of enforcement of this Ministerial Order is deemed to be the employment insurance separation slip under Form No. 6 of the new Employment Insurance Ordinance.

③The employment insurance certificate of seizure of property of persons in arrears on repayments, etc. under Article 17-7 of the new Employment Insurance Ordinance and the employment insurance inspection certificate under Article 144 of the new Employment Insurance Ordinance may, for the time being, continue to be in the corresponding forms of the former Employment Insurance Ordinance.
