Supplementary Provisions

This Ministerial Order comes into effect as of the date of promulgation.

①For the application of Article 102-3, paragraph (1), item (ii), (e), paragraphs (2) and (3), and Article 102-5, paragraph (1), item (ii), (g) and paragraph (2) of the Ordinance for Enforcement of the Employment Insurance Act after amendment (hereinafter in this Article referred to as the "New Ordinance"), leave or educational training in the base period for determination (meaning the base period for determination prescribed in Article 102-3, paragraph (1), item (ii), (e) of the New Ordinance; the same applies hereinafter in this Article) in which the day on which this Ministerial Order comes into effect (hereinafter referred to as the "Effective Date") falls that was conducted before the Effective Date is deemed to be leave or educational training conducted on or after the Effective Date.

②With regard to the payment of the employment adjustment benefit for leave conducted before the Effective Date (excluding leave under the preceding paragraph), and of the training adjustment benefit and the training adjustment expense grant under Article 102-4 of the Ordinance for Enforcement of the Employment Insurance Act before amendment (hereinafter in this Article referred to as the "Former Ordinance") for educational training conducted before the Effective Date (excluding educational training under the preceding paragraph), the provisions then in force continue to govern.

③For the application of Article 102-3, paragraph (4) of the New Ordinance, an employer that received or attempted to receive payment of the training adjustment expense grant under Article 102-4 of the Former Ordinance by deception or other wrongful acts is deemed to be an employer that received or attempted to receive payment of the training adjustment benefit under Article 102-4 of the New Ordinance by deception or other wrongful acts.

④The industries designated by the Minister of Labour under Article 102-10, paragraph (1), item (i), (a) of the Former Ordinance and the periods determined by the Minister of Labour for each such industry under item (ii), (a) of that paragraph are deemed to be, respectively, the industries designated by the Minister of Labour under Article 102-8, paragraph (1), item (i), (a) of the New Ordinance and the periods determined by the Minister of Labour for each such industry under item (ii), (a) of that paragraph, and the employers designated by the Minister of Labour under Article 102-10, paragraph (1), item (i), (b) of the Former Ordinance and the periods determined by the Minister of Labour for each such employer under item (ii), (b) of that paragraph are deemed to be, respectively, the employers designated by the Minister of Labour under Article 102-8, paragraph (1), item (i), (b) of the New Ordinance and the periods determined by the Minister of Labour for each such employer under item (ii), (b) of that paragraph.

⑤For the application of Article 102-8, paragraphs (2) and (3), and Article 102-10, paragraph (1), item (ii), (c) and paragraph (2) of the New Ordinance, educational training or leave in the base period for determination in which the Effective Date falls that was conducted before the Effective Date is deemed to be educational training or leave conducted on or after the Effective Date.

⑥With regard to the payment of the training benefit for business conversion, etc. and the training expense grant for business conversion, etc. under Article 102-9 of the Former Ordinance for educational training conducted before the Effective Date (excluding educational training under the preceding paragraph), and of the leave benefit for business conversion, etc. for leave conducted before the Effective Date (excluding leave under the preceding paragraph), the provisions then in force continue to govern.

⑦For the application of Article 102-8, paragraph (4) of the New Ordinance, an employer that received or attempted to receive payment of the training expense grant for business conversion, etc. under Article 102-9 of the Former Ordinance by deception or other wrongful acts is deemed to be an employer that received or attempted to receive payment of the training benefit for business conversion, etc. under Article 102-7 of the New Ordinance by deception or other wrongful acts.

⑧With regard to the payment of the employment development benefit for middle-aged and older persons under Article 102-7, item (i) of the Former Ordinance, the employment promotion grant for persons separated through business conversion, etc. under Article 102-11, item (i) of the Former Ordinance, the incentive for employing elderly persons under Article 103 of the Former Ordinance, the incentive for employing persons subject to specified wide-area placement under Article 106 of the Former Ordinance, the incentive for employing persons separated from specified industries under Article 110 of the Former Ordinance, and the incentive for employment of persons with mental and physical disabilities, the incentive for employing residents of areas subject to Dowa measures and the incentive for employing widows, etc. under Article 114, item (i) of the Former Ordinance, pertaining to hiring on a day before the Effective Date, the provisions then in force continue to govern.

⑨With regard to the payment of the industrial relocation benefit under Article 106 of the Former Ordinance pertaining to the relocation of a factory on a day before the Effective Date, the provisions then in force continue to govern.
