Supplementary Provisions, Article 28Recognition of Unemployment Specified by Order of the Ministry of Health, Labour and Welfare under Article 11-2, Paragraph (2) of the Supplementary Provisions of the Act

①A person qualified to receive educational training support benefits who seeks to receive recognition of unemployment pertaining to payment of educational training support benefits must, on the day on which the person is to receive that recognition of unemployment pertaining to payment of those educational training support benefits, appear at the competent Public Employment Security Office and submit a certificate of attendance for educational training support benefits (Form No. 33-2-9), attaching the educational training benefits and educational training support benefits qualified recipient's certificate (for a person who has been subject to determination of recipient qualification for basic allowance (excluding where the person has been issued a notice of recipient qualification), together with the qualified recipient's certificate; the same applies hereinafter in this paragraph) (or, where that person has been issued a notice of educational training recipient qualification, presenting the Individual Number Card); provided, however, that where there are legitimate grounds for being unable to submit it attaching the educational training benefits and educational training support benefits qualified recipient's certificate (or, where that person has been issued a notice of educational training recipient qualification, presenting the Individual Number Card), the person may do so without attaching the educational training benefits and educational training support benefits qualified recipient's certificate (or, where that person has been issued a notice of educational training recipient qualification, without presenting the Individual Number Card).

②Recognition of unemployment pertaining to payment of educational training support benefits under the preceding paragraph must be conducted on the day on which that person is to receive recognition of unemployment pertaining to payment of those educational training support benefits as prescribed in paragraph (3) of the preceding Article; provided, however, that this does not apply where there are unavoidable reasons, such as a natural disaster, for not having been able to receive recognition of unemployment pertaining to payment of those educational training support benefits.

③The provisions of Article 31, paragraphs (4) and (5) apply mutatis mutandis to recognition of unemployment in the case of the proviso to the preceding paragraph.
