Supplementary Provisions, Article 3

第三条

Notwithstanding the provisions of Article 101-5, paragraphs (2), (4) and (6) (including as applied mutatis mutandis pursuant to Article 101-7, paragraph (2)) of the New Ordinance, the written application for continuous employment benefits for the elderly during the period from the Effective Date to March 31, 1996 must be submitted, according to the category of month subject to payment (in the case of submission of a written application for continuous employment benefits for the elderly pertaining to an application for payment of re-employment benefits for the elderly, month subject to payment after re-employment) listed in the following items, within the period specified in each of those items; provided, however, that this does not apply where there is an unavoidable reason, such as a natural disaster, for not having submitted it.

新規則第百一条の五第二項、第四項及び第六項（第百一条の七第二項の規定により準用する場合を含む。）の規定にかかわらず、施行日から平成八年三月三十一日までの間における高年齢雇用継続給付支給申請書の提出は、次の各号に掲げる支給対象月（高年齢再就職給付金の支給申請に係る高年齢雇用継続給付支給申請書の提出の場合にあつては、再就職後の支給対象月）の区分に応じ、当該各号に定める期間にしなければならない。ただし、天災その他提出しなかつたことについてやむを得ない理由があるときは、この限りでない。

April through July 1995: August 1 through October 31, 1995;

平成七年四月から同年七月まで　同年八月一日から同年十月三十一日まで

August through October 1995: November 1 through December 31, 1995;

平成七年八月から同年十月まで　同年十一月一日から同年十二月三十一日まで

November 1995 through January 1996: February 1 through March 31, 1996.

平成七年十一月から平成八年一月まで　同年二月一日から同年三月三十一日まで

The provisions of Article 17-2, paragraph (4) apply mutatis mutandis to submission in the case of the proviso to the preceding paragraph.

第十七条の二第四項の規定は、前項ただし書の場合における提出について準用する。

The provisions of the preceding two paragraphs apply mutatis mutandis to the procedures for payment of basic childcare leave benefits. In this case, "Article 101-5, paragraphs (2), (4) and (6) (including as applied mutatis mutandis pursuant to Article 101-7, paragraph (2))" in paragraph (1) is deemed to be replaced with "Article 101-13, paragraphs (2), (4) and (6)", "written application for continuous employment benefits for the elderly" with "written application for basic childcare leave benefits", and "month subject to payment (in the case of submission of a written application for continuous employment benefits for the elderly pertaining to an application for payment of re-employment benefits for the elderly, month subject to payment after re-employment)" with "month that includes the first day of the payment unit period".

前二項の規定は、育児休業基本給付金の支給手続について準用する。この場合において、第一項中「第百一条の五第二項、第四項及び第六項（第百一条の七第二項の規定により準用する場合を含む。）」とあるのは「第百一条の十三第二項、第四項及び第六項」と、「高年齢雇用継続給付支給申請書」とあるのは「育児休業基本給付金支給申請書」と、「支給対象月（高年齢再就職給付金の支給申請に係る高年齢雇用継続給付支給申請書の提出の場合にあつては、再就職後の支給対象月）」とあるのは「支給単位期間の初日の属する月」と読み替えるものとする。

For the application of the provisions of Article 101-6, paragraph (1) (including as applied mutatis mutandis pursuant to Article 101-7, paragraph (2) and Article 102; the same applies hereinafter in this paragraph) to an insured person for whom payment of continuous employment benefits was decided during the period from April 1, 1995 to March 31, 1996, "within seven days counting from the day following that day" in that paragraph is deemed to be replaced with "by the payment deadline determined for that insured person".

平成七年四月一日から平成八年三月三十一日までに雇用継続給付の支給が決定された被保険者に対する第百一条の六第一項の規定（第百一条の七第二項及び第百二条において準用する場合を含む。以下この項において同じ。）の適用については、同項中「その日の翌日から起算して七日以内に」とあるのは、「当該被保険者について定めた支給期限までに」とする。
