Supplementary Provisions, Article 2Transitional Measures Concerning Employment Stabilization Programs, etc.

①With regard to the payment of the grant for employment development of specified job seekers to an employer that, before the day of enforcement of this Ministerial Order (hereinafter referred to as the "Effective Date"), came to be able to receive payment of the grant for employment development of specified job seekers pursuant to Article 110 of the Ordinance for Enforcement of the Employment Insurance Act before amendment by this Ministerial Order (hereinafter referred to as the "former Employment Insurance Ordinance") or Article 6-2 of the Ordinance for Enforcement of the Employment Measures Act before amendment by this Ministerial Order, the provisions then in force continue to govern.

②With regard to the payment of the employment adjustment grant to an employer that, before the Effective Date, came to be able to receive payment of the employment adjustment grant pursuant to Article 102-3 of the former Employment Insurance Ordinance, the provisions then in force continue to govern.

③With regard to the payment of the grant for emergency employment stabilization in small and medium-sized enterprises to an employer that, before the Effective Date, came to be able to receive payment of the grant for emergency employment stabilization in small and medium-sized enterprises pursuant to Article 15 of the Supplementary Provisions of the former Employment Insurance Ordinance, the provisions then in force continue to govern.

④During the period from December 9, 2008 until the day on which two months have passed from the Effective Date, with regard to the preparation of a re-employment assistance plan prescribed in Article 25, paragraph (1) of the Employment Measures Act that has as its content the provision of housing or the bearing of expenses prescribed in Article 15-6 of the Supplementary Provisions of the new Employment Insurance Ordinance, the provisions of Article 7-3, paragraph (1) of the Ordinance for Enforcement of the Employment Measures Act, as applied mutatis mutandis pursuant to Article 7-5 of that Ordinance, do not apply. In this case, the preparation of that re-employment assistance plan is to be as specified by the Director-General of the Employment Security Bureau of the Ministry of Health, Labour and Welfare.

⑤With regard to the payment of the special incentive for promoting employment of young persons, etc. to an employer that, before the Effective Date, came to be able to receive payment of that incentive pursuant to Article 15-9 of the Supplementary Provisions of the former Employment Insurance Ordinance (limited to payment in respect of a worker for whom the day on which the labor contract with no fixed term prescribed in item (i), (a) and (b) of that paragraph was concluded is before the Effective Date), the provisions then in force continue to govern.

⑥With regard to the payment of the grant for childcare support for small and medium-sized enterprises to an employer that, before the Effective Date, came to be able to receive payment of that grant pursuant to Article 17-3 of the Supplementary Provisions of the former Employment Insurance Ordinance, the provisions then in force continue to govern.

⑦With regard to the payment of the grant for employment stabilization, etc. for childcare and caregiving to an employer that, before February 1, 2009, came to fall under the entry for an employer of a place of business prescribed in Article 116, item (ii) of the Employment Insurance Ordinance that has put in order documents clarifying the status of bearing the costs required for implementing the measures prescribed in that item, in the table of Article 38 of the Ordinance for Enforcement of the Act on Childcare Leave, Caregiver Leave, and Other Measures for the Welfare of Workers Caring for Children or Other Family Members before amendment by this Ministerial Order, the provisions then in force continue to govern.
