第五条（法第三十条の四の規定による障害基礎年金の支給を停止する場合の給付の額の計算方法）
Article 5Method of Calculating the Amount of a Benefit When Payment of a Disability Basic Pension under Article 30-4 of the Act Is Suspended
The amount of a benefit that is a pension specified by Cabinet Order prescribed in Article 36-2, paragraph (1), item (i) of the Act (hereinafter referred to in this Article as a "pension benefit") is calculated in accordance with the following items.
法第三十六条の二第一項第一号に規定する政令で定める年金たる給付（以下この条において「年金給付」という。）の額は、次の各号によつて計算する。
When an addition or supplement is made to the pension benefit, the amount is the amount after that addition or supplement;
当該年金給付に加算又は加給が行われるときは、その加算され、又は加給された後の額による。
When two or more persons are able to jointly receive the same pension benefit, the amount is the amount obtained by dividing the amount of that benefit by the number of persons entitled to receive it;
二人以上の者が共同して同一の年金給付を受けることができるときは、その給付の額を受給権者の数で除して得た額による。
When the amount of the pension benefit is determined on a monthly basis, the amount is the amount obtained by multiplying that amount by 12;
当該年金給付の額が月を単位として定められているときは、その額に十二を乗じて得た額による。
When the same person is able to receive two or more pension benefits, the amount is the total of the amounts of those two or more benefits.
同一人が二以上の年金給付を受けることができるときは、その二以上の給付の額を合算した額による。

法第三十六条の二第一項第一号に規定する政令で定める年金たる給付（以下この条において「年金給付」という。）の額は、次の各号によつて計算する。
