第六十条

Supplementary Provisions, Article 60

この省令は昭和二十二年九月一日から、これを施行する。

This Ordinance comes into effect as of September 1, 1947.

第六十三条

Supplementary Provisions, Article 63

工場法又は鉱業法に基いて調製した従前の様式による名簿を使用する使用者は、新たに名簿を調製するまでこれを第五十三条の労働者名簿に代えることができる。

An employer that uses a roster in the former form prepared based on the Factory Act or the Mining Act may use it in place of the roster of workers referred to in Article 53 until the employer prepares a new roster.

第六十五条

Supplementary Provisions, Article 65

積雪の度が著しく高い地域として厚生労働大臣が指定する地域に所在する事業場において、冬期に当該地域における事業活動の縮小を余儀なくされる事業として厚生労働大臣が指定する事業に従事する労働者であつて、屋外で作業を行う必要がある業務であつて業務の性質上冬期に労働者が従事することが困難であるものとして厚生労働大臣が指定する業務に従事するものについては、第十二条の四第四項の規定にかかわらず、当分の間、法第三十二条の四第三項の厚生労働省令で定める一日の労働時間の限度は十時間とし、一週間の労働時間の限度は五十二時間とする。

With respect to workers at a workplace located in an area designated by the Minister of Health, Labour and Welfare as an area where the degree of snow accumulation is markedly high, who engage in a business designated by the Minister of Health, Labour and Welfare as a business that is compelled to reduce its business activities in that area in winter, and who engage in work designated by the Minister of Health, Labour and Welfare as work that needs to be performed outdoors and in which, due to the nature of the work, it is difficult for workers to engage in winter, notwithstanding the provisions of paragraph (4) of Article 12-4, for the time being, the limit on working hours per day specified by Order of the Ministry of Health, Labour and Welfare referred to in paragraph (3) of Article 32-4 of the Act is to be 10 hours, and the limit on working hours per week is to be 52 hours.

第六十六条

Supplementary Provisions, Article 66

一般乗用旅客自動車運送事業道路運送法(昭和二十六年法律第百八十三号)第三条第一号ハの一般乗用旅客自動車運送事業をいう。以下この条及び第六十九条第二項において同じ。)における四輪以上の自動車(一般乗用旅客自動車運送事業の用に供せられる自動車であつて、当該自動車による運送の引受けが営業所のみにおいて行われるものを除く。)の運転の業務に従事する労働者であつて、次の各号のいずれにも該当する業務に従事するものについての法第三十二条の四第三項の厚生労働省令で定める一日の労働時間の限度は、第十二条の四第四項の規定にかかわらず、当分の間、十六時間とする。

With respect to workers who engage in the work of driving automobiles with four or more wheels (excluding automobiles used for general passenger vehicle transportation business for which the acceptance of transportation by that automobile is conducted only at business offices) in general passenger vehicle transportation business (meaning the general passenger vehicle transportation business referred to in (c) of item (i) of Article 3 of the Road Transport Act (Act No. 183 of 1951); the same applies hereinafter in this Article and paragraph (2) of Article 69) and who engage in work falling under all of the following items, the limit on working hours per day specified by Order of the Ministry of Health, Labour and Welfare referred to in paragraph (3) of Article 32-4 of the Act is to be 16 hours for the time being, notwithstanding the provisions of paragraph (4) of Article 12-4.

当該業務に従事する労働者の労働時間(法第三十三条又は第三十六条第一項の規定により使用者が労働時間を延長した場合においては当該労働時間を、休日に労働させた場合においては当該休日に労働させた時間を含む。以下この号において同じ。)の終了から次の労働時間の開始までの期間が継続して二十二時間以上ある業務であること。

Work in which the period from the end of the working hours of the workers engaged in that work (including, in the case where the employer has extended working hours under the provisions of Article 33 or paragraph (1) of Article 36 of the Act, those working hours, and, in the case where the employer has had the workers work on days off, the hours worked on those days off; the same applies hereinafter in this item) to the start of the next working hours is 22 hours or more consecutively.

始業及び終業の時刻が同一の日に属しない業務であること。

Work in which the starting time and the ending time of work do not fall on the same day.

第六十七条

Supplementary Provisions, Article 67

法第百三十三条の厚生労働省令で定める者は、次のとおりとする。

The persons specified by Order of the Ministry of Health, Labour and Welfare referred to in Article 133 of the Act are to be as follows.

小学校就学の始期に達するまでの子を養育する労働者

Workers raising a child who has not yet reached the age of commencing elementary school

負傷、疾病又は身体上若しくは精神上の障害により、二週間以上の期間にわたり常時介護を必要とする状態にある次に掲げるいずれかの者を介護する労働者

Workers caring for any of the following persons who are in a condition requiring constant care over a period of two weeks or more due to injury, illness, or physical or mental disability

配偶者、父母若しくは子又は配偶者の父母

A spouse, parent or child, or a parent of the spouse

当該労働者が同居し、かつ、扶養している祖父母、兄弟姉妹又は孫

A grandparent, sibling or grandchild with whom the worker lives and whom the worker supports

法第百三十三条の厚生労働省令で定める期間は、平成十一年四月一日から平成十四年三月三十一日までの間とする。

The period specified by Order of the Ministry of Health, Labour and Welfare referred to in Article 133 of the Act is to be the period from April 1, 1999 to March 31, 2002.

第六十九条

Supplementary Provisions, Article 69

法第百三十九条第一項及び第二項の厚生労働省令で定める事業は、次に掲げるものとする。

The businesses specified by Order of the Ministry of Health, Labour and Welfare referred to in paragraphs (1) and (2) of Article 139 of the Act are to be the following.

法別表第一第三号に掲げる事業

The businesses listed in item (iii) of Appended Table 1 of the Act

事業場の所属する企業の主たる事業が法別表第一第三号に掲げる事業である事業場における事業

Businesses at a workplace where the principal business of the enterprise to which the workplace belongs is a business listed in item (iii) of Appended Table 1 of the Act

工作物の建設の事業に関連する警備の事業(当該事業において労働者に交通誘導警備の業務を行わせる場合に限る。)

a security business related to a business of constructing structures (limited to the case where workers are made to perform traffic guidance security work in that business)

法第百四十条第一項の厚生労働省令で定める業務は、一般乗用旅客自動車運送事業の業務、貨物自動車運送事業(貨物自動車運送事業法(平成元年法律第八十三号)第二条第一項に規定する貨物自動車運送事業をいう。)の業務、一般乗合旅客自動車運送事業(道路運送法第三条第一号イに規定する一般乗合旅客自動車運送事業をいう。)の業務、一般貸切旅客自動車運送事業(同号ロに規定する一般貸切旅客自動車運送事業をいう。)の業務その他四輪以上の自動車の運転の業務とする。

The work specified by Order of the Ministry of Health, Labour and Welfare referred to in Article 140, paragraph (1) of the Act is work in a general passenger vehicle transportation business, work in a motor truck transportation business (meaning a motor truck transportation business prescribed in Article 2, paragraph (1) of the Motor Truck Transportation Business Act (Act No. 83 of 1989)), work in a general scheduled passenger motor vehicle transportation business (meaning a general scheduled passenger motor vehicle transportation business prescribed in Article 3, item (i), (a) of the Road Transportation Act), work in a general chartered passenger motor vehicle transportation business (meaning a general chartered passenger motor vehicle transportation business prescribed in (b) of that item), and other work of driving a motor vehicle with four or more wheels.

第六十九条の二

Supplementary Provisions, Article 69-2

法第百四十一条第一項の厚生労働省令で定める者は、病院(医療法(昭和二十三年法律第二百五号)第一条の五第一項に規定する病院をいう。次条第二項第二号において同じ。)若しくは診療所(同法第一条の五第二項に規定する診療所をいう。次条第二項第二号において同じ。)において勤務する医師(医療を受ける者に対する診療を直接の目的とする業務を行わない者を除く。)又は介護老人保健施設(介護保険法(平成九年法律第百二十三号)第八条第二十八項に規定する介護老人保健施設をいう。次条第二項第二号において同じ。)若しくは介護医療院(同法第八条第二十九項に規定する介護医療院をいう。次条第二項第二号において同じ。)において勤務する医師(以下「特定医師」という。)をいう。

The person specified by Order of the Ministry of Health, Labour and Welfare referred to in Article 141, paragraph (1) of the Act means a physician who works at a hospital (meaning a hospital prescribed in Article 1-5, paragraph (1) of the Medical Care Act (Act No. 205 of 1948); the same applies in paragraph (2), item (ii) of the following Article) or a clinic (meaning a clinic prescribed in Article 1-5, paragraph (2) of that Act; the same applies in paragraph (2), item (ii) of the following Article) (excluding a physician who does not perform work whose direct purpose is the medical examination and treatment of persons receiving medical care), or a physician who works at a long-term care health facility (meaning a long-term care health facility prescribed in Article 8, paragraph (28) of the Long-Term Care Insurance Act (Act No. 123 of 1997); the same applies in paragraph (2), item (ii) of the following Article) or an integrated facility for medical and long-term care (meaning an integrated facility for medical and long-term care prescribed in Article 8, paragraph (29) of that Act; the same applies in paragraph (2), item (ii) of the following Article) (hereinafter referred to as a "specified physician").

第六十九条の三

Supplementary Provisions, Article 69-3

法第百四十一条第一項医療法第百二十八条の規定により適用する場合を含む。第五項において同じ。)の規定により法第三十六条の規定を読み替えて適用する場合における第十七条の規定の適用については、次の表の上欄に掲げる規定中同表の中欄に掲げる字句は、それぞれ同表の下欄に掲げる字句とする。ただし、医療法第百二十八条の規定により読み替えられた場合にあつては、同表第一項ただし書きの項中「法第百四十一条第二項」とあるのは「医療法(昭和二十三年法律第二百五号)第百二十八条の規定により読み替えて適用する法第百四十一条第二項」と、同表第一項第三号の項中「法第百四十一条第三項」とあるのは「医療法第百二十八条の規定により読み替えて適用する法第百四十一条第三項」とする。

With regard to the application of the provisions of Article 17 in the case where the provisions of Article 36 of the Act are applied with the replacement of terms pursuant to the provisions of Article 141, paragraph (1) of the Act (including as applied pursuant to the provisions of Article 128 of the Medical Care Act; the same applies in paragraph (5)), the terms set forth in the middle column of the following table in the provisions set forth in the left-hand column of that table are deemed to be replaced with the terms set forth in the right-hand column of that table, respectively; provided, however, that in the case of the replacement of terms pursuant to the provisions of Article 128 of the Medical Care Act, the term "Article 141, paragraph (2) of the Act" in the row for the proviso to paragraph (1) of that table is deemed to be replaced with "Article 141, paragraph (2) of the Act as applied with the replacement of terms pursuant to the provisions of Article 128 of the Medical Care Act (Act No. 205 of 1948)", and the term "Article 141, paragraph (3) of the Act" in the row for paragraph (1), item (iii) of that table is deemed to be replaced with "Article 141, paragraph (3) of the Act as applied with the replacement of terms pursuant to the provisions of Article 128 of the Medical Care Act".

法第百四十一条第一項の場合において、法第三十六条第一項の協定に、同条第二項第五号の厚生労働省令で定める事項として、前項の規定により読み替えて適用する第十七条第一項各号に掲げる事項のほか、次に掲げる事項を定めるものとする。

In the case referred to in Article 141, paragraph (1) of the Act, the agreement referred to in Article 36, paragraph (1) of the Act is to provide for the following matters as the matters specified by Order of the Ministry of Health, Labour and Welfare referred to in paragraph (2), item (v) of that Article, in addition to the matters set forth in the items of Article 17, paragraph (1) as applied with the replacement of terms pursuant to the provisions of the preceding paragraph:

対象期間における一日、一箇月及び一年のそれぞれの期間について労働時間を延長して労働させることができる時間又は労働させることができる休日の日数

the number of hours by which the working hours may be extended, or the number of days off on which work may be performed, for each of the periods of one day, one month and one year within the applicable period

医療法第十条の規定により病院若しくは診療所の開設者が当該病院若しくは当該診療所を管理させることとした者又は介護保険法第九十五条若しくは同法第百九条の規定により介護老人保健施設若しくは介護医療院の開設者が当該介護老人保健施設若しくは当該介護医療院を管理させることとした者(以下この項において「管理者」という。)に、一箇月について労働時間を延長して労働させ、及び休日において労働させる時間が百時間以上となることが見込まれる特定医師に対して厚生労働大臣が定める要件に該当する面接指導を行わせること。

to have the person whom the founder of a hospital or clinic has caused to administer that hospital or that clinic pursuant to the provisions of Article 10 of the Medical Care Act, or the person whom the founder of a long-term care health facility or integrated facility for medical and long-term care has caused to administer that long-term care health facility or that integrated facility for medical and long-term care pursuant to the provisions of Article 95 of the Long-Term Care Insurance Act or Article 109 of that Act (hereinafter referred to as the "administrator" in this paragraph), provide face-to-face guidance meeting the requirements specified by the Minister of Health, Labour and Welfare to a specified physician for whom the hours by which the working hours are extended combined with the hours of work on days off are expected to amount to 100 hours or more per month

管理者に、前号の規定による面接指導(面接指導の対象となる特定医師の希望により、当該管理者の指定した医師以外の医師が行つた面接指導であつて、当該管理者がその結果を証明する書面の提出を受けたものを含む。)の結果に基づき、当該面接指導を受けた特定医師の健康を保持するために必要な措置について、当該面接指導が行われた後(当該管理者の指定した医師以外の医師が当該面接指導を行つた場合にあつては、当該管理者がその結果を証明する書面の提出を受けた後)、遅滞なく、当該面接指導を行つた医師の意見を聴かせること。

to have the administrator, based on the results of the face-to-face guidance under the provisions of the preceding item (including face-to-face guidance provided by a physician other than the physician designated by that administrator at the request of the specified physician subject to the face-to-face guidance, for which that administrator has received the submission of a document certifying its results), hear the opinion of the physician who provided that face-to-face guidance on the measures necessary to maintain the health of the specified physician who received that face-to-face guidance, without delay after that face-to-face guidance has been provided (or, if a physician other than the physician designated by that administrator has provided that face-to-face guidance, after that administrator has received the submission of a document certifying its results)

管理者に、第二号の規定による面接指導を行つた医師の意見を勘案し、その必要があると認めるときは、当該面接指導を受けた特定医師の実情を考慮して、遅滞なく、労働時間の短縮、宿直の回数の減少その他の適切な措置を講じさせること。

to have the administrator, taking into account the opinion of the physician who provided the face-to-face guidance under the provisions of item (ii), when the administrator finds it necessary, take measures of reducing working hours, reducing the number of night duties, or other appropriate measures without delay, in consideration of the actual circumstances of the specified physician who received that face-to-face guidance

管理者に、医療法第百八条第六項の規定により、一箇月について労働時間を延長して労働させ、及び休日において労働させる時間が特に長時間である特定医師に対して労働時間の短縮のために必要な措置を講じさせること。

to have the administrator, pursuant to the provisions of Article 108, paragraph (6) of the Medical Care Act, take the measures necessary for reducing working hours with respect to a specified physician for whom the hours by which the working hours are extended combined with the hours of work on days off per month are particularly long

前項第三号の書面は、当該特定医師の受けた面接指導について、次に掲げる事項を記載したものでなければならない。

The document referred to in item (iii) of the preceding paragraph must state the following matters concerning the face-to-face guidance received by the specified physician concerned:

当該面接指導を受けた特定医師の氏名

the name of the specified physician who received the face-to-face guidance

当該面接指導を行つた医師の氏名

the name of the physician who provided the face-to-face guidance

当該面接指導を受けた特定医師の睡眠の状況

the sleep status of the specified physician who received the face-to-face guidance

当該面接指導を受けた特定医師の疲労の蓄積の状況

the status of accumulated fatigue of the specified physician who received the face-to-face guidance

前二号に掲げるもののほか、当該面接指導を受けた特定医師の心身の状況

beyond what is set forth in the preceding two items, the physical and mental condition of the specified physician who received the face-to-face guidance

第二項第二号から第五号までの事項は、次の各号に掲げる区分に応じ、当該各号に定める場合には、法第三十六条第一項の協定に定めないことができる。

The matters referred to in paragraph (2), items (ii) through (v) may be left out of the agreement referred to in Article 36, paragraph (1) of the Act in the cases specified in the following items, according to the categories set forth in those items:

第二項第二号から第四号までに掲げる事項 一箇月について労働時間を延長して労働させ、及び休日において労働させる時間が百時間以上となることが見込まれない場合

the matters set forth in paragraph (2), items (ii) through (iv): the case where the hours by which the working hours are extended combined with the hours of work on days off are not expected to amount to 100 hours or more per month

第二項第五号に掲げる事項 一箇月について労働時間を延長して労働させ、及び休日において労働させる時間が特に長時間となることが見込まれない場合

the matters set forth in paragraph (2), item (v): the case where the hours by which the working hours are extended combined with the hours of work on days off per month are not expected to be particularly long

法第百四十一条第一項の規定により読み替えて適用する法第三十六条第三項の厚生労働省令で定める時間は、一箇月について四十五時間及び一年について三百六十時間(法第三十二条の四第一項第二号の対象期間として三箇月を超える期間を定めて同条の規定により労働させる場合にあつては、一箇月について四十二時間及び一年について三百二十時間)とする。

The hours specified by Order of the Ministry of Health, Labour and Welfare referred to in Article 36, paragraph (3) of the Act as applied with the replacement of terms pursuant to the provisions of Article 141, paragraph (1) of the Act are 45 hours per month and 360 hours per year (or, if workers are made to work pursuant to the provisions of Article 32-4 of the Act with a period exceeding three months specified as the applicable period referred to in paragraph (1), item (ii) of that Article, 42 hours per month and 320 hours per year).

第六十九条の四

Supplementary Provisions, Article 69-4

法第百四十一条第二項の厚生労働省令で定める時間は、労働時間を延長して労働させ、及び休日において労働させることができる時間について、一箇月について百時間未満及び一年について九百六十時間とする。ただし、法第三十六条第一項の協定に前条第二項第二号から第四号までに規定する事項を定めた場合にあつては、一年について九百六十時間とする。

The hours specified by Order of the Ministry of Health, Labour and Welfare referred to in Article 141, paragraph (2) of the Act are, with respect to the hours by which the working hours may be extended and the hours of work that may be performed on days off, less than 100 hours per month and 960 hours per year; provided, however, that if the matters prescribed in paragraph (2), items (ii) through (iv) of the preceding Article are provided for in the agreement referred to in Article 36, paragraph (1) of the Act, they are 960 hours per year.

第六十九条の五

Supplementary Provisions, Article 69-5

法第百四十一条第三項の厚生労働省令で定める時間は、労働時間を延長して労働させ、及び休日において労働させる時間について、一箇月について百時間未満及び一年について九百六十時間とする。ただし、第六十九条の三第二項第二号に規定する面接指導が行われ、かつ、同項第四号に規定する措置が講じられた特定医師については一年について九百六十時間とする。

The hours specified by Order of the Ministry of Health, Labour and Welfare referred to in Article 141, paragraph (3) of the Act are, with respect to the hours by which the working hours are extended and the hours of work performed on days off, less than 100 hours per month and 960 hours per year; provided, however, that for a specified physician to whom the face-to-face guidance prescribed in Article 69-3, paragraph (2), item (ii) has been provided and for whom the measures prescribed in item (iv) of that paragraph have been taken, they are 960 hours per year.

第七十条

Supplementary Provisions, Article 70

第十六条第一項の規定にかかわらず、当該事業場の事業に法第百三十九条第一項に規定する事業が含まれている場合における法第三十六条第一項の規定による届出は、様式第九号の三の二法第百三十九条第一項の規定により読み替えて適用する法第三十六条第五項に規定する事項に関する定めをする場合にあつては、様式第九号の三の三)により、法第三十六条第二項第一号に規定する労働者に法第百四十条第一項に規定する業務に従事する労働者が含まれている場合における法第三十六条第一項の規定による届出は、様式第九号の三の四法第百四十条第一項の規定により読み替えて適用する法第三十六条第五項に規定する事項に関する定めをする場合にあつては、様式第九号の三の五)により、法第三十六条第二項第一号に規定する労働者に特定医師が含まれている場合における同条第一項の規定による届出は、様式第九号の四法第百四十一条第二項医療法第百二十八条の規定により読み替えて適用する場合を含む。)に規定する事項に関する定めをする場合にあつては、様式第九号の五)により、所轄労働基準監督署長にしなければならない。

Notwithstanding the provisions of Article 16, paragraph (1), a notification under the provisions of Article 36, paragraph (1) of the Act in the case where the business of the workplace concerned includes a business prescribed in Article 139, paragraph (1) of the Act must be made using Form No. 9-3-2 (or, if provisions are made on the matters prescribed in Article 36, paragraph (5) of the Act as applied with the replacement of terms pursuant to the provisions of Article 139, paragraph (1) of the Act, Form No. 9-3-3), a notification under the provisions of Article 36, paragraph (1) of the Act in the case where the workers prescribed in Article 36, paragraph (2), item (i) of the Act include workers engaged in the work prescribed in Article 140, paragraph (1) of the Act must be made using Form No. 9-3-4 (or, if provisions are made on the matters prescribed in Article 36, paragraph (5) of the Act as applied with the replacement of terms pursuant to the provisions of Article 140, paragraph (1) of the Act, Form No. 9-3-5), and a notification under the provisions of paragraph (1) of that Article in the case where the workers prescribed in Article 36, paragraph (2), item (i) of the Act include specified physicians must be made using Form No. 9-4 (or, if provisions are made on the matters prescribed in Article 141, paragraph (2) of the Act (including as applied with the replacement of terms pursuant to the provisions of Article 128 of the Medical Care Act), Form No. 9-5), in each case to the Director of the Labor Standards Office Concerned.

第五十九条の二の規定は、前項の届出について準用する。

The provisions of Article 59-2 apply mutatis mutandis to the notification referred to in the preceding paragraph.

第十六条第三項の規定は、第一項の届出について準用する。

The provisions of Article 16, paragraph (3) apply mutatis mutandis to the notification referred to in paragraph (1).

第七十一条

Supplementary Provisions, Article 71

第十七条第二項第二十四条の二の二第三項第四号第二十四条の二の二の二第二十四条の二の三第三項第四号第二十四条の二の三の二第二十四条の二の四第二項第三十四条の二の三において準用する場合を含む。)、第二十四条の七及び第三十四条の二第十五項第四号の規定の適用については、当分の間、これらの規定中「五年間」とあるのは、「三年間」とする。

With regard to the application of the provisions of Article 17, paragraph (2), Article 24-2-2, paragraph (3), item (iv), Article 24-2-2-2, Article 24-2-3, paragraph (3), item (iv), Article 24-2-3-2, Article 24-2-4, paragraph (2) (including as applied mutatis mutandis pursuant to Article 34-2-3), Article 24-7 and Article 34-2, paragraph (15), item (iv), for the time being, the term "five years" in these provisions is replaced with "three years".
