第一条（施行期日）
Supplementary Provisions, Article 1Effective Date
この省令は、令和六年四月一日から施行する。
This Ministerial Ordinance comes into effect as of April 1, 2024.
第二条（経過措置）
Supplementary Provisions, Article 2Transitional Measures
第一条の規定による改正後の労働基準法施行規則（以下「新規則」という。）第二十四条の二の二の二及び第二十四条の二の三の二の規定（保存に関する部分に限る。）は、この省令の施行後に作成された記録について適用する。
The provisions of Article 24-2-2-2 and Article 24-2-3-2 of the Ordinance for Enforcement of the Labor Standards Act as amended by the provisions of Article 1 (hereinafter referred to as the "new Rules") (limited to the parts concerning retention) apply to records prepared after this Ministerial Ordinance comes into effect.

労働基準法（以下「法」という。）第三十八条の三第二項において準用する法第三十八条の二第三項の届出をしようとする使用者は、この省令の施行前においても、新規則様式第十三号により同項の届出をすることができる。
An employer that intends to make the notification under Article 38-2, paragraph (3) of the Labor Standards Act (hereinafter referred to as the "Act") as applied mutatis mutandis pursuant to Article 38-3, paragraph (2) of the Act may, even before this Ministerial Ordinance comes into effect, make the notification under that paragraph using Form No. 13 of the new Ordinance.

Supplementary Provisions, Article 4
法第三十八条の四第一項の届出をしようとする使用者は、この省令の施行前においても、新規則様式第十三号の二により同項の届出をすることができる。この場合において、法第三十八条の四第四項の報告（以下単に「報告」という。）は新規則様式第十三号の四により行わなければならない。
An employer that intends to make the notification under Article 38-4, paragraph (1) of the Act may, even before this Ministerial Ordinance comes into effect, make the notification under that paragraph using Form No. 13-2 of the new Ordinance. In this case, the report under Article 38-4, paragraph (4) of the Act (hereinafter simply referred to as the "report") must be made using Form No. 13-4 of the new Ordinance.

Supplementary Provisions, Article 5
新規則第二十四条の二の五の規定は、有効期間の始期を令和六年四月一日以降とする法第三十八条の四第一項の決議（以下単に「決議」という。）に係る報告について適用し、有効期間の始期を令和六年三月三十一日以前とする決議に係る報告については、なお従前の例による。ただし、有効期間の始期を令和六年三月三十一日以前とする決議であって、有効期間の終期が令和六年四月一日以降であるものに係る報告については、この省令による改正前の労働基準法施行規則（以下「旧規則」という。）第二十四条の二の五第一項中「が行われた日」とあるのは「の有効期間の始期」と、「六箇月以内に一回、及びその後一年以内ごとに一回」とあるのは「六箇月以内ごとに一回」と読み替えて同項の規定を適用する。
The provisions of Article 24-2-5 of the new Rules apply to a report pertaining to a resolution under Article 38-4, paragraph (1) of the Act (hereinafter simply referred to as a "resolution") whose valid period is set to begin on or after April 1, 2024, and with respect to a report pertaining to a resolution whose valid period is set to begin on or before March 31, 2024, the provisions then in force continue to govern; provided, however, that with respect to a report pertaining to a resolution whose valid period is set to begin on or before March 31, 2024 and whose valid period ends on or after April 1, 2024, the provisions of Article 24-2-5, paragraph (1) of the Ordinance for Enforcement of the Labor Standards Act prior to the amendment by this Ministerial Ordinance (hereinafter referred to as the "former Rules") apply by deeming the term "the day on which the resolution was adopted" in that paragraph to be replaced with "the first day of the valid period of the resolution", and the term "once within six months, and once within every year thereafter" to be replaced with "once within every six months".

この省令の施行の際現にある旧規則に定める様式による用紙については、当分の間、これを取り繕って使用することができる。
Paper forms in accordance with the Forms prescribed in the former Rules that actually exist at the time this Ministerial Ordinance comes into effect may be used for the time being with corrections made to them.
