使用者は、法第三十九条第七項の規定により労働者に有給休暇を時季を定めることにより与えるに当たつては、あらかじめ、同項の規定により当該有給休暇を与えることを当該労働者に明らかにした上で、その時季について当該労働者の意見を聴かなければならない。
In granting paid leave to a worker by specifying the time thereof under the provisions of paragraph (7) of Article 39 of the Act, an employer must, in advance, make clear to the worker that the paid leave is to be granted under the provisions of that paragraph, and then hear the opinion of the worker regarding the time thereof.
使用者は、前項の規定により聴取した意見を尊重するよう努めなければならない。
An employer must endeavor to respect the opinion heard under the provisions of the preceding paragraph.
