次に掲げる者が、その職務に関し、不正の請託を受けて、財産上の利益を収受し、又はその要求若しくは約束をしたときは、五年以下の拘禁刑又は五百万円以下の罰金に処する。
When any one of the following persons accepts, solicits or promises to accept property benefits in connection with the person's duties, in response to a wrongful request, the person is punished by imprisonment for not more than five years or a fine of not more than five million yen:
any one of the persons set forth in the items of Article 960, paragraph (1) or the items of Article 960, paragraph (2);
第九百六十一条に規定する者
the person prescribed in Article 961; or
会計監査人又は第三百四十六条第四項の規定により選任された一時会計監査人の職務を行うべき者
financial auditor or a person who is temporarily to perform the duties of a financial auditor appointed pursuant to the provisions of Article 346, paragraph (4).
前項の利益を供与し、又はその申込み若しくは約束をした者は、三年以下の拘禁刑又は三百万円以下の罰金に処する。
A person who has given, offered or promised to give the benefits referred to in the preceding paragraph is punished by imprisonment for not more than three years or a fine of not more than three million yen.
