第三条（難民の認定等に関する経過措置）

附則第一条第二号に掲げる規定の施行の日（以下「第二号施行日」という。）前に第一条改正前入管法第六十一条の二第一項の申請をした外国人について、第二号施行日以後に難民の認定（第一条の規定による改正後の入管法（以下「第一条改正後入管法」という。）第六十一条の二第一項に規定する難民の認定をいう。附則第十一条第一項において同じ。）をしない処分をする場合についても、第一条改正後入管法第六十一条の二第三項の規定を適用する。
The provisions of Article 61-2, paragraph (3) of the Immigration Control Act as amended by the provisions of Article 1 (hereinafter referred to as the "Immigration Control Act as Amended by Article 1") also apply in the case where, on or after the date on which the provisions set forth in Article 1, item (ii) of the Supplementary Provisions come into effect (hereinafter referred to as the "Item (ii) Effective Date"), a disposition not to grant Recognition of Refugee Status (meaning Recognition of Refugee Status prescribed in Article 61-2, paragraph (1) of the Immigration Control Act as Amended by Article 1; the same applies in Article 11, paragraph (1) of the Supplementary Provisions) is made with regard to a foreign national who filed an application under Article 61-2, paragraph (1) of the Immigration Control Act Prior to Amendment by Article 1 before the Item (ii) Effective Date.
