Chapter V-2 Treatment of Detainees

第一節 総則

Section 1 General Provisions

第五十五条の三(入国者収容所等の事務)

Article 55-3Functions of Immigration Detention Centers, etc.

地方出入国在留管理局に、収容場を設ける。

Detention houses are established in regional immigration services bureaus.

入国者収容所等は、次に掲げる者を収容し、これらの者に対し必要な処遇を行う施設とする。

Immigration detention centers, etc. are facilities that detain the following persons and provide those persons with necessary treatment:

収容令書の執行を受ける者

persons subject to enforcement of written detention orders; and

退去強制令書の発付を受け、第五十二条第九項第五十二条の四第五項若しくは第六項の規定又は第五十五条第三項若しくは第四項(これらの規定を同条第五項において準用する場合を含む。)の規定により収容される者

persons who have been issued a deportation order and are detained pursuant to the provisions of Article 52, paragraph (9), or Article 52-4, paragraph (5) or (6), or pursuant to the provisions of Article 55, paragraph (3) or (4) (including as applied mutatis mutandis pursuant to paragraph (5) of that Article).

第五十五条の四(処遇の原則)

Article 55-4Principles of Treatment

被収容者入国者収容所等に収容されている者をいう。以下この章及び第七十一条の六において同じ。)の処遇は、被収容者の人権を尊重しつつ適正に行わなければならない。

The treatment of detainees (meaning persons detained in an immigration detention center, etc.; the same applies hereinafter in this Chapter and in Article 71-6) must be carried out appropriately while respecting the human rights of detainees.

被収容者には、入国者収容所等の保安上支障がない範囲内においてできる限りの自由が与えられなければならない。

Detainees must be given as much freedom as possible to the extent that it does not interfere with the security of the immigration detention center, etc.

第五十五条の五(活動の援助)

Article 55-5Assistance for Activities

入国者収容所長又は地方出入国在留管理局長(以下この章及び第八章において「入国者収容所長等」という。)は、法務省令で定めるところにより、被収容者に対し、知的、教育的及び娯楽的活動その他の活動について、援助を与えるように努めなければならない。

The director of the immigration detention center or the director of the regional immigration services bureau (hereinafter referred to as the "director of the immigration detention center, etc." in this Chapter and Chapter VIII) must endeavor to give detainees assistance with intellectual, educational and recreational activities and other activities, pursuant to Ministry of Justice Order.

入国者収容所長等は、前項の規定による援助の措置として、入国者収容所等に書籍を備え付けるものとする。この場合において、備え付けた書籍の閲覧の方法は、入国者収容所長等が定めるものとする。

The director of the immigration detention center, etc. is to keep books in the immigration detention center, etc. as a measure of assistance under the provisions of the preceding paragraph. In this case, the method of reading the books kept is to be determined by the director of the immigration detention center, etc.

被収容者が一人で行う礼拝その他の宗教上の行為は、禁止し、又は制限してはならない。ただし、入国者収容所等の規律及び秩序の維持その他管理運営上支障を生ずるおそれがある場合は、この限りでない。

Worship or other religious acts performed by a detainee alone must not be prohibited or restricted; provided, however, that this does not apply if there is a risk of hindrance to the maintenance of discipline and order in the immigration detention center, etc. or otherwise to its administration and operation.

第五十五条の七(書籍等の閲覧)

Article 55-7Reading of Books, etc.

被収容者が自弁の書籍等(書籍、雑誌、新聞紙その他の文書図画(信書を除く。)をいう。以下この章において同じ。)を閲覧することは、次項に規定する場合のほか、これを禁止し、又は制限してはならない。

A detainee's reading of books, etc. obtained at their own expense (meaning books, magazines, newspapers and other documents and drawings (excluding letters); the same applies hereinafter in this Chapter) must not be prohibited or restricted, except in the case prescribed in the following paragraph.

被収容者書籍等を閲覧することにより、入国者収容所等の規律及び秩序を害する結果を生ずるおそれがあるときには、その閲覧を禁止することができる。

If a detainee's reading of books, etc. is likely to result in harm to the discipline and order of the immigration detention center, etc., the reading may be prohibited.

第五十五条の八(被収容者の分離)

Article 55-8Separation of Detainees

男子の被収容者と女子の被収容者とは、分離して収容しなければならない。ただし、入国者収容所長等が被収容者が被収容者である乳児を監護する必要がある場合その他特に必要があると認めるときは、この限りでない。

Male detainees and female detainees must be detained separately; provided, however, that this does not apply if the director of the immigration detention center, etc. finds it particularly necessary, such as in the case where a detainee needs to care for an infant who is a detainee.

入国者収容所長等は、第五十五条の十九第二項の身体の検査及び第五十五条の四十九第二項の身体又は着衣の検査以外の場合であつても、女子の被収容者の処遇については、女子の入国警備官に行わせるように努めなければならない。

The director of the immigration detention center, etc. must endeavor to have female immigration control officers carry out the treatment of female detainees, even in cases other than the physical inspection set forth in Article 55-19, paragraph (2) and the inspection of the body or clothing set forth in Article 55-49, paragraph (2).

第五十五条の九(実地監査)

Article 55-9On-Site Audits

出入国在留管理庁長官は、法務大臣の定めるところにより、この章の規定の適正な施行を確保するため、その職員のうちから監査官を指名し、各入国者収容所等について、毎年一回以上、実地監査を行わせなければならない。

In order to ensure the proper enforcement of the provisions of this Chapter, the Commissioner of the Immigration Services Agency must, as provided for by the Minister of Justice, designate auditors from among the officials of the Agency and have them conduct an on-site audit of each immigration detention center, etc. at least once a year.

第五十五条の十(入国者収容所等視察委員会)

Article 55-10Immigration Detention Facilities Visiting Committees

法務省令で定める出入国在留管理官署に、入国者収容所等視察委員会(以下この節において「委員会」という。)を置く。

An Immigration Detention Facilities Visiting Committee (hereinafter referred to as the "Committee" in this Section) is established in each immigration services office specified by Ministry of Justice Order.

委員会は、入国者収容所等の適正な運営に資するため、法務省令で定める担当区域内にある入国者収容所等を視察し、その運営に関し、入国者収容所長等に対して意見を述べるものとする。

In order to contribute to the proper operation of immigration detention centers, etc., the Committee is to visit the immigration detention centers, etc. located within its area of responsibility specified by Ministry of Justice Order and state its opinions concerning their operation to the director of the immigration detention center, etc.

第五十五条の十一(組織等)

Article 55-11Organization, etc.

委員会は、委員十人以内で組織する。

The Committee is composed of not more than 10 members.

委員は、人格識見が高く、かつ、入国者収容所等の運営の改善向上に熱意を有する者のうちから、法務大臣が任命する。

The members are appointed by the Minister of Justice from among persons of high character and insight who are enthusiastic about improving and enhancing the operation of immigration detention centers, etc.

委員の任期は、一年とする。ただし、再任を妨げない。

The term of office of the members is 1 year; provided, however, that reappointment is not precluded.

委員は、非常勤とする。

The members serve on a part-time basis.

前各項に定めるもののほか、委員会の組織及び運営に関し必要な事項は、法務省令で定める。

Beyond what is provided for in the preceding paragraphs, necessary matters concerning the organization and operation of the Committee are specified by Ministry of Justice Order.

第五十五条の十二(委員会に対する情報の提供及び委員の視察等)

Article 55-12Provision of Information to the Committee and Visits by Members, etc.

入国者収容所長等は、入国者収容所等の運営の状況について、法務省令で定めるところにより、定期的に、又は必要に応じて、委員会に対し、情報を提供するものとする。

The director of the immigration detention center, etc. is to provide the Committee with information on the state of operation of the immigration detention center, etc., periodically or as necessary, pursuant to Ministry of Justice Order.

委員会は、入国者収容所等の運営の状況を把握するため、委員による入国者収容所等の視察をすることができる。この場合において、委員会は、必要があると認めるときは、入国者収容所長等に対し、委員による被収容者との面接の実施について協力を求めることができる。

In order to ascertain the state of operation of immigration detention centers, etc., the Committee may have its members visit immigration detention centers, etc. In this case, the Committee may, if it finds it necessary, request the cooperation of the director of the immigration detention center, etc. in conducting interviews with detainees by its members.

入国者収容所長等は、前項の視察及び面接について、必要な協力をしなければならない。

The director of the immigration detention center, etc. must provide necessary cooperation for the visits and interviews set forth in the preceding paragraph.

第五十五条の六十第一項第五十五条の六十一及び第五十五条の六十二の規定にかかわらず、被収容者委員会に対して提出する書面については、検査し、又はその提出を差し止め、若しくは制限してはならない。

Notwithstanding the provisions of Article 55-60, paragraph (1), Article 55-61 and Article 55-62, documents that a detainee submits to the Committee must not be inspected, and their submission must not be stopped or restricted.

第五十五条の十三(委員会の意見等の公表)

Article 55-13Publication of the Opinions of the Committee, etc.

法務大臣は、毎年、委員会入国者収容所長等に対して述べた意見及びこれを受けて入国者収容所長等が講じた措置の内容を取りまとめ、その概要を公表するものとする。

The Minister of Justice is to annually compile the opinions expressed by the Committee to the director of an immigration detention center, etc. and the content of measures taken by the director of an immigration detention center, etc. in response and is to publicize their outline.

第五十五条の十四(出国待機施設の視察等)

Article 55-14Visits to Departure Waiting Facilities, etc.

委員会は、第五十五条の十第二項に規定する事務を行うほか、出国待機施設第十三条の二第一項に規定する法務省令で定める施設をいう。以下この項及び第五十九条第三項において同じ。)の適正な運営に資するため、法務省令で定める担当区域内にある出国待機施設を視察し、その運営に関し、当該出国待機施設の所在地を管轄する地方出入国在留管理局の長に対して意見を述べるものとする。

In addition to carrying out the affairs prescribed in Article 55-10, paragraph (2), in order to contribute to the proper operation of departure waiting facilities (meaning the facilities specified by Ministry of Justice Order prescribed in Article 13-2, paragraph (1); the same applies hereinafter in this paragraph and in Article 59, paragraph (3)), the Committee is to visit the departure waiting facilities located within its area of responsibility specified by Ministry of Justice Order and state its opinions concerning their operation to the director of the regional immigration services bureau having jurisdiction over the location of the departure waiting facility.

前二条の規定は、前項に規定する事務を行う場合に準用する。

The provisions of the preceding two Articles apply mutatis mutandis when carrying out the affairs prescribed in the preceding paragraph.

入国者収容所長等は、その入国者収容所等の参観を申し出る者がある場合において相当と認めるときは、これを許すことができる。

If a person requests a tour of the immigration detention center, etc., the director of the immigration detention center, etc. may permit it if the director finds it appropriate.

第五十五条の十六(研修及び訓練)

Article 55-16Education and Training

入国者収容所等に勤務する入国警備官には、被収容者の人権に関する理解を深めさせ、並びに被収容者の処遇を適正かつ効果的に行うために必要な知識及び技能を習得させ、及び向上させるために必要な研修及び訓練を行うものとする。

Immigration control officers working at immigration detention centers, etc. are to be given the education and training necessary to deepen their understanding of the human rights of detainees and to acquire and improve the knowledge and skills necessary for carrying out the treatment of detainees appropriately and effectively.

第五十五条の十七(医師等職員の国家公務員法等の特例)

Article 55-17Special Provisions of the National Public Service Act, etc. for Medical Officers

医師等職員入国者収容所又は地方出入国在留管理局の職員である医師又は歯科医師をいう。以下この章において同じ。)であつて、一般職の職員の給与に関する法律(昭和二十五年法律第九十五号)別表第八イ医療職俸給表(一)の適用を受ける者は、部外診療(病院又は診療所その他これらに準ずるものとして内閣官房令・法務省令で定める施設(これらの職員が国家公務員の身分を有しないものに限る。)において行う医業又は歯科医業(当該医師等職員が団体の役員、顧問又は評議員の職を兼ねて行うもの及び自ら営利を目的とする私企業を営んで行うものを除く。)をいう。以下この条において同じ。)を行おうとする場合において、当該部外診療を行うことが、次の各号のいずれかに該当するときは、内閣官房令・法務省令で定めるところにより、出入国在留管理庁長官の承認を受けることができる。

A physician or dentist on staff (meaning a physician or dentist who is an official of an immigration detention center or a regional immigration services bureau; the same applies hereinafter in this Chapter) to whom the Medical Service Salary Schedule (I) in Appended Table 8 (a) of the Act on Remuneration of Officials in the Regular Service (Act No. 95 of 1950) applies may, if intending to engage in outside medical practice (meaning the practice of medicine or dentistry at a hospital, clinic or any other facility specified by Cabinet Secretariat and Ministry of Justice Order as being equivalent thereto (limited to a facility whose staff do not have the status of national public employees) (excluding practice that the physician or dentist on staff engages in while concurrently holding the position of officer, advisor or councilor of an organization and practice that the physician or dentist on staff engages in by personally operating a private enterprise for profit); the same applies hereinafter in this Article), obtain the approval of the Commissioner of the Immigration Services Agency pursuant to Cabinet Secretariat and Ministry of Justice Order if engaging in the outside medical practice falls under either of the following items:

その正規の勤務時間一般職の職員の勤務時間、休暇等に関する法律(平成六年法律第三十三号)第十三条第一項に規定する正規の勤務時間をいう。以下この条において同じ。)において、勤務しないこととなる場合

the case where it results in the medical officer not working during their regular working hours (meaning the regular working hours prescribed in Article 13, paragraph (1) of the Act on Working Hours, Leave, and Other Matters of Officials in the Regular Service (Act No. 33 of 1994); the same applies hereinafter in this Article); or

報酬を得て、行うこととなる場合

the case where it is engaged in for remuneration.

前項の承認を受けた医師等職員が、その正規の勤務時間において、当該承認に係る部外診療を行うため勤務しない場合には、その勤務しない時間については、国家公務員法(昭和二十二年法律第百二十号)第百一条第一項前段の規定は、適用しない。

If a physician or dentist on staff who has obtained the approval set forth in the preceding paragraph does not work during their regular working hours in order to engage in the outside medical practice pertaining to that approval, the provisions of the first sentence of Article 101, paragraph (1) of the National Public Service Act (Act No. 120 of 1947) do not apply with respect to the hours not worked.

第一項の承認を受けた医師等職員が、報酬を得て、当該承認に係る部外診療を行う場合には、国家公務員法第百四条の許可を要しない。

If a physician or dentist on staff who has obtained the approval set forth in paragraph (1) engages in the outside medical practice pertaining to that approval for remuneration, the permission set forth in Article 104 of the National Public Service Act is not required.

第一項の承認を受けた医師等職員が、その正規の勤務時間において、当該承認に係る部外診療を行うため勤務しない場合には、一般職の職員の給与に関する法律第十五条の規定にかかわらず、その勤務しない一時間につき、同法第十九条に規定する勤務一時間当たりの給与額を減額して給与を支給する。

If a physician or dentist on staff who has obtained the approval set forth in paragraph (1) does not work during their regular working hours in order to engage in the outside medical practice pertaining to that approval, notwithstanding the provisions of Article 15 of the Act on Remuneration of Officials in the Regular Service, their remuneration is paid after deducting, for each hour not worked, the amount of remuneration per working hour prescribed in Article 19 of that Act.

第二節 収容の開始

Section 2 Commencement of Detention

第五十五条の十八(収容開始時の告知)

Article 55-18Notification upon Commencement of Detention

入国者収容所長等は、被収容者に対し、その入国者収容所等における収容の開始に際し、次に掲げる事項を告知しなければならない。

Upon commencing the detention of a detainee in the immigration detention center, etc., the director of the immigration detention center, etc. must notify the detainee of the following matters:

物品の貸与及び支給並びに自弁に関する事項

matters concerning the lending and provision of goods and the use of goods obtained at one's own expense;

第五十五条の二十九第一項に規定する保管私物その他の金品の取扱いに関する事項

matters concerning the handling of personal belongings in possession prescribed in Article 55-29, paragraph (1) and other money and goods;

保健衛生及び医療に関する事項

matters concerning health, hygiene and medical care;

宗教上の行為に関する事項

matters concerning religious acts;

書籍等の閲覧に関する事項

matters concerning the reading of books, etc.;

第五十五条の四十八第一項に規定する遵守事項

the rules to be observed prescribed in Article 55-48, paragraph (1);

面会及び通信の発受に関する事項

matters concerning visits and the sending and receiving of correspondence;

審査の申請を行うことができる措置、審査の申請をすべき行政庁及び審査の申請期間その他の審査の申請に関する事項

the measures against which a request for examination may be filed, the administrative agency with which the request for examination is to be filed, the period for filing the request for examination, and other matters concerning applications for review;

第五十五条の七十四第一項の規定による申告を行うことができる行為、申告先及び申告期間その他の同項の規定による申告に関する事項

the acts concerning which a report may be filed under the provisions of Article 55-74, paragraph (1), the authority to which the report is to be filed, the period for filing the report, and other matters concerning reports under the provisions of that paragraph; and

苦情の申出に関する事項

matters concerning the filing of complaints.

前項の規定による告知は、法務省令で定めるところにより、書面で行うものとする。

The notification under the provisions of the preceding paragraph is to be given in writing, pursuant to Ministry of Justice Order.

第五十五条の十九(識別のための身体検査)

Article 55-19Physical Inspection for Identification

入国警備官は、被収容者について、その入国者収容所等における収容の開始に際し、その者の識別のため必要な限度で、その身体を検査することができる。その後必要が生じたときも、同様とする。

Upon commencing the detention of a detainee in the immigration detention center, etc., an immigration control officer may inspect the detainee's body to the extent necessary for identifying the detainee. The same applies when the need subsequently arises.

女子の被収容者について前項の規定により検査を行う場合には、女子の入国警備官がこれを行わなければならない。ただし、女子の入国警備官がその検査を行うことができない場合には、男子の入国警備官が入国者収容所長等の指名する女子の職員を指揮して、これを行うことができる。

If an inspection is conducted on a female detainee pursuant to the provisions of the preceding paragraph, a female immigration control officer must conduct it; provided, however, that if a female immigration control officer is unable to conduct the inspection, a male immigration control officer may conduct it by directing a female official designated by the director of the immigration detention center, etc.

第五十五条の二十(起居動作の時間帯)

Article 55-20Hours for Daily Activities

入国者収容所長等は、法務省令で定めるところにより、食事、就寝その他の起居動作をすべき時間帯を定め、これを被収容者に告知するものとする。

The director of the immigration detention center, etc. is to set the hours during which meals, sleep and other daily activities are to take place, and notify detainees thereof, pursuant to Ministry of Justice Order.

第三節 金品の取扱い等

Section 3 Handling of Money and Goods, etc.

第五十五条の二十一(物品の貸与等)

Article 55-21Lending of Goods, etc.

被収容者には、次に掲げる物品(書籍等を除く。以下この条から第五十五条の二十四まで及び第五十五条の六十八第一項第三号において同じ。)であつて、入国者収容所等における日常生活に必要なもの(第五十五条の二十三第一項各号に掲げる物品を除く。)を貸与し、又は支給するものとする。

Detainees are to be lent or provided with the following goods (excluding books, etc.; the same applies hereinafter from this Article through Article 55-24 and in Article 55-68, paragraph (1), item (iii)) that are necessary for daily life in the immigration detention center, etc. (excluding the goods set forth in the items of Article 55-23, paragraph (1)):

衣類及び寝具

clothing and bedding;

食事及び湯茶

meals, and hot water and tea; and

日用品、筆記具その他の物品

daily necessities, writing materials and other goods.

被収容者には、前項に定めるもののほか、法務省令で定めるところにより、必要に応じ、入国者収容所等における日常生活に用いる物品(第五十五条の二十三第一項各号に掲げる物品を除く。)を貸与し、又は嗜好品を支給することができる。

In addition to what is provided for in the preceding paragraph, detainees may, as necessary, be lent goods used for daily life in the immigration detention center, etc. (excluding the goods set forth in the items of Article 55-23, paragraph (1)) or be provided with luxury items, pursuant to Ministry of Justice Order.

第五十五条の二十二(自弁の物品の使用等)

Article 55-22Use of Goods Obtained at One's Own Expense, etc.

入国者収容所長等は、被収容者が、次に掲げる物品(次条第一項各号に掲げる物品を除く。)について、自弁のものを使用し、又は摂取したい旨の申出をした場合には、入国者収容所等の規律及び秩序の維持その他管理運営上支障を生ずるおそれがある場合を除き、法務省令で定めるところにより、これを許すものとする。

If a detainee requests to use or consume the following goods (excluding the goods set forth in the items of paragraph (1) of the following Article) obtained at their own expense, the director of the immigration detention center, etc. is to permit it pursuant to Ministry of Justice Order, except where there is a risk of hindrance to the maintenance of discipline and order in the immigration detention center, etc. or otherwise to its administration and operation:

衣類

clothing;

食料品及び飲料

food and beverages;

室内装飾品

room decorations;

嗜好品

luxury items; and

日用品、文房具その他の入国者収容所等における日常生活に用いる物品

daily necessities, stationery and other goods used for daily life in the immigration detention center, etc.

第五十五条の二十三(補正器具等の自弁等)

Article 55-23Corrective Devices, etc. Obtained at One's Own Expense, etc.

被収容者には、次に掲げる物品については、入国者収容所等の規律及び秩序の維持その他管理運営上支障を生ずるおそれがある場合を除き、自弁のものを使用させるものとする。

Detainees are to be allowed to use the following goods obtained at their own expense, except where there is a risk of hindrance to the maintenance of discipline and order in the immigration detention center, etc. or otherwise to its administration and operation:

眼鏡その他の補正器具

eyeglasses and other corrective devices;

信書を発するのに必要な封筒その他の物品

envelopes and other goods necessary for sending letters; and

その他法務省令で定める物品

other goods specified by Ministry of Justice Order.

前項各号に掲げる物品について、被収容者が自弁のものを使用することができない場合であつて、必要と認めるときは、その者にこれを貸与し、又は支給するものとする。

With regard to the goods set forth in the items of the preceding paragraph, if a detainee is unable to use such goods obtained at their own expense and it is found necessary, the goods are to be lent or provided to the detainee.

第五十五条の二十四(物品の貸与等の基準)

Article 55-24Standards for Lending of Goods, etc.

第五十五条の二十一又は前条第二項の規定により貸与し、又は支給する物品は、被収容者の健康を保持するに足り、かつ、国民生活の実情等を勘案し、被収容者としての地位に照らして、適正と認められるものでなければならない。

Goods lent or provided pursuant to the provisions of Article 55-21 or paragraph (2) of the preceding Article must be sufficient to maintain the health of detainees, and must be found appropriate in light of their status as detainees, taking into consideration the actual state of the lives of the people and other circumstances.

第五十五条の二十五(金品の検査)

Article 55-25Inspection of Money and Goods

入国者収容所等の職員は、次に掲げる金品について、検査を行うことができる。

Officials of an immigration detention center, etc. may inspect the following money and goods:

被収容者が収容される際に所持する現金及び物品

cash and goods in the possession of a detainee at the time of being detained;

被収容者が収容中に取得した現金及び物品(信書を除く。次号において同じ。)であつて、同号に掲げる現金及び物品以外のもの(入国者収容所長等から支給された物品を除く。)

cash and goods (excluding letters; the same applies in the following item) acquired by a detainee during detention, other than the cash and goods set forth in that item (excluding goods provided by the director of the immigration detention center, etc.); and

被収容者に交付するため当該被収容者以外の者が入国者収容所等に持参し、又は送付した現金及び物品

cash and goods brought or sent to the immigration detention center, etc. by a person other than the detainee for delivery to the detainee.

第五十五条の二十六(収容時の所持物品等の処分)

Article 55-26Disposal of Goods in Possession at the Time of Detention, etc.

入国者収容所長等は、前条第一号又は第二号に掲げる物品が次の各号のいずれかに該当する場合には、被収容者に対し、その物品について、親族(婚姻の届出をしていないが、事実上婚姻関係と同様の事情にある者を含む。以下この節において同じ。)その他相当と認める者への交付その他相当の処分を求めるものとする。

If goods set forth in item (i) or (ii) of the preceding Article fall under any of the following items, the director of the immigration detention center, etc. is to request the detainee to deliver the goods to a relative (including a person who has not registered a marriage but is in a de facto marital relationship with the detainee; the same applies hereinafter in this Section) or any other person the director finds appropriate, or to otherwise dispose of the goods appropriately:

保管に不便なものであるとき。

the goods are inconvenient to store;

腐敗し、又は滅失するおそれがあるものであるとき。

the goods are likely to decay or be lost; or

危険を生ずるおそれがあるものであるとき。

the goods are likely to cause danger.

前項の規定により物品の処分を求めた場合において、被収容者が相当の期間内にその処分をしないときは、入国者収容所長等は、これを売却してその代金を被収容者に引き渡すものとする。ただし、売却することができないものは、廃棄することができる。

If a request for disposal of goods has been made pursuant to the provisions of the preceding paragraph and the detainee does not dispose of the goods within a reasonable period, the director of the immigration detention center, etc. is to sell the goods and hand over the proceeds to the detainee; provided, however, that goods that cannot be sold may be discarded.

第五十五条の二十七(差入物の引取り等)

Article 55-27Collection of Items Sent In, etc.

入国者収容所長等は、第五十五条の二十五第三号に掲げる現金又は物品が次の各号のいずれかに該当する場合には、その現金又は物品を持参し、又は送付した者(以下この節において「差入人」という。)に対し、その引取りを求めるものとする。

If cash or goods set forth in Article 55-25, item (iii) fall under any of the following items, the director of the immigration detention center, etc. is to request the person who brought or sent the cash or goods (hereinafter referred to as the "sender" in this Section) to collect them:

被収容者に交付することにより、入国者収容所等の規律及び秩序を害するおそれがあるものであるとき。

delivering them to the detainee is likely to harm the discipline and order of the immigration detention center, etc.;

差入人の氏名が明らかでないものであるとき。

the name of the sender is unknown;

自弁により使用し、若しくは摂取することができることとされる物品又は出所の際に必要と認められる物品(以下この節において「自弁物品等」という。)以外の物品であるとき。

they are goods other than goods that may be used or consumed at the detainee's own expense or goods found to be necessary upon leaving the facility (hereinafter referred to as "self-provided goods, etc." in this Section); or

前条第一項各号のいずれかに該当する物品であるとき。

they are goods that fall under any of the items of paragraph (1) of the preceding Article.

第五十五条の二十五第三号に掲げる現金又は物品であつて、前項第一号又は第二号に該当するものについて、差入人の所在が明らかでないため同項の規定による引取りを求めることができないときは、入国者収容所長等は、その旨を政令で定める方法によつて公告しなければならない。

If, with regard to cash or goods set forth in Article 55-25, item (iii) that fall under item (i) or (ii) of the preceding paragraph, the collection under the provisions of that paragraph cannot be requested because the whereabouts of the sender are unknown, the director of the immigration detention center, etc. must give public notice to that effect by the method specified by Cabinet Order.

前項に規定する現金又は物品について、第一項の規定による引取りを求め、又は前項の規定により公告した日から起算して六月を経過する日までに差入人がその現金又は物品の引取りをしないときは、その現金又は物品は、国庫に帰属する。

If the sender does not collect the cash or goods prescribed in the preceding paragraph by the day on which 6 months have elapsed, counting from the day on which the collection was requested under the provisions of paragraph (1) or the public notice was given pursuant to the provisions of the preceding paragraph, the cash or goods belong to the National Treasury.

第二項に規定する物品であつて、第一項第四号に該当するものについては、入国者収容所長等は、前項の期間内でも、これを売却してその代金を保管することができる。ただし、売却できないものは、廃棄することができる。

With regard to goods prescribed in paragraph (2) that fall under paragraph (1), item (iv), the director of the immigration detention center, etc. may sell them and keep the proceeds even within the period set forth in the preceding paragraph; provided, however, that goods that cannot be sold may be discarded.

第五十五条の二十五第三号に掲げる現金又は物品であつて、第一項第三号又は第四号に該当するもの(同項第一号又は第二号に該当するものを除く。)について、差入人の所在が明らかでないため同項の規定による引取りを求めることができないとき、若しくはその引取りを求めることが相当でないとき、又は差入人がその引取りを拒んだときは、入国者収容所長等は、被収容者に対し、親族その他相当と認める者への交付その他相当の処分を求めるものとする。

If, with regard to cash or goods set forth in Article 55-25, item (iii) that fall under paragraph (1), item (iii) or (iv) (excluding those falling under item (i) or (ii) of that paragraph), the collection under the provisions of that paragraph cannot be requested because the whereabouts of the sender are unknown, or it is not appropriate to request the collection, or the sender has refused to collect them, the director of the immigration detention center, etc. is to request the detainee to deliver them to a relative or any other person the director finds appropriate, or to otherwise dispose of them appropriately.

前条第二項の規定は、前項の規定により処分を求めた場合について準用する。

The provisions of paragraph (2) of the preceding Article apply mutatis mutandis if disposal has been requested pursuant to the provisions of the preceding paragraph.

第五十五条の二十五第三号に掲げる現金又は物品であつて、第一項各号のいずれにも該当しないものについて、被収容者がその交付を受けることを拒んだ場合には、入国者収容所長等は、差入人に対し、その引取りを求めるものとする。この場合においては、第二項及び第三項の規定を準用する。

If a detainee has refused to receive cash or goods set forth in Article 55-25, item (iii) that do not fall under any of the items of paragraph (1), the director of the immigration detention center, etc. is to request the sender to collect them. In this case, the provisions of paragraphs (2) and (3) apply mutatis mutandis.

第五十五条の二十八(金品の引渡し及び領置)

Article 55-28Handover and Custody of Money and Goods

次に掲げる金品のうち、この節の規定により被収容者が使用し、又は摂取することができるものは、被収容者に引き渡すものとする。

Of the following money and goods, those that a detainee may use or consume pursuant to the provisions of this Section are to be handed over to the detainee:

第五十五条の二十五第一号又は第二号に掲げる金品であつて、第五十五条の二十六第一項各号のいずれにも該当しないもの

第五十五条の二十五第三号に掲げる金品であつて、前条第一項各号のいずれにも該当しないもの(被収容者が交付を受けることを拒んだ金品を除く。)

money and goods set forth in Article 55-25, item (iii) that do not fall under any of the items of paragraph (1) of the preceding Article (excluding money and goods that the detainee has refused to receive).

前項各号に掲げる金品のうち、この節の規定により被収容者が使用し、又は摂取することができるもの以外のものは、入国者収容所長等が領置するものとする。

Of the money and goods set forth in the items of the preceding paragraph, those other than the ones that a detainee may use or consume pursuant to the provisions of this Section are to be held in custody by the director of the immigration detention center, etc.

第五十五条の二十九(保管私物等)

Article 55-29Personal Belongings in Possession, etc.

入国者収容所長等は、法務省令で定めるところにより、保管私物被収容者前条第一項の規定により引渡しを受けて保管する物品(第五項の規定により引渡しを受けて保管する物品を含む。)及び被収容者が受けた信書でその保管するものをいう。以下この節及び第五十五条の六十八第一項第四号において同じ。)の保管方法について、入国者収容所等の管理運営上必要な制限をすることができる。

The director of an immigration detention center, etc. may, pursuant to Ministry of Justice Order, impose restrictions necessary for the administration and operation of the immigration detention center, etc. on the method of storing personal effects kept by the detainee (meaning goods that a detainee has received and keeps pursuant to the provisions of paragraph (1) of the preceding Article (including goods that the detainee has received and keeps pursuant to the provisions of paragraph (5)) and letters received by the detainee that the detainee keeps; the same applies hereinafter in this Section and in Article 55-68, paragraph (1), item (iv)).

入国者収容所長等は、被収容者保管私物(法務省令で定めるものを除く。)の総量(第五項及び次条において「保管総量」という。)が保管限度量(被収容者一人当たりについて保管することができる物品の量として入国者収容所長等が定める量をいう。同項及び同条において同じ。)を超えるとき、又は被収容者について領置している物品(法務省令で定めるものを除く。)の総量(第四項及び同条において「領置総量」という。)が領置限度量(被収容者一人当たりについて領置することができる物品の量として入国者収容所長等が定める量をいう。同項及び同条において同じ。)を超えるときは、当該被収容者に対し、その超過量に相当する量の物品について、親族その他相当と認める者への交付その他相当の処分を求めることができる。腐敗し、又は滅失するおそれが生じた物品についても、同様とする。

If the total quantity of the personal effects kept by the detainee (excluding those specified by Ministry of Justice Order) (referred to as the "total quantity in possession" in paragraph (5) and the following Article) exceeds the possession limit (meaning the quantity of goods that may be kept per detainee, as determined by the director of an immigration detention center, etc.; the same applies in that paragraph and that Article), or if the total quantity of goods held in custody for a detainee (excluding those specified by Ministry of Justice Order) (referred to as the "total quantity in custody" in paragraph (4) and that Article) exceeds the custody limit (meaning the quantity of goods that may be held in custody per detainee, as determined by the director of an immigration detention center, etc.; the same applies in that paragraph and that Article), the director of an immigration detention center, etc. may request the detainee to deliver goods in a quantity equivalent to the excess to a relative or any other person the director finds appropriate, or to otherwise dispose of them appropriately. The same applies to goods that have become likely to decay or be lost.

第五十五条の二十六第二項の規定は、前項の規定により処分を求めた場合について準用する。

The provisions of Article 55-26, paragraph (2) apply mutatis mutandis if disposal has been requested pursuant to the provisions of the preceding paragraph.

入国者収容所長等は、被収容者保管私物について領置することを求めた場合において、相当と認めるときは、これを領置することができる。ただし、領置総量が領置限度量を超えることとなる場合は、この限りでない。

If a detainee has requested that personal effects kept by the detainee be held in custody, the director of an immigration detention center, etc. may hold them in custody if the director finds it appropriate; provided, however, that this does not apply if the total quantity in custody would exceed the custody limit.

入国者収容所長等は、前項の規定により領置している物品について、被収容者がその引渡しを求めた場合には、これを引き渡すものとする。ただし、保管総量が保管限度量を超えることとなる場合は、この限りでない。

If a detainee has requested the handover of goods held in custody pursuant to the provisions of the preceding paragraph, the director of the immigration detention center, etc. is to hand them over; provided, however, that this does not apply if the total quantity in possession would exceed the possession limit.

第五十五条の三十(物品の購入)

Article 55-30Purchase of Goods

入国者収容所長等は、被収容者が自ら保管する現金を使用して自弁物品等を購入することを申請した場合には、その購入により、保管総量が保管限度量を超え、又は領置総量が領置限度量を超えることとなるときを除き、これを許すものとする。

If a detainee applies to purchase self-provided goods, etc. using cash that the detainee keeps, the director of the immigration detention center, etc. is to permit it, except when the purchase would cause the total quantity in possession to exceed the possession limit or the total quantity in custody to exceed the custody limit.

第五十五条の三十一(保管私物等の交付)

Article 55-31Delivery of Personal Belongings in Possession, etc.

入国者収容所長等は、被収容者が、保管私物、自ら保管する現金又は領置されている物品(第五十五条の六十五に規定する文書図画に該当するものを除く。)について、他の者への交付(信書の発信に該当するものを除く。)を申請した場合には、その交付(その相手方が親族であるものを除く。)により入国者収容所等の規律及び秩序を害するおそれがある場合を除き、これを許すものとする。

If a detainee applies to deliver personal effects kept by the detainee, cash that the detainee keeps, or goods held in custody (excluding those that fall under the documents and drawings prescribed in Article 55-65) to another person (excluding delivery that constitutes the sending of letters), the director of an immigration detention center, etc. is to permit it, except where the delivery (excluding delivery to a relative) is likely to harm the discipline and order of the immigration detention center, etc.

第五十五条の三十二(差入れ等に関する制限)

Article 55-32Restrictions on Sending In Items, etc.

入国者収容所長等は、この節に定めるもののほか、法務省令で定めるところにより、差入人による被収容者に対する金品の交付及び被収容者による自弁物品等の購入について、入国者収容所等の管理運営上必要な制限をすることができる。

In addition to what is provided for in this Section, the director of the immigration detention center, etc. may, pursuant to Ministry of Justice Order, impose restrictions necessary for the administration and operation of the immigration detention center, etc. on the delivery of money and goods to detainees by senders and the purchase of self-provided goods, etc. by detainees.

第五十五条の三十三(領置物の引渡し)

Article 55-33Handover of Goods Held in Custody

入国者収容所長等は、被収容者の出所の際、領置している物品をその者に引き渡すものとする。

The director of the immigration detention center, etc. is to hand over the goods held in custody to a detainee when the detainee leaves the facility.

第五十五条の三十四(出所者の遺留物)

Article 55-34Items Left Behind by Persons Who Have Left the Facility

出所した被収容者遺留物入国者収容所等に遺留した金品をいう。以下この節及び第五十五条の八十二において同じ。)は、その出所の日から起算して六月を経過する日までに、その者からその引渡しを求める申出がなく、又はその引渡しに要する費用の提供がないときは、国庫に帰属する。

Articles left behind by a detainee who has left the facility (meaning money and goods left behind in the immigration detention center, etc.; the same applies hereinafter in this Section and in Article 55-82) belong to the National Treasury if, by the day on which six months have elapsed, counting from the day of leaving the facility, the person has not requested their handover or has not tendered the costs required for the handover.

前項の期間内でも、入国者収容所長等は、腐敗し、又は滅失するおそれが生じた遺留物は、廃棄することができる。

Even within the period set forth in the preceding paragraph, the director of an immigration detention center, etc. may discard articles left behind that have become likely to decay or be lost.

第五十五条の三十五(逃走者等の遺留物)

Article 55-35Items Left Behind by Escapees, etc.

被収容者が次の各号のいずれかに該当する場合において、当該各号に定める日から起算して六月を経過する日までに、その者から引渡しを求める申出がなく、又は引渡しに要する費用の提供がないときは、その遺留物は、国庫に帰属する。

If a detainee falls under any of the following items and, by the day on which six months have elapsed, counting from the day specified in the respective item, the person has not requested their handover or has not tendered the costs required for the handover, the articles left behind by the detainee belong to the National Treasury:

逃走したとき 逃走した日

if the detainee has escaped: the day of the escape; or

第五十五条の五十四第二項の規定により解放された場合において、同条第三項に規定する避難を必要とする状況がなくなつた後速やかに同項に規定する場所に出頭しなかつたとき 当該避難を必要とする状況がなくなつた日

if the detainee has been released pursuant to the provisions of Article 55-54, paragraph (2) and has not promptly appeared at the place prescribed in paragraph (3) of that Article after the situation requiring evacuation prescribed in that paragraph ceased to exist: the day on which the situation requiring evacuation ceased to exist.

前条第二項の規定は、前項遺留物について準用する。

The provisions of paragraph (2) of the preceding Article apply mutatis mutandis to the articles left behind set forth in the preceding paragraph.

第五十五条の三十六(死亡者の遺留物)

Article 55-36Items Left Behind by Deceased Persons

死亡した被収容者遺留物は、法務省令で定めるところにより、その遺族等(法務省令で定める遺族その他の者をいう。以下この章において同じ。)に対し、その申請に基づき、引き渡すものとする。

Articles left behind by a deceased detainee are to be handed over to the bereaved family, etc. (meaning the bereaved family and other persons specified by Ministry of Justice Order; the same applies hereinafter in this Chapter) upon their application, pursuant to Ministry of Justice Order.

死亡した被収容者遺留物がある場合において、その遺族等の所在が明らかでないため第五十五条の八十二の規定による通知をすることができないときは、入国者収容所長等は、その旨を政令で定める方法によつて公告しなければならない。

If there are articles left behind by a deceased detainee and the notice under the provisions of Article 55-82 cannot be given because the whereabouts of the bereaved family, etc. are unknown, the director of an immigration detention center, etc. must give public notice to that effect by the method specified by Cabinet Order.

第一項遺留物は、第五十五条の八十二の規定による通知をし、又は前項の規定による公告をした日から起算して六月を経過する日までに第一項の申請がないときは、国庫に帰属する。

The articles left behind set forth in paragraph (1) belong to the National Treasury if the application set forth in paragraph (1) is not made by the day on which six months have elapsed, counting from the day on which the notice under the provisions of Article 55-82 was given or the public notice under the provisions of the preceding paragraph was given.

第五十五条の三十四第二項の規定は、第一項遺留物について準用する。

The provisions of Article 55-34, paragraph (2) apply mutatis mutandis to the articles left behind set forth in paragraph (1).

第四節 保健衛生及び医療

Section 4 Health, Sanitation and Medical Care

第五十五条の三十七(保健衛生及び医療の原則)

Article 55-37Principles of Health, Sanitation and Medical Care

入国者収容所等においては、被収容者の心身の状況を把握することに努め、被収容者の健康及び入国者収容所等内の衛生を保持するため、社会一般の保健衛生及び医療の水準に照らし適切な保健衛生上及び医療上の措置を講ずるものとする。

At an immigration detention center, etc., efforts are to be made to ascertain the physical and mental condition of detainees, and appropriate health, sanitation and medical measures in light of the standards of health, sanitation and medical care in society in general are to be taken in order to maintain the health of detainees and sanitation within the immigration detention center, etc.

被収容者には、日曜日その他法務省令で定める日を除き、できる限り戸外で、その健康を保持するため適当な場所で運動を行う機会を与えなければならない。

Except on Sundays and other days specified by Ministry of Justice Order, detainees must be given the opportunity to exercise, outdoors to the extent possible, in a place suitable for maintaining their health.

第五十五条の三十九(被収容者の清潔義務)

Article 55-39Detainees' Duty of Cleanliness

被収容者は、身体、着衣及び所持品並びに居室その他日常使用する場所を清潔にしなければならない。

Detainees must keep their bodies, clothing and personal belongings, and their rooms and other places they use daily, clean.

被収容者には、法務省令で定めるところにより、入国者収容所等における保健衛生上適切な入浴を行わせるものとする。

Detainees are to be allowed to bathe as appropriate for health and sanitation at the immigration detention center, etc., pursuant to the provisions of Ministry of Justice Order.

第五十五条の四十一(健康診断等)

Article 55-41Medical Examinations, etc.

入国者収容所長等は、入国警備官に、被収容者から、その入国者収容所等における収容の開始に際し、疾病、外傷等の有無その他の健康状態につき事情を聴取させなければならない。

The director of the immigration detention center, etc. must have an immigration control officer interview a detainee, upon the commencement of the detainee's detention at the immigration detention center, etc., regarding the presence or absence of illness, injury or the like and other aspects of the detainee's state of health.

入国者収容所長等は、被収容者に対し、三月に一回以上定期的に、法務省令で定めるところにより、医師による健康診断を受けさせなければならない。入国者収容所等における保健衛生上必要があるときも、同様とする。

The director of the immigration detention center, etc. must have detainees undergo a medical examination by a physician periodically, at least once every three months, pursuant to the provisions of Ministry of Justice Order. The same applies when it is necessary for health and sanitation at the immigration detention center, etc.

被収容者は、前項の規定による健康診断を受けなければならない。この場合においては、その健康診断の実施のため必要な限度内における採血、エックス線撮影その他の医学的処置を拒むことはできない。

Detainees must undergo the medical examination pursuant to the provisions of the preceding paragraph. In this case, they may not refuse blood sampling, X-ray imaging or other medical procedures to the extent necessary for conducting the medical examination.

第五十五条の四十二(診療等)

Article 55-42Medical Treatment, etc.

入国者収容所長等は、被収容者が次の各号のいずれかに該当する場合には、速やかに、医師等職員又は入国者収容所長等が委嘱する医師等(医師又は歯科医師をいう。次条及び第五十五条の五十三第五項において同じ。)による診療(栄養補給の処置を含む。以下この節及び第五十五条の六十八第一項第五号において同じ。)を行い、その他必要な医療上の措置をとるものとする。ただし、第一号に該当する場合において、その者の心身に著しい障害が生ずるおそれ又は他人にその疾病を感染させるおそれがないときは、その者の意思に反しない場合に限る。

If a detainee falls under any of the following items, the director of an immigration detention center, etc. is to promptly provide medical treatment (including nutritional support measures; the same applies hereinafter in this Section and in Article 55-68, paragraph (1), item (v)) by a physician or dentist on staff or by a physician, etc. (meaning a physician or dentist; the same applies in the following Article and in Article 55-53, paragraph (5)) commissioned by the director of an immigration detention center, etc., and take other necessary medical measures; provided, however, that in the case where the detainee falls under item (i), if there is no risk of serious harm to the detainee's mind or body or of the detainee infecting others with the disease, this applies only if it is not against the detainee's will:

負傷し、若しくは疾病にかかつているとき、又はこれらの疑いがあるとき。

if the detainee is injured or ill, or is suspected of being so;

飲食物を摂取しない場合において、その心身に著しい障害が生ずるおそれがあるとき。

if, in the case where the detainee does not take food or drink, there is a risk of serious harm to the detainee's mind or body.

入国者収容所長等は、前項の規定により診療を行う場合において、必要に応じ被収容者入国者収容所等の外の病院又は診療所に通院させ、やむを得ないときは被収容者を入国者収容所等の外の病院又は診療所に入院させることができる。

In the case where the director of the immigration detention center, etc. provides medical treatment pursuant to the provisions of the preceding paragraph, the director may, as necessary, have the detainee visit a hospital or clinic outside the immigration detention center, etc. as an outpatient, and, if unavoidable, have the detainee admitted to a hospital or clinic outside the immigration detention center, etc.

第五十五条の四十三(指名医による診療)

Article 55-43Medical Treatment by a Designated Physician

入国者収容所長等は、負傷し、又は疾病にかかつている被収容者が、医師等(医師等職員及び入国者収容所長等が委嘱する医師等を除く。)を指名して、その診療を受けることを申請した場合において、傷病の種類及び程度、入国者収容所等に収容される前にその医師等による診療を受けていたことその他の事情に照らして、その被収容者の医療上適当であると認めるときは、入国者収容所等内又は入国者収容所長等が適当と認める病院若しくは診療所において、自弁によりその診療を受けることを許すことができる。

If a detainee who is injured or ill applies to receive medical treatment from a physician, etc. (excluding a physician or dentist on staff and a physician, etc. commissioned by the director of an immigration detention center, etc.) whom the detainee designates, and the director of an immigration detention center, etc. finds it medically appropriate for the detainee in light of the type and degree of the injury or illness, the fact that the detainee had been receiving medical treatment from that physician, etc. before being detained in the immigration detention center, etc., and other circumstances, the director may permit the detainee to receive that medical treatment at the detainee's own expense within the immigration detention center, etc. or at a hospital or clinic that the director of an immigration detention center, etc. finds appropriate.

入国者収容所長等は、前項の規定による診療を受けることを許す場合において、同項の診療を行う医師等(以下この条において「指名医」という。)の診療方法を確認するため、又はその後にその被収容者に対して入国者収容所等において診療を行うため必要があるときは、入国者収容所等の職員をしてその診療に立ち会わせ、若しくはその診療に関して指名医に質問させ、又は診療録の写しその他のその診療に関する資料の提出を求めることができる。

In the case where the director of the immigration detention center, etc. permits a detainee to receive medical treatment pursuant to the provisions of the preceding paragraph, if it is necessary in order to confirm the treatment methods of the physician, etc. providing the treatment set forth in that paragraph (hereinafter referred to as the "designated physician" in this Article), or in order to subsequently provide medical treatment to the detainee at the immigration detention center, etc., the director may have an official of the immigration detention center, etc. be present at the treatment or question the designated physician about the treatment, or may request the submission of a copy of the medical records and other materials concerning the treatment.

指名医は、その診療に際し、入国者収容所長等が法務省令で定めるところにより指示する事項を遵守しなければならない。

In providing medical treatment, the designated physician must comply with the matters that the director of the immigration detention center, etc. instructs pursuant to the provisions of Ministry of Justice Order.

入国者収容所長等は、第一項の規定による診療を受けることを許した場合において、その指名医が、第二項の規定により入国者収容所長等が行う措置に従わないとき、前項の規定により入国者収容所長等が指示する事項を遵守しないとき、その他その診療を継続することが不適当であるときは、これを中止し、以後、その指名医の診療を受けることを許さないことができる。

In the case where the director of the immigration detention center, etc. has permitted a detainee to receive medical treatment pursuant to the provisions of paragraph (1), if the designated physician does not follow the measures taken by the director of the immigration detention center, etc. pursuant to the provisions of paragraph (2), does not comply with the matters instructed by the director of the immigration detention center, etc. pursuant to the provisions of the preceding paragraph, or it is otherwise inappropriate to continue the treatment, the director may discontinue the treatment and not permit the detainee to receive treatment from that designated physician thereafter.

入国者収容所長等は、被収容者が調髪又はひげそりを行いたい旨の申出をした場合には、法務省令で定めるところにより、これを許すものとする。

If a detainee requests to have a haircut or to shave, the director of the immigration detention center, etc. is to permit it pursuant to the provisions of Ministry of Justice Order.

第五十五条の四十五(感染症予防上の措置)

Article 55-45Measures for the Prevention of Infectious Diseases

入国者収容所長等は、入国者収容所等内における感染症の発生を予防し、又はそのまん延を防止するため必要がある場合には、被収容者に対し、第五十五条の四十一第二項及び第三項の規定による健康診断又は第五十五条の四十二の規定による診療その他必要な医療上の措置をとるほか、予防接種、当該疾病を感染させるおそれがなくなるまでの間の隔離その他法務省令で定める措置をとるものとする。

If it is necessary in order to prevent the occurrence of an infectious disease within the immigration detention center, etc. or to prevent its spread, the director of the immigration detention center, etc., in addition to conducting medical examinations for detainees pursuant to the provisions of Article 55-41, paragraphs (2) and (3), or providing medical treatment pursuant to the provisions of Article 55-42 and taking other necessary medical measures, is to take vaccination, isolation until there is no longer a risk of infecting others with that disease, and other measures specified by Ministry of Justice Order.

入国者収容所長等は、老人、妊産婦、身体虚弱者その他の養護を必要とする被収容者について、その養護を必要とする事情に応じ、第五十五条の四十二の規定による医療上の措置に準じた措置をとるものとする。

For elderly persons, expectant and nursing mothers, physically frail persons and other detainees who require care, the director of the immigration detention center, etc. is to take measures equivalent to the medical measures pursuant to the provisions of Article 55-42, according to the circumstances requiring such care.

入国者収容所長等は、被収容者が出産するときは、やむを得ない場合を除き、入国者収容所等の外の病院、診療所又は助産所に入院させるものとする。

When a detainee is to give birth, the director of the immigration detention center, etc. is to have the detainee admitted to a hospital, clinic or midwifery home outside the immigration detention center, etc., except when unavoidable.

第五節 規律及び秩序の維持

Section 5 Maintenance of Discipline and Order

第五十五条の四十七(入国者収容所等の規律及び秩序)

Article 55-47Discipline and Order at Immigration Detention Centers, etc.

入国者収容所等の規律及び秩序は、適正に維持されなければならない。

Discipline and order at immigration detention centers, etc. must be properly maintained.

前項の目的を達成するためとる措置は、被収容者の収容を確保し、並びにその処遇のための適切な環境及びその安全かつ平穏な共同生活を維持するため必要な限度を超えてはならない。

Measures taken to achieve the purpose set forth in the preceding paragraph must not exceed the limit necessary to ensure the detention of detainees and to maintain an appropriate environment for their treatment and their safe and peaceful communal life.

第五十五条の四十八(遵守事項等)

Article 55-48Rules to Be Observed, etc.

入国者収容所長等は、被収容者が遵守すべき事項(次項において「遵守事項」という。)を定めるものとする。

The director of the immigration detention center, etc. is to establish the rules that detainees must observe (referred to as the "rules to be observed" in the following paragraph).

遵守事項は、次に掲げる事項を具体的に定めるものとする。

The rules to be observed are to specifically set out the following matters:

犯罪行為をしてはならないこと。

not to commit criminal acts;

他人に対し、粗野若しくは乱暴な言動をし、又は迷惑を及ぼす行為をしてはならないこと。

not to use coarse or violent words or behavior toward others, or engage in acts that cause them a nuisance;

自身を傷つける行為をしてはならないこと。

not to engage in acts that injure oneself;

被収容者の処遇に従事する職員の職務の執行を妨げる行為をしてはならないこと。

not to engage in acts that obstruct the performance of duties of officials engaged in the treatment of detainees;

自己又は他の被収容者の収容の確保を妨げるおそれのある行為をしてはならないこと。

not to engage in acts that are likely to obstruct ensuring the detention of oneself or other detainees;

入国者収容所等の安全を害するおそれのある行為をしてはならないこと。

not to engage in acts that are likely to harm the safety of the immigration detention center, etc.;

入国者収容所等の衛生又は風紀を害する行為をしてはならないこと。

not to engage in acts that harm sanitation or public morals at the immigration detention center, etc.;

金品について、不正な使用、所持、授受その他の行為をしてはならないこと。

not to engage in the improper use, possession, giving or receiving of money or goods, or other improper acts involving them;

前各号に掲げるもののほか、入国者収容所等の規律及び秩序を維持するため必要な事項

in addition to what is set forth in each of the preceding items, matters necessary for maintaining discipline and order at the immigration detention center, etc.;

前各号に掲げる事項について定めた遵守事項に違反する行為を企て、あおり、唆し、又は援助してはならないこと。

not to plan, incite, instigate or assist acts violating the rules to be observed established with regard to the matters set forth in each of the preceding items.

前二項に定めるもののほか、入国者収容所長等又はその指定する職員は、入国者収容所等の規律及び秩序を維持するため必要がある場合には、被収容者に対し、その生活及び行動について指示することができる。

Beyond what is provided for in the preceding two paragraphs, if it is necessary in order to maintain discipline and order at the immigration detention center, etc., the director of the immigration detention center, etc. or an official designated by the director may give instructions to detainees concerning their daily life and conduct.

第五十五条の四十九(身体の検査等)

Article 55-49Inspection of the Body, etc.

入国警備官は、入国者収容所等の規律及び秩序を維持するため必要がある場合には、被収容者について、その身体、着衣、所持品及び居室を検査し、並びにその所持品を取り上げて一時保管することができる。

If it is necessary in order to maintain discipline and order at the immigration detention center, etc., an immigration control officer may inspect the body, clothing, personal belongings and room of a detainee, and take away and temporarily keep the detainee's personal belongings.

第五十五条の十九第二項の規定は、前項の規定による女子の被収容者の身体及び着衣の検査について準用する。

The provisions of Article 55-19, paragraph (2) apply mutatis mutandis to the inspection of the body and clothing of a female detainee pursuant to the provisions of the preceding paragraph.

入国警備官は、入国者収容所等の規律及び秩序を維持するため必要がある場合には、入国者収容所等内において、被収容者以外の者(第五十五条の五十六第一項各号に掲げる者を除く。)の着衣及び携帯品を検査し、並びにその者の携帯品を取り上げて一時保管することができる。

If it is necessary in order to maintain discipline and order at the immigration detention center, etc., an immigration control officer may, within the immigration detention center, etc., inspect the clothing and belongings carried by a person other than a detainee (excluding the persons set forth in the items of Article 55-56, paragraph (1)), and take away and temporarily keep that person's belongings.

前項の検査は、文書図画の内容の検査に及んではならない。

The inspection set forth in the preceding paragraph must not extend to inspection of the contents of documents or drawings.

第五十五条の五十(被収容者の隔離)

Article 55-50Isolation of Detainees

入国者収容所長等は、被収容者が次の各号のいずれかに該当する場合には、その者を他の被収容者から隔離することができる。

If a detainee falls under any of the following items, the director of the immigration detention center, etc. may isolate the detainee from other detainees:

他の被収容者と接触することにより入国者収容所等の規律及び秩序を害するおそれがあるとき。

if there is a risk that the detainee will harm discipline and order at the immigration detention center, etc. through contact with other detainees;

他の被収容者から危害を加えられるおそれがあり、これを避けるために他に方法がないとき。

if there is a risk that the detainee will be harmed by other detainees and there is no other way to avoid this.

前項の規定による隔離の期間は、一月とする。ただし、特に継続の必要がある場合には、入国者収容所長等は、十日ごとにこれを更新することができる。

The period of isolation pursuant to the provisions of the preceding paragraph is one month; provided, however, that if there is a particular need to continue it, the director of the immigration detention center, etc. may renew it every 10 days.

入国者収容所長等は、前項の期間中であつても、隔離の必要がなくなつたときは、直ちにその隔離を中止しなければならない。

Even during the period set forth in the preceding paragraph, the director of the immigration detention center, etc. must immediately discontinue the isolation when it is no longer necessary.

第五十五条の五十一(制止等の措置)

Article 55-51Measures to Stop Acts, etc.

入国警備官は、被収容者が自身を傷つけ若しくは他人に危害を加え、逃走し、入国者収容所等の職員の職務の執行を妨げ、その他入国者収容所等の規律及び秩序を著しく害する行為をし、又はこれらの行為をしようとする場合には、合理的に必要と判断される限度で、その行為を制止し、その被収容者を拘束し、その他その行為を抑止するため必要な措置をとることができる。

If a detainee injures themselves or inflicts harm on another person, escapes, obstructs the performance of duties of an official of the immigration detention center, etc., or otherwise engages in an act that seriously harms discipline and order at the immigration detention center, etc., or attempts to engage in any of these acts, an immigration control officer may, to the extent judged reasonably necessary, stop the act, restrain the detainee, and take other measures necessary to suppress the act.

入国警備官は、被収容者以外の者が次の各号のいずれかに該当する場合には、合理的に必要と判断される限度で、その行為を制止し、その行為をする者を拘束し、その他その行為を抑止するため必要な措置をとることができる。

If a person other than a detainee falls under any of the following items, an immigration control officer may, to the extent judged reasonably necessary, stop the act, restrain the person engaging in the act, and take other measures necessary to suppress the act:

入国者収容所等に侵入し、その設備を損壊し、入国者収容所等の職員の職務の執行を妨げ、又はこれらの行為を正にしようとするとき。

if the person intrudes into the immigration detention center, etc., damages its facilities, obstructs the performance of duties of an official of the immigration detention center, etc., or is on the verge of engaging in any of these acts;

入国警備官の要求を受けたのに入国者収容所又は地方出入国在留管理局から退去しないとき。

if the person does not leave the immigration detention center or regional immigration services bureau despite a demand by an immigration control officer;

被収容者の逃走又は入国者収容所等の職員の職務執行の妨害を、現場で、援助し、あおり、又は唆すとき。

if the person, at the scene, assists, incites or instigates the escape of a detainee or the obstruction of the performance of duties of an official of the immigration detention center, etc.;

被収容者に危害を加え、又は正に加えようとするとき。

if the person inflicts harm on a detainee or is on the verge of doing so.

前二項の措置に必要な警備用具については、法務省令で定める。

The security equipment necessary for the measures set forth in the preceding two paragraphs is specified by Ministry of Justice Order.

第五十五条の五十二(捕縄及び手錠の使用)

Article 55-52Use of Arresting Ropes and Handcuffs

入国警備官は、被収容者を護送する場合又は被収容者が次の各号のいずれかに該当する行為をするおそれがある場合には、法務省令で定めるところにより、捕縄又は手錠を使用することができる。

An immigration control officer may use arresting ropes or handcuffs pursuant to the provisions of Ministry of Justice Order when escorting a detainee or if there is a risk that a detainee will engage in an act falling under any of the following items:

逃走すること。

escaping;

自身を傷つけ、又は他人に危害を加えること。

injuring themselves or inflicting harm on another person;

入国者収容所等の設備、器具その他の物を損壊すること。

damaging the facilities, equipment or other objects of the immigration detention center, etc.

捕縄及び手錠の制式は、法務省令で定める。

The specifications of arresting ropes and handcuffs are specified by Ministry of Justice Order.

第五十五条の五十三(保護室等への収容)

Article 55-53Placement in Protective Cells, etc.

入国警備官は、被収容者が次の各号のいずれかに該当する場合には、入国者収容所長等の命令により、その者を保護室又は法務大臣が定める基準を満たす単独室(以下この条及び第五十五条の七十四第一項第三号において「保護室等」という。)に収容することができる。

If a detainee falls under any of the following items, an immigration control officer may, by order of the director of the immigration detention center, etc., place the detainee in a protection room or in a single room meeting the standards specified by the Minister of Justice (hereinafter referred to as a "protection room, etc." in this Article and in Article 55-74, paragraph (1), item (iii)):

自身を傷つけるおそれがあるとき。

if there is a risk that the detainee will injure themselves;

次のイからハまでのいずれかに該当する場合において、入国者収容所等の規律及び秩序を維持するため特に必要があるとき。

if, in the case where the detainee falls under any of the following (a) through (c), it is particularly necessary in order to maintain discipline and order at the immigration detention center, etc.:

入国警備官の制止に従わず、大声又は騒音を発するとき。

if the detainee disobeys an immigration control officer's order to stop and raises their voice or makes noise;

他人に危害を加えるおそれがあるとき。

if there is a risk that the detainee will inflict harm on another person;

入国者収容所等の設備、器具その他の物を損壊し、又は汚損するおそれがあるとき。

if there is a risk that the detainee will damage or soil the facilities, equipment or other objects of the immigration detention center, etc.

前項に規定する場合において、入国者収容所長等の命令を待ついとまがないときは、入国警備官は、その命令を待たないで、その被収容者保護室等に収容することができる。この場合には、速やかに、その旨を入国者収容所長等に報告しなければならない。

In the case referred to in the preceding paragraph, if there is no time to wait for an order from the director of the immigration detention center, etc., an immigration control officer may place the detainee in a protection room, etc. without waiting for that order. In this case, the officer must promptly report this to the director of the immigration detention center, etc.

保護室等への収容の期間は、二十四時間以内とする。ただし、特に継続の必要がある場合には、入国者収容所長等は、二十四時間ごとにこれを更新することができる。

The period of placement in a protection room, etc. is 24 hours or less; provided, however, that if there is a particular need to continue it, the director of the immigration detention center, etc. may renew it every 24 hours.

入国者収容所長等は、前項の期間中であつても、保護室等への収容の必要がなくなつたときは、直ちにその収容を中止させなければならない。

Even during the period set forth in the preceding paragraph, the director of the immigration detention center, etc. must have the placement discontinued immediately when placement in a protection room, etc. is no longer necessary.

被収容者保護室等に収容し、又はその収容の期間を更新した場合には、入国者収容所長等は、速やかに、その被収容者の健康状態について、医師等職員又は入国者収容所長等が委嘱する医師等の意見を聴かなければならない。

If a detainee has been placed in a protection room, etc. or the period of that placement has been renewed, the director of the immigration detention center, etc. must promptly hear the opinion of a physician or dentist on staff or a physician, etc. commissioned by the director of the immigration detention center, etc. regarding the detainee's state of health.

保護室の構造及び設備の基準は、法務省令で定める。

The standards for the structure and equipment of protective cells are specified by Ministry of Justice Order.

第五十五条の五十四(災害時の避難及び解放)

Article 55-54Evacuation and Release in the Event of a Disaster

入国者収容所長等は、地震、火災その他の災害に際し、入国者収容所等内において避難の方法がないときは、被収容者を適当な場所に護送しなければならない。

In the event of an earthquake, fire or other disaster, if there is no means of evacuation within the immigration detention center, etc., the director of the immigration detention center, etc. must escort detainees to an appropriate place.

前項の場合において、被収容者を護送することができないときは、入国者収容所長等は、その者を入国者収容所等から解放することができる。地震、火災その他の災害に際し、入国者収容所等の外にある被収容者を避難させるため適当な場所に護送することができない場合も、同様とする。

In the case referred to in the preceding paragraph, if it is not possible to escort detainees, the director of the immigration detention center, etc. may release them from the immigration detention center, etc. The same applies if, in the event of an earthquake, fire or other disaster, it is not possible to escort a detainee who is outside the immigration detention center, etc. to an appropriate place for evacuation.

前項の規定により解放された者は、避難を必要とする状況がなくなつた後速やかに、入国者収容所等又は入国者収容所長等が指定した場所に出頭しなければならない。

A person released pursuant to the provisions of the preceding paragraph must appear at the immigration detention center, etc. or at a place designated by the director of the immigration detention center, etc. promptly after the situation requiring evacuation has ceased.

第六節 外部交通

Section 6 External Communication

入国者収容所長等は、被収容者に対し、他の者から面会の申出があつたときは、これを許すものとする。ただし、入国者収容所等の規律及び秩序を維持し、又は衛生を保持するため必要があると認めるときは、この限りでない。

When another person requests a visit with a detainee, the director of the immigration detention center, etc. is to permit it; provided, however, that this does not apply if the director finds it necessary in order to maintain discipline and order or to preserve sanitation at the immigration detention center, etc.

第五十五条の五十六(領事官等以外の者との面会の立会い等)

Article 55-56Attendance at Visits with Persons Other Than Consular Officers, etc.

入国者収容所長等は、その指名する職員に、被収容者と次に掲げる者(以下この節において「領事官等」という。)以外の者との面会に立ち会わせ、又はその面会の状況を録音させ、若しくは録画させるものとする。ただし、入国者収容所等の規律及び秩序を維持し、又は衛生を保持するため必要がないと認める場合には、その立会い並びに録音及び録画(次項において「立会い等」という。)をさせないことができる。

The director of the immigration detention center, etc. is to have an official designated by the director attend visits between a detainee and a person other than the persons listed below (hereinafter referred to as "consular officers, etc." in this Section), or have the official make an audio recording or video recording of the visit; provided, however, that if the director finds that it is not necessary in order to maintain discipline and order or to preserve sanitation at the immigration detention center, etc., the director may decide not to have the attendance and the audio and video recording (referred to as "attendance, etc." in the following paragraph) carried out:

被収容者の国籍又は市民権の属する国の領事官

a consular officer of the state of which the detainee is a national or citizen;

被収容者の訴訟代理人又は弁護人である弁護士(依頼によりこれらの者になろうとする弁護士を含む。)

an attorney who is the detainee's counsel in a lawsuit or defense counsel (including an attorney who intends to become such counsel upon request).

入国者収容所長等は、前項の規定にかかわらず、被収容者と次に掲げる者との面会については、入国者収容所等の規律及び秩序を害する結果を生ずるおそれがあると認めるべき特別の事情がある場合を除き、立会い等をさせてはならない。

Notwithstanding the provisions of the preceding paragraph, the director of the immigration detention center, etc. must not have attendance, etc. carried out for visits between a detainee and the persons listed below, except in the case where there are special circumstances that give grounds to find that the visit is likely to result in harm to discipline and order at the immigration detention center, etc.:

自己に対する入国者収容所長等の措置その他自己が受けた処遇に関し調査を行う国又は地方公共団体の機関の職員

an official of an organ of the national government or of a local public entity that conducts an investigation concerning measures taken by the director of the immigration detention center, etc. against the detainee or other treatment the detainee has received;

自己に対する入国者収容所長等の措置その他自己が受けた処遇に関し弁護士法(昭和二十四年法律第二百五号)第三条第一項に規定する職務を遂行する弁護士

an attorney performing the duties provided for in Article 3, paragraph (1) of the Attorney Act (Act No. 205 of 1949) concerning measures taken by the director of the immigration detention center, etc. against the detainee or other treatment the detainee has received.

第五十五条の五十七(面会の一時停止及び終了)

Article 55-57Suspension and Termination of Visits

入国者収容所等の職員は、次の各号のいずれか(領事官等との面会にあつては、第一号ロ又はハに限る。)に該当する場合には、その行為若しくは発言を制止し、又はその面会を一時停止させることができる。この場合においては、面会の一時停止のため、被収容者又は面会の相手方に対し面会の場所からの退出を命じ、その他必要な措置をとることができる。

If a case falls under any of the following items (for a visit with a consular officer, etc., limited to item (i)(b) or (c)), an official of the immigration detention center, etc. may stop the act or statement, or suspend the visit. In this case, in order to suspend the visit, the official may order the detainee or the visitor to leave the place of the visit and take other necessary measures:

被収容者又は面会の相手方が次のイからハまでのいずれかに該当する行為をするとき。

if the detainee or the visitor engages in an act falling under any of the following (a) through (c):

次条第一項の規定による制限に違反する行為

an act violating a restriction imposed pursuant to the provisions of paragraph (1) of the following Article;

入国者収容所等の規律及び秩序を害する行為

an act that harms discipline and order at the immigration detention center, etc.;

衛生上の支障がある行為

an act that is detrimental to sanitation;

被収容者又は面会の相手方が次のイからハまでのいずれかに該当する内容の発言をするとき。

if the detainee or the visitor makes a statement with content falling under any of the following (a) through (c):

暗号の使用その他の理由によつて、入国者収容所等の職員が理解できないもの

content that officials of the immigration detention center, etc. cannot understand due to the use of code or for any other reason;

犯罪の実行を共謀し、あおり、又は唆すもの

content that conspires in, incites or instigates the commission of a crime;

入国者収容所等の規律及び秩序を害する結果を生ずるおそれのあるもの

content that is likely to result in harm to discipline and order at the immigration detention center, etc.

入国者収容所長等は、前項の規定により面会が一時停止された場合において、面会を継続させることが相当でないと認めるときは、その面会を終わらせることができる。

In the case where a visit has been suspended pursuant to the provisions of the preceding paragraph, if the director of the immigration detention center, etc. finds it inappropriate to allow the visit to continue, the director may terminate the visit.

入国者収容所長等は、被収容者の面会に関し、法務省令で定めるところにより、面会の相手方の人数、面会の場所、日及び時間帯、面会の時間及び回数その他面会の態様について、入国者収容所等の規律及び秩序の維持、衛生の保持その他管理運営上必要な制限をすることができる。

With regard to visits with detainees, the director of the immigration detention center, etc. may, pursuant to the provisions of Ministry of Justice Order, impose restrictions necessary for maintaining discipline and order, preserving sanitation or otherwise managing and operating the immigration detention center, etc., on the number of visitors, the place, days and hours of visits, the duration and frequency of visits, and other aspects of visits.

前項の規定により面会の回数について制限をするときは、その回数は、面会の相手方一人ごとに一日につき一回を下回つてはならない。

When restricting the frequency of visits pursuant to the provisions of the preceding paragraph, the frequency must not be less than once per day for each visitor.

第五十五条の五十九(発受を許す信書)

Article 55-59Letters Permitted to Be Sent and Received

入国者収容所長等は、被収容者に対し、第五十五条の六十一の規定により差し止める場合を除き、他の者との間で信書を発受することを許すものとする。

The director of the immigration detention center, etc. is to permit detainees to send and receive letters to and from other persons, except where they are withheld pursuant to the provisions of Article 55-61.

第五十五条の六十(信書の検査)

Article 55-60Inspection of Letters

入国者収容所長等は、入国者収容所等の規律及び秩序の維持その他の理由により必要があると認める場合には、その指名する職員に、被収容者が発受する信書について、検査を行わせることができる。

If the director of the immigration detention center, etc. finds it necessary for maintaining discipline and order at the immigration detention center, etc. or for any other reason, the director may have an official designated by the director inspect letters sent or received by detainees.

次に掲げる信書については、前項の検査は、これらの信書に該当することを確認するために必要な限度において行うものとする。ただし、第四号に掲げる信書について、入国者収容所等の規律及び秩序を害する結果を生ずるおそれがあると認めるべき特別の事情がある場合は、この限りでない。

For the following letters, the inspection set forth in the preceding paragraph is to be conducted to the extent necessary to confirm that they fall under those letters; provided, however, that this does not apply to letters set forth in item (iv) if there are special circumstances that give grounds to find that they are likely to result in harm to discipline and order at the immigration detention center, etc.:

領事官等から受ける信書

letters received from consular officers, etc.;

被収容者が国又は地方公共団体の機関から受ける信書

letters received by a detainee from an organ of the national government or of a local public entity;

被収容者が自己に対する入国者収容所長等の措置その他自己が受けた処遇に関し調査を行う国又は地方公共団体の機関に対して発する信書

letters sent by a detainee to an organ of the national government or of a local public entity that conducts an investigation concerning measures taken by the director of the immigration detention center, etc. against the detainee or other treatment the detainee has received;

被収容者が自己に対する入国者収容所長等の措置その他自己が受けた処遇に関し弁護士法第三条第一項に規定する職務を遂行する弁護士(弁護士法人又は弁護士・外国法事務弁護士共同法人を含む。次条第二項において同じ。)との間で発受する信書

letters sent or received by a detainee to or from an attorney (including a legal professional corporation or a joint corporation of attorneys and registered foreign lawyers; the same applies in paragraph (2) of the following Article) performing the duties provided for in Article 3, paragraph (1) of the Attorney Act concerning measures taken by the director of the immigration detention center, etc. against the detainee or other treatment the detainee has received.

第五十五条の六十一(信書の内容による差止め等)

Article 55-61Withholding, etc. Based on the Content of Letters

入国者収容所長等は、前条の規定による検査の結果、被収容者が発受する信書について、その全部又は一部が次の各号のいずれかに該当する場合には、その発受を差し止め、又はその該当箇所を削除し、若しくは抹消することができる。同条第二項各号に掲げる信書について、これらの信書に該当することを確認する過程においてその全部又は一部が次の各号のいずれかに該当することが判明した場合も、同様とする。

If, as a result of an inspection pursuant to the provisions of the preceding Article, the whole or part of a letter sent or received by a detainee falls under any of the following items, the director of the immigration detention center, etc. may withhold the sending or receipt of the letter, or delete or blot out the relevant portion. The same applies if, in the process of confirming that a letter set forth in any of the items of paragraph (2) of that Article falls under those letters, it becomes clear that the whole or part of it falls under any of the following items:

暗号の使用その他の理由によつて、入国者収容所等の職員が理解できない内容のものであるとき。

if its content cannot be understood by officials of the immigration detention center, etc. due to the use of code or for any other reason;

発受によつて、刑罰法令に触れることとなり、又は刑罰法令に触れる結果を生ずるおそれがあるとき。

if sending or receiving it would violate criminal laws and regulations or is likely to result in a violation of criminal laws and regulations;

発受によつて、入国者収容所等の規律及び秩序を害する結果を生ずるおそれがあるとき。

if sending or receiving it is likely to result in harm to discipline and order at the immigration detention center, etc.;

威迫にわたる記述又は明らかな虚偽の記述があるため、受信者を著しく不安にさせ、又は受信者に損害を被らせるおそれがあるとき。

if it contains intimidating statements or clearly false statements and is therefore likely to cause the recipient serious anxiety or to cause the recipient to suffer damage;

受信者を著しく侮辱する記述があるとき。

if it contains statements that seriously insult the recipient.

前項の規定にかかわらず、被収容者が国又は地方公共団体の機関との間で発受する信書であつてその機関の権限に属する事項を含むもの及び被収容者が弁護士との間で発受する信書であつてその被収容者に係る弁護士法第三条第一項に規定する弁護士の職務に属する事項を含むものについては、その発受の差止め又はその事項に係る部分の削除若しくは抹消は、その部分の全部又は一部が前項第一号から第三号までのいずれかに該当する場合に限り、これを行うことができる。

Notwithstanding the provisions of the preceding paragraph, with regard to letters sent or received by a detainee to or from an organ of the national government or of a local public entity that contain matters within the authority of that organ, and letters sent or received by a detainee to or from an attorney that contain matters within the duties of an attorney provided for in Article 3, paragraph (1) of the Attorney Act concerning that detainee, the withholding of their sending or receipt or the deletion or blotting out of the portion concerning those matters may be carried out only if the whole or part of that portion falls under any of items (i) through (iii) of the preceding paragraph.

入国者収容所長等は、法務省令で定めるところにより、被収容者が発する信書の作成要領、その発信の申請の日及び時間帯並びに被収容者の信書の発受の方法について、入国者収容所等の管理運営上必要な制限をすることができる。

The director of the immigration detention center, etc. may, pursuant to the provisions of Ministry of Justice Order, impose restrictions necessary for the management and operation of the immigration detention center, etc. on the guidelines for preparing letters sent by detainees, the days and hours for applying to send them, and the methods by which detainees send and receive letters.

信書の発信に要する費用については、被収容者が負担することができない場合において、入国者収容所長等が発信の目的に照らし相当と認めるときは、その全部又は一部を国庫の負担とする。

In the case where a detainee is unable to bear the costs required for sending a letter, if the director of the immigration detention center, etc. finds it appropriate in light of the purpose of sending it, the whole or part of those costs is to be borne by the National Treasury.

第五十五条の六十四(発受を差し止めた信書等の取扱い)

Article 55-64Handling of Letters Whose Sending or Receipt Has Been Withheld, etc.

入国者収容所長等は、第五十五条の六十一の規定により信書の発受を差し止めた場合にはその信書を、同条の規定により信書の一部を削除した場合にはその削除した部分を保管するものとする。

The director of the immigration detention center, etc. is to keep the letter, in the case where its sending or receipt has been withheld pursuant to the provisions of Article 55-61, and the deleted portion, in the case where part of a letter has been deleted pursuant to the provisions of that Article.

入国者収容所長等は、第五十五条の六十一の規定により信書の記述の一部を抹消する場合には、その抹消する部分の複製を作成し、これを保管するものとする。

When blotting out part of the text of a letter pursuant to the provisions of Article 55-61, the director of the immigration detention center, etc. is to make a copy of the portion to be blotted out and keep it.

入国者収容所長等は、被収容者の出所の際、前二項の規定により保管する信書の全部若しくは一部又は複製(以下この章において「発受差止信書等」という。)をその者に引き渡すものとする。

When a detainee leaves the facility, the director of the immigration detention center, etc. is to hand over to the detainee the whole or part of the letters, or the copies, kept pursuant to the provisions of the preceding two paragraphs (hereinafter referred to as "withheld letters, etc." in this Chapter).

入国者収容所長等は、被収容者が死亡した場合には、法務省令で定めるところにより、その遺族等に対し、その申請に基づき、発受差止信書等を引き渡すものとする。

If a detainee dies, the director of the immigration detention center, etc. is to hand over the withheld letters, etc. to the detainee's bereaved family members, etc. upon their application, pursuant to the provisions of Ministry of Justice Order.

前二項の規定にかかわらず、発受差止信書等の引渡しにより入国者収容所等の規律及び秩序の維持に支障を生ずるおそれがあるときは、これを引き渡さないものとする。次に掲げる場合において、その引渡しにより入国者収容所等の規律及び秩序の維持に支障を生ずるおそれがあるときも、同様とする。

Notwithstanding the provisions of the preceding two paragraphs, if the handover of withheld letters, etc. is likely to hinder the maintenance of discipline and order at the immigration detention center, etc., they are not to be handed over. The same applies if, in the following cases, their handover is likely to hinder the maintenance of discipline and order at the immigration detention center, etc.:

出所した被収容者が、出所後に、発受差止信書等の引渡しを求めたとき。

if a detainee who has left the facility requests the handover of withheld letters, etc. after leaving the facility;

被収容者が、第五十五条の三十五第一項各号のいずれかに該当する場合において、発受差止信書等の引渡しを求めたとき。

if a detainee, in the case where the detainee falls under any of the items of Article 55-35, paragraph (1), requests the handover of withheld letters, etc.

第五十五条の三十四第一項第五十五条の三十五第一項並びに第五十五条の三十六第二項及び第三項の規定は、被収容者に係る発受差止信書等前項の規定により引き渡さないこととされたものを除く。)について準用する。この場合において、同条第三項中「第一項の申請」とあるのは、「第五十五条の六十四第四項の申請」と読み替えるものとする。

The provisions of Article 55-34, paragraph (1), Article 55-35, paragraph (1), and Article 55-36, paragraphs (2) and (3) apply mutatis mutandis to withheld letters, etc. pertaining to a detainee (excluding those that are not to be handed over pursuant to the provisions of the preceding paragraph). In this case, the phrase "the application set forth in paragraph (1)" in paragraph (3) of that Article is deemed to be replaced with "the application set forth in Article 55-64, paragraph (4)".

第五項の規定により引き渡さないこととした発受差止信書等は、次の各号に掲げる日から起算して三年を経過した日に、国庫に帰属する。

Withheld letters, etc. that are not to be handed over pursuant to the provisions of paragraph (5) belong to the National Treasury on the day on which three years have elapsed counting from the day set forth in each of the following items:

被収容者の出所又は死亡の日

the day of the detainee leaving the facility or death;

被収容者第五十五条の三十五第一項各号のいずれかに該当することとなつた日

the day on which the detainee comes to fall under any of the items of Article 55-35, paragraph (1).

第五十五条の六十五(被収容者作成の文書図画)

Article 55-65Documents and Drawings Prepared by Detainees

入国者収容所長等は、被収容者がその作成した文書図画(信書を除く。)を他の者に交付することを申請した場合には、その交付につき、被収容者が発する信書に準じて検査その他の措置をとることができる。

If a detainee applies to deliver documents or drawings (excluding letters) prepared by the detainee to another person, the director of the immigration detention center, etc. may, with respect to that delivery, conduct inspections and take other measures in the same manner as for letters sent by detainees.

第五十五条の六十六(電話等による通信)

Article 55-66Communication by Telephone, etc.

入国者収容所長等は、被収容者に対し、相当と認めるときは、電話その他政令で定める電気通信の方法による通信を行うことを許すことができる。

The director of the immigration detention center, etc. may, when finding it appropriate, permit a detainee to communicate by telephone or by other means of telecommunication specified by Cabinet Order.

第五十五条の六十三の規定は、前項の通信について準用する。

The provisions of Article 55-63 apply mutatis mutandis to the communication set forth in the preceding paragraph.

第五十五条の六十七(通信の確認等)

Article 55-67Confirmation of Communications, etc.

入国者収容所長等は、入国者収容所等の規律及び秩序の維持その他の理由により必要があると認める場合には、その指名する職員に、前条第一項の通信の内容を確認するため、その通信を受けさせ、又はその内容を記録させることができる。

If the director of the immigration detention center, etc. finds it necessary for maintaining discipline and order at the immigration detention center, etc. or for any other reason, the director may have an official designated by the director receive the communication set forth in paragraph (1) of the preceding Article or record its content, in order to confirm the content of that communication.

第五十五条の五十七第一項第一号イを除く。)及び第二項の規定は、前条第一項の通信について準用する。

The provisions of Article 55-57, paragraph (1) (excluding item (i)(a)) and paragraph (2) apply mutatis mutandis to the communication set forth in paragraph (1) of the preceding Article.

第五十五条の六十八(審査の申請)

Article 55-68Request for Examination

次に掲げる入国者収容所長等の措置に不服がある者は、書面で、出入国在留管理庁長官に対し、審査の申請をすることができる。

A person who is dissatisfied with any of the following measures taken by the director of the immigration detention center, etc. may file a request for examination in writing with the Commissioner of the Immigration Services Agency:

第五十五条の六に規定する宗教上の行為の禁止又は制限

prohibition or restriction of religious acts provided for in Article 55-6;

第五十五条の七第二項の規定による書籍等の閲覧の禁止

prohibition of reading books, etc. pursuant to the provisions of Article 55-7, paragraph (2);

第五十五条の二十二の規定による自弁の物品の使用又は摂取を許さない処分

a disposition not permitting the use or consumption of goods procured at the detainee's own expense pursuant to the provisions of Article 55-22;

第五十五条の三十一の規定による保管私物、自ら保管する現金又は領置されている物品の交付を許さない処分

a disposition not permitting the delivery of personal effects kept by the detainee, cash that the detainee keeps or goods held in custody pursuant to the provisions of Article 55-31;

第五十五条の四十三第一項の規定による診療を受けることを許さない処分又は同条第四項の規定による診療の中止

a disposition not permitting the receipt of medical treatment pursuant to the provisions of Article 55-43, paragraph (1), or the discontinuation of medical treatment pursuant to the provisions of paragraph (4) of that Article;

第五十五条の五十第一項の規定による隔離

isolation pursuant to the provisions of Article 55-50, paragraph (1);

第五十五条の六十一第五十五条の六十二又は第五十五条の六十五の規定による信書の発受又は文書図画の交付の差止め又は制限

withholding or restriction of the sending or receipt of letters or of the delivery of documents or drawings pursuant to the provisions of Article 55-61, Article 55-62 or Article 55-65;

第五十五条の六十四第五項前段の規定による発受差止信書等の引渡しをしない処分(同条第三項の規定による引渡しに係るものに限る。)

a disposition not handing over withheld letters, etc. pursuant to the provisions of the first sentence of Article 55-64, paragraph (5) (limited to a disposition relating to handover pursuant to the provisions of paragraph (3) of that Article).

前項の規定による審査の申請(以下この節において単に「審査の申請」という。)は、これを行う者が自らしなければならない。

A request for examination pursuant to the provisions of the preceding paragraph (hereinafter simply referred to as a "request for examination" in this Section) must be filed by the person making it in person.

第五十五条の六十九(審査の申請期間)

Article 55-69Period for Requesting Examination

審査の申請は、前条第一項に規定する措置の告知があつた日の翌日から起算して三十日以内にしなければならない。

A request for examination must be filed within 30 days counting from the day following the day on which notice of the measure provided for in paragraph (1) of the preceding Article was given.

天災その他前項の期間内に審査の申請をしなかつたことについてやむを得ない理由があるときは、同項の規定にかかわらず、その理由がやんだ日の翌日から起算して一週間以内に限り、審査の申請をすることができる。

If there is a natural disaster or other unavoidable reason for not having filed a request for examination within the period set forth in the preceding paragraph, a request for examination may, notwithstanding the provisions of that paragraph, be filed only within one week counting from the day following the day on which that reason ceased to exist.

入国者収容所長等が誤つて法定の期間よりも長い期間を審査の申請期間として教示した場合において、その教示された期間内に審査の申請がされたときは、その審査の申請は、法定の期間内にされたものとみなす。

In the case where the director of the immigration detention center, etc. has erroneously informed a person of a period longer than the statutory period as the period for requesting examination, if a request for examination is filed within the period so informed, the request for examination is deemed to have been filed within the statutory period.

第五十五条の七十(行政不服審査法の準用)

Article 55-70Mutatis Mutandis Application of the Administrative Complaint Review Act

行政不服審査法(平成二十六年法律第六十八号)第十五条第十八条第三項第十九条第二項及び第四項第二十二条第一項及び第五項第二十三条第二十五条第一項第二項及び第六項第二十六条第二十七条並びに第三十九条の規定は、審査の申請について準用する。この場合において、同法第二十五条第二項中「審査請求人の申立てにより又は職権で」とあるのは、「職権で」と読み替えるものとするほか、必要な技術的読替えは、政令で定める。

The provisions of Article 15, Article 18, paragraph (3), Article 19, paragraphs (2) and (4), Article 22, paragraphs (1) and (5), Article 23, Article 25, paragraphs (1), (2) and (6), Article 26, Article 27 and Article 39 of the Administrative Complaint Review Act (Act No. 68 of 2014) apply mutatis mutandis to a request for examination. In this case, the phrase "upon the petition of the requester for review or ex officio" in Article 25, paragraph (2) of that Act is deemed to be replaced with "ex officio", and any other necessary technical replacement of terms is specified by Cabinet Order.

第五十五条の七十一(調査)

Article 55-71Investigation

出入国在留管理庁長官は、職権で、審査の申請に関して必要な調査をするものとする。

The Commissioner of the Immigration Services Agency is to conduct the necessary investigation concerning a request for examination ex officio.

出入国在留管理庁長官は、前項の調査をするため必要があるときは、入国者収容所長等に対し、報告若しくは資料その他の物件の提出を命じ、又はその指名する職員をして、審査の申請をした者その他の関係者に対し質問をさせ、若しくは物件の提出を求めさせ、これらの者が提出した物件を留め置かせ、若しくは検証を行わせることができる。

If it is necessary for the investigation set forth in the preceding paragraph, the Commissioner of the Immigration Services Agency may order the director of the immigration detention center, etc. to submit reports or materials or other objects, or have an official designated by the Commissioner question the person who filed the request for examination or other relevant persons or request them to submit objects, retain the objects submitted by those persons, or conduct an inspection.

第五十五条の七十二(裁決)

Article 55-72Determination

出入国在留管理庁長官は、審査の申請を受けたときは、できる限り九十日以内に裁決をするよう努めるものとする。

When the Commissioner of the Immigration Services Agency receives a request for examination, the Commissioner is to endeavor to make a determination within 90 days to the extent possible.

行政不服審査法第四十五条第一項及び第二項第四十六条第一項本文及び第二項(第二号を除く。)、第四十七条(ただし書及び第二号を除く。)、第四十八条第五十条第一項及び第三項第五十一条並びに第五十二条第一項及び第二項の規定は、審査の申請の裁決について準用する。この場合において、同法第五十一条第三項中「総務省令」とあるのは、「法務省令」と読み替えるものとするほか、必要な技術的読替えは、政令で定める。

The provisions of Article 45, paragraphs (1) and (2), Article 46, paragraph (1), main clause and paragraph (2) (excluding item (ii)), Article 47 (excluding the proviso and item (ii)), Article 48, Article 50, paragraphs (1) and (3), Article 51 and Article 52, paragraphs (1) and (2) of the Administrative Complaint Review Act apply mutatis mutandis to a determination on a request for examination. In this case, the phrase "Order of the Ministry of Internal Affairs and Communications" in Article 51, paragraph (3) of that Act is deemed to be replaced with "Ministry of Justice Order", and any other necessary technical replacement of terms is specified by Cabinet Order.

第五十五条の七十三(再審査の申請)

Article 55-73Request for Re-Examination

審査の申請の裁決に不服がある者は、書面で、法務大臣に対し、再審査の申請をすることができる。

A person who is dissatisfied with a determination on a request for examination may file a request for re-examination in writing with the Minister of Justice.

前項の規定による再審査の申請(以下この節において単に「再審査の申請」という。)は、審査の申請についての裁決の告知があつた日の翌日から起算して三十日以内にしなければならない。

The provisions of Article 55-68, paragraph (2), Article 55-69, paragraph (2), Article 55-71 and paragraph (1) of the preceding Article, and Article 15, Article 18, paragraph (3), Article 19, paragraphs (2) and (4), Article 23, Article 25, paragraphs (1), (2) and (6), Article 26, Article 27, Article 39, the main clause of Article 46, paragraph (1) and paragraph (2) (excluding item (ii)), Article 47 (excluding the proviso and item (ii)), Article 48, Article 50, paragraph (1), Article 51, Article 52, paragraphs (1) and (2), Article 62, paragraph (2) and Article 64, paragraphs (1) through (3) of the Administrative Complaint Review Act apply mutatis mutandis to a request for re-examination. In this case, "upon petition by the requestor for review or ex officio" in Article 25, paragraph (2) of the same Act is deemed to be replaced with "ex officio", and "Order of the Ministry of Internal Affairs and Communications" in Article 51, paragraph (3) of the same Act is deemed to be replaced with "Ministry of Justice Order", and any other necessary technical replacement is provided for by Cabinet Order.

第五十五条の七十四(出入国在留管理庁長官に対する事実の申告)

Article 55-74Report of Facts to the Commissioner of the Immigration Services Agency

被収容者は、自己に対する入国者収容所等の職員による行為であつて、次に掲げるものがあつたときは、政令で定めるところにより、書面で、出入国在留管理庁長官に対し、その事実を申告することができる。

If any of the following acts has been committed against a detainee by officials of the immigration detention center, etc., the detainee may, pursuant to the provisions of Cabinet Order, report those facts in writing to the Commissioner of the Immigration Services Agency:

身体に対する違法な有形力の行使

unlawful exercise of physical force against the body;

違法又は不当な捕縄又は手錠の使用

unlawful or unjust use of arresting ropes or handcuffs;

違法又は不当な保護室等への収容

unlawful or unjust placement in a protection room, etc.

前項の規定による申告は、その申告に係る事実があつた日の翌日から起算して三十日以内にしなければならない。

A report under the provisions of the preceding paragraph must be made within 30 days from the day following the day on which the facts pertaining to the report occurred.

第五十五条の六十八第二項第五十五条の六十九第二項及び第三項並びに第五十五条の七十一並びに行政不服審査法第十八条第三項第二十二条第一項及び第五項第二十三条第二十七条並びに第三十九条の規定は、第一項の規定による申告について準用する。この場合において、必要な技術的読替えは、政令で定める。

The provisions of Article 55-68, paragraph (2), Article 55-69, paragraphs (2) and (3), and Article 55-71, and Article 18, paragraph (3), Article 22, paragraphs (1) and (5), Article 23, Article 27 and Article 39 of the Administrative Complaint Review Act apply mutatis mutandis to a report under the provisions of paragraph (1). In this case, any necessary technical replacement is provided for by Cabinet Order.

前条第一項の規定による申告が適法であるときは、出入国在留管理庁長官は、その申告に係る事実の有無について確認し、その結果をその申告をした者に通知するものとする。ただし、その者が出所したときは、この限りでない。

If a report under the provisions of paragraph (1) of the preceding Article is lawful, the Commissioner of the Immigration Services Agency is to confirm whether or not the facts pertaining to the report exist and notify the person who made the report of the result; provided, however, that this does not apply if that person has left the facility.

前条第一項の規定による申告が法定の期間経過後にされたものであるとき、その他不適法であるときは、出入国在留管理庁長官は、その旨をその申告をした者に通知するものとする。この場合においては、前項ただし書の規定を準用する。

If a report under the provisions of paragraph (1) of the preceding Article was made after the expiration of the statutory period or is otherwise unlawful, the Commissioner of the Immigration Services Agency is to notify the person who made the report to that effect. In this case, the provisions of the proviso to the preceding paragraph apply mutatis mutandis.

第五十五条の七十二第一項並びに行政不服審査法第五十条第一項及び第三項の規定は、前二項の規定による通知について準用する。この場合において、必要な技術的読替えは、政令で定める。

The provisions of Article 55-72, paragraph (1), and Article 50, paragraphs (1) and (3) of the Administrative Complaint Review Act apply mutatis mutandis to a notice under the provisions of the preceding two paragraphs. In this case, any necessary technical replacement is provided for by Cabinet Order.

出入国在留管理庁長官は、前条第一項に規定する事実があつたことを確認した場合において、必要があると認めるときは、同様の行為の再発の防止のため必要な措置その他の措置をとるものとする。

If the Commissioner of the Immigration Services Agency has confirmed that the facts prescribed in paragraph (1) of the preceding Article occurred and finds it necessary, the Commissioner is to take the measures necessary to prevent the recurrence of similar acts and other measures.

第五十五条の七十六(法務大臣に対する事実の申告)

Article 55-76Report of Facts to the Minister of Justice

被収容者は、前条第一項又は第二項の規定による通知を受けた場合において、その内容に不服があるときは、政令で定めるところにより、書面で、法務大臣に対し、第五十五条の七十四第一項に規定する事実を申告することができる。

If a detainee who has received a notice under the provisions of paragraph (1) or (2) of the preceding Article is dissatisfied with its content, the detainee may, pursuant to the provisions of Cabinet Order, report the facts prescribed in Article 55-74, paragraph (1) in writing to the Minister of Justice.

前項の規定による申告は、前条第一項又は第二項の規定による通知を受けた日の翌日から起算して三十日以内にしなければならない。

A report under the provisions of the preceding paragraph must be made within 30 days from the day following the day on which the notice under the provisions of paragraph (1) or (2) of the preceding Article was received.

第五十五条の六十八第二項第五十五条の六十九第二項第五十五条の七十一第五十五条の七十二第一項並びに前条第一項第二項及び第四項並びに行政不服審査法第十八条第三項第二十三条第二十七条第三十九条及び第五十条第一項の規定は、第一項の規定による申告について準用する。この場合において、必要な技術的読替えは、政令で定める。

第五十五条の七十七(法務大臣に対する苦情の申出)

Article 55-77Complaints to the Minister of Justice

被収容者は、自己に対する入国者収容所長等の措置その他自己が受けた処遇について、書面で、法務大臣に対し、苦情の申出をすることができる。

A detainee may file a complaint in writing with the Minister of Justice concerning measures taken against the detainee by the director of the immigration detention center, etc. or other treatment the detainee has received.

第五十五条の六十八第二項の規定は、前項の苦情の申出について準用する。

The provisions of Article 55-68, paragraph (2) apply mutatis mutandis to the complaint set forth in the preceding paragraph.

法務大臣は、第一項の苦情の申出を受けたときは、これを誠実に処理し、処理の結果を当該苦情の申出をした者に通知しなければならない。ただし、その者が出所したときは、この限りでない。

Upon receiving a complaint set forth in paragraph (1), the Minister of Justice must process it in good faith and notify the person who filed the complaint of the result of the processing; provided, however, that this does not apply if that person has left the facility.

被収容者は、自己に対する入国者収容所長等の措置その他自己が受けた処遇について、口頭又は書面で、第五十五条の九の規定により実地監査を行う監査官(以下この節において単に「監査官」という。)に対し、苦情の申出をすることができる。

A detainee may file a complaint, orally or in writing, with an auditor who conducts an on-site audit pursuant to the provisions of Article 55-9 (hereinafter simply referred to as an "auditor" in this Section) concerning measures taken against the detainee by the director of the immigration detention center, etc. or other treatment the detainee has received.

第五十五条の六十八第二項の規定は、前項の苦情の申出について準用する。

The provisions of Article 55-68, paragraph (2) apply mutatis mutandis to the complaint set forth in the preceding paragraph.

監査官は、口頭による第一項の苦情の申出を受けるに当たつては、入国者収容所等の職員を立ち会わせてはならない。

In receiving an oral complaint set forth in paragraph (1), an auditor must not have officials of the immigration detention center, etc. present.

前条第三項の規定は、監査官第一項の苦情の申出を受けた場合について準用する。

The provisions of paragraph (3) of the preceding Article apply mutatis mutandis where an auditor has received a complaint set forth in paragraph (1).

第五十五条の七十九(入国者収容所長等に対する苦情の申出)

Article 55-79Complaints to the Director of the Immigration Detention Center, etc.

被収容者は、自己に対する入国者収容所長等の措置その他自己が受けた処遇について、口頭又は書面で、入国者収容所長等に対し、苦情の申出をすることができる。

A detainee may file a complaint, orally or in writing, with the director of the immigration detention center, etc. concerning measures taken against the detainee by the director of the immigration detention center, etc. or other treatment the detainee has received.

第五十五条の六十八第二項の規定は、前項の苦情の申出について準用する。

被収容者が口頭で第一項の苦情の申出をするときは、入国者収容所長等は、その指名する職員にその内容を聴取させることができる。

第五十五条の七十七第三項の規定は、入国者収容所長等第一項の苦情の申出を受けた場合について準用する。

第五十五条の八十(秘密申立て)

Article 55-80Confidential Filing

入国者収容所長等は、被収容者審査の申請等(審査の申請、再審査の申請又は第五十五条の七十四第一項若しくは第五十五条の七十六第一項の規定による申告をいう。次項及び次条において同じ。)をし、又は法務大臣若しくは監査官に対する苦情の申出(第五十五条の七十七第一項又は第五十五条の七十八第一項の苦情の申出をいう。)をするに当たり、その内容を入国者収容所又は地方出入国在留管理局の職員に秘密にすることができるように、必要な措置を講じなければならない。

The director of the immigration detention center, etc. must take the necessary measures so that, when a detainee files a request for examination, etc. (meaning a request for examination, a request for re-examination, or a report under the provisions of Article 55-74, paragraph (1) or Article 55-76, paragraph (1); the same applies in the following paragraph and the following Article) or a complaint to the Minister of Justice or an auditor (meaning a complaint set forth in Article 55-77, paragraph (1) or Article 55-78, paragraph (1)), the detainee is able to keep its content confidential from the officials of the immigration detention center or the regional immigration services bureau.

第五十五条の六十の規定にかかわらず、審査の申請等又は苦情の申出(第五十五条の七十七第一項第五十五条の七十八第一項又は前条第一項の苦情の申出をいう。次条において同じ。)の書面は、検査をしてはならない。

Notwithstanding the provisions of Article 55-60, documents of a request for examination, etc. or of a complaint (meaning a complaint set forth in Article 55-77, paragraph (1), Article 55-78, paragraph (1) or paragraph (1) of the preceding Article; the same applies in the following Article) must not be inspected.

第五十五条の八十一(不利益取扱いの禁止)

Article 55-81Prohibition of Disadvantageous Treatment

入国者収容所又は地方出入国在留管理局の職員は、被収容者審査の申請等又は苦情の申出をしたことを理由として、その者に対し、不利益な取扱いをしてはならない。

Officials of an immigration detention center or a regional immigration services bureau must not treat a detainee disadvantageously on the grounds that the detainee has filed a request for examination, etc. or a complaint.

第八節 死亡

Section 8 Death

入国者収容所長等は、被収容者が死亡した場合には、法務省令で定めるところにより、その遺族等に対し、その死亡の原因及び日時並びに交付すべき遺留物又は発受差止信書等があるときはその旨を速やかに通知しなければならない。

If a detainee dies, the director of the immigration detention center, etc. must, pursuant to the provisions of Ministry of Justice Order, promptly notify the bereaved family, etc. of the detainee of the cause and the date and time of death and, if there are articles left behind or withheld letters, etc. to be delivered, of that fact.

第五十五条の八十三(死体に関する措置)

Article 55-83Measures Concerning Dead Bodies

被収容者が死亡した場合において、その死体の埋葬又は火葬を行う者がないときは、墓地、埋葬等に関する法律(昭和二十三年法律第四十八号)第九条の規定にかかわらず、その埋葬又は火葬は、入国者収容所長等が行うものとする。

If a detainee dies and there is no person to carry out the burial or cremation of the body, the burial or cremation is to be carried out by the director of the immigration detention center, etc., notwithstanding the provisions of Article 9 of the Act on Graveyards, Burial, etc. (Act No. 48 of 1948).

前項に定めるもののほか、被収容者の死体に関する措置については、法務省令で定める。

Beyond what is provided for in the preceding paragraph, measures concerning the body of a detainee are provided for by Ministry of Justice Order.
