入国警備官は、被収容者が自身を傷つけ若しくは他人に危害を加え、逃走し、入国者収容所等の職員の職務の執行を妨げ、その他入国者収容所等の規律及び秩序を著しく害する行為をし、又はこれらの行為をしようとする場合には、合理的に必要と判断される限度で、その行為を制止し、その被収容者を拘束し、その他その行為を抑止するため必要な措置をとることができる。
If a detainee injures themselves or inflicts harm on another person, escapes, obstructs the performance of duties of an official of the immigration detention center, etc., or otherwise engages in an act that seriously harms discipline and order at the immigration detention center, etc., or attempts to engage in any of these acts, an immigration control officer may, to the extent judged reasonably necessary, stop the act, restrain the detainee, and take other measures necessary to suppress the act.
入国警備官は、被収容者以外の者が次の各号のいずれかに該当する場合には、合理的に必要と判断される限度で、その行為を制止し、その行為をする者を拘束し、その他その行為を抑止するため必要な措置をとることができる。
If a person other than a detainee falls under any of the following items, an immigration control officer may, to the extent judged reasonably necessary, stop the act, restrain the person engaging in the act, and take other measures necessary to suppress the act:
入国者収容所等に侵入し、その設備を損壊し、入国者収容所等の職員の職務の執行を妨げ、又はこれらの行為を正にしようとするとき。
if the person intrudes into the immigration detention center, etc., damages its facilities, obstructs the performance of duties of an official of the immigration detention center, etc., or is on the verge of engaging in any of these acts;
if the person does not leave the immigration detention center or regional immigration services bureau despite a demand by an immigration control officer;
if the person, at the scene, assists, incites or instigates the escape of a detainee or the obstruction of the performance of duties of an official of the immigration detention center, etc.;
前二項の措置に必要な警備用具については、法務省令で定める。
The security equipment necessary for the measures set forth in the preceding two paragraphs is specified by Ministry of Justice Order.
