第五十条（災害応急対策及びその実施責任）
Article 50Emergency Disaster Control Measures and Responsibility for Their Implementation
Emergency disaster control measures are to be performed with respect to the following matters, when a disaster occurs or is likely to occur, for the purpose of preventing a disaster or preventing the spread of the disaster, or of conducting emergency rescue work:
災害応急対策は、次に掲げる事項について、災害が発生し、又は発生するおそれがある場合に災害の発生を防御し、又は応急的救助を行う等災害の拡大を防止するために行うものとする。
matters concerning the issuance and transmission of alarms, and recommendations or instructions for evacuation;
警報の発令及び伝達並びに避難の勧告又は指示に関する事項
matters concerning emergency measures, such as fire-fighting and flood prevention;
消防、水防その他の応急措置に関する事項
matters concerning rescue, aid, and protection of disaster victims;
被災者の救難、救助その他保護に関する事項
matters concerning emergency education of children and school children affected by disasters;
災害を受けた児童及び生徒の応急の教育に関する事項
matters concerning emergency restoration of facilities and equipment;
施設及び設備の応急の復旧に関する事項
matters concerning protection of the living environment and public health such as treatment and cleanup of waste, epidemic control, and others;
廃棄物の処理及び清掃、防疫その他の生活環境の保全及び公衆衛生に関する事項
matters concerning the preservation of social order at disaster areas regarding crime prevention, traffic control, etc.;
犯罪の予防、交通の規制その他災害地における社会秩序の維持に関する事項
matters concerning ensuring emergency transport;
緊急輸送の確保に関する事項
beyond what is provided for in each of the preceding items, any matters related to measures for prevention of the occurrence or spread of disasters.
The head of a designated administrative organ, the head of a designated local administrative organ, the head or any other executive agency of a local government, designated public corporations and designated local public corporations, and any other parties responsible, by laws and regulations, for implementing emergency disaster control measures must carry out the measures, as provided for by laws and regulations or under a disaster management plan, exercising full care to ensure the safety of those engaged in emergency disaster control measures.
定義第二条第一項第一号・法令全体に適用
暴風、竜巻、豪雨、豪雪、洪水、崖崩れ、土石流、高潮、地震、津波、地盤の液状化、噴火、地滑りその他の異常な自然現象又は大規模な火事若しくは爆発その他その及ぼす被害の程度においてこれらに類する政令で定める原因により生ずる被害
わかりやすく言うと
暴風、豪雨、地震、津波、噴火などの異常な自然現象や、大規模な火事・爆発によって生じる被害のことです。被害の程度がこれらに似た原因で政令で定めるものによる被害も含まれます。
定義第二条第一項第三号・法令全体に適用
次に掲げる機関で内閣総理大臣が指定するもの
わかりやすく言うと
国の行政機関のうち、内閣総理大臣が指定するもののことです。内閣府、宮内庁、デジタル庁、防災庁、各省・委員会・庁のほか、内閣府設置法や国家行政組織法などに定める審議会などの合議制の機関、試験研究機関などの施設等機関、特別の機関の中から指定されます。
定義第二条第一項第四号・法令全体に適用
指定行政機関の地方支分部局（内閣府設置法第四十三条及び第五十七条（宮内庁法第十八条第一項において準用する場合を含む。）並びに宮内庁法第十七条第一項並びに国家行政組織法第九条の地方支分部局をいう。）その他の国の地方行政機関で、内閣総理大臣が指定するもの
わかりやすく言うと
国の地方行政機関のうち、内閣総理大臣が指定するもののことです。指定行政機関の所掌事務を分担して受け持つために置かれる地方支分部局などが、その対象になります。
定義第二条第一項第五号・法令全体に適用
独立行政法人（独立行政法人通則法（平成十一年法律第百三号）第二条第一項に規定する独立行政法人をいう。）、日本銀行、日本赤十字社、日本放送協会その他の公共的機関及び電気、ガス、輸送、通信その他の公益的事業を営む法人で、内閣総理大臣が指定するもの
わかりやすく言うと
独立行政法人、日本銀行、日本赤十字社、日本放送協会などの公共的機関と、電気、ガス、輸送、通信などの公益的事業を営む法人のうち、内閣総理大臣が指定したものです。
定義第二条第一項第六号・法令全体に適用
地方独立行政法人（地方独立行政法人法（平成十五年法律第百十八号）第二条第一項に規定する地方独立行政法人をいう。）及び港湾法（昭和二十五年法律第二百十八号）第四条第一項の港務局（第八十二条第一項において「港務局」という。）、土地改良法（昭和二十四年法律第百九十五号）第五条第一項の土地改良区その他の公共的施設の管理者並びに都道府県の地域において電気、ガス、輸送、通信その他の公益的事業を営む法人で、当該都道府県の知事が指定するもの
わかりやすく言うと
都道府県知事が指定する法人などのことです。地方公共団体が設立する地方独立行政法人や港務局、土地改良区などの公共的施設の管理者と、その都道府県の地域で電気、ガス、輸送、通信などの公益的事業を営む法人の中から指定されます。
