第五条（用語の定義）

この条から附則第三十八条の二まで、附則第四十一条から第九十条まで及び附則第九十二条から第九十四条までにおいて、次の各号に掲げる用語の意義は、それぞれ当該各号に定めるところによる。

新国民年金法 第一条の規定による改正後の国民年金法をいう。

旧国民年金法 第一条の規定による改正前の国民年金法をいう。

旧交渉法 附則第二条第一項の規定による廃止前の厚生年金保険及び船員保険交渉法をいう。

保険料納付済期間、保険料免除期間、政府及び実施機関、実施機関たる共済組合等、第一号被保険者、第二号被保険者又は合算対象期間 それぞれ国民年金法第五条第一項、同条第二項、同条第八項、同条第九項、同法第七条第一項第一号、同項第二号又は同法附則第九条第一項に規定する保険料納付済期間、保険料免除期間、政府及び実施機関、実施機関たる共済組合等、第一号被保険者、第二号被保険者又は合算対象期間をいう。

第一種被保険者 男子である厚生年金保険法による被保険者（同法第二条の五第一項第一号に規定する第一号厚生年金被保険者（以下「第一号厚生年金被保険者」という。）に限る。）であつて、第三種被保険者、第四種被保険者及び船員任意継続被保険者以外のものをいう。

第二種被保険者 女子である厚生年金保険法による被保険者（第一号厚生年金被保険者に限る。）であつて、第三種被保険者、第四種被保険者及び船員任意継続被保険者以外のものをいう。

第三種被保険者 鉱業法（昭和二十五年法律第二百八十九号）第四条に規定する事業の事業場に使用され、かつ、常時坑内作業に従事する厚生年金保険法による被保険者（第一号厚生年金被保険者に限る。）又は船員法（昭和二十二年法律第百号）第一条に規定する船員として厚生年金保険法第六条第一項第三号に規定する船舶に使用される同法による被保険者（第一号厚生年金被保険者に限る。）であつて、第四種被保険者及び船員任意継続被保険者以外のものをいう。

第四種被保険者 附則第四十三条第一項の規定によりなおその効力を有するものとされた旧厚生年金保険法第十五条第一項の規定によつて厚生年金保険法による被保険者となつた者及び附則第四十三条第二項又は第五項の規定によつて同法による被保険者となつた者をいう。

船員任意継続被保険者 附則第四十四条第一項の規定によつて厚生年金保険法による被保険者となつた者をいう。

通算対象期間 旧通則法に規定する通算対象期間並びに法令の規定により当該通算対象期間に算入された期間及び当該通算対象期間とみなされた期間をいう。

物価指数 総務庁において作成する全国消費者物価指数又は総理府において作成した全国消費者物価指数をいう。

老齢基礎年金、障害基礎年金又は遺族基礎年金 それぞれ国民年金法による老齢基礎年金、障害基礎年金又は遺族基礎年金をいう。

老齢厚生年金、障害厚生年金又は遺族厚生年金 それぞれ厚生年金保険法による老齢厚生年金、障害厚生年金又は遺族厚生年金をいう。

退職共済年金、障害共済年金又は遺族共済年金 それぞれ被用者年金制度の一元化等を図るための厚生年金保険法等の一部を改正する法律（平成二十四年法律第六十三号。以下「平成二十四年一元化法」という。）附則第三十七条第一項の規定によりなおその効力を有するものとされた平成二十四年一元化法第二条の規定による改正前の国家公務員共済組合法（昭和三十三年法律第百二十八号）の長期給付に関する規定その他の法律の規定、平成二十四年一元化法附則第六十一条第一項の規定によりなおその効力を有するものとされた平成二十四年一元化法第三条の規定による改正前の地方公務員等共済組合法（昭和三十七年法律第百五十二号）の長期給付に関する規定その他の法律の規定又は平成二十四年一元化法附則第七十九条の規定によりなおその効力を有するものとされた平成二十四年一元化法第四条の規定による改正前の私立学校教職員共済法（昭和二十八年法律第二百四十五号）の長期給付に関する規定その他の法律の規定による退職共済年金、障害共済年金又は遺族共済年金をいう。
