①A person who, on the Effective Date, has the right to receive a disability basic pension under the provisions of Article 25 of the Supplementary Provisions, a disability pension under the former National Pension Act, a disability pension under the former Employees' Pension Insurance Act, or any other benefit paid as a pension whose ground for payment is disability that is specified by Cabinet Order (hereinafter referred to as "disability pensions, etc." in this paragraph), and who has a premium-paid period prescribed in Article 5, paragraph (3) of the former National Pension Act for the period from the day on which the person came to have the right to receive those disability pensions, etc. (where those disability pensions, etc. are a disability basic pension under the provisions of Article 25 of the Supplementary Provisions or any other benefit specified by Cabinet Order, the day specified by Cabinet Order; the same applies in item (ii)) to the day before the Effective Date (hereinafter referred to as the "applicable former premium-paid period" in this Article) (excluding a person, other than a person who has the right to receive a disability basic pension under the provisions of Article 25 of the Supplementary Provisions or a disability welfare pension under the former National Pension Act, who is prescribed in Article 31, paragraph (1) of the Supplementary Provisions) may, as specified by Cabinet Order, claim payment of a special lump-sum payment; provided, however, that this does not apply if the person falls under any of the following items.

②When the claim under the preceding paragraph has been made, a special lump-sum payment is paid to the person who made that claim.

③The amount of the special lump-sum payment is the amount calculated, as specified by Cabinet Order, according to the applicable former premium-paid period, based on the total amount of the National Pension premiums for the period from April 1, 1961 to the day before the Effective Date.

④Where a special lump-sum payment has been received pursuant to the provisions of paragraph (2), the applicable former premium-paid period is deemed, for the purposes of calculating the amount of an old-age basic pension or an additional pension under the National Pension Act, not to be an insured period of the National Pension that is a premium-paid period prescribed in Article 5, paragraph (3) of the former National Pension Act, and, for the purposes of applying the provisions of the proviso to Article 30, paragraph (1) of the National Pension Act (including as applied mutatis mutandis pursuant to Article 30-2, paragraph (2), Article 30-3, paragraph (2), Article 34, paragraph (5) and Article 36, paragraph (3) of that Act), the proviso to Article 37 of that Act, and the proviso to Article 58, paragraph (1) of the new Employees' Pension Insurance Act, not to be an insured period of the National Pension.

⑤Where a special lump-sum payment has been received pursuant to the provisions of paragraph (2), the amount of an old-age pension or an aggregated old-age pension under the former National Pension Act is, notwithstanding the provisions of that Act that remain in force pursuant to the provisions of Article 32, paragraph (2) of the Supplementary Provisions, the amount obtained by deducting the amount calculated for the applicable former premium-paid period in the same manner as provided in Article 27 of that Act.

⑥Beyond what is provided for in the preceding paragraphs, necessary matters concerning the payment of special lump-sum payments (including necessary matters incidental to that payment) are specified by Cabinet Order.

The provisions then in force continue to govern the application of penal provisions to acts committed before the Effective Date.

Beyond what is provided for in these Supplementary Provisions, transitional measures necessary incidental to the enforcement of this Act are specified by Cabinet Order.
