第一条（施行期日）

この法律の規定は、次の各号に掲げる区分に従い、それぞれ当該各号に定める日から施行する。

第四条及び附則第十三条の規定 政令で定める日

第十三条

第四条の規定の施行の日（以下この項において「施行日」という。）において二十歳をこえ七十歳未満である者が、障害認定日（国民年金法第三十条第一項に規定する障害認定日をいう。以下この条において同じ。）が施行日前である傷病（初診日において同法第七条第二項第一号から第四号までのいずれかに該当した者のその傷病を除く。）により、施行日において同法別表に定める程度の障害の状態にあるときは、第四条の規定による改正後の同法第五十六条第一項本文の規定にかかわらず、その者に同条の障害福祉年金を支給する。

前項の規定は、初診日が昭和三十六年四月一日（同日において二十歳未満であつた者にあつては、二十歳に達した日）以後である傷病により同項に規定する障害の状態にある者については、次の各号のいずれかに該当する場合に限り適用し、初診日が同日前である傷病による障害と初診日が同日以後である傷病による障害とを併合して同項に規定する障害の状態にある者については、初診日が同日以後である傷病による障害が厚生大臣の定める程度以上のものであり、かつ、その傷病に係る障害認定日の前日において次の各号のいずれかに該当する場合に限り適用する。ただし、明治四十四年四月一日以前に生まれた者（昭和三十六年四月一日において五十歳をこえた者）については、この限りでない。

初診日において国民年金の被保険者であつた者については、国民年金法第五十六条第一項各号のいずれかに該当したこと。

初診日において国民年金の被保険者でなかつた者については、国民年金法第七十九条の二第一項に規定する老齢福祉年金の支給要件に該当したこと。
Supplementary Provisions, Article 15
第十五条

昭和四十九年一月一日前に同日以後の期間について前納された国民年金の保険料（国民年金法の一部を改正する法律（昭和四十四年法律第八十六号。以下「法律第八十六号」という。）附則第十五条第一項の規定による被保険者に係る保険料を除く。）は、この法律による改正後の国民年金法の規定により当該前納に係る期間の各月につき納付すべきこととなる保険料に、さきに到来する月の分から順次充当するものとする。

第十六条

昭和四十九年一月一日前に同日以後の期間に係る国民年金の保険料を前納した法律第八十六号附則第十五条第一項の規定による被保険者が、当該前納に係る期間につき追加して納付すべき国民年金の保険料の額は、一月につき百五十円とする。

第十八条

国民年金の被保険者又は被保険者であつた者（国民年金法による老齢年金及び通算老齢年金の受給権者を除く。）は、都道府県知事に申し出て、昭和四十八年四月一日前のその者の国民年金の被保険者期間（同法第七十五条第一項、附則第六条第一項及び附則第七条第一項並びに法律第八十六号附則第十五条第一項の規定による被保険者に係る被保険者期間を除く。）のうち、国民年金の保険料納付済期間及び保険料免除期間以外の期間（当該期間に係る国民年金の保険料を徴収する権利が時効によつて消滅している期間に限る。）について、一月につき九百円を納付することができる。

前項の規定による納付は、昭和五十年十二月三十一日（同日以前に六十五歳に達する者にあつては、六十五歳に達する日の前日）までに行なわなければならない。

第一項の規定による納付は、さきに経過した月の分から順次行なうものとする。

第一項の規定により納付が行なわれたときは、納付が行なわれた日に、納付に係る月の国民年金の保険料が納付されたものとみなす。

第十九条

明治三十九年四月二日から明治四十四年四月一日までの間に生まれた者（昭和三十六年四月一日において五十歳をこえ、五十五歳をこえない者）であつて、国民年金法第七条第二項第一号から第三号までのいずれにも該当しないもの（法律第八十六号附則第十五条第一項の規定による被保険者を除く。）は、都道府県知事に申し出て、国民年金の被保険者となることができる。ただし、その者が、次の各号のいずれかに該当するときは、この限りでない。

日本国民でないとき。

日本国内に住所を有しないとき。

国民年金法第五条第一項に規定する被用者年金各法による通算老齢年金若しくは通算退職年金を受けることができるとき、又はこれらの年金の受給資格要件たる期間を満たしているとき。

第一項の申出をした者は、その申出をした日に被保険者の資格を取得するものとする。

国民年金法第十三条第一項の規定は、第一項の申出があつた場合に準用する。

第一項の規定による被保険者は、いつでも、都道府県知事に申し出て、被保険者の資格を喪失することができる。

国民年金法第七条第二項第一号に該当するに至つたとき。

前項の申出が受理されたとき。

国民年金の保険料を滞納し、国民年金法第九十六条第一項の規定による指定の期限までに、その保険料を納付しないとき。

国民年金法による老齢年金又は通算老齢年金の受給資格要件たる期間を満たすに至つたとき。

第一項の規定による被保険者の昭和四十八年十二月までの月分の国民年金の保険料の額は、国民年金法第八十七条第三項の規定にかかわらず、一月につき九百円とする。

前項の規定による納付は、昭和五十年六月三十日までに行なわなければならない。

第八項の規定により納付する金額は、国民年金法第八十五条第一項第一号の規定の適用については、保険料とみなす。

第一項の規定による被保険者については、国民年金法第八十七条の二、第八十九条、第九十条及び附則第七条の二の規定を適用しない。

第二十一条（老齢特別給付金）

明治三十九年四月一日以前に生まれた者（昭和三十六年四月一日において五十五歳をこえた者）には、昭和四十九年一月から老齢特別給付金を支給する。ただし、その者が日本国民でないとき又は国民年金法による老齢福祉年金（以下この条において「老齢福祉年金」という。）の受給権者であるときは、この限りでない。

老齢特別給付金の年額は、十万八千円とする。

老齢特別給付金の受給権は、受給権者が次の各号のいずれかに該当するに至つたときは、消滅する。

老齢特別給付金は、国民年金法（第七十九条の二（第六項を除く。）及び第八十条を除く。）の規定の適用については、老齢福祉年金とみなす。
