Supplementary Provisions, Article 34Special Provisions on Bearing the Expenses Required for the National Pension Program
第三十四条（国民年金事業に要する費用の負担の特例）
The national treasury bears, for the time being, each fiscal year, in order to cover the expenses required for the National Pension program, beyond the amounts prescribed in the items of Article 85, paragraph (1) and in paragraph (2) of the National Pension Act, the amounts listed in the following items out of the expenses required for benefits paid as a pension under that Act and benefits paid as a pension under the former National Pension Act.
国庫は、当分の間、毎年度、国民年金事業に要する費用に充てるため、国民年金法第八十五条第一項各号及び第二項に規定する額のほか、同法による年金たる給付及び旧国民年金法による年金たる給付に要する費用のうち、次の各号に掲げる額を負担する。
An amount equivalent to one-quarter of the total of the expenses required for the benefit of additional pensions under the National Pension Act and the expenses required for the benefit of death lump-sum payments under that Act (excluding the expenses required for the benefit of the portion equivalent to the amount specified in Article 52-4, paragraph (1) of that Act) in that fiscal year;
当該年度における国民年金法による付加年金の給付に要する費用及び同法による死亡一時金の給付に要する費用（同法第五十二条の四第一項に定める額に相当する部分の給付に要する費用を除く。）の総額の四分の一に相当する額
The amount obtained by multiplying the total of the expenses required for the benefit of disability basic pensions paid pursuant to the provisions of Article 25 of the Supplementary Provisions and survivors' basic pensions paid pursuant to the provisions of Article 28 of the Supplementary Provisions in that fiscal year by the ratio specified by Cabinet Order, taking into consideration the ratio of the amount prescribed in Article 58 of the former National Pension Act, or the amounts prescribed in Article 62 and Article 63, paragraph (1) of that Act, to the amount of the disability basic pension or the amount of the survivors' basic pension;
The total of the additional amounts under the provisions of Article 17 of the Supplementary Provisions, out of the expenses required for the benefit of old-age basic pensions in that fiscal year;
The combined amount of the amounts obtained by multiplying the amount of the expenses required for benefits paid as a pension under the former National Pension Act (excluding old-age pensions and old-age welfare pensions paid by virtue of falling under the provisions of Article 9-3, paragraph (1) of the Supplementary Provisions of that Act) relating to persons who have a premium exemption period prescribed in Article 5, paragraph (4) of that Act (including a period deemed to be that premium exemption period under other laws and regulations) in that fiscal year (excluding the expenses required for the benefit of old-age pensions whose amount is calculated pursuant to the provisions of Article 77, paragraph (1) or (2) of that Act, and the expenses listed in item (vi)) by the number obtained by dividing the number listed in (a) by the number listed in (b);
The number obtained by dividing the number of months of that premium exemption period by 3;
当該保険料免除期間の月数を三で除して得た数
The number obtained by adding the number listed in (a) to the number of months of premium-paid periods concerned.
イに掲げる数と当該保険料納付済期間の月数とを合算した数
The total amount of the expenses required for the benefit of old-age pensions whose amount is calculated pursuant to the provisions of Article 77, paragraph (1) or (2) of the former National Pension Act in that fiscal year (excluding the expenses required for the benefit of the portion equivalent to the amounts listed below);
当該年度における旧国民年金法第七十七条第一項又は第二項の規定によつてその額が計算される老齢年金の給付に要する費用（次に掲げる額に相当する部分の給付に要する費用を除く。）の総額
The amount listed in Article 27, paragraph (1), item (i) of the former National Pension Act;
旧国民年金法第二十七条第一項第一号に掲げる額
An amount equivalent to three-quarters of the amount obtained by multiplying the amount listed in Article 77, paragraph (1), item (i) of the former National Pension Act by the number obtained by dividing the number of months of premium-paid periods relating to the insured period referred to in that item by the number of months of that insured period;
旧国民年金法第七十七条第一項第一号に掲げる額に同号の被保険者期間に係る保険料納付済期間の月数を当該被保険者期間の月数で除して得た数を乗じて得た額の四分の三に相当する額
An amount equivalent to three-quarters of the amount obtained by multiplying 200 yen by the number of months of premium-paid periods relating to premiums under the provisions of Article 87-2, paragraph (1) of the former National Pension Act.
二百円に旧国民年金法第八十七条の二第一項の規定による保険料に係る保険料納付済期間の月数を乗じて得た額の四分の三に相当する額
An amount equivalent to one-quarter of the total amount of the expenses required for the benefit of old-age pensions (excluding the old-age pensions listed in the preceding item and old-age welfare pensions) and aggregated old-age pensions under the former National Pension Act in that fiscal year (excluding the expenses required for the benefit of the portion equivalent to the amount specified in Article 27, paragraph (1) of that Act (including where that paragraph governs pursuant to Article 29-4, paragraph (1) of that Act));
An amount equivalent to one-eighth of the total amount of the expenses required for the benefit of old-age pensions paid pursuant to the provisions of Article 16, paragraph (1) of the Supplementary Provisions of Act No. 86 before the amendment or Article 20, paragraph (1) of the Supplementary Provisions of Act No. 92 before the amendment in that fiscal year;
当該年度における改正前の法律第八十六号附則第十六条第一項又は改正前の法律第九十二号附則第二十条第一項の規定により支給する老齢年金の給付に要する費用の総額の八分の一に相当する額
An amount equivalent to one-quarter of the total amount of the expenses required for the benefit of the portion equivalent to the amount obtained by multiplying 840 yen by the number of months of premium-paid periods on which the calculation of the amount of that pension was based, out of the expenses required for the benefit of pensions whose amount is calculated pursuant to the provisions of Article 12, paragraph (2) of the Supplementary Provisions of Act No. 92 before the amendment in that fiscal year;
The total amount of the expenses required for the benefit of old-age welfare pensions under the former National Pension Act in that fiscal year.
当該年度における旧国民年金法による老齢福祉年金の給付に要する費用の総額
For the purposes of applying the provisions of Article 85, paragraph (1) of the National Pension Act, for the time being, the phrase "the amounts listed in the following item and item (iii)" in that paragraph is deemed to be replaced with "the amounts listed in the following item and item (iii) and the amount of the expenses listed in the items of Article 34, paragraph (1) of the Supplementary Provisions of the Act Partially Amending the National Pension Act, etc. (Act No. 34 of 1985; hereinafter referred to as the "1985 Amendment Act") (excluding items (i), (vi) and (ix)) (excluding the expenses for the portion equivalent to an amount equivalent to one-third of the amount prescribed in (c) of item (v) of that paragraph relating to the expenses required for the benefit of old-age pensions prescribed in that item)", and the phrase "480" is deemed to be replaced with "480 (or, for the persons listed in the left-hand column of Appended Table 4 of the Supplementary Provisions of the 1985 Amendment Act, the numbers listed in the right-hand column of that table, respectively)".
国民年金法第八十五条第一項の規定の適用については、当分の間、同項中「次号及び第三号に掲げる額」とあるのは「次号及び第三号に掲げる額並びに国民年金法等の一部を改正する法律（昭和六十年法律第三十四号。以下「昭和六十年改正法」という。）附則第三十四条第一項各号（第一号、第六号及び第九号を除く。）に掲げる費用（同項第五号に規定する老齢年金の給付に要する費用に係る同号ハに規定する額の三分の一に相当する額に相当する部分の費用を除く。）の額」と、「四百八十」とあるのは「四百八十（昭和六十年改正法附則別表第四の上欄に掲げる者については、それぞれ同表の下欄に掲げる数）」と読み替えるものとする。
For the purposes of applying the provisions of Article 85, paragraph (1) of the National Pension Act, the phrase "disability basic pension" in item (iii) of that paragraph is deemed to be replaced with "disability basic pension (excluding a disability basic pension under the provisions of Article 25 of the Supplementary Provisions of the Act Partially Amending the National Pension Act, etc. (Act No. 34 of 1985))".
国民年金法第八十五条第一項の規定の適用については、同項第三号中「障害基礎年金」とあるのは、「障害基礎年金（国民年金法等の一部を改正する法律（昭和六十年法律第三十四号）附則第二十五条の規定による障害基礎年金を除く。）」とする。
The national treasury bears, each fiscal year, for the expenses listed in the following items, the amounts specified in those items, respectively.
国庫は、毎年度、次の各号に掲げる費用について、それぞれ当該各号に定める額を負担する。
Expenses required for pensions paid by a National Pension Fund or the National Pension Fund Association to persons entitled to receive an old-age basic pension (excluding one whose payment is suspended in full) in that fiscal year: an amount equivalent to one-quarter of the amount obtained by multiplying 200 yen (or, for a pension paid by a National Pension Fund to a person entitled to receive an old-age basic pension under Article 28, or Article 9-2 or Article 9-2-2 of the Supplementary Provisions, of the National Pension Act, the amount specified by Cabinet Order) by the number of months of the membership period of that National Pension Fund (meaning the membership period prescribed in Article 130, paragraph (2) of that Act; the same applies hereinafter in this item) or of the membership period of a National Pension Fund on which the calculation of the amount of the pension for whose payment that National Pension Fund Association is liable is based;
当該年度における老齢基礎年金（その全額につき支給を停止されているものを除く。）の受給権者に国民年金基金又は国民年金基金連合会が支給する年金に要する費用 二百円（国民年金法第二十八条又は附則第九条の二若しくは第九条の二の二の規定による老齢基礎年金の受給権者に基金が支給する年金については、政令で定める額）に当該国民年金基金の加入員期間（同法第百三十条第二項に規定する加入員期間をいう。以下この号において同じ。）又は当該国民年金基金連合会がその支給に関する義務を負つている年金の額の計算の基礎となる国民年金基金の加入員期間の月数を乗じて得た額の四分の一に相当する額
Expenses required for lump-sum payments paid by a National Pension Fund or the National Pension Fund Association in that fiscal year: an amount equivalent to one-quarter of the additional amount under Article 52-4, paragraph (2) of the new National Pension Act.
当該年度における国民年金基金又は国民年金基金連合会が支給する一時金に要する費用 新国民年金法第五十二条の四第二項の加算額の四分の一に相当する額
For the purposes of applying the provisions of Article 86 of the new National Pension Act, the phrase "this Act or" in that Article is deemed to be replaced with "this Act (including this Act before its amendment by Article 1 of the Act Partially Amending the National Pension Act, etc. (Act No. 34 of 1985; hereinafter referred to as the "1985 Amendment Act") in cases where the provisions then in force continue to govern pursuant to the provisions of the 1985 Amendment Act, and this Act before its amendment by Article 1 of that Act as it remains in force pursuant to the provisions of the 1985 Amendment Act; the same applies hereinafter in this Article) or".
新国民年金法第八十六条の規定の適用については、同条中「この法律又は」とあるのは、「この法律（国民年金法等の一部を改正する法律（昭和六十年法律第三十四号。以下「昭和六十年改正法」という。）の規定によりなお従前の例によるものとされた場合における同法第一条の規定による改正前のこの法律及び昭和六十年改正法の規定によりなおその効力を有するものとされた同法第一条の規定による改正前のこの法律を含む。以下この条において同じ。）又は」とする。
Supplementary Provisions, Article 35
第三十五条
Of the expenses required for insurance benefits paid as a pension under the former Employees' Pension Insurance Act (including old-age pensions and aggregated old-age pensions under that Act as it remains in force pursuant to the provisions of Article 63, paragraph (1) of the Supplementary Provisions), insurance benefits paid as a pension that the government, as the implementer of Employees' Pension Insurance, is to pay pursuant to the provisions of Article 87, paragraph (2) of the Supplementary Provisions, benefits paid as a pension that the government, as the implementer of Employees' Pension Insurance, is to pay pursuant to the provisions of Article 16, paragraph (3) of the Supplementary Provisions of the 1996 Amendment Act, and benefits paid as a pension that the government, as the implementer of Employees' Pension Insurance, is to pay pursuant to the provisions of Article 16, paragraph (3) of the Supplementary Provisions of the 2001 Integration Act, the expenses listed in the following items and other expenses specified by Cabinet Order as expenses required for benefits equivalent to an old-age basic pension, a disability basic pension or a survivors' basic pension are, as specified by Cabinet Order, borne by the government as the administrator of the National Pension, as expenses required for the benefit of old-age basic pensions, disability basic pensions or survivors' basic pensions.
旧厚生年金保険法による年金たる保険給付（附則第六十三条第一項の規定によりなおその効力を有するものとされた同法による老齢年金及び通算老齢年金を含む。）、附則第八十七条第二項の規定により厚生年金保険の実施者たる政府が支給するものとされた年金たる保険給付、平成八年改正法附則第十六条第三項の規定により厚生年金保険の実施者たる政府が支給するものとされた年金たる給付及び平成十三年統合法附則第十六条第三項の規定により厚生年金保険の実施者たる政府が支給するものとされた年金である給付に要する費用のうち、次の各号に掲げる費用その他老齢基礎年金、障害基礎年金又は遺族基礎年金に相当する給付に要する費用として政令で定める費用については、政令で定めるところにより、老齢基礎年金、障害基礎年金又は遺族基礎年金の給付に要する費用として、国民年金の管掌者たる政府が負担する。

六十五歳以上の者に支給する老齢年金又は通算老齢年金の給付に要する費用のうち、昭和三十六年四月一日以後の当該被保険者期間に係る部分の給付に要する費用であつて老齢基礎年金又は旧国民年金法による老齢年金（老齢福祉年金を除く。）の額に相当する部分（附則第七十九条第二号に掲げる額に相当する部分を除く。）

Of the expenses required for the benefit of pensions for surviving family paid to the wife or child of a deceased insured person or person who was an insured person (excluding those that the government, as the implementer of Employees' Pension Insurance, is to pay pursuant to the provisions of Article 16, paragraph (3) of the Supplementary Provisions of the 1996 Amendment Act and Article 16, paragraph (3) of the Supplementary Provisions of the 2001 Integration Act), the portion of benefits whose ground for payment arose on or after April 1, 1961 that is equivalent to the amount of a survivors' basic pension.
死亡した被保険者又は被保険者であつた者の妻又は子に支給する遺族年金（平成八年改正法附則第十六条第三項及び平成十三年統合法附則第十六条第三項の規定により厚生年金保険の実施者たる政府が支給するものとされたものを除く。）の給付に要する費用のうち、昭和三十六年四月一日以後に支給事由の生じた給付であつて遺族基礎年金の額に相当する部分
The government as the administrator of the National Pension grants to mutual aid associations, etc. as implementing bodies, each fiscal year, as specified by Cabinet Order, the expenses listed in the following items and other expenses specified by Cabinet Order as expenses required for benefits equivalent to an old-age basic pension, a disability basic pension or a survivors' basic pension, out of the expenses required for the benefit of retirement pensions, reduced retirement pensions, aggregated retirement pensions, disability pensions, pensions for surviving family and aggregated survivors' pensions paid by a mutual aid association or the Promotion and Mutual Aid Corporation for Private Schools of Japan.
国民年金の管掌者たる政府は、共済組合又は日本私立学校振興・共済事業団が支給する退職年金、減額退職年金、通算退職年金、障害年金、遺族年金及び通算遺族年金の給付に要する費用のうち、次の各号に掲げる費用その他老齢基礎年金、障害基礎年金又は遺族基礎年金に相当する給付に要する費用として政令で定める費用を、毎年度、政令で定めるところにより、実施機関たる共済組合等に対して交付する。
Of the expenses required for the benefit of retirement pensions, reduced retirement pensions or aggregated retirement pensions paid to persons aged 65 or older, the expenses required for the benefit of the portion relating to the period as a member or the period as a subscriber on or after April 1, 1961, being the portion equivalent to the amount of an old-age basic pension or of an old-age pension under the former National Pension Act (excluding an old-age welfare pension) (excluding the portion equivalent to the amounts listed in Article 31, paragraph (1), item (ii) of the Supplementary Provisions of the 1985 National Public Officers Mutual Aid Amendment Act, Article 33, paragraph (1), item (ii) of the Supplementary Provisions of the 1985 Local Public Officers Mutual Aid Amendment Act and Article 6, paragraph (1), item (ii) of the Supplementary Provisions of the Act Partially Amending the Private School Personnel Mutual Aid Association Act, etc. (Act No. 106 of 1985));
六十五歳以上の者に支給する退職年金、減額退職年金又は通算退職年金の給付に要する費用のうち、昭和三十六年四月一日以後の当該組合員期間又は加入者期間に係る部分の給付に要する費用であつて老齢基礎年金又は旧国民年金法による老齢年金（老齢福祉年金を除く。）の額に相当する部分（昭和六十年国家公務員共済改正法附則第三十一条第一項第二号、昭和六十年地方公務員共済改正法附則第三十三条第一項第二号及び私立学校教職員共済組合法等の一部を改正する法律（昭和六十年法律第百六号）附則第六条第一項第二号に掲げる額に相当する部分を除く。）
Of the expenses required for the benefit of disability pensions, the portion of benefits whose ground for payment arose on or after April 1, 1961 that is equivalent to the amount of a disability basic pension;
障害年金の給付に要する費用のうち、昭和三十六年四月一日以後に支給事由の生じた給付であつて障害基礎年金の額に相当する部分
Of the expenses required for the benefit of pensions for surviving family paid to the wife or child of a deceased member of a mutual aid association (including a voluntary continuing member of the Mutual Aid Association for Employees of Agricultural, Forestry and Fishery Organizations; the same applies hereinafter in this item) or of a person who was a member of a mutual aid association, the portion of benefits whose ground for payment arose on or after April 1, 1961 that is equivalent to the amount of a survivors' basic pension.
The expenses borne by the government as the administrator of the National Pension pursuant to the provisions of paragraph (1) and the expenses granted by the government as the administrator of the National Pension pursuant to the provisions of the preceding paragraph are deemed to be expenses required for the basic pension benefit for the purposes of applying the provisions of Article 38-2, paragraph (1) of the Supplementary Provisions and Article 85, paragraph (1) and Article 94-2 of the National Pension Act.
第一項の規定により国民年金の管掌者たる政府が負担する費用及び前項の規定により国民年金の管掌者たる政府が交付する費用は、附則第三十八条の二第一項並びに国民年金法第八十五条第一項及び第九十四条の二の規定の適用については、基礎年金の給付に要する費用とみなす。
The expenses required for benefits paid as a pension under the former National Pension Act (including old-age pensions and aggregated old-age pensions under that Act as it remains in force pursuant to the provisions of Article 31, paragraph (1) of the Supplementary Provisions) (excluding, of the expenses required for the benefit of old-age pensions or aggregated old-age pensions, the portion equivalent to the amount specified in Article 27, paragraph (2) of that Act (including where that paragraph governs pursuant to Article 29-4 of that Act), and the expenses required for the benefit of widow's pensions, old-age welfare pensions and old-age pensions paid by virtue of falling under the provisions of Article 9-3, paragraph (1) of the Supplementary Provisions of that Act) are deemed to be expenses required for the basic pension benefit for the purposes of applying the provisions of Article 38-2, paragraph (1) of the Supplementary Provisions and Article 85, paragraph (1) and Article 94-2 of the National Pension Act.
旧国民年金法による年金たる給付（附則第三十一条第一項の規定によりなおその効力を有するものとされた同法による老齢年金及び通算老齢年金を含む。）に要する費用（老齢年金又は通算老齢年金の給付に要する費用のうち同法第二十七条第二項（同法第二十九条の四においてその例による場合を含む。）に定める額に相当する部分並びに寡婦年金、老齢福祉年金及び同法附則第九条の三第一項の規定に該当することにより支給される老齢年金の給付に要する費用を除く。）は、附則第三十八条の二第一項並びに国民年金法第八十五条第一項及び第九十四条の二の規定の適用については、基礎年金の給付に要する費用とみなす。
