第二十一条（老齢特別給付金）

明治三十九年四月一日以前に生まれた者（昭和三十六年四月一日において五十五歳をこえた者）には、昭和四十九年一月から老齢特別給付金を支給する。ただし、その者が日本国民でないとき又は国民年金法による老齢福祉年金（以下この条において「老齢福祉年金」という。）の受給権者であるときは、この限りでない。

老齢特別給付金の年額は、十万八千円とする。

老齢特別給付金の受給権は、受給権者が次の各号のいずれかに該当するに至つたときは、消滅する。

死亡したとき。

日本国民でなくなつたとき。

老齢特別給付金は、国民年金法（第七十九条の二（第六項を除く。）及び第八十条を除く。）の規定の適用については、老齢福祉年金とみなす。
