第十五条（任意加入の特例）

明治三十九年四月二日から明治四十四年四月一日までの間に生まれた者（昭和三十六年四月一日において五十歳をこえ、五十五歳をこえない者）であつて、昭和三十六年四月一日において被保険者とならなかつたもののうち、第七条第二項第一号から第三号までのいずれにも該当しない者は、同項及び第七十四条の規定にかかわらず、都道府県知事に申し出て、被保険者となることができる。ただし、その者が、次の各号のいずれかに該当するときは、この限りでない。

日本国民でないとき。

日本国内に住所を有しないとき。

被用者年金各法に基づく通算老齢年金若しくは通算退職年金を受けることができるとき、又はこれらの年金の受給資格要件たる期間を満たしているとき。

第一項の申出をした者は、その申出をした日に被保険者の資格を取得するものとする。

第十三条第一項の規定は、第一項の申出があつた場合に準用する。

第一項の規定による被保険者は、いつでも、都道府県知事に申し出て、被保険者の資格を喪失することができる。

第七条第二項第一号に該当するに至つたとき。

前項の申出が受理されたとき。

保険料を滞納し、第九十六条第一項の規定による指定の期限までに、その保険料を納付しないとき。

被保険者期間（一年未満のものを除く。）と昭和三十六年四月一日以降の他の公的年金制度に係る通算対象期間（一年未満のものを除く。）とを合算した期間が十年に達したとき。

被保険者期間が五年に達したとき。

第七十八条第一項に規定する老齢年金の裁定の請求をしたとき。

第一項の規定による被保険者については、第八十七条の二、第八十九条、第九十条及び国民年金法附則第七条の二の規定を適用しない。
