第一条（施行期日等）

この法律は、公布の日から施行する。ただし、次の各号に掲げる改正規定は、それぞれ当該各号に掲げる日から施行する。

Supplementary Provisions, Article 2
第二条（従前の年金給付の額の改定）

昭和四十五年七月一日において現に老齢年金（老齢福祉年金を除く。以下同じ。）、通算老齢年金、障害年金（障害福祉年金を除く。以下同じ。）、母子年金（母子福祉年金を除く。以下同じ。）、準母子年金（準母子福祉年金を除く。以下同じ。）又は遺児年金を受ける権利を有する者に支給する当該年金給付については、同月から、その額をこの法律による改正後の第二十七条の規定を適用する第二十八条第三項（第二十九条の五において準用する場合を含む。）又はこの法律による改正後の第三十三条、第三十八条（第四十一条の三において準用する場合を含む。）若しくは第四十三条の規定を適用して計算して得た額に、それぞれ改定する。

第三条

昭和四十四年十月一日において現に障害福祉年金、母子福祉年金、準母子福祉年金又は老齢福祉年金（以下「福祉年金」という。）を受ける権利を有する者に支給する当該福祉年金については、同月から、その額をこの法律による改正後の第五十八条、第六十二条（第六十四条の四において準用する場合を含む。）又は第七十九条の二第三項の規定を適用して計算して得た額に、それぞれ改定する。

老齢年金、通算老齢年金、障害年金、母子年金、準母子年金及び遺児年金の額で昭和四十五年六月以前の月分のもの並びに障害福祉年金、母子福祉年金、準母子福祉年金及び老齢福祉年金の額で昭和四十四年九月以前の月分のもの並びに死亡一時金で昭和四十五年七月一日においてまだ支給していないものの額については、なお従前の例による。

第五条（障害年金等の支給に関する経過措置）

昭和四十五年七月一日前に別表に定める程度の障害の状態に該当しなくなつたため障害年金の受給権者でなくなつた者が、当該障害年金の支給事由となつた傷病により、同日において同表に定める程度の障害の状態にあるとき、又は同月二日から当該障害年金の受給権者でなくなつた日から起算して三年を経過した日の前日までの間において、同表に定める程度の障害の状態に該当するに至つたとき（昭和四十五年七月一日以後同表に定める程度の障害の状態に該当するに至るまでの間において、第三十五条第二号に規定する厚生大臣の定める程度の障害の状態に該当しなくなつたときを除く。）は、第三十条第一項の規定にかかわらず、その者に同条の障害年金を支給する。

第六条（福祉年金の支給停止に関する経過措置）

この法律による改正後の第六十五条第六項、第六十六条第一項及び第二項並びに第六十七条第二項（第七十九条の二においてこれらの規定を準用する場合を含む。）の規定は、昭和四十三年以降の年の所得による福祉年金の支給の停止について適用し、昭和四十二年以前の年の所得による福祉年金の支給の停止については、なお従前の例による。

夫及び妻がともに老齢福祉年金を受けることができることによる当該老齢福祉年金の支給の停止は、昭和四十四年十月以降の月分については行なわないものとし、同月前の月分の当該老齢福祉年金の支給の停止については、なお従前の例による。

第七条（国庫負担に関する経過措置）

この法律による改正後の第八十五条第一項の規定による国庫の負担は、昭和四十五年度以降の年度分から適用し、この法律による改正後の同項の規定による国庫負担の額とこの法律による改正前の同項の規定による国庫負担の額との調整に関して必要な措置は、政令で定める。

昭和四十五年六月以前の月に係る保険料については、なお従前の保険料の額による。

昭和四十七年七月以後の月分の保険料については、この法律による改正後の第八十七条第三項中「四百五十円」とあるのは、「五百五十円」とする。

第十条

昭和四十五年七月一日前に同日以後の期間に係る保険料を前納した者が、当該前納に係る期間につき追加して納付すべき保険料の額は、被保険者が三十五歳に達する日の属する月の前月までは一月につき三百五十円（昭和四十七年七月以後の各月については、四百五十円）、被保険者が三十五歳に達した日の属する月以後は一月につき三百円（昭和四十七年七月以後の各月については、四百円）とする。

前項に規定する者については、第八十七条の二第一項及び第二項中「前条第三項」とあるのは、「国民年金法の一部を改正する法律（昭和四十四年法律第八十六号）附則第十条第一項」と読み替えるものとする。

昭和四十二年一月一日から昭和四十五年六月三十日までの間に同年七月一日以後の期間について前納された保険料のうち、国民年金法の一部を改正する法律（昭和四十一年法律第九十二号）附則第十四条第一項に規定する保険料の額に相当する部分は、第一項の規定により当該期間について追加して納付すべき額の保険料に、さきに到来する月の分から順次充当するものとする。

第十三条（保険料納付の特例）

被保険者又は被保険者であつた者は、都道府県知事に申し出て、昭和四十五年七月一日前のその者の被保険者期間（国民年金法附則第六条第一項の規定による被保険者に係る被保険者期間及びこの法律附則第十五条第一項の規定による被保険者に係る被保険者期間を除く。）のうち、保険料納付済期間又は保険料免除期間以外の期間（当該期間に係る保険料を徴収する権利が時効によつて消滅している期間に限る。）について、一月につき四百五十円を納付することができる。

前項の規定による納付は、昭和四十七年六月三十日までに行なわなければならない。ただし、同日までに六十五歳に達する者は、六十五歳に達する日の前日までとする。

第十四条（任意加入被保険者の特例）

第七十五条第一項又は国民年金法附則第七条第一項の規定による被保険者であつた者であつて、第七条第二項第一号、第二号又は第三号のいずれにも該当しないものは、都道府県知事に申し出て、被保険者となることができる。ただし、日本国民でない者又は日本国内に住所を有しない者は、この限りでない。

前項の申出は、昭和四十五年九月三十日までに行なわなければならない。

第七十五条第三項から第五項まで、国民年金法附則第七条第三項並びに前条第三項及び第四項の規定は、第一項の規定による被保険者について準用する。この場合において、第七十五条第五項第四号中「被保険者期間」とあるのは、「昭和三十六年四月から国民年金法の一部を改正する法律（昭和四十四年法律第八十六号）附則第十四条第一項の申出をした日の属する月の前月までの期間とその申出をした日以降の被保険者期間とを合算した期間（他の公的年金制度に係る通算対象期間で一年未満のもの及び他の公的年金制度に係る通算対象期間以外の期間で一年未満のものを除く。）」と読み替えるものとする。

第一項の規定による被保険者が第七条第二項第一号に該当するに至つたため被保険者でなくなつた後同号に該当しなくなつた場合における国民年金法附則第七条の二の規定の適用については、同条第四項中「被保険者期間（一年未満のものを除く。）と昭和三十六年四月一日以降の他の公的年金制度に係る通算対象期間（一年未満のものを除く。）とを合算した期間」とあるのは、「昭和三十六年四月から国民年金法の一部を改正する法律（昭和四十四年法律第八十六号）附則第十四条第一項の申出をした日の属する月の前月までの期間、その申出をした日以降の被保険者期間及び同日以降の他の公的年金制度に係る通算対象期間を合算した期間（他の公的年金制度に係る通算対象期間で一年未満のもの及び他の公的年金制度に係る通算対象期間以外の期間で一年未満のものを除く。）」と読み替えるものとする。

第十五条（任意加入の特例）

明治三十九年四月二日から明治四十四年四月一日までの間に生まれた者（昭和三十六年四月一日において五十歳をこえ、五十五歳をこえない者）であつて、昭和三十六年四月一日において被保険者とならなかつたもののうち、第七条第二項第一号から第三号までのいずれにも該当しない者は、同項及び第七十四条の規定にかかわらず、都道府県知事に申し出て、被保険者となることができる。ただし、その者が、次の各号のいずれかに該当するときは、この限りでない。

日本国民でないとき。
