第三条(中小事業主に関する経過措置)
Supplementary Provisions, Article 3Transitional Measures Concerning Small and Medium-Sized Business Operators
中小事業主(その資本金の額又は出資の総額が三億円(小売業又はサービス業を主たる事業とする事業主については五千万円、卸売業を主たる事業とする事業主については一億円)以下である事業主及びその常時使用する労働者の数が三百人(小売業を主たる事業とする事業主については五十人、卸売業又はサービス業を主たる事業とする事業主については百人)以下である事業主をいう。第四項及び附則第十一条において同じ。)の事業に係る協定(新労基法第百三十九条第二項に規定する事業、第百四十条第二項に規定する業務、第百四十一条第四項に規定する者及び第百四十二条に規定する事業に係るものを除く。)についての前条の規定の適用については、「平成三十一年四月一日」とあるのは、「令和二年四月一日」とする。
With regard to the application of the provisions of the preceding Article to an agreement pertaining to the business of a small and medium-sized business operator (meaning a business operator whose amount of stated capital or total amount of contributions is 300 million yen or less (50 million yen or less for a business operator whose principal business is retail or services, and 100 million yen or less for a business operator whose principal business is wholesale) and a business operator whose number of regularly employed workers is 300 or less (50 or less for a business operator whose principal business is retail, and 100 or less for a business operator whose principal business is wholesale or services); the same applies in paragraph (4) and in Article 11 of the Supplementary Provisions) (excluding an agreement pertaining to a business prescribed in Article 139, paragraph (2), work prescribed in Article 140, paragraph (2), persons prescribed in Article 141, paragraph (4) and a business prescribed in Article 142 of the new Labor Standards Act), the term "April 1, 2019" is deemed to be replaced with "April 1, 2020".
前項の規定により読み替えられた前条の規定によりなお従前の例によることとされた協定をする使用者及び労働組合又は労働者の過半数を代表する者は、当該協定をするに当たり、新労基法第三十六条第一項から第五項までの規定により当該協定に定める労働時間を延長して労働させ、又は休日において労働させることができる時間数を勘案して協定をするように努めなければならない。
The employer and the labor union or the person representing a majority of the workers who conclude an agreement for which the provisions then in force are to remain applicable pursuant to the provisions of the preceding Article as replaced pursuant to the provisions of the preceding paragraph must, in concluding that agreement, endeavor to conclude it while taking into consideration the number of hours, to be specified in that agreement pursuant to the provisions of Article 36, paragraphs (1) through (5) of the new Labor Standards Act, for which workers may be made to work by extending working hours or may be made to work on days off.
The government is to provide the persons prescribed in the preceding paragraph with necessary information, advice and other support with regard to the agreement referred to in that paragraph.
行政官庁は、当分の間、中小事業主に対し新労基法第三十六条第九項の助言及び指導を行うに当たっては、中小企業における労働時間の動向、人材の確保の状況、取引の実態その他の事情を踏まえて行うよう配慮するものとする。
For the time being, in providing a small and medium-sized business operator with the advice and guidance referred to in Article 36, paragraph (9) of the new Labor Standards Act, the relevant government agency is to give consideration to doing so on the basis of trends in working hours at small and medium-sized enterprises, the status of securing human resources, the actual conditions of transactions and other circumstances.
