Supplementary Provisions

第一条(施行期日)

Supplementary Provisions, Article 1Effective Date

この法律は、平成十一年四月一日から施行する。ただし、第百五条の二の次に一条を加える改正規定並びに附則第八条の規定及び附則第十五条の規定(地方公務員法(昭和二十五年法律第二百六十一号)第五十八条第三項の改正規定中「及び第百二条」を「、第百二条及び第百五条の三」に改める部分に限る。)は平成十年十月一日から、第三十八条の二の次に二条を加える改正規定(第三十八条の四に係る部分に限る。)、第五十六条第一項の改正規定、同条第二項の改正規定(「満十二才」を「満十三歳」に改める部分に限る。)、第六十条第三項の改正規定(同項第二号の改正規定を除く。)及び第百六条第一項の改正規定(第三十八条の四第一項及び第五項に規定する決議に係る部分に限る。)並びに附則第六条の規定、附則第十一条第一項の規定及び附則第十五条の規定(同法第五十八条第三項の改正規定中「第三十九条第五項」を「第三十八条の四第三十九条第五項」に改める部分に限る。)は平成十二年四月一日から施行する。

This Act comes into effect as of April 1, 1999; provided, however, that the provisions adding one Article after Article 105-2, the provisions of Article 8 of the Supplementary Provisions and the provisions of Article 15 of the Supplementary Provisions (limited to the part of the provisions amending Article 58, paragraph (3) of the Local Public Service Act (Act No. 261 of 1950) that replaces "and Article 102" with ", Article 102 and Article 105-3") come into effect as of October 1, 1998, and the provisions adding two Articles after Article 38-2 (limited to the part pertaining to Article 38-4), the provisions amending Article 56, paragraph (1), the provisions amending paragraph (2) of that Article (limited to the part replacing "12 years of age" with "13 years of age"), the provisions amending Article 60, paragraph (3) (excluding the provisions amending item (ii) of that paragraph) and the provisions amending Article 106, paragraph (1) (limited to the part pertaining to the resolutions prescribed in Article 38-4, paragraphs (1) and (5)), and the provisions of Article 6 of the Supplementary Provisions, the provisions of Article 11, paragraph (1) of the Supplementary Provisions and the provisions of Article 15 of the Supplementary Provisions (limited to the part of the provisions amending Article 58, paragraph (3) of that Act that replaces "Article 39, paragraph (5)" with "Article 38-4, Article 39, paragraph (5)") come into effect as of April 1, 2000.

第二条(退職時の証明に関する経過措置)

Supplementary Provisions, Article 2Transitional Measures Concerning Certificates upon Retirement

この法律による改正後の労働基準法(以下「新法」という。)第二十二条第一項の規定は、この法律の施行の日以後に退職した労働者について適用し、この法律の施行の日前に退職した労働者については、なお従前の例による。

The provisions of Article 22, paragraph (1) of the Labor Standards Act as amended by this Act (hereinafter referred to as the "new Act") apply to a worker who retires on or after the date on which this Act comes into effect, and with regard to a worker who retired before the date on which this Act comes into effect, the provisions then in force continue to govern.

第三条(労働時間に関する経過措置)

Supplementary Provisions, Article 3Transitional Measures Concerning Working Hours

この法律による改正前の労働基準法(以下「旧法」という。)第三十二条の四の規定は、同条第一項の協定(労働時間の短縮の促進に関する臨時措置法(平成四年法律第九十号)第七条に規定する労働時間短縮推進委員会の同項に規定する事項についての決議を含む。)であって、この法律の施行の際同項第二号の対象期間として平成十一年三月三十一日を含む期間を定めているものについては、なおその効力を有する。

The provisions of Article 32-4 of the Labor Standards Act prior to amendment by this Act (hereinafter referred to as the "former Act") remain in force with respect to an agreement under paragraph (1) of that Article (including a resolution, on the matters prescribed in that paragraph, of a working hours reduction promotion committee prescribed in Article 7 of the Act on Temporary Measures for Promoting the Reduction of Working Hours (Act No. 90 of 1992)) that, at the time this Act comes into effect, sets a period that includes March 31, 1999 as the applicable period referred to in item (ii) of that paragraph.

第四条(休憩に関する経過措置)

Supplementary Provisions, Article 4Transitional Measures Concerning Breaks

この法律の施行前にされた旧法第三十四条第二項ただし書の許可の申請であって、この法律の施行の際に許可又は不許可の処分がされていないものについての許可又は不許可の処分については、なお従前の例による。

With regard to a disposition granting or denying permission on an application for the permission referred to in the proviso to Article 34, paragraph (2) of the former Act that was filed before this Act comes into effect and on which no disposition granting or denying permission has been made at the time this Act comes into effect, the provisions then in force continue to govern.

この法律の施行前に旧法第三十四条第二項ただし書の規定による許可を受けた場合(前項の規定により同項の許可を受けた場合を含む。)における休憩時間については、なお従前の例による。

With regard to breaks in the case where permission under the provisions of the proviso to Article 34, paragraph (2) of the former Act was obtained before this Act comes into effect (including the case where the permission referred to in the preceding paragraph was obtained pursuant to the provisions of that paragraph), the provisions then in force continue to govern.

第五条(年次有給休暇に関する経過措置)

Supplementary Provisions, Article 5Transitional Measures Concerning Annual Paid Leave

この法律の施行の際四月一日以外の日が基準日(継続勤務した期間を新法第三十九条第二項に規定する六箇月経過日から一年ごとに区分した各期間(最後に一年未満の期間を生じたときは、当該期間)の初日をいう。以下この条において同じ。)である労働者に係る有給休暇については、この法律の施行の日後の最初の基準日の前日までの間は、同項及び新法第三十九条第三項の規定にかかわらず、なお従前の例による。

With regard to paid leave for a worker whose base date (meaning the first day of each of the periods into which the period of continuous service is divided in one-year intervals starting from the six-month mark prescribed in Article 39, paragraph (2) of the new Act (or, if a period of less than one year arises at the end, that period); the same applies hereinafter in this Article) is a day other than April 1 at the time this Act comes into effect, the provisions then in force continue to govern until the day before the first base date after the date on which this Act comes into effect, notwithstanding the provisions of that paragraph and Article 39, paragraph (3) of the new Act.

新法第百三十五条第一項に規定する労働者であって平成十二年四月一日において継続勤務するもののうち、同日において四月一日以外の日が基準日である労働者に係る有給休暇については、同年四月一日から同日後の最初の基準日の前日までの間は、同月一日前において同項の規定により読み替えて適用する新法第三十九条第二項及び第三項の規定の例による。

With regard to paid leave for a worker who, from among the workers prescribed in Article 135, paragraph (1) of the new Act who are in continuous service on April 1, 2000, has as the base date as of that day a day other than April 1, from April 1 of that year until the day before the first base date after that day, the provisions of Article 39, paragraphs (2) and (3) of the new Act as applied before the first day of that month with the replacement of terms pursuant to that paragraph govern.

前項の規定は、新法第百三十五条第二項に規定する労働者であって平成十三年四月一日において継続勤務するものについて準用する。

The provisions of the preceding paragraph apply mutatis mutandis to a worker who is prescribed in Article 135, paragraph (2) of the new Act and who is in continuous service on April 1, 2001.

第六条(最低年齢に関する経過措置)

第五十六条第二項の改正規定(「満十二才」を「満十三歳」に改める部分に限る。以下この条において同じ。)の施行前にされた満十二歳の児童を使用する許可の申請(映画の製作又は演劇の事業に係る職業に係る申請を除く。)であって、第五十六条第二項の改正規定の施行の際に許可又は不許可の処分がされていないものについての許可又は不許可の処分については、なお従前の例による。

With regard to a disposition granting or denying permission on an application for permission to employ a child 12 years of age (excluding an application concerning an occupation in a business of motion picture production or theatrical performance) that was filed before the provisions amending Article 56, paragraph (2) (limited to the part replacing "12 years of age" with "13 years of age"; the same applies hereinafter in this Article) come into effect and on which no disposition granting or denying permission has been made at the time the provisions amending Article 56, paragraph (2) come into effect, the provisions then in force continue to govern.

第五十六条第二項の改正規定の施行前に旧法第五十六条第二項の規定による許可を受けた場合(前項の規定により同項の許可を受けた場合を含む。)における児童の使用については、なお従前の例による。

With regard to the employment of a child in the case where permission under the provisions of Article 56, paragraph (2) of the former Act was obtained before the provisions amending Article 56, paragraph (2) come into effect (including the case where the permission referred to in the preceding paragraph was obtained pursuant to the provisions of that paragraph), the provisions then in force continue to govern.

新法第五十六条第二項に規定する職業のうち、満十二歳の児童の就労実態、当該児童の就労に係る事業の社会的必要性及び当該事業の代替要員の確保の困難性を考慮して厚生労働省令で定める職業については、厚生労働省令で定める日までに行政官庁の許可を受けたときは、満十二歳の児童をその者が満十三歳に達するまでの間、その者の修学時間外に使用することができる。この場合において、第五十七条第二項第六十条第二項及び第六十一条第五項の規定の適用については、第五十七条第二項中「児童」とあるのは、「児童(労働基準法の一部を改正する法律(平成十年法律第百十二号)附則第六条第三項の規定により使用する児童を含む。第六十条第二項及び第六十一条第五項において同じ。)」とする。

With regard to an occupation specified by Order of the Ministry of Health, Labour and Welfare, from among the occupations prescribed in Article 56, paragraph (2) of the new Act, in consideration of the actual state of work of children 12 years of age, the social necessity of the business in which those children work and the difficulty of securing replacement personnel for that business, if the permission of the administrative agency is obtained by the day specified by Order of the Ministry of Health, Labour and Welfare, a child 12 years of age may be employed outside the child's school hours until the child reaches 13 years of age. In this case, with regard to the application of the provisions of Article 57, paragraph (2), Article 60, paragraph (2) and Article 61, paragraph (5), the term "child" in Article 57, paragraph (2) is deemed to be replaced with "child (including a child employed pursuant to the provisions of Article 6, paragraph (3) of the Supplementary Provisions of the Act Partially Amending the Labor Standards Act (Act No. 112 of 1998); the same applies in Article 60, paragraph (2) and Article 61, paragraph (5))".

第七条(年少者の労働時間に関する経過措置)

Supplementary Provisions, Article 7Transitional Measures Concerning Working Hours of Minors

この法律の施行の際旧法第六十条第三項に規定する者を労働させることとしている使用者については、同項第二号の規定に基づき旧法第三十二条の四第一項第二号の規定の例による対象期間として定められている期間(平成十一年三月三十一日を含む期間に限る。)が終了するまでの間、新法第六十条第三項第二号中「第三十二条の四及び第三十二条の四の二の規定」とあるのは、「労働基準法の一部を改正する法律(平成十年法律第百十二号)による改正前の第三十二条の四の規定」として、同項の規定を適用する。

With regard to an employer who, at the time this Act comes into effect, is to have a person prescribed in Article 60, paragraph (3) of the former Act work, until the end of the period set as the applicable period in accordance with the provisions of Article 32-4, paragraph (1), item (ii) of the former Act based on the provisions of item (ii) of that paragraph (limited to a period that includes March 31, 1999), the provisions of Article 60, paragraph (3) of the new Act apply by deeming the term "the provisions of Article 32-4 and Article 32-4-2" in item (ii) of that paragraph to be replaced with "the provisions of Article 32-4 prior to amendment by the Act Partially Amending the Labor Standards Act (Act No. 112 of 1998)".

第八条(紛争の解決の援助に関する経過措置)

Supplementary Provisions, Article 8Transitional Measures Concerning Assistance in Resolving Disputes

平成十一年三月三十一日までの間は、新法第百五条の三第一項中「雇用の分野における男女の均等な機会及び待遇の確保等に関する法律(昭和四十七年法律第百十三号)第十二条第一項」とあるのは、「雇用の分野における男女の均等な機会及び待遇の確保等女性労働者の福祉の増進に関する法律(昭和四十七年法律第百十三号)第十四条」とする。

Until March 31, 1999, the term "Article 12, paragraph (1) of the Act on Securing, Etc. of Equal Opportunity and Treatment between Men and Women in Employment (Act No. 113 of 1972)" in Article 105-3, paragraph (1) of the new Act is deemed to be replaced with "Article 14 of the Act on Securing, Etc. of Equal Opportunity and Treatment between Men and Women in Employment and Promotion of the Welfare of Women Workers (Act No. 113 of 1972)".

第九条(罰則に関する経過措置)

Supplementary Provisions, Article 9Transitional Measures Concerning Penal Provisions

この法律(附則第一条ただし書に規定する規定については、当該規定)の施行前にした行為並びに附則第二条及び第五条第一項の規定によりなお従前の例によることとされる事項並びに附則第三条の規定によりなお効力を有することとされる旧法第三十二条の四の規定に係る事項に係るこの法律の施行後にした行為に対する罰則の適用については、なお従前の例による。

With regard to the application of penal provisions to acts committed before this Act (or, for the provisions prescribed in the proviso to Article 1 of the Supplementary Provisions, those provisions) comes into effect and to acts committed after this Act comes into effect with respect to matters that are to be governed by the provisions then in force pursuant to the provisions of Article 2 and Article 5, paragraph (1) of the Supplementary Provisions and matters concerning the provisions of Article 32-4 of the former Act that are to remain in effect pursuant to the provisions of Article 3 of the Supplementary Provisions, the provisions then in force continue to govern.

第十条(政令への委任)

Supplementary Provisions, Article 10Delegation to Cabinet Order

附則第二条から前条までに定めるもののほか、この法律の施行に伴い必要な経過措置(罰則に関する経過措置を含む。)は、政令で定める。

Beyond what is provided for in Article 2 through the preceding Article of the Supplementary Provisions, transitional measures necessary in connection with the enforcement of this Act (including transitional measures concerning penal provisions) are specified by Cabinet Order.

第十一条(検討)

Supplementary Provisions, Article 11Review

政府は、第三十八条の二の次に二条を加える改正規定(第三十八条の四に係る部分に限る。)の施行後三年を経過した場合において、新法第三十八条の四の規定について、その施行の状況を勘案しつつ検討を加え、必要があると認めるときは、その結果に基づいて必要な措置を講ずるものとする。

In the case where three years have elapsed after the provisions adding two Articles after Article 38-2 (limited to the part pertaining to Article 38-4) come into effect, the government is to review the provisions of Article 38-4 of the new Act while taking into consideration the status of their enforcement, and, when it finds it necessary, is to take necessary measures based on the results of that review.

政府は、新法第百三十三条の厚生労働省令で定める期間が終了するまでの間において、子の養育又は家族の介護を行う労働者の時間外労働の動向、育児休業、介護休業等育児又は家族介護を行う労働者の福祉に関する法律(平成三年法律第七十六号)の施行の状況等を勘案し、当該労働者の福祉の増進の観点から、時間外労働が長時間にわたる場合には当該労働者が時間外労働の免除を請求することができる制度に関し検討を加え、その結果に基づいて必要な措置を講ずるものとする。

Until the end of the period specified by Order of the Ministry of Health, Labour and Welfare referred to in Article 133 of the new Act, the government is to take into consideration trends in overtime work by workers who are raising children or caring for family members, the status of enforcement of the Act on Childcare Leave, Caregiver Leave, and Other Measures for the Welfare of Workers Caring for Children or Other Family Members (Act No. 76 of 1991), and other circumstances, and, from the standpoint of promoting the welfare of those workers, to review a system under which those workers may request exemption from overtime work in the case where overtime work extends over long hours, and is to take necessary measures based on the results of that review.

第十二条(深夜業に関する自主的な努力の促進)

Supplementary Provisions, Article 12Promotion of Voluntary Efforts Concerning Night Work

国は、深夜業に従事する労働者の就業環境の改善、健康管理の推進等当該労働者の就業に関する条件の整備のための事業主、労働者その他の関係者の自主的な努力を促進するものとする。

The State is to promote the voluntary efforts of business operators, workers and other persons concerned toward the development of conditions concerning the employment of workers engaged in night work, such as the improvement of the working environment of those workers and the promotion of their health management.
