Supplementary Provisions

第一条(施行期日)

Supplementary Provisions, Article 1Effective Date

この法律は、平成三十一年四月一日から施行する。ただし、次の各号に掲げる規定は、当該各号に定める日から施行する。

This Act comes into effect on April 1, 2019; provided, however, that the provisions set forth in the following items come into effect as of the days specified in those items.

第三条の規定並びに附則第七条第二項第八条第二項第十四条及び第十五条の規定、附則第十八条中社会保険労務士法(昭和四十三年法律第八十九号)別表第一第十八号の改正規定、附則第十九条中高年齢者等の雇用の安定等に関する法律(昭和四十六年法律第六十八号)第二十八条及び第三十八条第三項の改正規定、附則第二十条中建設労働者の雇用の改善等に関する法律(昭和五十一年法律第三十三号)第三十条第二項の改正規定、附則第二十七条の規定、附則第二十八条中厚生労働省設置法(平成十一年法律第九十七号)第四条第一項第五十二号の改正規定及び同法第九条第一項第四号の改正規定(「(平成十年法律第四十六号)」の下に「、労働施策の総合的な推進並びに労働者の雇用の安定及び職業生活の充実等に関する法律」を加える部分に限る。)並びに附則第三十条の規定 公布の日

第二条(時間外及び休日の労働に係る協定に関する経過措置)

Supplementary Provisions, Article 2Transitional Measures Concerning Agreements on Off-Hours Work and Work on Days Off

第一条の規定による改正後の労働基準法(以下「新労基法」という。)第三十六条の規定(新労基法第百三十九条第二項第百四十条第二項第百四十一条第四項及び第百四十二条の規定により読み替えて適用する場合を含む。)は、平成三十一年四月一日以後の期間のみを定めている協定について適用し、同年三月三十一日を含む期間を定めている協定については、当該協定に定める期間の初日から起算して一年を経過する日までの間については、なお従前の例による。

The provisions of Article 36 of the Labor Standards Act as amended by the provisions of Article 1 (hereinafter referred to as "the new Labor Standards Act") (including the case where those provisions are applied with the replacement of terms pursuant to the provisions of Article 139, paragraph (2), Article 140, paragraph (2), Article 141, paragraph (4) and Article 142 of the new Labor Standards Act) apply to an agreement that specifies only a period on or after April 1, 2019, and with regard to an agreement that specifies a period that includes March 31 of that year, the provisions then in force continue to govern until the day on which one year elapses counting from the first day of the period specified in that agreement.

第三条(中小事業主に関する経過措置)

Supplementary Provisions, Article 3Transitional Measures Concerning Small and Medium-Sized Business Operators

中小事業主(その資本金の額又は出資の総額が三億円(小売業又はサービス業を主たる事業とする事業主については五千万円、卸売業を主たる事業とする事業主については一億円)以下である事業主及びその常時使用する労働者の数が三百人(小売業を主たる事業とする事業主については五十人、卸売業又はサービス業を主たる事業とする事業主については百人)以下である事業主をいう。第四項及び附則第十一条において同じ。)の事業に係る協定(新労基法第百三十九条第二項に規定する事業、第百四十条第二項に規定する業務、第百四十一条第四項に規定する者及び第百四十二条に規定する事業に係るものを除く。)についての前条の規定の適用については、「平成三十一年四月一日」とあるのは、「令和二年四月一日」とする。

With regard to the application of the provisions of the preceding Article to an agreement pertaining to the business of a small and medium-sized business operator (meaning a business operator whose amount of stated capital or total amount of contributions is 300 million yen or less (50 million yen or less for a business operator whose principal business is retail or services, and 100 million yen or less for a business operator whose principal business is wholesale) and a business operator whose number of regularly employed workers is 300 or less (50 or less for a business operator whose principal business is retail, and 100 or less for a business operator whose principal business is wholesale or services); the same applies in paragraph (4) and in Article 11 of the Supplementary Provisions) (excluding an agreement pertaining to a business prescribed in Article 139, paragraph (2), work prescribed in Article 140, paragraph (2), persons prescribed in Article 141, paragraph (4) and a business prescribed in Article 142 of the new Labor Standards Act), the term "April 1, 2019" is deemed to be replaced with "April 1, 2020".

前項の規定により読み替えられた前条の規定によりなお従前の例によることとされた協定をする使用者及び労働組合又は労働者の過半数を代表する者は、当該協定をするに当たり、新労基法第三十六条第一項から第五項までの規定により当該協定に定める労働時間を延長して労働させ、又は休日において労働させることができる時間数を勘案して協定をするように努めなければならない。

The employer and the labor union or the person representing a majority of the workers who conclude an agreement for which the provisions then in force are to remain applicable pursuant to the provisions of the preceding Article as replaced pursuant to the provisions of the preceding paragraph must, in concluding that agreement, endeavor to conclude it while taking into consideration the number of hours, to be specified in that agreement pursuant to the provisions of Article 36, paragraphs (1) through (5) of the new Labor Standards Act, for which workers may be made to work by extending working hours or may be made to work on days off.

政府は、前項に規定する者に対し、同項の協定に関して、必要な情報の提供、助言その他の支援を行うものとする。

The government is to provide the persons prescribed in the preceding paragraph with necessary information, advice and other support with regard to the agreement referred to in that paragraph.

行政官庁は、当分の間、中小事業主に対し新労基法第三十六条第九項の助言及び指導を行うに当たっては、中小企業における労働時間の動向、人材の確保の状況、取引の実態その他の事情を踏まえて行うよう配慮するものとする。

For the time being, in providing a small and medium-sized business operator with the advice and guidance referred to in Article 36, paragraph (9) of the new Labor Standards Act, the relevant government agency is to give consideration to doing so on the basis of trends in working hours at small and medium-sized enterprises, the status of securing human resources, the actual conditions of transactions and other circumstances.

第四条(年次有給休暇に関する経過措置)

Supplementary Provisions, Article 4Transitional Measures Concerning Annual Paid Leave

この法律の施行の際四月一日以外の日が基準日(継続勤務した期間を労働基準法第三十九条第二項に規定する六箇月経過日から一年ごとに区分した各期間(最後に一年未満の期間を生じたときは、当該期間をいう。以下この条において同じ。)の初日をいい、同法第三十九条第一項から第三項までの規定による有給休暇を当該有給休暇に係る当該各期間の初日より前の日から与えることとした場合はその日をいう。以下この条において同じ。)である労働者に係る有給休暇については、この法律の施行の日後の最初の基準日の前日までの間は、新労基法第三十九条第七項の規定にかかわらず、なお従前の例による。

With regard to paid leave pertaining to a worker for whom, at the time this Act comes into effect, a day other than April 1 is the base date (meaning the first day of each sub-period (or, if a final period of less than one year arises, meaning that period; the same applies hereinafter in this Article) into which the period of continuous employment is divided in one-year units beginning at the six-month mark prescribed in Article 39, paragraph (2) of the Labor Standards Act, or, in the case where paid leave under the provisions of Article 39, paragraphs (1) through (3) of that Act is to be granted from a day earlier than the first day of the sub-period to which that paid leave pertains, meaning that day; the same applies hereinafter in this Article), notwithstanding the provisions of Article 39, paragraph (7) of the new Labor Standards Act, the provisions then in force continue to govern until the day before the first base date after the date on which this Act comes into effect.

第十二条(検討)

Supplementary Provisions, Article 12Review

政府は、この法律の施行後五年を経過した場合において、新労基法第三十六条の規定について、その施行の状況、労働時間の動向その他の事情を勘案しつつ検討を加え、必要があると認めるときは、その結果に基づいて所要の措置を講ずるものとする。

If five years have elapsed since this Act came into effect, the government is to review the provisions of Article 36 of the new Labor Standards Act while taking into consideration the status of their enforcement, trends in working hours and other circumstances, and, when it finds it necessary, is to take the required measures based on the results of that review.

政府は、新労基法第百三十九条に規定する事業及び新労基法第百四十条に規定する業務に係る新労基法第三十六条の規定の特例の廃止について、この法律の施行後の労働時間の動向その他の事情を勘案しつつ引き続き検討するものとする。

The government is to continue to consider the abolition of the special provisions concerning Article 36 of the new Labor Standards Act for the businesses prescribed in Article 139 of the new Labor Standards Act and the work prescribed in Article 140 of the new Labor Standards Act, while taking into consideration trends in working hours after this Act comes into effect and other circumstances.

政府は、前二項に定める事項のほか、この法律の施行後五年を目途として、この法律による改正後のそれぞれの法律(以下この項において「改正後の各法律」という。)の規定について、労働者使用者の協議の促進等を通じて、仕事と生活の調和、労働条件の改善、雇用形態又は就業形態の異なる労働者の間の均衡のとれた待遇の確保その他の労働者の職業生活の充実を図る観点から、改正後の各法律の施行の状況等を勘案しつつ検討を加え、必要があると認めるときは、その結果に基づいて所要の措置を講ずるものとする。

Beyond the matters provided for in the preceding two paragraphs, the government is, with a target of five years after this Act comes into effect, to review the provisions of the respective Acts as amended by this Act (hereinafter referred to in this paragraph as the "respective Acts as amended") from the perspective of achieving harmony between work and life, improving working conditions, securing balanced treatment among workers with different forms of employment or forms of work, and otherwise enriching the vocational lives of workers, through the promotion of consultation between workers and employers and other means, while taking into consideration the status of enforcement of the respective Acts as amended and other circumstances, and, when it finds it necessary, is to take the required measures based on the results of that review.

第二十九条(罰則に関する経過措置)

Supplementary Provisions, Article 29Transitional Measures Concerning Penal Provisions

この法律(附則第一条第三号に掲げる規定にあっては、当該規定)の施行前にした行為並びにこの附則の規定によりなお従前の例によることとされる場合及びこの附則の規定によりなおその効力を有することとされる場合におけるこの法律の施行後にした行為に対する罰則の適用については、なお従前の例による。

With regard to the application of penal provisions to conduct engaged in before this Act (or, for the provisions set forth in Article 1, item (iii) of the Supplementary Provisions, those provisions) comes into effect and to conduct engaged in after this Act comes into effect in the case where the provisions then in force are to remain applicable pursuant to the provisions of these Supplementary Provisions and in the case where provisions are to remain in force pursuant to the provisions of these Supplementary Provisions, the provisions then in force continue to govern.

第三十条(政令への委任)

Supplementary Provisions, Article 30Delegation to Cabinet Order

この附則に規定するもののほか、この法律の施行に伴い必要な経過措置(罰則に関する経過措置を含む。)は、政令で定める。

Beyond what is prescribed in these Supplementary Provisions, the transitional measures necessary in connection with the enforcement of this Act (including transitional measures concerning penal provisions) are specified by Cabinet Order.
