第三条（障害厚生年金等の支給及び額の改定等に関する経過措置）
Supplementary Provisions, Article 3Transitional Measures Concerning Payment, Revision of the Amount, etc. of the Disability Employees' Pension, etc.
The provisions of the Appended Table of the New National Pension Order and Appended Table I of the Order for Enforcement of the Employees' Pension Insurance Act as amended by the provisions of Article 2 (referred to as the "New Employees' Pension Insurance Order" in the following paragraph and paragraph (6)) apply to the payment of the disability employees' pension, etc. (meaning the disability employees' pension and other benefits that are pensions paid according to a degree of disability falling under a disability grade prescribed in Article 47, paragraph (2) of the Employees' Pension Insurance Act; hereinafter the same in this Article) for a month on or after the month following the month that includes the Effective Date, and the provisions then in force continue to govern the payment of the disability employees' pension, etc. for a month on or before the month that includes the Effective Date.
新国年令別表及び第二条の規定による改正後の厚生年金保険法施行令（次項及び第六項において「新厚年令」という。）別表第一の規定は、施行日の属する月の翌月以後の月分の障害厚生年金等（障害厚生年金その他の厚生年金保険法第四十七条第二項に規定する障害等級に該当する障害の程度に応じて支給される年金たる給付をいう。以下この条において同じ。）の支給について適用し、施行日の属する月以前の月分の障害厚生年金等の支給については、なお従前の例による。
The provisions of Appended Table II of the New Employees' Pension Insurance Order apply to the payment of a disability allowance for which the right to receive arises on or after the Effective Date, and the provisions then in force continue to govern the payment of a disability allowance for which the right to receive arose before the Effective Date.
新厚年令別表第二の規定は、施行日以後に受給権が発生する障害手当金の支給について適用し、施行日前に受給権が発生した障害手当金の支給については、なお従前の例による。
A beneficiary of the disability employees' pension, etc. whose right to receive it arose before the Effective Date (limited to a person whose degree of disability falls under the state of disability of grade 2 prescribed in the Appended Table of the Former National Pension Order) and whose degree of disability comes to fall under the state of disability of grade 1 prescribed in the Appended Table of the New National Pension Order as a result of the enforcement of this Cabinet Order, or a beneficiary of the disability employees' pension, etc. whose right to receive it arose before the Effective Date (limited to a person whose degree of disability falls under the state of disability prescribed in Appended Table I of the Order for Enforcement of the Employees' Pension Insurance Act prior to amendment by the provisions of Article 2) and whose degree of disability comes to fall under the state of disability of grade 2 prescribed in the Appended Table of the New National Pension Order as a result of the enforcement of this Cabinet Order, may request the administering body of the system relating to benefits of the disability employees' pension, etc. to revise the amount of that disability employees' pension, etc.
施行日前に受給権が発生した障害厚生年金等の受給権者（その障害の程度が旧国年令別表に定める二級の障害の状態に該当する者に限る。）であって、この政令の施行によりその障害の程度が新国年令別表に定める一級の障害の状態に該当することとなったもの又は施行日前に受給権が発生した障害厚生年金等の受給権者（その障害の程度が第二条の規定による改正前の厚生年金保険法施行令別表第一に定める障害の状態に該当する者に限る。）であって、この政令の施行によりその障害の程度が新国年令別表に定める二級の障害の状態に該当することとなったものは、障害厚生年金等の給付に係る制度の管掌機関に対し、当該障害厚生年金等の額の改定を請求することができる。
The administering body of the system relating to benefits of the disability employees' pension, etc. may revise the amount of the disability employees' pension, etc. when a request under the preceding paragraph is made.
障害厚生年金等の給付に係る制度の管掌機関は、前項の規定による請求があったときは、障害厚生年金等の額を改定することができる。
The provisions of paragraph (3) do not apply to a person aged 65 or over who is a beneficiary of the disability employees' pension, etc. (limited to a person who does not hold the right to receive the disability basic pension based on the same ground for payment as that disability employees' pension, etc.).
第三項の規定は、六十五歳以上の者であって、かつ、障害厚生年金等の受給権者（当該障害厚生年金等と同一の支給事由に基づく障害基礎年金の受給権を有しない者に限る。）については、適用しない。
A beneficiary of a disability allowance whose right to receive it arose before the Effective Date and whose degree of disability comes to fall under the state of disability prescribed in Appended Table I of the New Employees' Pension Insurance Order as a result of the enforcement of this Cabinet Order may, on or after the day on which two years have elapsed from the day on which that right to receive arose and until the day preceding the day on which the beneficiary reaches the age of 65, claim payment of a disability employees' pension from the implementing organization prescribed in Article 2-5, paragraph (1) of the Employees' Pension Insurance Act.
施行日前に受給権が発生した障害手当金の受給権者であって、この政令の施行によりその障害の程度が新厚年令別表第一に定める障害の状態に該当することとなったものは、当該受給権が発生した日から起算して二年を経過した日以後六十五歳に達する日の前日までの間に、厚生年金保険法第二条の五第一項に規定する実施機関に対し、障害厚生年金の支給を請求することができる。
The provisions of Article 47-2, paragraph (3) of the Employees' Pension Insurance Act apply mutatis mutandis to a claim under the preceding paragraph.
厚生年金保険法第四十七条の二第三項の規定は、前項の規定による請求について準用する。
