附 則
Supplementary Provisions
This Cabinet Order comes into effect on January 1, 2017.
この政令は、平成二十九年一月一日から施行する。
In the case of applying Article 26, paragraph (1) of the Employees' Pension Insurance Act to an insured person covered by employees' pension insurance, or a person who was an insured person, who began to raise a child who falls under the persons prescribed in Article 1-3 of the Order for Enforcement of the Employees' Pension Insurance Act as amended by the provisions of Article 3 (excluding a child prescribed in Article 3, paragraph (1) of the Act on Childcare Leave, etc. of Diet Officers (Act No. 108 of 1991) prior to the amendment by the Act Partially Amending the Act on Childcare Leave, etc. of Diet Officers (Act No. 83 of 2016), Article 3, paragraph (1) of the Act on Childcare Leave, etc. of National Public Officers (Act No. 109 of 1991) prior to the amendment by the provisions of Article 3 of the Act Partially Amending the Act on Remuneration of Officials in the Regular Service, etc. (Act No. 80 of 2016) (including where applied mutatis mutandis pursuant to Article 27, paragraph (1) of the Act on Childcare Leave, etc. of National Public Officers and the Act on Temporary Measures concerning Court Officials (Act No. 299 of 1951) (limited to the part pertaining to item (vii))), Article 2, paragraph (1) of the Act on Childcare Leave, etc. of Local Public Officers (Act No. 110 of 1991) prior to the amendment by the provisions of Article 1 of the Act Partially Amending the Act on Childcare Leave, etc. of Local Public Officers and the Act on Childcare Leave, Caregiver Leave, and Other Measures for the Welfare of Workers Caring for Children or Other Family Members (Act No. 95 of 2016), and Article 2, paragraph (1) of the Act on Childcare Leave for Judges (Act No. 111 of 1991) prior to the amendment by the Act Partially Amending the Act on Childcare Leave for Judges (Act No. 96 of 2016)) before January 1, 2017, and who, on or after that day as well, continuously raises or raised that child, in that paragraph, the phrase "the day on which the person started to raise that child (" is deemed to be replaced with "January 1, 2017 (", the phrase "the month before the month that includes the day on which the person began to raise the child" with "December 2016", and the phrase "the month in question" with "that month".
平成二十九年一月一日前に第三条の規定による改正後の厚生年金保険法施行令第一条の三に規定する者に該当する者（国会職員の育児休業等に関する法律の一部を改正する法律（平成二十八年法律第八十三号）による改正前の国会職員の育児休業等に関する法律（平成三年法律第百八号）第三条第一項、一般職の職員の給与に関する法律等の一部を改正する法律（平成二十八年法律第八十号）第三条の規定による改正前の国家公務員の育児休業等に関する法律（平成三年法律第百九号）第三条第一項（同法第二十七条第一項及び裁判所職員臨時措置法（昭和二十六年法律第二百九十九号）（第七号に係る部分に限る。）において準用する場合を含む。）、地方公務員の育児休業等に関する法律及び育児休業、介護休業等育児又は家族介護を行う労働者の福祉に関する法律の一部を改正する法律（平成二十八年法律第九十五号）第一条の規定による改正前の地方公務員の育児休業等に関する法律（平成三年法律第百十号）第二条第一項及び裁判官の育児休業に関する法律の一部を改正する法律（平成二十八年法律第九十六号）による改正前の裁判官の育児休業に関する法律（平成三年法律第百十一号）第二条第一項に規定する子を除く。）の養育を開始し、同日以後も引き続き当該者を養育し、又は養育していた厚生年金保険の被保険者又は被保険者であった者について厚生年金保険法第二十六条第一項の規定を適用する場合には、同項中「当該子を養育することとなつた日（」とあるのは「平成二十九年一月一日（」と、「当該子を養育することとなつた日の属する月の前月」とあるのは「平成二十八年十二月」と、「当該月」とあるのは「同月」とする。
