Supplementary Provisions, Article 9-4-11Special Provisions on Retroactive Payment of Premiums Relating to a Specified Reason
第九条の四の十一（特定事由に係る保険料の追納の特例）
An insured person or a person who was an insured person may, when having a period falling under any of the following items (excluding a premium-paid period; referred to in paragraph (3) as the "period eligible for retroactive payment"), make a request to that effect to the Minister of Health, Labour and Welfare.
A period found to be one during which the person became unable to make retroactive payment under the provisions of Article 94 due to a specified reason; or
A period deemed to be a specified partial exemption period under the provisions of Article 9-4-7, paragraph (4) of the Supplementary Provisions; or
附則第九条の四の七第四項の規定により特定一部免除期間とみなされた期間
A period deemed to be a specified full exemption period under the provisions of Article 9-4-7, paragraph (6) of the Supplementary Provisions.
附則第九条の四の七第六項の規定により特定全額免除期間とみなされた期間
The Minister of Health, Labour and Welfare is, when finding that the request under the preceding paragraph (limited to one relating to item (i) of that paragraph) is well-founded, or when there has been a request under that paragraph (limited to one relating to item (ii) or item (iii) of that paragraph), to approve that request.
A person who made the request under paragraph (1) may, when having received approval under the provisions of the preceding paragraph, make retroactive payment of the whole or part of the premium for each month of the period eligible for retroactive payment to which that approval relates (limited to a premium treated as not required to be paid under the provisions of Article 89, paragraph (1), Article 90, paragraph (1) or Article 90-3, paragraph (1), and a premium for which part of the amount is treated as not required to be paid under the provisions of Article 90-2, paragraphs (1) through (3)). However, with respect to a premium for which part of the amount is treated as not required to be paid under the provisions of paragraphs (1) through (3) of that Article, this is limited to a case where the remaining amount has been paid.
第一項の申出をした者は、前項の規定による承認を受けたときは、当該承認に係る追納対象期間の各月の保険料（第八十九条第一項、第九十条第一項又は第九十条の三第一項の規定により納付することを要しないものとされた保険料及び第九十条の二第一項から第三項までの規定によりその一部の額につき納付することを要しないものとされた保険料に限る。）の全部又は一部につき追納をすることができる。ただし、同条第一項から第三項までの規定によりその一部の額につき納付することを要しないものとされた保険料については、その残余の額につき納付されたときに限る。
Retroactive payment under the provisions of the preceding paragraph is to be made in order, starting with the premium for the month that elapsed earliest.
前項の規定による追納は、先に経過した月の分の保険料から順次に行うものとする。
The amount to be paid retroactively in the case referred to in paragraph (3) is the amount obtained by adding the amount specified by Cabinet Order to the amount of the premium for each month of the period to which that retroactive payment relates.
第三項の場合において追納すべき額は、当該追納に係る期間の各月の保険料の額に政令で定める額を加算した額とする。
The provisions of Article 9-4-9, paragraphs (6) through (8) of the Supplementary Provisions apply mutatis mutandis to the case referred to in paragraph (3). In this case, the necessary replacement of terms is specified by Cabinet Order.
附則第九条の四の九第六項から第八項までの規定は、第三項の場合に準用する。この場合において、必要な読替えは、政令で定める。
The provisions of Article 9-4-7, paragraphs (9) and (10) of the Supplementary Provisions apply mutatis mutandis to approval under the provisions of paragraph (2).
附則第九条の四の七第九項及び第十項の規定は、第二項の規定による承認について準用する。
Beyond what is provided for in the preceding paragraphs, the procedure for the request under paragraph (1) and any other matters necessary concerning the application of the provisions of the preceding paragraphs are specified by Cabinet Order.
