Supplementary Provisions, Article 5Voluntarily Insured Persons
第五条（任意加入被保険者）
A person falling under any of the following items (excluding a category 2 insured person and a category 3 insured person) may, notwithstanding the provisions of Article 7, paragraph (1), apply to the Minister of Health, Labour and Welfare and become an insured person.
A person who has an address in Japan and is 20 years of age or older but under 60 years of age, and who is entitled to receive old-age benefits, etc. under the Employees' Pension Insurance Act (excluding a person specified by Order of the Ministry of Health, Labour and Welfare as a person for whom there is a special reason that this Act should not apply);
日本国内に住所を有する二十歳以上六十歳未満の者であつて、厚生年金保険法に基づく老齢給付等を受けることができるもの（この法律の適用を除外すべき特別の理由がある者として厚生労働省令で定める者を除く。）
A person who has an address in Japan and is 60 years of age or older but under 65 years of age (excluding a person specified by Order of the Ministry of Health, Labour and Welfare as a person for whom there is a special reason that this Act should not apply); or
日本国内に住所を有する六十歳以上六十五歳未満の者（この法律の適用を除外すべき特別の理由がある者として厚生労働省令で定める者を除く。）
A person who has Japanese nationality or is otherwise a person specified by Cabinet Order, and who does not have an address in Japan and is 20 years of age or older but under 65 years of age.
日本国籍を有する者その他政令で定める者であつて、日本国内に住所を有しない二十歳以上六十五歳未満のもの
Where a person falling under item (i) or item (ii) of the preceding paragraph intends to make a request under the provisions of that paragraph, the person must make, to the Minister of Health, Labour and Welfare, a request stating that the person wishes for payment by account transfer, or a request stating that the case falls under a case specified by Order of the Ministry of Health, Labour and Welfare as a case where there is a justifiable reason for not making payment by account transfer.
A person who has made a request under the provisions of the preceding paragraph (in the case of a person listed in item (iii) of paragraph (1), under the provisions of that paragraph) is to acquire status as an insured person on the day on which the person made that request.
An insured person under the provisions of paragraph (1) may, at any time, apply to the Minister of Health, Labour and Welfare and lose status as an insured person.
第一項の規定による被保険者は、いつでも、厚生労働大臣に申し出て、被保険者の資格を喪失することができる。
An insured person under the provisions of paragraph (1) loses status as an insured person on the day following the day on which the person comes to fall under Article 9, item (i), or on the day on which the person comes to fall under any of the following items.
The person has reached 65 years of age;
六十五歳に達したとき。
The person has acquired status as an insured person of Employees' Pension Insurance;
厚生年金保険の被保険者の資格を取得したとき。
The request under the preceding paragraph has been accepted; or
前項の申出が受理されたとき。
The total number of months obtained by adding together the numbers of months listed in the items of Article 27 has reached 480.
第二十七条各号に掲げる月数を合算した月数が四百八十に達したとき。
An insured person who is a person listed in item (i) of paragraph (1) loses status as an insured person, in addition to under the provisions of the preceding paragraph, on the day following the day on which the person comes to fall under any of the following items (or, where the person acquires status as an insured person again on the day on which the person comes to fall under item (i), or comes to fall under item (ii) or item (iii), on that day).
The person has ceased to have an address in Japan;
日本国内に住所を有しなくなつたとき。
The person has ceased to fall under a person who is entitled to receive old-age benefits, etc. under the Employees' Pension Insurance Act;
厚生年金保険法に基づく老齢給付等を受けることができる者に該当しなくなつたとき。
The person has become a dependent spouse;
被扶養配偶者となつたとき。
The person is in arrears with premiums and does not pay those premiums by the designated time limit under the provisions of Article 96, paragraph (1); or
保険料を滞納し、第九十六条第一項の規定による指定の期限までに、その保険料を納付しないとき。
The person has become a person specified by Order of the Ministry of Health, Labour and Welfare as a person for whom there is a special reason that this Act should not apply.
この法律の適用を除外すべき特別の理由がある者として厚生労働省令で定める者となつたとき。
An insured person who is a person listed in item (ii) of paragraph (1) loses status as an insured person, in addition to under the provisions of paragraph (5), on the day following the day on which the person comes to fall under any of item (i), item (iv) and item (v) of the preceding paragraph (or, where the person acquires status as an insured person again on the day on which the person comes to fall under item (i) of that paragraph, on that day).
An insured person who is a person listed in item (iii) of paragraph (1) loses status as an insured person, in addition to under the provisions of paragraph (5), on the day following the day on which the person comes to fall under any of the following items (or, where the person acquires status as an insured person again on the day on which that fact occurred, on that day).
The person has come to have an address in Japan;
日本国内に住所を有するに至つたとき。
The person has ceased to fall under either a person who has Japanese nationality or a person specified by Cabinet Order and prescribed in item (iii) of paragraph (1);
日本国籍を有する者及び第一項第三号に規定する政令で定める者のいずれにも該当しなくなつたとき。
The person has become a dependent spouse (limited to a case where the person is under 60 years of age); or
被扶養配偶者となつたとき（六十歳未満であるときに限る。）。
The person is in arrears with premiums and, after that, two years have passed without the premiums having been paid.
保険料を滞納し、その後、保険料を納付することなく二年間が経過したとき。
An insured person under the provisions of paragraph (1) is, for the purpose of applying the provisions of Article 87-2, deemed to be a category 1 insured person, and the insured period as that insured person is deemed to be, for the purpose of applying the provisions of Article 5, paragraph (1), the insured period as an insured person prescribed in Article 7, paragraph (1), item (i), and, for the purpose of applying the provisions of Article 49 through Article 52-6 and Article 9-3 and Article 9-3-2 of the Supplementary Provisions, the insured period as a category 1 insured person, respectively.
The provisions of Article 88-2 through Article 90-3 do not apply to an insured person under the provisions of paragraph (1).
第一項の規定による被保険者については、第八十八条の二から第九十条の三までの規定を適用しない。
An insured person under the provisions of paragraph (1) (excluding a person listed in item (i) of that paragraph; the same applies in paragraph (13)) is, for the purpose of applying the provisions of Article 116, paragraphs (1) and (2), and Article 127, paragraph (1), deemed to be a category 1 insured person.
An insured person under the provisions of paragraph (1) (limited to a person listed in item (iii) of that paragraph) may, notwithstanding the provisions of Article 127, paragraph (1), apply to the regional fund for the district in which the person had an address, or the occupation-based fund of which the person was a member, and become a member of the regional fund or the occupation-based fund. In this case, for the purpose of applying the provisions of Article 116, paragraphs (1) and (2), and Article 127, paragraph (3), the phrase "a person who has" in Article 116, paragraph (1) is deemed to be replaced with "a person who has or had", the phrase "a person engaged in" in paragraph (2) of that Article is deemed to be replaced with "a person engaged in or who was engaged in", the phrase "a member of the regional fund" in Article 127, paragraph (3), item (ii) is deemed to be replaced with "a member of the regional fund (excluding a person who became a member under the provisions of Article 5, paragraph (12) of the Supplementary Provisions)", and the phrase "a member of the occupation-based fund" is deemed to be replaced with "a member of the occupation-based fund (excluding a person who became a member under the provisions of that paragraph)".
第一項の規定による被保険者（同項第三号に掲げる者に限る。）は、第百二十七条第一項の規定にかかわらず、その者が住所を有していた地区に係る地域型基金又はその者が加入していた職能型基金に申し出て、地域型基金又は職能型基金の加入員となることができる。この場合における第百十六条第一項及び第二項並びに第百二十七条第三項の規定の適用については、第百十六条第一項中「有する者」とあるのは「有する者及び有していた者」と、同条第二項中「従事する者」とあるのは「従事する者及び従事していた者」と、第百二十七条第三項第二号中「地域型基金の加入員」とあるのは「地域型基金の加入員（附則第五条第十二項の規定により加入員となつた者を除く。）」と、「職能型基金の加入員」とあるのは「職能型基金の加入員（同項の規定により加入員となつた者を除く。）」とする。
For the purpose of applying the provisions of Article 130, paragraph (2) (excluding a case where it is applied mutatis mutandis under Article 137-17, paragraph (5)) and Article 34, paragraph (4), item (i) of the Supplementary Provisions of the Act Partially Amending the National Pension Act, etc. (Act No. 34 of 1985; hereinafter referred to as the "1985 Amendment Act"), in a case where an insured person under the provisions of paragraph (1) is an early leaver and has again become a member of the original National Pension Fund, the phrase "the period during which the person was a member of that fund" in Article 130, paragraph (2) is deemed to be replaced with "the period during which the person was a member of that fund, excluding the period that is the basis for calculating the amount of the pension or lump-sum payment for which the National Pension Fund Association (meaning the National Pension Fund Association prescribed in Article 137-4) is liable to pay", the phrase "means the membership period prescribed in Article 130, paragraph (2) of that Act; the same applies below in this item" in Article 34, paragraph (4), item (i) of the Supplementary Provisions of the 1985 Amendment Act is deemed to be replaced with "means the membership period prescribed in Article 130, paragraph (2) of that Act as applied by replacing terms under the provisions of Article 5, paragraph (13) of the Supplementary Provisions of that Act", and the phrase "the number of months of the membership period" is deemed to be replaced with "the number of months of the period during which the person was a member". In this case, the provisions of Article 137-18 do not apply.
第一項の規定による被保険者が中途脱退者であつて再びもとの基金の加入員となつた場合における第百三十条第二項（第百三十七条の十七第五項において準用する場合を除く。）及び国民年金法等の一部を改正する法律（昭和六十年法律第三十四号。以下「昭和六十年改正法」という。）附則第三十四条第四項第一号の規定の適用については、第百三十条第二項中「当該基金の加入員であつた期間」とあるのは「当該基金の加入員であつた期間であつて、連合会（第百三十七条の四に規定する連合会をいう。）がその支給に関する義務を負つている年金又は一時金の額の計算の基礎となる期間を除いたもの」と、昭和六十年改正法附則第三十四条第四項第一号中「同法第百三十条第二項に規定する加入員期間をいう。以下この号において同じ」とあるのは「同法附則第五条第十三項の規定により読み替えて適用する同法第百三十条第二項に規定する加入員期間をいう」と、「加入員期間の月数」とあるのは「加入員であつた期間の月数」とする。この場合においては、第百三十七条の十八の規定は、適用しない。
