国民年金の被保険者又は被保険者であつた者（国民年金法による老齢年金及び通算老齢年金の受給権者を除く。）は、都道府県知事に申し出て、昭和五十三年四月一日前のその者の国民年金の被保険者期間（同法第七十五条第一項、附則第六条第一項及び附則第七条第一項、国民年金法の一部を改正する法律（昭和四十四年法律第八十六号）附則第十五条第一項並びに厚生年金保険法等の一部を改正する法律（昭和四十八年法律第九十二号）附則第十九条第一項の規定による被保険者に係る被保険者期間を除く。）のうち、国民年金の保険料納付済期間及び保険料免除期間以外の期間（当該期間に係る国民年金の保険料を徴収する権利が時効によつて消滅している期間に限る。）について、一月につき四千円を納付することができる。

前項の規定による納付は、昭和五十五年六月三十日までに行わなければならない。

第一項の規定による納付は、先に経過した月の分から順次行うものとする。

第一項の規定により納付が行われたときは、納付が行われた日に、納付に係る月の国民年金の保険料が納付されたものとみなす。

国民年金法第七十八条第一項に定める老齢年金の受給資格要件たる期間を満たしていない者が、第一項の規定による納付を行うことにより、六十五歳に達した後に同法第七十八条第一項に定める老齢年金の受給資格要件たる期間を満たしたときは、同項の規定にかかわらず、その者に同条の老齢年金を支給する。
