第二条（国民年金法の一部改正に伴う経過措置）

昭和四十五年十月一日において現に障害福祉年金、母子福祉年金、準母子福祉年金又は老齢福祉年金（以下「福祉年金」という。）を受ける権利を有する者に支給する当該福祉年金については、同月から、その額をこの法律による改正後の国民年金法第五十八条、第六十二条（第六十四条の四において準用する場合を含む。）又は第七十九条の二第三項の規定を適用して計算して得た額に、それぞれ改定する。

昭和四十五年九月以前の月分の福祉年金の額については、なお従前の例による。

この法律による改正後の国民年金法第六十六条及び第六十七条第二項（第七十九条の二第五項においてこれらの規定を準用する場合を含む。）の規定は、昭和四十四年以降の年の所得による福祉年金の支給の停止について適用し、昭和四十三年以前の年の所得による福祉年金の支給の停止については、なお従前の例による。

この法律による改正後の国民年金法第七十九条の二第五項中「第六十五条」とあるのは、昭和四十五年九月三十日までは、「第六十五条（第三項を除く。）」と読み替えるものとする。
