第二条(労働時間に関する経過措置)

With respect to the working hours pertaining to the week that includes March 31, 2001, the provisions then in force continue to govern, notwithstanding the provisions of Article 25-2, paragraph (1) of the Ordinance for Enforcement of the Labor Standards Act as amended by this Ministerial Ordinance (hereinafter referred to as the "new Rules").

平成十三年三月三十一日を含む一週間に係る労働時間については、この省令による改正後の労働基準法施行規則(以下「新規則」という。)第二十五条の二第一項の規定にかかわらず、なお従前の例による。

With respect to a worker whom, at the time this Ministerial Ordinance comes into effect, an employer has arranged to have work pursuant to the provisions of Article 25-2, paragraph (2) of the Ordinance for Enforcement of the Labor Standards Act prior to the amendment by this Ministerial Ordinance (hereinafter referred to as the "former Rules"), with respect to the working hours pertaining to the period of an agreement, etc. under the former Rules that includes March 31, 2001, from among the fixed periods of not more than one month specified by an agreement based on the provisions of that paragraph or by the rules of employment or an equivalent instrument, or the settlement periods referred to in item (ii) of Article 25-2, paragraph (3) of the former Rules specified by an agreement based on the provisions of that paragraph or by an agreement, the provisions then in force continue to govern, notwithstanding the provisions of Article 25-2, paragraphs (2) and (3) of the new Rules.

この省令の施行の際使用者がこの省令による改正前の労働基準法施行規則(以下「旧規則」という。)第二十五条の二第二項の規定により労働させることとしている労働者に関しては、同項の規定に基づく協定による、又は就業規則その他これに準ずるものによる定めをしている一箇月以内の一定の期間又は旧規則第二十五条の二第三項の規定に基づく協定による、又は協定による定めをしている同項第二号の清算期間のうち平成十三年三月三十一日を含む旧規則による協定等の期間に係る労働時間については、新規則第二十五条の二第二項及び第三項の規定にかかわらず、なお従前の例による。
