Supplementary Provisions, Article 1Effective Date

第一条(施行期日)

This Ministerial Ordinance comes into effect as of April 1, 1991.

この省令は、平成三年四月一日から施行する。

Supplementary Provisions, Article 2Interim Measures

第二条(暫定措置)

Until March 31, 1993, with respect to the application of the provisions of Article 26 of the Ordinance for Enforcement of the Labor Standards Act after the amendment, the term "44 hours" in that Article is deemed to be replaced with "46 hours".

平成五年三月三十一日までの間は、改正後の労働基準法施行規則第二十六条の規定の適用については、同条中「四十四時間」とあるのは、「四十六時間」とする。

Supplementary Provisions, Article 3

第三条

Until March 31, 1992, an employer may, notwithstanding the provisions of Article 32 of the Labor Standards Act, have fire defense personnel and full-time members of fire corps work up to 46 hours per week and up to eight hours per day.

使用者は、消防職員及び常勤の消防団員については、平成四年三月三十一日までの間は、労働基準法第三十二条の規定にかかわらず、一週間について四十六時間、一日について八時間まで労働させることができる。

If an employer has established, through the rules of employment or anything equivalent thereto, that the working hours per week averaged over a fixed period not exceeding eight weeks will not exceed 46 hours, the employer may, notwithstanding the provisions of the preceding paragraph, have the persons prescribed in that paragraph work more than 46 hours in a specified week or more than eight hours on a specified day, in accordance with that provision.

使用者は、就業規則その他これに準ずるものにより、八週間以内の一定の期間を平均し一週間当たりの労働時間が四十六時間を超えない定めをした場合には、前項に規定する者については、同項の規定にかかわらず、その定めにより、特定された週において四十六時間又は特定された日において八時間を超えて、労働させることができる。
