Supplementary Provisions, Article 3-2

With regard to surviving employees' pension funds prescribed in Article 3, item (xi) of the Supplementary Provisions of the Act Partially Amending the Employees' Pension Insurance Act, etc. for Ensuring the Soundness and Reliability of the Public Pension System (Act No. 63 of 2013) (excluding those for which a structure for the management and investment of reserve funds for pension benefits, etc. prescribed in Article 136-3, paragraph (4) of the Employees' Pension Insurance Act (Act No. 115 of 1954) prior to its amendment by the provisions of Article 1 of the Act Partially Amending the Employees' Pension Insurance Act, etc. for Ensuring the Soundness and Reliability of the Public Pension System, which is to remain in force pursuant to the provisions of Article 5, paragraph (1) of the Supplementary Provisions of that amending Act, has been established and for which the notification under the provisions of Article 176, paragraph (2) of the Employees' Pension Insurance Act prior to that amendment has been made), the provisions of Article 34-3, paragraph (1) (including where applied mutatis mutandis pursuant to Article 2-2 of the Act on Engagement in Trust Business by Financial Institutions, Articles 11-5 and 11-27 of the Agricultural Co-operatives Act, Article 11-11 of the Fishery Industry Cooperative Act (including where applied mutatis mutandis pursuant to Article 92, paragraph (1), Article 96, paragraph (1), and Article 100, paragraph (1) of that Act), Article 6-5-11 of the Act on Financial Businesses by Cooperative (Act No. 183 of 1949), Article 89-2 of the Shinkin Bank Act, Article 17-2 of the Long Term Credit Bank Act (Act No. 187 of 1952), Article 94-2 of the Labor Bank Act (Act No. 227 of 1953), Article 13-4 of the Banking Act (including where applied mutatis mutandis pursuant to Article 10, paragraph (1) of the Act on Development Bank of Japan Inc. (Act No. 85 of 2007)) and Articles 52-2-5 and 52-60-17 of the Banking Act, Article 300-2 of the Insurance Business Act, Article 31, paragraph (2) of the Act on the Provision of Financial Services and the Development of the Accessible Environment Thereto, Articles 59-3 and 59-7 of the Norinchukin Bank Act, Article 24-2 of the Trust Business Act (including where applied mutatis mutandis pursuant to Article 99, paragraph (8) of the Insurance Business Act (including where applied mutatis mutandis pursuant to Article 199 of that Act)), Article 29 of the Shoko Chukin Bank Limited Act (Act No. 74 of 2007), and Article 62-17, paragraph (1) of the Payment Services Act) do not apply for the time being.
