Supplementary Provisions

This Act comes into effect as of the date specified by Cabinet Order within a period not exceeding six months from the date of promulgation; provided, however, that the provisions amending Article 48 and the provisions amending Article 62, paragraph (4), the provisions of the following Article, and the provisions of Article 3 of the Supplementary Provisions (limited to the portions pertaining to the provisions amending Article 48 and the provisions amending Article 62, paragraph (4)) come into effect as of the date of promulgation.

The provisions of the proviso to Article 48 of the Securities and Exchange Act as amended apply to the purchase and sale of securities, securities index, etc. futures transactions, securities option transactions, or foreign market securities futures transactions (hereinafter in this Article referred to as "securities trade, etc.") concluded on or after the day on which enforcement takes place under the proviso to the preceding Article (hereinafter in this Article referred to as the "Partial Effective Date"), and the provisions then in force continue to govern securities trade, etc. concluded before the Partial Effective Date.

With regard to the application of penal provisions to acts committed before the enforcement of this Act (in the case of the provisions amending Article 48 and the provisions amending Article 62, paragraph (4), meaning enforcement pursuant to the proviso to Article 1 of the Supplementary Provisions; the same applies hereinafter) and to acts committed after the enforcement of this Act that relate to matters for which the provisions then in force are to continue to govern pursuant to the provisions of these Supplementary Provisions, the provisions then in force continue to govern.

Beyond what is provided for in these Supplementary Provisions, transitional measures necessary incidental to the enforcement of this Act are specified by Cabinet Order.
