Supplementary Provisions, Article 1Effective Date

第一条（施行期日）

This Act comes into effect on April 1, 2004; provided, however, that the provisions set forth in the following items come into effect on the dates specified respectively in those items:

この法律は、平成十六年四月一日から施行する。ただし、次の各号に掲げる規定は、当該各号に定める日から施行する。

Supplementary Provisions, Article 2Transitional Measures Concerning Major Shareholders of Securities Companies, etc.

第二条（証券会社等の主要株主に関する経過措置）

A person who, at the time this Act comes into effect, is a major shareholder of a securities company (meaning a securities company prescribed in as amended by the provisions of (hereinafter referred to as the "New Securities and Exchange Act"); the same applies hereinafter in this Article) (meaning a major shareholder prescribed in of the New Securities and Exchange Act; the same applies hereinafter in this Article), or a major shareholder of a holding company (meaning a holding company prescribed in ) that has a securities company as its subsidiary company (meaning a subsidiary company prescribed in of the New Securities and Exchange Act) (hereinafter in this Article referred to as a "major shareholder of a securities company, etc."), is deemed to have become that major shareholder of a securities company, etc. on the day this Act comes into effect (hereinafter referred to as "the effective date").

この法律の施行の際現に証券会社（の規定による改正後の証券取引法（以下「新証券取引法」という。）に規定する証券会社をいう。以下この条において同じ。）の主要株主（に規定する主要株主をいう。以下この条において同じ。）又は証券会社を子会社（に規定する子会社をいう。）とする持株会社（に規定する持株会社をいう。）の主要株主（以下この条において「証券会社等の主要株主」という。）に該当する者は、この法律の施行の日（以下「施行日」という。）において当該証券会社等の主要株主となったものとみなす。

第三条（外務員に対する監督上の処分に関する経過措置）

The provisions of (limited to ) of the New Securities and Exchange Act apply to acts on or after the effective date.

（に限る。）の規定は、施行日以後の行為について適用する。

Supplementary Provisions, Article 38Transitional Measures Concerning the Application of Penal Provisions

第三十八条（罰則の適用に関する経過措置）

With regard to the application of penal provisions to acts committed before this Act comes into effect, the provisions then in force continue to govern.

この法律の施行前にした行為に対する罰則の適用については、なお従前の例による。

Supplementary Provisions, Article 39Delegation of Other Transitional Measures to Cabinet Order

第三十九条（その他の経過措置の政令への委任）

Beyond what is provided for in this Act, transitional measures necessary in connection with the enforcement of this Act are specified by Cabinet Order.

この法律に規定するもののほか、この法律の施行に伴い必要な経過措置は、政令で定める。

Supplementary Provisions, Article 40Review

第四十条（検討）

Once five years have passed after this Act comes into effect, the government is to take into account the implementation status of the provisions amended by this Act and the changes in socioeconomic conditions, review the financial system amended by this Act, and take the required measures based on the results of the review if it finds this to be necessary.

政府は、この法律の施行後五年を経過した場合において、この法律による改正後の規定の実施状況、社会経済情勢の変化等を勘案し、この法律による改正後の金融諸制度について検討を加え、必要があると認めるときは、その結果に基づいて所要の措置を講ずるものとする。
