第二条(経過措置)

With respect to the number of days specified by Order of the Ministry of Health, Labour and Welfare in consideration of the ratio between the number of days specified by Order of the Ministry of Health, Labour and Welfare as the number of prescribed working days per week for an ordinary worker referred to in Article 39, paragraph (3) of the Labor Standards Act (hereinafter referred to as the "Act") and the number of prescribed working days per week or the average number of prescribed working days per week for the worker concerned, for a worker who has been in continuous service for more than six months before the date on which this Ministerial Ordinance comes into effect (hereinafter referred to as the "effective date"), whose base date (meaning the day following the day on which the period of continuous service prescribed in Article 39, paragraph (1) of the Act ends; the same applies hereinafter in this Article) is a day other than April 1, and whose prescribed working hours per week are less than 30 hours, the provisions then in force continue to govern until the day preceding the first base date after the effective date, notwithstanding the provisions of Article 24-3, paragraph (3) of the Ordinance for Enforcement of the Labor Standards Act as amended (hereinafter referred to as the "new Rules").

この省令の施行の日(以下「施行日」という。)前に六箇月を超えて継続勤務している労働者であって四月一日以外の日が基準日労働基準法(以下「法」という。)第三十九条第一項に定める継続勤務の期間の終了する日の翌日をいう。以下この条において同じ。)であるもののうち一週間の所定労働時間が三十時間未満のものに係る法第三十九条第三項の通常の労働者の一週間の所定労働日数として厚生労働省令で定める日数と当該労働者の一週間の所定労働日数又は一週間当たりの平均所定労働日数との比率を考慮して厚生労働省令で定める日数は、施行日後の最初の基準日の前日までの間は、改正後の労働基準法施行規則(以下「新規則」という。)第二十四条の三第三項の規定にかかわらず、なお従前の例による。
