Supplementary Provisions, Article 8

第八条

In each business year from the business year following the business year prescribed in paragraph (1) of the preceding Article to the business year that includes the day on which the liquidation account of the fund to which a securities company belongs is abolished pursuant to the provisions of Article 10 of the Supplementary Provisions, if the amount of the obligations pertaining to the borrowings that have come to vest in the liquidation account pursuant to the provisions of paragraph (2) of the preceding Article exceeds the amount of the assets belonging to the liquidation account, the securities company must, in addition to the burden charges under the provisions of Article 79-64, paragraph (1), pay burden charges to the fund as funds for the fund to apply to the performance of those obligations, as provided by the operational rules.

The provisions of Article 79-64, paragraph (2), Article 79-65, paragraph (1), and Article 79-66 apply mutatis mutandis to the burden charges set forth in the preceding paragraph.

The amount of the burden charges under the provisions of paragraph (1) is not to be less than the amount obtained by multiplying the calculation base amount by the burden charge rate that the Prime Minister and the Minister of Finance specify in consideration of the amount required for the performance of the obligations pertaining to the borrowings that have come to vest in the liquidation account pursuant to the provisions of paragraph (2) of the preceding Article.
