A performer has the exclusive right to broadcast and cablecast that performer's performance.
The provisions of the preceding paragraph do not apply in the following cases:
前項の規定は、次に掲げる場合には、適用しない。
a performance whose sound or visuals have been recorded with the authorization of the owner of the right provided for in paragraph (1) of the preceding Article;
a performance referred to in paragraph (2) of the preceding Article that has undergone sound recording or visual recording on an object other than a sound recording referred to in that paragraph.
録音権及び録画権
前項の規定は、同項に規定する権利を有する者の許諾を得て映画の著作物において録音され、又は録画された実演については、これを録音物（音を専ら影像とともに再生することを目的とするものを除く。）に録音する場合を除き、適用しない。

著作物を、演劇的に演じ、舞い、演奏し、歌い、口演し、朗詠し、又はその他の方法により演ずること（これらに類する行為で、著作物を演じないが芸能的な性質を有するものを含む。）
