Chapter I General Provisions

第一章 総則

Article 1Purpose

第一条(目的)

The purpose of this Act is to elevate the status of workers by promoting their being on equal standing with their employer in their negotiations with the employer; to defend the exercise by workers of voluntary organization and association in labor unions so that they may carry out collective action, including the designation of representatives of their own choosing to negotiate working conditions; and to promote the practice of collective bargaining, and procedures therefore, for the purpose of concluding collective agreements regulating relations between employers and workers.

この法律は、労働者が使用者との交渉において対等の立場に立つことを促進することにより労働者の地位を向上させること、労働者がその労働条件について交渉するために自ら代表者を選出することその他の団体行動を行うために自主的に労働組合を組織し、団結することを擁護すること並びに使用者と労働者との関係を規制する労働協約を締結するための団体交渉をすること及びその手続を助成することを目的とする。

The provisions of are to apply to collective bargaining and other acts of labor unions which are justifiable and have been performed for the attainment of the purpose of the preceding paragraph, provided, however, that in any case exercises of violence must not be construed as justifiable acts of labor unions.

の規定は、労働組合の団体交渉その他の行為であつて前項に掲げる目的を達成するためにした正当なものについて適用があるものとする。但し、いかなる場合においても、暴力の行使は、労働組合の正当な行為と解釈されてはならない。

Article 2Labor Unions

第二条(労働組合)

The term "labor unions" as used in this Act means those organizations, or federations thereof, formed voluntarily and composed mainly of workers for the main purposes of maintaining and improving working conditions and raising the economic status of the workers; provided, however, that this does not apply to cases that fall under any of the following items:

この法律で「労働組合」とは、労働者が主体となつて自主的に労働条件の維持改善その他経済的地位の向上を図ることを主たる目的として組織する団体又はその連合団体をいう。但し、左の各号の一に該当するものは、この限りでない。

organizations that allow participation by workers in supervisory positions having direct authority with respect to executives, hiring, dismissal, promotions, or transfers; workers in supervisory positions having access to confidential information relating to plans and policies on the employer's labor relationships so that their official duties and responsibilities directly conflict with their sincerity and responsibilities as members of the labor union; and other persons who represent the interests of the employer;

役員、雇入解雇昇進又は異動に関して直接の権限を持つ監督的地位にある労働者、使用者の労働関係についての計画と方針とに関する機密の事項に接し、そのためにその職務上の義務と責任とが当該労働組合の組合員としての誠意と責任とに直接にてい触する監督的地位にある労働者その他使用者の利益を代表する者の参加を許すもの

organizations that receive the employer's financial assistance in paying the organizations' operational expenditures; provided, however, that this does not prevent the employer from permitting workers to deliberate or negotiate with the employer during working hours without loss of time or wages, and excludes the employer's contributions for public welfare funds or welfare and other funds which are actually used for payments to prevent or relieve economic adversity or misfortunes, or to the provision of office of minimum space;

団体の運営のための経費の支出につき使用者の経理上の援助を受けるもの。但し、労働者が労働時間中に時間又は賃金を失うことなく使用者と協議し、又は交渉することを使用者が許すことを妨げるものではなく、且つ、厚生資金又は経済上の不幸若しくは災厄を防止し、若しくは救済するための支出に実際に用いられる福利その他の基金に対する使用者の寄附及び最小限の広さの事務所の供与を除くものとする。

organizations whose purposes are limited to mutual aid projects or other welfare businesses;

共済事業その他福利事業のみを目的とするもの

organizations whose purposes are principally political or social movements.

主として政治運動又は社会運動を目的とするもの

Article 3Workers

第三条(労働者)

The term "workers" as used in this Act means those persons who live on their wages, salaries, or other equivalent income, regardless of the kind of occupation.

この法律で「労働者」とは、職業の種類を問わず、賃金、給料その他これに準ずる収入によつて生活する者をいう。

Chapter II Labor Unions

第二章 労働組合

Article 5Treatment of an Organization Established as a Labor Union

第五条(労働組合として設立されたものの取扱)

Unless a labor union has submitted evidence to the Labour Relations Commission and proved that it is in compliance with Article 2 and paragraph (2) of this Article, the labor union is not qualified to participate in the procedures provided in this Act and will not be granted the remedies provided in this Act; provided, however, that nothing herein should be construed as to deny protections for individual workers pursuant to Article 7, item (i).

労働組合は、労働委員会に証拠を提出して第二条及び第二項の規定に適合することを立証しなければ、この法律に規定する手続に参与する資格を有せず、且つ、この法律に規定する救済を与えられない。但し、第七条第一号の規定に基く個々の労働者に対する保護を否定する趣旨に解釈されるべきではない。

The constitution of a labor union must include the provisions listed in the following items:

労働組合の規約には、左の各号に掲げる規定を含まなければならない。

name;

名称

the location of its principal office;

主たる事務所の所在地

that the members of a labor union other than the labor union that is a federation (hereinafter referred to as a "local union") have the right to participate in all issues or disputes of the labor union and have the right to receive equal treatment;

連合団体である労働組合以外の労働組合(以下「単位労働組合」という。)の組合員は、その労働組合のすべての問題に参与する権利及び均等の取扱を受ける権利を有すること。

no one will be disqualified from union membership in any case on the basis of race, religion, sex, family origin or status;

何人も、いかなる場合においても、人種、宗教、性別、門地又は身分によつて組合員たる資格を奪われないこと。

in the case of a local labor union, that the officers are elected by direct secret vote of the union members, and, in the case of a federation or a labor union having national scope, that the officers are elected by direct secret vote either of the members of the local unions or of delegates elected by direct secret vote of the members of the local unions;

単位労働組合にあつては、その役員は、組合員の直接無記名投票により選挙されること、及び連合団体である労働組合又は全国的規模をもつ労働組合にあつては、その役員は、単位労働組合の組合員又はその組合員の直接無記名投票により選挙された代議員の直接無記名投票により選挙されること。

that a general assembly meeting is held at least once every year;

総会は、少くとも毎年一回開催すること。

that a financial report showing all sources of revenues and expenditures, the names of main contributors and the current financial status, together with a certificate by a professionally qualified accounting auditor commissioned by the union members proving that the reports are accurate are released to the union members at least once every year,

すべての財源及び使途、主要な寄附者の氏名並びに現在の経理状況を示す会計報告は、組合員によつて委嘱された職業的に資格がある会計監査人による正確であることの証明書とともに、少くとも毎年一回組合員に公表されること。

that no strike is to be started without a majority decision made by direct secret vote either of the union members or of delegates elected by direct secret vote of the union members;

同盟罷業は、組合員又は組合員の直接無記名投票により選挙された代議員の直接無記名投票の過半数による決定を経なければ開始しないこと。

in the case of local labor union, that its constitution will not be amended unless the amendment has received majority support by direct secret vote of the union members, and, in the case of a labor union which is a federation or a labor union which has national scope, the constitution will not be amended unless the amendment has received majority support by direct secret vote either of the members of the local labor unions or of the delegates elected by direct secret vote of the members of the local labor unions.

単位労働組合にあつては、その規約は、組合員の直接無記名投票による過半数の支持を得なければ改正しないこと、及び連合団体である労働組合又は全国的規模をもつ労働組合にあつては、その規約は、単位労働組合の組合員又はその組合員の直接無記名投票により選挙された代議員の直接無記名投票による過半数の支持を得なければ改正しないこと。

Article 6Authority to Negotiate

第六条(交渉権限)

Representatives of a labor union or those to whom the authority has been delegated by the labor union have authority to negotiate with the employer or the employers' organization on behalf of the labor union or the members of the labor union with respect to conclusion of collective agreements and other matters.

労働組合の代表者又は労働組合の委任を受けた者は、労働組合又は組合員のために使用者又はその団体と労働協約の締結その他の事項に関して交渉する権限を有する。

Article 7Unfair Labor Practices

第七条(不当労働行為)

The employer must not commit the acts listed in any of the following items:

使用者は、次の各号に掲げる行為をしてはならない。

to dismiss or otherwise treat in a disadvantageous manner a worker by reason of the worker being a member of a labor union, having tried to join or organize a labor union, or having performed justifiable acts of a labor union; or to make it a condition of employment that the worker will not join or will withdraw from a labor union; provided, however, that this does not preclude a worker from concluding a collective agreement which requires, as a condition of employment, that the workers will be members of such labor union where a labor union represents a majority of workers employed at a particular factory or workplace;

労働者が労働組合の組合員であること、労働組合に加入し、若しくはこれを結成しようとしたこと若しくは労働組合の正当な行為をしたことの故をもつて、その労働者を解雇し、その他これに対して不利益な取扱いをすること又は労働者が労働組合に加入せず、若しくは労働組合から脱退することを雇用条件とすること。ただし、労働組合が特定の工場事業場に雇用される労働者の過半数を代表する場合において、その労働者がその労働組合の組合員であることを雇用条件とする労働協約を締結することを妨げるものではない。

to refuse to bargain collectively with the representatives of the workers employed by the employer without legitimate grounds;

使用者が雇用する労働者の代表者と団体交渉をすることを正当な理由がなくて拒むこと。

to control or interfere with the formation or management of a labor union by workers or to give financial assistance in paying the labor union's operational expenditures; provided, however, that this does not preclude the employer from permitting workers to deliberate or negotiate with the employer during working hours without loss of time or wage, and this excludes the employer's contributions for public welfare funds or welfare and other funds which are actually used for payments to prevent or relieve economic adversity or misfortunes, or to the provision of office of minimum space;

労働者が労働組合を結成し、若しくは運営することを支配し、若しくはこれに介入すること、又は労働組合の運営のための経費の支払につき経理上の援助を与えること。ただし、労働者が労働時間中に時間又は賃金を失うことなく使用者と協議し、又は交渉することを使用者が許すことを妨げるものではなく、かつ、厚生資金又は経済上の不幸若しくは災厄を防止し、若しくは救済するための支出に実際に用いられる福利その他の基金に対する使用者の寄附及び最小限の広さの事務所の供与を除くものとする。

to dismiss or otherwise treat in a disadvantageous manner a worker for the reason that the worker has filed a motion with the Labour Relations Commission that the employer has violated the provisions of this Article; that the worker has requested the Central Labour Relations Commission to review an order issued under the provisions of Article 27-12, paragraph (1); or that when the Labour Relations Commission has conducted an investigation or a hearing in regard to these motions, or has made a recommendation of a settlement to the party, or has made an adjustment of labor disputes as provided for under the Labor Relations Adjustment Act (Act No. 25 of 1946), the worker has presented evidence or made a statement.

労働者が労働委員会に対し使用者がこの条の規定に違反した旨の申立てをしたこと若しくは中央労働委員会に対し第二十七条の十二第一項の規定による命令に対する再審査の申立てをしたこと又は労働委員会がこれらの申立てに係る調査若しくは審問をし、若しくは当事者に和解を勧め、若しくは労働関係調整法(昭和二十一年法律第二十五号)による労働争議の調整をする場合に労働者が証拠を提示し、若しくは発言をしたことを理由として、その労働者を解雇し、その他これに対して不利益な取扱いをすること。

Article 8Compensation of Damages

第八条(損害賠償)

An employer may not claim compensation against a labor union or a union member for damages received through a strike or other acts of dispute which are justifiable acts.

使用者は、同盟罷業その他の争議行為であつて正当なものによつて損害を受けたことの故をもつて、労働組合又はその組合員に対し賠償を請求することができない。

Article 9Diversion of Funds

第九条(基金の流用)

When a labor union seeks to divert funds specially set up for mutual aid projects and other welfare businesses for other purposes, it must obtain a resolution of the general assembly meeting of the union.

労働組合は、共済事業その他福利事業のために特設した基金を他の目的のために流用しようとするときは、総会の決議を経なければならない。

Article 10Dissolution

第十条(解散)

A labor union will be dissolved due to the following causes:

労働組合は、左の事由によつて解散する。

emergence of causes of dissolution as provided in the constitution of the labor union;

規約で定めた解散事由の発生

resolution for dissolution at the general assembly meeting of the labor union by at least three-fourths of majority of the union members or of the affiliated organizations.

組合員又は構成団体の四分の三以上の多数による総会の決議

Article 11Labor Union That is a Corporation

第十一条(法人である労働組合)

A labor union which has received certification by the Labour Relations Commission that it is in compliance with the provisions of this Act is incorporated by registering at the location of its main office.

この法律の規定に適合する旨の労働委員会の証明を受けた労働組合は、その主たる事務所の所在地において登記することによつて法人となる。

The matters necessary for registration of labor unions in addition to what is provided for in this Act are prescribed by Cabinet Order.

この法律に規定するものの外、労働組合の登記に関して必要な事項は、政令で定める。

The information necessary for registration of labor unions may not be duly asserted against a third party until registration has been made.

労働組合に関して登記すべき事項は、登記した後でなければ第三者に対抗することができない。

Article 12Representatives

第十二条(代表者)

A labor union that is a corporation must have one or more representatives.

法人である労働組合には、一人又は数人の代表者を置かなければならない。

In the case where there are two or more representatives, if the constitution does not provide otherwise, the affairs of the labor union that is a corporation are decided by a majority of the representatives.

代表者が数人ある場合において、規約に別段の定めがないときは、法人である労働組合の事務は、代表者の過半数で決する。

Article 12-2Representation of a Labor Union That is a Corporation

第十二条の二(法人である労働組合の代表)

A representative represents the labor union that is a corporation in all of the affairs of the labor union that is a corporation; provided, however, that the representative may not act contrary to the provisions of the constitution, and must also follow the resolutions at the general assembly meeting.

代表者は、法人である労働組合のすべての事務について、法人である労働組合を代表する。ただし、規約の規定に反することはできず、また、総会の決議に従わなければならない。

Article 12-3Limitations on the Authority of Representation of Representatives

第十二条の三(代表者の代表権の制限)

With regard to the management of a labor union that is a corporation, a limitation placed on the authority of representation of a representative may not be duly asserted against a third party in good faith.

法人である労働組合の管理については、代表者の代表権に加えた制限は、善意の第三者に対抗することができない。

Article 12-4Delegation of Acts as Agent by Representatives

第十二条の四(代表者の代理行為の委任)

With regard to the management of a labor union that is a corporation, a representative may delegate to another person the authority to act as agent for specific acts only when this is not prohibited by the constitution or by a resolution at the general assembly meeting.

法人である労働組合の管理については、代表者は、規約又は総会の決議によつて禁止されていないときに限り、特定の行為の代理を他人に委任することができる。

Article 12-5Acts Involving a Conflict of Interest

第十二条の五(利益相反行為)

With regard to a matter in which the interests of a labor union that is a corporation and those of a representative conflict, such as the labor union that is a corporation guaranteeing an obligation of the representative or any other matter in dealings with a person other than the representative, the representative does not have the authority of representation. In this case, the court must appoint a special agent at the request of an interested person.

法人である労働組合が代表者の債務を保証することその他代表者以外の者との間において法人である労働組合と代表者との利益が相反する事項については、代表者は、代表権を有しない。この場合においては、裁判所は、利害関係人の請求により、特別代理人を選任しなければならない。

Article 12-6Mutatis Mutandis Application of the Act on General Incorporated Associations and General Incorporated Foundations

第十二条の六(一般社団法人及び一般財団法人に関する法律の準用)

The provisions of and (excluding the case provided for in Article 8) of the apply mutatis mutandis to a labor union that is a corporation.

及び(第八条に規定する場合を除く。)の規定は、法人である労働組合について準用する。

Article 13Capacity of a Labor Union That is a Corporation in Liquidation

第十三条(清算中の法人である労働組合の能力)

A labor union that is a corporation which has dissolved is deemed to continue to exist until the completion of its liquidation, within the scope of the purpose of the liquidation.

解散した法人である労働組合は、清算の目的の範囲内において、その清算の結了に至るまではなお存続するものとみなす。

Article 13-2Liquidators

第十三条の二(清算人)

When a labor union that is a corporation has dissolved, its representatives become its liquidators; provided, however, that this does not apply when the constitution provides otherwise, or when a person other than a representative has been appointed at the general assembly meeting.

法人である労働組合が解散したときは、代表者がその清算人となる。ただし、規約に別段の定めがあるとき、又は総会において代表者以外の者を選任したときは、この限りでない。

Article 13-3Appointment of a Liquidator by the Court

第十三条の三(裁判所による清算人の選任)

When there is no person who is to become a liquidator pursuant to the provisions of the preceding Article, or when there is a risk that damage will arise because of a vacancy in the position of liquidator, the court may appoint a liquidator at the request of an interested person.

前条の規定により清算人となる者がないとき、又は清算人が欠けたため損害を生ずるおそれがあるときは、裁判所は、利害関係人の請求により、清算人を選任することができる。

Article 13-4Dismissal of Liquidators

第十三条の四(清算人の解任)

When there are serious grounds, the court may dismiss a liquidator at the request of an interested person.

重要な事由があるときは、裁判所は、利害関係人の請求により、清算人を解任することができる。

Article 13-5Registration of Liquidators and of Dissolution

第十三条の五(清算人及び解散の登記)

A liquidator must, within two weeks after the dissolution, register at the location of the principal office the liquidator's name and address, and the cause and date of the dissolution.

清算人は、解散後二週間以内に、主たる事務所の所在地において、その氏名及び住所並びに解散の原因及び年月日の登記をしなければならない。

A liquidator who has assumed office during the liquidation must, within two weeks after assuming office, register at the location of the principal office the liquidator's name and address.

清算中に就職した清算人は、就職後二週間以内に、主たる事務所の所在地において、その氏名及び住所の登記をしなければならない。

Article 13-6Duties and Authority of a Liquidator

第十三条の六(清算人の職務及び権限)

The duties of a liquidator are as follows:

清算人の職務は、次のとおりとする。

the conclusion of current business;

現務の結了

the collection of debts and the performance of obligations; and

債権の取立て及び債務の弁済

delivery of residual assets.

残余財産の引渡し

A liquidator may perform any act necessary to carry out the duties listed in the items of the preceding paragraph.

清算人は、前項各号に掲げる職務を行うために必要な一切の行為をすることができる。

Article 13-7Demand for Submission of Claims, etc.

第十三条の七(債権の申出の催告等)

Within two months from the day on which a liquidator takes office, the liquidator must demand that creditors file their claims within a stated period of time, by giving public notice on at least three occasions. In such a case, the stated period of time may not be shorter than two months.

清算人は、その就職の日から二月以内に、少なくとも三回の公告をもつて、債権者に対し、一定の期間内にその債権の申出をすべき旨の催告をしなければならない。この場合において、その期間は、二月を下ることができない。

The public notice under the preceding paragraph must include a statement that a creditor who does not submit a claim within that period is to be excluded from the liquidation; provided, however, that a liquidator may not exclude a known creditor.

前項の公告には、債権者がその期間内に申出をしないときは清算から除斥されるべき旨を付記しなければならない。ただし、清算人は、知れている債権者を除斥することができない。

A liquidator must separately demand that each known creditor submit a claim.

清算人は、知れている債権者には、各別にその申出の催告をしなければならない。

The public notice under paragraph (1) is given by publication in the Official Gazette.

第一項の公告は、官報に掲載してする。

Article 13-8Submission of a Claim after Expiration of the Period

第十三条の八(期間経過後の債権の申出)

A creditor who submits a claim after the expiration of the period under paragraph (1) of the preceding Article may make a claim only against the assets that, after the obligations of the labor union that is a corporation have been fully discharged, have not yet been delivered to the persons to whom the rights are to vest.

前条第一項の期間の経過後に申出をした債権者は、法人である労働組合の債務が完済された後まだ権利の帰属すべき者に引き渡されていない財産に対してのみ、請求をすることができる。

Article 13-9Commencement of Bankruptcy Proceedings for a Labor Union That is a Corporation in Liquidation

第十三条の九(清算中の法人である労働組合についての破産手続の開始)

When it has become clear during liquidation that the assets of a labor union that is a corporation are insufficient to fully discharge its obligations, the liquidator must immediately file a petition for commencement of bankruptcy proceedings and give public notice to that effect.

清算中に法人である労働組合の財産がその債務を完済するのに足りないことが明らかになつたときは、清算人は、直ちに破産手続開始の申立てをし、その旨を公告しなければならない。

In the case where a labor union that is a corporation in liquidation has become subject to an order commencing bankruptcy proceedings, the liquidator's duties are to be terminated when the liquidator has transferred the liquidator's affairs to the bankruptcy trustee.

清算人は、清算中の法人である労働組合が破産手続開始の決定を受けた場合において、破産管財人にその事務を引き継いだときは、その任務を終了したものとする。

In the case provided for in the preceding paragraph, if the labor union that is a corporation in liquidation has already paid anything to creditors or delivered anything to the persons to whom the rights are to vest, the bankruptcy trustee may recover it.

前項に規定する場合において、清算中の法人である労働組合が既に債権者に支払い、又は権利の帰属すべき者に引き渡したものがあるときは、破産管財人は、これを取り戻すことができる。

The public notice pursuant to the provisions of paragraph (1) is given by publication in the Official Gazette.

第一項の規定による公告は、官報に掲載してする。

Article 13-10Vesting of Residual Assets

第十三条の十(残余財産の帰属)

The assets of a labor union that is a corporation which has dissolved vest in the person designated in its constitution.

解散した法人である労働組合の財産は、規約で指定した者に帰属する。

When the constitution does not designate the person in whom the rights are to vest or does not specify the method for designating that person, a representative may, upon a resolution at the general assembly meeting, dispose of the assets for a purpose similar to the purpose of that labor union that is a corporation.

規約で権利の帰属すべき者を指定せず、又はその者を指定する方法を定めなかつたときは、代表者は、総会の決議を経て、当該法人である労働組合の目的に類似する目的のために、その財産を処分することができる。

Assets not disposed of pursuant to the provisions of the preceding two paragraphs vest in the National Treasury.

前二項の規定により処分されない財産は、国庫に帰属する。

Article 13-11Jurisdiction over Cases Concerning Appointment of Special Agents, etc.

第十三条の十一(特別代理人の選任等に関する事件の管轄)

The following cases are subject to the jurisdiction of the district court having jurisdiction over the location of the principal office of the labor union that is a corporation:

次に掲げる事件は、法人である労働組合の主たる事務所の所在地を管轄する地方裁判所の管轄に属する。

cases concerning the appointment of a special agent; and

特別代理人の選任に関する事件

cases concerning liquidators of a labor union that is a corporation.

法人である労働組合の清算人に関する事件

Article 13-12Restriction on Appeal

第十三条の十二(不服申立ての制限)

No appeal may be entered against a judicial decision appointing a liquidator of a labor union that is a corporation.

法人である労働組合の清算人の選任の裁判に対しては、不服を申し立てることができない。

Article 13-13Remuneration for Liquidators Appointed by the Court

第十三条の十三(裁判所の選任する清算人の報酬)

In the case where the court has appointed a liquidator of a labor union that is a corporation pursuant to the provisions of Article 13-3, it may determine the amount of remuneration to be paid by the labor union that is a corporation to that liquidator. In this case, the court must hear the statement of that liquidator.

裁判所は、第十三条の三の規定により法人である労働組合の清算人を選任した場合には、法人である労働組合が当該清算人に対して支払う報酬の額を定めることができる。この場合においては、裁判所は、当該清算人の陳述を聴かなければならない。

Chapter III Collective Agreements

第三章 労働協約

Article 14Collective Agreement Becoming Effective

第十四条(労働協約の効力の発生)

A collective agreement between a labor union and an employer or an employers' organization concerning working conditions and other matters becomes effective when the agreement is put in writing and is either signed by or affixed the names and seals by both of the parties concerned.

労働組合と使用者又はその団体との間の労働条件その他に関する労働協約は、書面に作成し、両当事者が署名し、又は記名押印することによつてその効力を生ずる。

Article 15Term of Collective Agreements

第十五条(労働協約の期間)

An effective period exceeding three years may not be provided for in a collective agreement.

労働協約には、三年をこえる有効期間の定をすることができない。

A collective agreement providing for an effective period exceeding three years is deemed as a collective agreement providing for an effective period of three years.

三年をこえる有効期間の定をした労働協約は、三年の有効期間の定をした労働協約とみなす。

A collective agreement which does not provide for an effective period may be terminated by either party by giving advance notice to the other party in writing either signed by or affixed the name and seal by the party giving notice of the termination. The same applies to a collective agreement which provides for a definite term that includes a provision to the effect that the agreement continues to be effective after the expiration of the period without specifying a deadline after the expiration of the period.

有効期間の定がない労働協約は、当事者の一方が、署名し、又は記名押印した文書によつて相手方に予告して、解約することができる。一定の期間を定める労働協約であつて、その期間の経過後も期限を定めず効力を存続する旨の定があるものについて、その期間の経過後も、同様とする。

The advance notice set forth in the preceding paragraph must be given at least ninety days prior to the date on which termination is to be made.

前項の予告は、解約しようとする日の少くとも九十日前にしなければならない。

Article 16Effect of the Standards

第十六条(基準の効力)

Any part of an individual labor contract that contravenes the standards concerning working conditions and other matters relating to the treatment of workers provided in the collective agreement will be void. In such a case, the invalidated part of the individual labor contract is to be governed by those standards. The same applies to particulars the individual labor contract does not prescribe.

労働協約に定める労働条件その他の労働者の待遇に関する基準に違反する労働契約の部分は、無効とする。この場合において無効となつた部分は、基準の定めるところによる。労働契約に定がない部分についても、同様とする。

Article 17General Binding Effect

第十七条(一般的拘束力)

When three-fourths or more of the workers of the same kind regularly employed in a particular factory or workplace come under application of a particular collective agreement, the agreement also applies to the remaining workers of the same kind employed in the factory or the workplace.

一の工場事業場に常時使用される同種の労働者の四分の三以上の数の労働者が一の労働協約の適用を受けるに至つたときは、当該工場事業場に使用される他の同種の労働者に関しても、当該労働協約が適用されるものとする。

Article 18General Binding Effect in a Locality

第十八条(地域的の一般的拘束力)

When a majority of the workers of the same kind in a particular locality come under application of a particular collective agreement, the Minister of Health, Labour and Welfare or the prefectural governor may, at the request of either one or both of the parties to the collective agreement and, pursuant to a resolution of the Labour Relations Commission, decide that the collective agreement (including an agreement amended pursuant to the provisions of paragraph (2)) should apply to the remaining workers of the same kind employed in the same locality and to their employers.

一の地域において従業する同種の労働者の大部分が一の労働協約の適用を受けるに至つたときは、当該労働協約の当事者の双方又は一方の申立てに基づき、労働委員会の決議により、厚生労働大臣又は都道府県知事は、当該地域において従業する他の同種の労働者及びその使用者も当該労働協約(第二項の規定により修正があつたものを含む。)の適用を受けるべきことの決定をすることができる。

In the case the Labour Relations Commission, in adopting the resolution set forth in the preceding paragraph, finds that the collective agreement contains inappropriate parts, the Commission may amend those parts.

労働委員会は、前項の決議をする場合において、当該労働協約に不適当な部分があると認めたときは、これを修正することができる。

The decision as prescribed in paragraph (1) is to be made by public notice.

第一項の決定は、公告によつてする。

Chapter IV Labour Relations Commission

第四章 労働委員会

Section 1 Establishment, Duties, and Administrative Affairs under the Jurisdiction, Organizations, and Related Matters

第一節 設置、任務及び所掌事務並びに組織等

Article 19Labour Relations Commission

第十九条(労働委員会)

A Labour Relations Commission is to be composed of equal numbers of persons representing employers (hereinafter referred to as "employer members"), persons representing workers (hereinafter referred to as "labor members"), and persons representing the public interest (hereinafter referred to as "public interest members").

労働委員会は、使用者を代表する者(以下「使用者委員」という。)、労働者を代表する者(以下「労働者委員」という。)及び公益を代表する者(以下「公益委員」という。)各同数をもつて組織する。

The Labour Relations Commissions are to consist of the Central Labour Relations Commission and Prefectural Labour Relations Commissions.

労働委員会は、中央労働委員会及び都道府県労働委員会とする。

The particulars concerning the Labour Relations Commission in addition to what is provided for in this Act are to be prescribed by Cabinet Order.

労働委員会に関する事項は、この法律に定めるもののほか、政令で定める。

Article 19-2Central Labour Relations Commission

第十九条の二(中央労働委員会)

The Central Labour Relations Commission is established under the jurisdiction of the Minister of Health, Labour and Welfare based on the provisions of .

の規定に基づいて、厚生労働大臣の所轄の下に、中央労働委員会を置く。

The Central Labour Relations Commission has the duty to defend the workers' uniting and promote the fair adjustment of labor relationships.

中央労働委員会は、労働者が団結することを擁護し、及び労働関係の公正な調整を図ることを任務とする。

In order to fulfill the duties set forth in the preceding paragraph, the Central Labour Relations Commission takes charge of affairs set forth in the provisions of Article 5, Article 11, Article 18, and Article 26 of this Act, administrative affairs concerning examination, etc., cases of unfair labor practice, (meaning the disposition of cases pursuant to the provisions of Article 7, the following Section, and Section 3 of this Act; the same applies hereinafter), administrative affairs concerning the conciliation, mediation, and arbitration of labor disputes, administrative affairs pursuant to the provisions of Article 35-2 and Article 35-3 of the Labor Relations Adjustment Act, and other administrative affairs belonging to the Central Labour Relations Commission based on other laws (including orders based on laws).

中央労働委員会は、前項の任務を達成するため、第五条、第十一条、第十八条及び第二十六条の規定による事務、不当労働行為事件の審査等(第七条、次節及び第三節の規定による事件の処理をいう。以下同じ。)に関する事務、労働争議のあつせん、調停及び仲裁に関する事務並びに労働関係調整法第三十五条の二及び第三十五条の三の規定による事務その他法律(法律に基づく命令を含む。)に基づき中央労働委員会に属させられた事務をつかさどる。

Article 19-3Appointment of the Members of the Central Labour5 Relations Commission

第十九条の三(中央労働委員会の委員の任命等)

The Central Labour Relations Commission is to be composed of fifteen members from employer members, labor members, and public interest members.

中央労働委員会は、使用者委員、労働者委員及び公益委員各十五人をもつて組織する。

The Prime Minister appoints the employer members based upon the recommendations of employers' organizations (for four of the employer members, based upon the recommendations of agencies engaged in administrative execution (meaning an agency engaged in administrative execution provided for in ; the same applies in this paragraph, paragraph (2), item (ii) of the following Article, and Article 19-10, paragraph (1))). The Prime Minister appoints the labor members based upon the recommendations of the labor unions (for four of the labor members, based upon the recommendations of the labor unions formed or joined by employees provided for in (hereinafter referred to as "employees of an agency engaged in administrative execution" in this Chapter)). The Prime Minister, after obtaining the consent of both Houses, appoints the public interest members from among the persons stated in the list of candidates prepared by the Minister of Health, Labor and Welfare with the consent of the employer members and the labor members.

使用者委員は使用者団体の推薦(使用者委員のうち四人については、行政執行法人(に規定する行政執行法人をいう。以下この項、次条第二項第二号及び第十九条の十第一項において同じ。)の推薦)に基づいて、労働者委員は労働組合の推薦(労働者委員のうち四人については、に規定する職員(以下この章において「行政執行法人職員」という。)が結成し、又は加入する労働組合の推薦)に基づいて、公益委員は厚生労働大臣が使用者委員及び労働者委員の同意を得て作成した委員候補者名簿に記載されている者のうちから両議院の同意を得て、内閣総理大臣が任命する。

In the case where the term of office of a public interest member has expired or a vacancy has occurred for a public interest member and the consent of both Houses cannot be obtained because the Diet is not in session or the House of Representatives has been dissolved, notwithstanding the provisions of the preceding paragraph, the Prime Minister may appoint a public interest member from among the persons stated in the list of candidates prepared by the Minister of Health, Labor and Welfare after obtaining the consent of the employer members and the labor members.

公益委員の任期が満了し、又は欠員を生じた場合において、国会の閉会又は衆議院の解散のために両議院の同意を得ることができないときは、内閣総理大臣は、前項の規定にかかわらず、厚生労働大臣が使用者委員及び労働者委員の同意を得て作成した委員候補者名簿に記載されている者のうちから、公益委員を任命することができる。

In the case referred to in the preceding paragraph, subsequent approval by both Houses must be sought at the first session of the Diet after the appointment. In this case, if subsequent approval of both Houses cannot be obtained, the Prime Minister must immediately dismiss the public interest member.

前項の場合においては、任命後最初の国会で両議院の事後の承認を求めなければならない。この場合において、両議院の事後の承認が得られないときは、内閣総理大臣は、直ちにその公益委員を罷免しなければならない。

As to appointment of the public interest members, seven or more those members must not belong to the same political party.

公益委員の任命については、そのうち七人以上が同一の政党に属することとなつてはならない。

The members of the Central Labour Relations Commission (simply referred to as "members" in the following Article to Article 19-9) is to serve on a part-time basis; provided, however, that up to two public interest members may serve on a full-time basis.

中央労働委員会の委員(次条から第十九条の九までにおいて単に「委員」という。)は、非常勤とする。ただし、公益委員のうち二人以内は、常勤とすることができる。

Article 19-4Disqualification Clause of Members

第十九条の四(委員の欠格条項)

A person who has been sentenced to punishment of imprisonment or a greater punishment, and who is still under the execution of the sentence or who has not ceased to be subject to the execution of the sentence, may not become a member.

拘禁刑以上の刑に処せられ、その執行を終わるまで、又は執行を受けることがなくなるまでの者は、委員となることができない。

A person who falls under any of the following items may not become a public interest member:

次の各号のいずれかに該当する者は、公益委員となることができない。

a member of the Diet or a member of the assembly of a local government;

国会又は地方公共団体の議会の議員

an officer of an agency engaged in administrative execution, an employee of an agency engaged in administrative execution, or a member or officer of a labor union formed or joined by employees of an agency engaged in administrative execution;

行政執行法人の役員、行政執行法人職員又は行政執行法人職員が結成し、若しくは加入する労働組合の組合員若しくは役員

Article 19-5Term of Office of Members

第十九条の五(委員の任期等)

The term of office of members is to be two years; provided, however, that the term of office of a member who is appointed to fill a vacancy is to be the remaining term of the predecessor.

委員の任期は、二年とする。ただし、補欠の委員の任期は、前任者の残任期間とする。

Members may be re-appointed.

委員は、再任されることができる。

When the term of office of a member has expired, the member is to remain in office until a successor is appointed.

委員の任期が満了したときは、当該委員は、後任者が任命されるまで引き続き在任するものとする。

Article 19-6Services of Public Interest Members

第十九条の六(公益委員の服務)

A public interest member serving full-time may not perform any act falling under any of the following items while in office:

常勤の公益委員は、在任中、次の各号のいずれかに該当する行為をしてはならない。

to become an officer of a political party or other political organizations, or actively engage in political activities;

政党その他の政治的団体の役員となり、又は積極的に政治運動をすること。

except in cases permitted by the Prime Minister, to receive remuneration and engage in any other duty, undertake a business for profit, or otherwise engage in any business for pecuniary profit.

内閣総理大臣の許可のある場合を除くほか、報酬を得て他の職務に従事し、又は営利事業を営み、その他金銭上の利益を目的とする業務を行うこと。

A public interest member serving part-time may not perform any act falling under item (i) of the preceding paragraph while in office.

非常勤の公益委員は、在任中、前項第一号に該当する行為をしてはならない。

Article 19-7Loss of Job and Dismissal of a Member

第十九条の七(委員の失職及び罷免)

A member loses their job in the case where the member comes to fall under any of the items of Article 19-4, paragraph (1). The same applies in the case where a public interest member comes to fall under any of the items of paragraph (2) of the same Article.

委員は、第十九条の四第一項に規定する者に該当するに至つた場合には、その職を失う。公益委員が同条第二項各号のいずれかに該当するに至つた場合も、同様とする。

When the Prime Minister finds that a member cannot execute their duties by reason of mental or physical disorder, a member has breached their duties, or a member has committed a misconduct unbefitting for a member, the Prime Minister may dismiss the member with the consent of the Central Labour Relations Commission in the case of an employer member or a labor member, or with the consent of both Houses in the case of a public interest member.

内閣総理大臣は、委員が心身の故障のために職務の執行ができないと認める場合又は委員に職務上の義務違反その他委員たるに適しない非行があると認める場合には、使用者委員及び労働者委員にあつては中央労働委員会の同意を得て、公益委員にあつては両議院の同意を得て、その委員を罷免することができる。

Pursuant to the provisions of the preceding paragraph, if the Prime Minister has requested the Central Labour Relations Commission to give its consent to the dismissal of an employer member or a labor member, the member may not take part in the decision.

前項の規定により、内閣総理大臣が中央労働委員会に対して、使用者委員又は労働者委員の罷免の同意を求めた場合には、当該委員は、その議事に参与することができない。

The Prime Minister is to immediately dismiss a public interest member who has newly come to belong to a political party to which six of the other public interest members already belong.

内閣総理大臣は、公益委員のうち六人が既に属している政党に新たに属するに至つた公益委員を直ちに罷免するものとする。

If seven or more public interest members have come to belong to the same political party (excluding cases which fall under the provisions of the preceding paragraph), with the consent of both Houses, the Prime Minister is to dismiss public interest members so that the number of public interest members belonging to the same party is six; provided, however, that the Prime Minister may not dismiss members who have not changed the political party to which they belong.

内閣総理大臣は、公益委員のうち七人以上が同一の政党に属することとなつた場合(前項の規定に該当する場合を除く。)には、同一の政党に属する者が六人になるように、両議院の同意を得て、公益委員を罷免するものとする。ただし、政党所属関係に異動のなかつた委員を罷免することはできないものとする。

Article 19-8Remuneration of the Members

第十九条の八(委員の給与等)

Members are to receive salaries, allowances, and other remuneration as prescribed separately by laws, and are also to be reimbursed the necessary expenses incurred in performing their duties as specified by Cabinet Order.

委員は、別に法律の定めるところにより俸給、手当その他の給与を受け、及び政令の定めるところによりその職務を行うために要する費用の弁償を受けるものとする。

Article 19-9Chairperson of the Central Labour Relations Commission

第十九条の九(中央労働委員会の会長)

The Central Labour Relations Commission is to have a chairperson.

中央労働委員会に会長を置く。

The chairperson is elected by the members from among the public interest members.

会長は、委員が公益委員のうちから選挙する。

The chairperson presides over the business of the Central Labour Relations Commission and represents the Central Labour Relations Commission.

会長は、中央労働委員会の会務を総理し、中央労働委員会を代表する。

The Central Labour Relations Commission must designate in advance a member, by election by the members from among the public interest members, who acts on behalf of the chairperson in the case the chairperson is impeded from performing their duties.

中央労働委員会は、あらかじめ公益委員のうちから委員の選挙により、会長に故障がある場合において会長を代理する委員を定めておかなければならない。

Article 19-10Local Members for Adjustment

第十九条の十(地方調整委員)

Local members for adjustment are to be established within the Central Labour Relations Commission representing the employers, the workers, and the public interest, to participate in conciliation or mediation in disputes and other cases arising between an agency engaged in administrative execution and the employees of an agency engaged in administrative execution employed by it, as well as other disputes or other cases as provided for by Cabinet Order as those to be dealt with locally by the Central Labour Relations Commission; and to participate in procedures as provided for in Article 24-2, paragraph (5).

中央労働委員会に、行政執行法人とその行政執行法人職員との間に発生した紛争その他の事件で地方において中央労働委員会が処理すべきものとして政令で定めるものに係るあつせん若しくは調停又は第二十四条の二第五項の規定による手続に参与させるため、使用者、労働者及び公益をそれぞれ代表する地方調整委員を置く。

The Minister of Health, Labor and Welfare appoints local members for adjustment with the consent of the Central Labour Relations Commission for each district specified by Cabinet Order.

地方調整委員は、中央労働委員会の同意を得て、政令で定める区域ごとに厚生労働大臣が任命する。

The provisions of the main clause of Article 19-5, paragraph (1) and paragraph (2); Article 19-7, paragraph (2); and Article 19-8 apply mutatis mutandis to the local members for adjustment. In this case, the term "the Prime Minister" in Article 19-7, paragraph (2), is deemed to be replaced with "the Minister of Health, Labour and Welfare"; and the phrase "with the consent of the Central Labour Relations Commission in the case of an employer member or a labor member, or with the consent of both Houses in the case of a public interest member" in the same paragraph is deemed to be replaced with "with the consent of the Central Labour Relations Commission."

第十九条の五第一項本文及び第二項、第十九条の七第二項並びに第十九条の八の規定は、地方調整委員について準用する。この場合において、第十九条の七第二項中「内閣総理大臣」とあるのは「厚生労働大臣」と、「使用者委員及び労働者委員にあつては中央労働委員会の同意を得て、公益委員にあつては両議院」とあるのは「中央労働委員会」と読み替えるものとする。

Article 19-11Secretariat of the Central Labour Relations Commission

第十九条の十一(中央労働委員会の事務局)

A secretariat is to be established within the Central Labour Relations Commission to organize the administrative affairs of the Commission, and the secretariat is to have a director-general and other necessary staff members appointed by the Minister of Health, Labor and Welfare with the consent of the chairperson.

中央労働委員会にその事務を整理させるために事務局を置き、事務局に会長の同意を得て厚生労働大臣が任命する事務局長及び必要な職員を置く。

A local office that takes charge of administrative affairs in the local area is to be established in the secretariat.

事務局に、地方における事務を分掌させるため、地方事務所を置く。

The location, name, and jurisdictional district of a local office are prescribed by Cabinet Order.

地方事務所の位置、名称及び管轄区域は、政令で定める。

Article 19-12Prefectural Labour Relations Commission

第十九条の十二(都道府県労働委員会)

A Prefectural Labour Relations Commission is established under the jurisdiction of the prefectural governor.

都道府県知事の所轄の下に、都道府県労働委員会を置く。

The Prefectural Labour Relations Commission is to be composed of thirteen members each, eleven members each, nine members each, seven members each, or five members each for employer members, labor members, and public interest members, respectively, for the number as specified by Cabinet Order; provided, however, that it may be composed of the number of members adding two members each of employer members, labor members, and public interest members to the number specified by Cabinet Order, pursuant to the provisions of Prefectural Order.

都道府県労働委員会は、使用者委員、労働者委員及び公益委員各十三人、各十一人、各九人、各七人又は各五人のうち政令で定める数のものをもつて組織する。ただし、条例で定めるところにより、当該政令で定める数に使用者委員、労働者委員及び公益委員各二人を加えた数のものをもつて組織することができる。

The prefectural governor appoints the employer members based upon the recommendations of the employers' organizations, the labor members based upon the recommendations of the labor unions, and the public interest members with the consent of the employer members and the labor members.

使用者委員は使用者団体の推薦に基づいて、労働者委員は労働組合の推薦に基づいて、公益委員は使用者委員及び労働者委員の同意を得て、都道府県知事が任命する。

The appointment of public interest members is to be made in accordance with the number of public interest members listed in the left-hand column of the Appended Table for the Prefectural Labour Relations Commission (for Prefectural Labour Relations Commissions composed of members with two members added to the number specified by Cabinet Order pursuant to the proviso to paragraph 2 of this Article, the number of public interest members that added those two members ), and the number of public interest members exceeding the number specified in the right-hand column of the Table must not belong to the same political party.

公益委員の任命については、都道府県労働委員会における別表の上欄に掲げる公益委員の数(第二項ただし書の規定により公益委員の数を同項の政令で定める数に二人を加えた数とする都道府県労働委員会にあつては当該二人を加えた数)に応じ、それぞれ同表の下欄に定める数以上の公益委員が同一の政党に属することとなつてはならない。

When a public interest member has contravened the provisions of the preceding paragraph due to their actions, the member is to retire as a matter of course.

公益委員は、自己の行為によつて前項の規定に抵触するに至つたときは、当然退職するものとする。

The provisions of Article 19-3, paragraph (6); Article 19-4, paragraph (1); Article 19-5; Article 19-7, the first sentence of paragraph (1), paragraph (2) and paragraph (3); Article 19-8; Article 19-9; and paragraph (1) of the preceding Article apply mutatis mutandis to Prefectural Labour Relations Commissions. In this case, the term "on a full-time basis" in the proviso to Article 19-3, paragraph (6) is deemed to be replaced with "on a full-time basis pursuant to the provisions of Prefectural Order"; "the Prime Minister" in Article 19-7, paragraph (2) is deemed to be replaced with "the prefectural governor"; "with the consent of the Central Labour Relations Commission in the case of an employer member or a labor member, or with the consent of both Houses in the case of a public interest member" in the same paragraph is deemed to be replaced with "the Prefectural Labour Relations Commission"; "the Prime Minister" in paragraph 3 of the same Article is deemed to be replaced with "the prefectural governor"; "an employer member or a labor member" in is deemed to be replaced with "a member of the Prefectural Labour Relations Commission"; and "the Minister of Health, Labor and Welfare" in paragraph (1) of the preceding Article is deemed to be replaced with "the prefectural governor."

第十九条の三第六項、第十九条の四第一項、第十九条の五、第十九条の七第一項前段、第二項及び第三項、第十九条の八、第十九条の九並びに前条第一項の規定は、都道府県労働委員会について準用する。この場合において、第十九条の三第六項ただし書中「、常勤」とあるのは「、条例で定めるところにより、常勤」と、第十九条の七第二項中「内閣総理大臣」とあるのは「都道府県知事」と、「使用者委員及び労働者委員にあつては中央労働委員会の同意を得て、公益委員にあつては両議院」とあるのは「都道府県労働委員会」と、同条第三項中「内閣総理大臣」とあるのは「都道府県知事」と、「使用者委員又は労働者委員」とあるのは「都道府県労働委員会の委員」と、前条第一項中「厚生労働大臣」とあるのは「都道府県知事」と読み替えるものとする。

Article 20Authority of the Labour Relations Commission

第二十条(労働委員会の権限)

In addition to those particulars provided under the provisions of Articles 5, Article 11, and Article 18, the Labour Relations Commission has the authority to conduct examinations, etc., of unfair labor practice cases and perform conciliation, mediation and arbitration of labor disputes.

労働委員会は、第五条、第十一条及び第十八条の規定によるもののほか、不当労働行為事件の審査等並びに労働争議のあつせん、調停及び仲裁をする権限を有する。

Article 21Meetings

第二十一条(会議)

When a Labour Relations Commission finds it necessary for the public interest, its meetings may be opened to the public.

労働委員会は、公益上必要があると認めたときは、その会議を公開することができる。

The meetings of a Labour Relations Commission is convened by the chairperson.

労働委員会の会議は、会長が招集する。

The Labour Relations Commission may not hold a meeting nor make any decision unless one or more employer members, labor members, and public interest members are present.

労働委員会は、使用者委員、労働者委員及び公益委員各一人以上が出席しなければ、会議を開き、議決することができない。

Decisions are to be made by a majority of the members present, and in the case of tie in votes, the chairperson is to make the decision.

議事は、出席委員の過半数で決し、可否同数のときは、会長の決するところによる。

Article 22Compulsory Authority

第二十二条(強制権限)

If a Labour Relations Commission finds it necessary for performing its administrative affairs, it may request the attendance, submission of reports or necessary books and documents, by the employer or the employers' organization or the labor union, or other persons concerned. The Labour Relations Commission may also have its members or staff members (hereinafter simply referred to as "staff members") inspect factories and other relevant workplaces and inspect the business situations, books and documents and other objects.

労働委員会は、その事務を行うために必要があると認めたときは、使用者又はその団体、労働組合その他の関係者に対して、出頭、報告の提出若しくは必要な帳簿書類の提出を求め、又は委員若しくは労働委員会の職員(以下単に「職員」という。)に関係工場事業場に臨検し、業務の状況若しくは帳簿書類その他の物件を検査させることができる。

In cases where a Labour Relations Commission has its members or staff members inspect or investigate the places pursuant to the preceding paragraph, the Commission must require them to carry an identification card and to present the card to the persons concerned.

労働委員会は、前項の臨検又は検査をさせる場合においては、委員又は職員にその身分を証明する証票を携帯させ、関係人にこれを呈示させなければならない。

Article 23Obligation to Keep Secrets

第二十三条(秘密を守る義務)

Members or those who have been members, as well as staff members or those who have been staff members of a Labour Relations Commission, must not disclose any secrets obtained in relation to their duties. The same applies to local members for adjustment or those who have been local members for adjustment of the Central Labour Relations Commission.

労働委員会の委員若しくは委員であつた者又は職員若しくは職員であつた者は、その職務に関して知得した秘密を漏らしてはならない。中央労働委員会の地方調整委員又は地方調整委員であつた者も、同様とする。

Article 24Authority Executed Solely by Public Interest Members

第二十四条(公益委員のみで行う権限)

The public interest members of a Labour Relations Commission participate in the disposition of cases as prescribed in Article 5 and Article 11; examinations, etc., of unfair labor practice cases (referred to as "examinations, etc." in the following Article); and dispositions of cases as prescribed in Article 42 of the Labor Relations Adjustment Act; provided, however, that employer members and labor members may participate in the procedures for conducting an investigation (limited to cases in which the public interest members so request) and holding a hearing pursuant to the provisions of Article 27, paragraph (1) (including as applied mutatis mutandis pursuant to Article 27-17) and in the procedures for recommending a settlement pursuant to the provisions of Article 27-14, paragraph (1) (including as applied mutatis mutandis pursuant to Article 27-17), or may perform an act pursuant to the provisions of Article 27-7, paragraph (4) and Article 27-12, paragraph (2) (including as applied mutatis mutandis pursuant to Article 27-17).

第五条及び第十一条の規定による事件の処理並びに不当労働行為事件の審査等(次条において「審査等」という。)並びに労働関係調整法第四十二条の規定による事件の処理には、労働委員会の公益委員のみが参与する。ただし、使用者委員及び労働者委員は、第二十七条第一項(第二十七条の十七の規定により準用する場合を含む。)の規定により調査(公益委員の求めがあつた場合に限る。)及び審問を行う手続並びに第二十七条の十四第一項(第二十七条の十七の規定により準用する場合を含む。)の規定により和解を勧める手続に参与し、又は第二十七条の七第四項及び第二十七条の十二第二項(第二十七条の十七の規定により準用する場合を含む。)の規定による行為をすることができる。

The Central Labour Relations Commission may have public interest members serving full time investigate the situations of labor relationships of employees of an agency engaged in administrative execution, and other particulars found necessary for performing administrative affairs of the Central Labour Relations Commission, in addition to those related to the cases pending before the Central Labour Relations Commission.

中央労働委員会は、常勤の公益委員に、中央労働委員会に係属している事件に関するもののほか、行政執行法人職員の労働関係の状況その他中央労働委員会の事務を処理するために必要と認める事項の調査を行わせることができる。

Article 24-2Panel

第二十四条の二(合議体等)

The Central Labour Relations Commission conducts its examinations, etc., through a panel, consisting of five public interest members appointed by the chairperson.

中央労働委員会は、会長が指名する公益委員五人をもつて構成する合議体で、審査等を行う。

Notwithstanding the provisions of the preceding paragraph, in cases that fall under any of the following items, a panel consisting of all public interest members conducts the examinations, etc.:

前項の規定にかかわらず、次の各号のいずれかに該当する場合においては、公益委員の全員をもつて構成する合議体で、審査等を行う。

cases in which the panel set forth in the preceding paragraph finds that its opinion concerning the interpretation and application of law and regulations is opposed to dispositions imposed by the Central Labour Relations Commission pursuant to Article 5, paragraph (1) or Article 11, paragraph (1), or Article 27-12, paragraph (1) (including as applied mutatis mutandis pursuant to Article 27-17);

前項の合議体が、法令の解釈適用について、その意見が前に中央労働委員会のした第五条第一項若しくは第十一条第一項又は第二十七条の十二第一項(第二十七条の十七の規定により準用する場合を含む。)の規定による処分に反すると認めた場合

cases in which the panel set forth in the preceding paragraph cannot make its coordinated opinion because opinions of its members are divided;

前項の合議体を構成する者の意見が分かれたため、その合議体としての意見が定まらない場合

cases in which the panel set forth in the preceding paragraph finds it reasonable for a panel consisting of all public interest members to conduct examinations, etc.; and

前項の合議体が、公益委員の全員をもつて構成する合議体で審査等を行うことを相当と認めた場合

cases in which filing of an objection pursuant to the provision of Article 27-10, paragraph 3 (including as applied mutatis mutandis pursuant to Article 27-17) are conducted proceedings.

第二十七条の十第三項(第二十七条の十七の規定により準用する場合を含む。)の規定による異議の申立てを審理する場合

A Prefectural Labour Relations Commission conducts the examinations, etc., through its panel, consisting of all public interest members; provided, however, that, as provided for by ordinance, a panel consisting of five or seven public interest members appointed by the chairperson may conduct examinations, etc. In this case, the provisions of the preceding paragraph (except items (i) and (iv)) apply mutatis mutandis to Prefectural Labour Relations Commissions.

都道府県労働委員会は、公益委員の全員をもつて構成する合議体で、審査等を行う。ただし、条例で定めるところにより、会長が指名する公益委員五人又は七人をもつて構成する合議体で、審査等を行うことができる。この場合において、前項(第一号及び第四号を除く。)の規定は、都道府県労働委員会について準用する。

A Labour Relations Commission, in conducting examinations, etc., in accordance with the provisions of the preceding three paragraphs, may have one or more public interest members carry out the procedures for examinations, etc., in whole or in part (excluding disposition under the provisions of Article 5, paragraph (1), Article 11, paragraph (1), Article 27-4, paragraph (1) (including as applied mutatis mutandis pursuant to Article 27-17); Article 27-7, paragraph (1) (including as applied mutatis mutandis pursuant to Article 27-17, other than parts where the parties concerned or witnesses are made to give a statement or where the submitted objects are retained); Article 27-10, paragraphs (2) and (4), and Article 27-12, paragraph (1) (including as applied mutatis mutandis pursuant to Article 27-17); and a motion under Article 27-20; the same applies in the following paragraph).

労働委員会は、前三項の規定により審査等を行うときは、一人又は数人の公益委員に審査等の手続(第五条第一項、第十一条第一項、第二十七条の四第一項(第二十七条の十七の規定により準用する場合を含む。)、第二十七条の七第一項(当事者若しくは証人に陳述させ、又は提出された物件を留め置く部分を除き、第二十七条の十七の規定により準用する場合を含む。)、第二十七条の十第二項並びに同条第四項及び第二十七条の十二第一項(第二十七条の十七の規定により準用する場合を含む。)の規定による処分並びに第二十七条の二十の申立てを除く。次項において同じ。)の全部又は一部を行わせることができる。

Among the procedures for examination, etc., carried out by the Central Labour Relations Commission, the Central Labour Relations Commission may have the local members for adjustment representing the public interest undertake the procedures in whole or in part in making an investigation and holding a hearing pursuant to the provisions of Article 27, paragraph (1) (including as applied mutatis mutandis pursuant to Article 27-17), and the procedures in whole or in part in recommending a settlement pursuant to the provisions of Article 27-14, paragraph (1) (including as applied mutatis mutandis pursuant to Article 27-17). In this case, the local members for adjustment representing the employers and the local members for adjustment representing the workers may participate in those procedures (for the procedures in conducting an investigation, limited to the case where the local members for adjustment representing the public interest so request).

中央労働委員会は、公益を代表する地方調整委員に、中央労働委員会が行う審査等の手続のうち、第二十七条第一項(第二十七条の十七の規定により準用する場合を含む。)の規定により調査及び審問を行う手続並びに第二十七条の十四第一項(第二十七条の十七の規定により準用する場合を含む。)の規定により和解を勧める手続の全部又は一部を行わせることができる。この場合において、使用者を代表する地方調整委員及び労働者を代表する地方調整委員は、これらの手続(調査を行う手続にあつては公益を代表する地方調整委員の求めがあつた場合に限る。)に参与することができる。

Article 25Jurisdiction of the Central Labour Relations Commission

第二十五条(中央労働委員会の管轄等)

In cases concerning the labor relationships of employees of an agency engaged in administrative execution, the Central Labour Relations Commission assumes exclusive jurisdiction over the conciliation, mediation, arbitration, and disposition (for dispositions under the provisions of Article 5, paragraph (1) and Article 11, paragraph (1) concerning a labor union that is formed or joined by employees of an agency engaged in administrative execution, the dispositions are limited to those specified by Cabinet Order); and the Central Labour Relations Commission assumes priority jurisdiction over the conciliation, mediation, arbitration, and disposition of cases which extend over two or more prefectures or which are related to issues of national significance.

中央労働委員会は、行政執行法人職員の労働関係に係る事件のあつせん、調停、仲裁及び処分(行政執行法人職員が結成し、又は加入する労働組合に関する第五条第一項及び第十一条第一項の規定による処分については、政令で定めるものに限る。)について、専属的に管轄するほか、二以上の都道府県にわたり、又は全国的に重要な問題に係る事件のあつせん、調停、仲裁及び処分について、優先して管轄する。

The Central Labour Relations Commission may re-examine the dispositions of the Prefectural Labour Relations Commission pursuant to the provisions of Articles 5, paragraph (1); Article 11, paragraph (1); and Article 27-12, paragraph (1), with full authority to rescind, approve, or modify the dispositions, or dismiss an appeal for re-examination of those dispositions. The re-examination is to be conducted based on an appeal of either party to the disposition of the Prefectural Labour Relations Commission, or by the Central Labour Commission's authority.

中央労働委員会は、第五条第一項、第十一条第一項及び第二十七条の十二第一項の規定による都道府県労働委員会の処分を取り消し、承認し、若しくは変更する完全な権限をもつて再審査し、又はその処分に対する再審査の申立てを却下することができる。この再審査は、都道府県労働委員会の処分の当事者のいずれか一方の申立てに基づいて、又は職権で、行うものとする。

Article 26Rule-Making Power

第二十六条(規則制定権)

The Central Labour Relations Commission may establish rules for its procedures as well as for the Prefectural Labour Relations Commission's procedures.

中央労働委員会は、その行う手続及び都道府県労働委員会が行う手続に関する規則を定めることができる。

The Prefectural Labour Relations Commission may establish rules on matters concerning the convocation of its meetings and other particulars specified by Cabinet Order to the extent that they do not violate the regulation set forth in the preceding paragraph.

都道府県労働委員会は、前項の規則に違反しない限りにおいて、その会議の招集に関する事項その他の政令で定める事項に関する規則を定めることができる。

Section 2 Procedures for Examination of Unfair Labor Practice Cases

第二節 不当労働行為事件の審査の手続

Article 27Commencement of Examinations of Unfair Labor Practice Cases

第二十七条(不当労働行為事件の審査の開始)

If a motion that an employer has violated the provisions of Article 7 is received, the Labour Relations Commission must conduct an investigation without delay and, if it is found necessary, hold a hearing on whether there are reasons for filing the motion. In this case, sufficient opportunity to submit evidence and to cross-examine the witnesses must be given to the employer and to the movant for the procedures of the hearing.

労働委員会は、使用者が第七条の規定に違反した旨の申立てを受けたときは、遅滞なく調査を行い、必要があると認めたときは、当該申立てが理由があるかどうかについて審問を行わなければならない。この場合において、審問の手続においては、当該使用者及び申立人に対し、証拠を提出し、証人に反対尋問をする充分な機会が与えられなければならない。

A Labour Relations Commission may not accept a motion set forth in the preceding paragraph when more than one year has elapsed since the day on which the act in question was committed (in the case of a continuing act, the date on which the act was finished).

労働委員会は、前項の申立てが、行為の日(継続する行為にあつてはその終了した日)から一年を経過した事件に係るものであるときは、これを受けることができない。

Article 27-2Disqualification of Public Interest Members

第二十七条の二(公益委員の除斥)

A public interest member is disqualified from execution of duties concerning examinations in the case where the member falls under any of the following items:

公益委員は、次の各号のいずれかに該当するときは、審査に係る職務の執行から除斥される。

the public interest member, their spouse, or any person who was formerly their spouse, is or was formerly a party involved in the case or the representative of the party which is a corporation;

公益委員又はその配偶者若しくは配偶者であつた者が事件の当事者又は法人である当事者の代表者であり、又はあつたとき。

the public interest member is or was formerly a blood relative of the party within the fourth degree of kinship, a relative by marriage of the party within the third degree, or a cohabiting relative;

公益委員が事件の当事者の四親等以内の血族、三親等以内の姻族又は同居の親族であり、又はあつたとき。

the public interest member is a guardian, supervisor of a guardian, a curator, supervisor of a curator, an assistant, or supervisor of an assistant to the party involved in the case;

公益委員が事件の当事者の後見人、後見監督人、保佐人、保佐監督人、補助人又は補助監督人であるとき。

the public interest member has become a witness to the case; or

公益委員が事件について証人となつたとき。

the public interest member is or was formerly the party's agent, with regard to a pending case.

公益委員が事件について当事者の代理人であり、又はあつたとき。

If any of the causes for disqualification prescribed in the preceding paragraph apply, the party to the case may file a motion for the disqualification of the public interest member in question.

前項に規定する除斥の原因があるときは、当事者は、除斥の申立てをすることができる。

Article 27-3Challenge to Public Interest Members

第二十七条の三(公益委員の忌避)

If a public interest member has any circumstances which should preclude fair examination, the party may challenge the public interest member.

公益委員について審査の公正を妨げるべき事情があるときは、当事者は、これを忌避することができる。

The party may not challenge a public interest member after the party has made a statement in writing or orally on the case to the Labour Relations Commission; provided, however, that this does not apply to a party who did not know the existence of grounds for a challenge, or when the grounds for a challenge arose after the statement was made.

当事者は、事件について労働委員会に対し書面又は口頭をもつて陳述した後は、公益委員を忌避することができない。ただし、忌避の原因があることを知らなかつたとき、又は忌避の原因がその後に生じたときは、この限りでない。

Article 27-4Decisions on Motions for Disqualification or Challenge

第二十七条の四(除斥又は忌避の申立てについての決定)

The Labour Relations Commission makes decisions on motions for disqualification or challenge.

除斥又は忌避の申立てについては、労働委員会が決定する。

Public interest members who are involved in the motion for disqualification or challenge may not participate in the decisions set forth in the preceding paragraph; provided, however, that the members may state their opinions.

除斥又は忌避の申立てに係る公益委員は、前項の規定による決定に関与することができない。ただし、意見を述べることができる。

The decisions made pursuant to the provisions of paragraph (1) are to be made in writing with the reasons attached.

第一項の規定による決定は、書面によるものとし、かつ、理由を付さなければならない。

Article 27-5Suspension of the Examination Procedures

第二十七条の五(審査の手続の中止)

If a motion for disqualification or challenge has been filed, the Labour Relations Commission must suspend the examination procedures until a decision is made concerning the motion; provided, however, that this does not apply when urgent action is required.

労働委員会は、除斥又は忌避の申立てがあつたときは、その申立てについての決定があるまで審査の手続を中止しなければならない。ただし、急速を要する行為についてはこの限りでない。

Article 27-6Examination Plan

第二十七条の六(審査の計画)

Prior to commencement of a hearing, the Labour Relations Commission must hear the opinions of both parties and establish an examination plan.

労働委員会は、審問開始前に、当事者双方の意見を聴いて、審査の計画を定めなければならない。

The examination plan set forth in the preceding paragraph must include the following information:

前項の審査の計画においては、次に掲げる事項を定めなければならない。

issues and evidence consolidated in the investigation procedure (including those consolidated as evidence requiring examination during the course of the subsequent examination procedure);

調査を行う手続において整理された争点及び証拠(その後の審査の手続における取調べが必要な証拠として整理されたものを含む。)

the duration and number of hearings, and the number of witnesses to be examined;

審問を行う期間及び回数並びに尋問する証人の数

scheduled timing for delivery of orders provided for in Article 27-12, paragraph (1).

第二十七条の十二第一項の命令の交付の予定時期

The Labour Relations Commission may change the examination plan upon hearing the opinions of both parties if it finds that the change is necessary in consideration of the present state of examination and other circumstances.

労働委員会は、審査の現状その他の事情を考慮して必要があると認めるときは、当事者双方の意見を聴いて、審査の計画を変更することができる。

The Labour Relations Commission and the parties must endeavor to ensure that examinations are conducted in accordance with the examination plan, so as to realize a proper and expeditious examination.

労働委員会及び当事者は、適正かつ迅速な審査の実現のため、審査の計画に基づいて審査が行われるよう努めなければならない。

Article 27-7Examination of Evidence

第二十七条の七(証拠調べ)

The Labour Relations Commission, upon motion by either party or by the Labour Relations Commission's authority, may examine evidence by the methods listed in item (ii) for the procedures for investigation, and by the methods listed in the following items for the procedures for hearings:

労働委員会は、当事者の申立てにより又は職権で、調査を行う手続においては第二号に掲げる方法により、審問を行う手続においては次の各号に掲げる方法により証拠調べをすることができる。

to order the parties or witnesses to appear and have them make statements to the extent necessary to find facts;

事実の認定に必要な限度において、当事者又は証人に出頭を命じて陳述させること。

to order the holders of those books and documents, or other objects related to the case (hereinafter referred to as the "objects") to submit the objects, without which it is found likely to be difficult to certify the facts, or to retain the objects already submitted.

事件に関係のある帳簿書類その他の物件であつて、当該物件によらなければ当該物件により認定すべき事実を認定することが困難となるおそれがあると認めるもの(以下「物件」という。)の所持者に対し、当該物件の提出を命じ、又は提出された物件を留め置くこと。

The Labour Relations Commission, when deciding whether or not to make a disposition to issue an order to submit objects pursuant to the provision of item (ii) of the preceding paragraph (hereinafter referred to as the "order to submit objects"), must take into consideration the protection of secrets of individuals and business secrets of companies.

労働委員会は、前項第二号の規定により物件の提出を命ずる処分(以下「物件提出命令」という。)をするかどうかを決定するに当たつては、個人の秘密及び事業者の事業上の秘密の保護に配慮しなければならない。

The Labour Relations Commission, in issuing an order to submit objects, may order the submission of the objects other than the parts the submission of which it finds unnecessary or inappropriate as a result of consideration taken pursuant to the provision of the preceding paragraph.

労働委員会は、物件提出命令をする場合において、物件に提出を命ずる必要がないと認める部分又は前項の規定により配慮した結果提出を命ずることが適当でないと認める部分があるときは、その部分を除いて、提出を命ずることができる。

Employer members and labor members who participate in the procedure for investigations or hearings may state opinions when the Labour Relations Commission intends to issue an order to the parties or witnesses to appear pursuant to the provisions of paragraph 1, item (i) (hereinafter referred to as the "order to appear as witnesses, etc."), or intends to order the submission of the objects.

調査又は審問を行う手続に参与する使用者委員及び労働者委員は、労働委員会が第一項第一号の規定により当事者若しくは証人に出頭を命ずる処分(以下「証人等出頭命令」という。)又は物件提出命令をしようとする場合には、意見を述べることができる。

The Labour Relations Commission, when it has examined evidence by its authority, must hear the opinions of the parties about the results of the examination.

労働委員会は、職権で証拠調べをしたときは、その結果について、当事者の意見を聴かなければならない。

The motion for an order to submit objects must be filed with clarification of the following information:

物件提出命令の申立ては、次に掲げる事項を明らかにしてしなければならない。

indication of the objects;

物件の表示

purport of the objects;

物件の趣旨

holder of the objects;

物件の所持者

facts to be proved.

証明すべき事実

The Labour Relations Commission, before issuing an order to submit objects, must interrogate the holders of the objects.

労働委員会は、物件提出命令をしようとする場合には、物件の所持者を審尋しなければならない。

The Labour Relations Commission, when issuing an order to submit objects, must clarify the information listed in each item (except for item (iii)) of paragraph 6.

労働委員会は、物件提出命令をする場合には、第六項各号(第三号を除く。)に掲げる事項を明らかにしなければならない。

Article 27-8

第二十七条の八

The Labour Relations Commission, when having witnesses give a statement, must have them take an oath.

労働委員会が証人に陳述させるときは、その証人に宣誓をさせなければならない。

The Labour Relations Commission, when having the parties give a statement, may have them take an oath.

労働委員会が当事者に陳述させるときは、その当事者に宣誓をさせることができる。

Article 27-9

第二十七条の九

The provisions of , , and apply mutatis mutandis to the procedures whereby a Labour Relations Commission has witnesses give a statement. The provisions of as applied mutatis mutandis pursuant to the provisions of apply mutatis mutandis to the procedure in which a Labour Relations Commission has the parties give a statement.

、及びの規定は、労働委員会が証人に陳述させる手続に、の規定において準用するの規定は、労働委員会が当事者に陳述させる手続について準用する。

Article 27-10Appeal

第二十七条の十(不服の申立て)

When persons have received an order to appear as witnesses, etc., or an order to submit objects from a Prefectural Labour Relations Commission (hereinafter referred to as an "order, etc., to appear as witnesses, etc." in this Article) and are dissatisfied with the order, etc., to appear as witnesses, etc., those persons may appeal to the Central Labour Relations Commission in writing for examination stating the reasons within one week from the day when they received the order, etc., to appear as witnesses, etc., (when there are compelling reasons such as natural disaster for not appealing within that period, within one week from the day following the date the reasons have ceased to exist).

都道府県労働委員会の証人等出頭命令又は物件提出命令(以下この条において「証人等出頭命令等」という。)を受けた者は、証人等出頭命令等について不服があるときは、証人等出頭命令等を受けた日から一週間以内(天災その他この期間内に審査の申立てをしなかつたことについてやむを得ない理由があるときは、その理由がやんだ日の翌日から起算して一週間以内)に、その理由を記載した書面により、中央労働委員会に審査を申し立てることができる。

In the case that the Central Labour Relations Commission finds that there is a reason for the appeal for examination pursuant to the provisions of the preceding paragraph, it shall rescind the whole or part of the order, etc., to appear as witnesses, etc.

中央労働委員会は、前項の規定による審査の申立てを理由があると認めるときは、証人等出頭命令等の全部又は一部を取り消す。

When persons have received an order, etc., to appear as witnesses, etc., from the Central Labour Relations Commission and are dissatisfied with the order, the persons may file a written objection to the Central Labour Relations Commission, stating the reasons within one week from the day when they received the order, etc., to appear as witnesses, etc. (when there are compelling reasons such as natural disaster for not appealing within that period, within one week from the day following the date the reasons have ceased).

中央労働委員会の証人等出頭命令等を受けた者は、証人等出頭命令等について不服があるときは、証人等出頭命令等を受けた日から一週間以内(天災その他この期間内に異議の申立てをしなかつたことについてやむを得ない理由があるときは、その理由がやんだ日の翌日から起算して一週間以内)に、その理由を記載した書面により、中央労働委員会に異議を申し立てることができる。

In the case that the Central Labour Relations Commission finds that there is a reason for filing of an objection pursuant to the provisions of the preceding paragraph, it rescinds the whole or part of the order, etc., to appear as witnesses, etc., or modifies the order.

中央労働委員会は、前項の規定による異議の申立てを理由があると認めるときは、証人等出頭命令等の全部若しくは一部を取り消し、又はこれを変更する。

The proceedings of request for examination or filing of an objection is executed in writing.

審査の申立て又は異議の申立ての審理は、書面による。

The Central Labour Relations Commission may interrogate persons who request examination or file an objection by its authority.

中央労働委員会は、職権で審査申立人又は異議申立人を審尋することができる。

Article 27-11Maintenance of Order at Hearing Tribunal

第二十七条の十一(審問廷の秩序維持)

The Labour Relations Committee may order persons interfering hearings to leave the courtroom, and take other necessary measures to maintain order at hearing tribunals.

労働委員会は、審問を妨げる者に対し退廷を命じ、その他審問廷の秩序を維持するために必要な措置を執ることができる。

Article 27-12Order for Relief

第二十七条の十二(救済命令等)

The Labour Relations Commission, when the case is ready to issue of an order, must certify the facts and, on the basis of the certification, admit the whole or part of the relief related to the request of the movant, or issue an order to dismiss the motion (hereinafter referred to as the "order for relief, etc.").

労働委員会は、事件が命令を発するのに熟したときは、事実の認定をし、この認定に基づいて、申立人の請求に係る救済の全部若しくは一部を認容し、又は申立てを棄却する命令(以下「救済命令等」という。)を発しなければならない。

Employer members and labor members who participate in the procedure for an investigation or hearing may state opinions in the case that the Labour Relations Commission intends to issue an order for relief, etc.

調査又は審問を行う手続に参与する使用者委員及び労働者委員は、労働委員会が救済命令等を発しようとする場合は、意見を述べることができる。

The certification of facts and the order for relief, etc. set forth in paragraph (1) is to be executed in writing, and their copies must be delivered to the employer and the movant.

第一項の事実の認定及び救済命令等は、書面によるものとし、その写しを使用者及び申立人に交付しなければならない。

An order for relief, etc. becomes effective on the day of the delivery.

救済命令等は、交付の日から効力を生ずる。

Article 27-13Finalizing an Order for Relief

第二十七条の十三(救済命令等の確定)

An order for relief, etc. becomes final and binding when the employer has not filed an action for rescission provided by Article 27-19, paragraph (1) within the period set forth in the same paragraph.

使用者が救済命令等について第二十七条の十九第一項の期間内に同項の取消しの訴えを提起しないときは、救済命令等は、確定する。

If the employer does not accede to the final and binding order for relief, etc., the Labour Relations Commission must notify the district court with jurisdiction over the location of the employer to that effect. Labor unions and workers may also make this notification.

使用者が確定した救済命令等に従わないときは、労働委員会は、使用者の住所地の地方裁判所にその旨を通知しなければならない。この通知は、労働組合及び労働者もすることができる。

Article 27-14Settlement

第二十七条の十四(和解)

The Labor Relations Commission may recommend settlement to the parties at any time in the course of the examination.

労働委員会は、審査の途中において、いつでも、当事者に和解を勧めることができる。

When a settlement has been established between the parties and both parties make motions before the order for relief, etc. becomes final and binding, and when the Labour Relations Commission finds that the content of the settlement is appropriate to maintain or establish normal order of labor relationships between the parties, the examination procedure is terminated.

救済命令等が確定するまでの間に当事者間で和解が成立し、当事者双方の申立てがあつた場合において、労働委員会が当該和解の内容が当事者間の労働関係の正常な秩序を維持させ、又は確立させるため適当と認めるときは、審査の手続は終了する。

In cases as prescribed in the preceding paragraph, the order for relief, etc. already issued for the case related to the settlement (limited to the settlement that the Labour Relations Commission finds appropriate pursuant to the provisions of the preceding paragraph; the same applies in the following paragraph) ceases to be effective.

前項に規定する場合において、和解(前項の規定により労働委員会が適当と認めたものに限る。次項において同じ。)に係る事件について既に発せられている救済命令等は、その効力を失う。

The Labour Relations Commission, in the case that a settlement includes agreement on payments of a certain amount of money or delivery of a certain quantity of fungible things or securities, draw up a record of settlement concerning the agreement upon request from both parties.

労働委員会は、和解に金銭の一定額の支払又はその他の代替物若しくは有価証券の一定の数量の給付を内容とする合意が含まれる場合は、当事者双方の申立てにより、当該合意について和解調書を作成することができる。

The record of settlement prescribed in the preceding paragraph, where compulsory execution is concerned, is deemed to be the title of obligation listed in .

前項の和解調書は、強制執行に関しては、に掲げる債務名義とみなす。

Granting of certificate of execution concerning the title of obligation set forth in the preceding paragraph is performed by the chairperson of the Labour Relations Commission. The service pursuant to the second sentence of is to be made in the same way.

前項の規定による債務名義についての執行文の付与は、労働委員会の会長が行う。後段の送達も、同様とする。

Trial on objections concerning the granting of the certificate of execution, pursuant to the provisions of the preceding paragraph, is to be conducted at the district court having jurisdiction over the location of the Labour Relations Commission.

前項の規定による執行文付与に関する異議についての裁判は、労働委員会の所在地を管轄する地方裁判所においてする。

Particulars necessary for the service of the record of settlement set forth in paragraph (4) and for the service pursuant to the second sentence of paragraph (6) are specified by Cabinet Order.

第四項の和解調書の送達及び第六項後段の送達に関して必要な事項は、政令で定める。

Article 27-15Request for Re-examination

第二十七条の十五(再審査の申立て)

When receiving order for relief, etc. from a Prefectural Labour Relations Commission, employers may request re-examination to the Central Labour Relations Commission within fifteen days (if there are compelling reasons, such as natural disaster for not making a request within that period, within one week from the day following the date the reasons ceased to exist); provided, however, that the request does not suspend the validity of the order for relief, etc., and the order for relief, etc. ceases to be effective when the Central Labour Relations Commission rescinds or modifies the order as a result of re-examination conducted pursuant to the provisions of Article 25, paragraph (2).

使用者は、都道府県労働委員会の救済命令等の交付を受けたときは、十五日以内(天災その他この期間内に再審査の申立てをしなかつたことについてやむを得ない理由があるときは、その理由がやんだ日の翌日から起算して一週間以内)に中央労働委員会に再審査の申立てをすることができる。ただし、この申立ては、救済命令等の効力を停止せず、救済命令等は、中央労働委員会が第二十五条第二項の規定による再審査の結果、これを取り消し、又は変更したときは、その効力を失う。

The provisions of the preceding paragraph apply mutatis mutandis to requests for re-examination by labor unions or workers of the Central Labour Relations Commission.

前項の規定は、労働組合又は労働者が中央労働委員会に対して行う再審査の申立てについて準用する。

Article 27-16Relations between Re-examination and Lawsuit

第二十七条の十六(再審査と訴訟との関係)

The Central Labour Relations Commission may not re-examine an order for relief, etc. when the whole or part of the order for relief, etc. by a Prefectural Labour Relations Commission is supported by a final and binding judgment based on the action pursuant to Article 27-19, paragraph (1).

中央労働委員会は、第二十七条の十九第一項の訴えに基づく確定判決によつて都道府県労働委員会の救済命令等の全部又は一部が支持されたときは、当該救済命令等について、再審査することができない。

Article 27-17Application Mutatis Mutandis to the Procedure for Re-examination

第二十七条の十七(再審査の手続への準用)

The provisions of Article 27, paragraph (1); Article 27-2 through Article 27-9; Article 27-10, paragraphs (3) through (6); and Article 27-11 through Article 27-14 apply mutatis mutandis to the procedure for re-examination taken by the Central Labour Relations Commission. In this case, the phrase "when the public member bears witness to the case" in Article 27-2, paragraph (1), item (iv) is deemed to be replaced with "when the public member bears witness to the case, or when the public member gets involved in the order for relief, etc. of a Prefectural Labour Relations Commission which has already been issued for the case."

第二十七条第一項、第二十七条の二から第二十七条の九まで、第二十七条の十第三項から第六項まで及び第二十七条の十一から第二十七条の十四までの規定は、中央労働委員会の再審査の手続について準用する。この場合において、第二十七条の二第一項第四号中「とき」とあるのは「とき又は事件について既に発せられている都道府県労働委員会の救済命令等に関与したとき」と読み替えるものとする。

Article 27-18Period of Examination

第二十七条の十八(審査の期間)

The Labour Relations Commission, for the purpose of conducting expeditious examinations, is to set a target for the period of examination, and publicize the degree of achievement of the target and any other implementation status of the examination.

労働委員会は、迅速な審査を行うため、審査の期間の目標を定めるとともに、目標の達成状況その他の審査の実施状況を公表するものとする。

Section 3 Lawsuits

第三節 訴訟

Article 27-19Filing an Action for Rescission

第二十七条の十九(取消しの訴え)

When an employer has not requested the Central Labour Relations Commission to review an order for relief, etc. by the Prefectural Labour Relations Commission, or when the Central Labour Relations Commission has issued an order for relief, etc., the employer may file an action for rescission of the order for relief, etc. within thirty days from the day on which the order-for-relief, etc. was delivered. This period is unextendable.

使用者が都道府県労働委員会の救済命令等について中央労働委員会に再審査の申立てをしないとき、又は中央労働委員会が救済命令等を発したときは、使用者は、救済命令等の交付の日から三十日以内に、救済命令等の取消しの訴えを提起することができる。この期間は、不変期間とする。

When an employer has requested the Central Labour Relations Commission to re-examine an order pursuant to the provisions of Article 27-15, paragraph (1), the employer may file an action for rescission only against the order for relief, etc. by the Central Labour Relations Commission for that request. The provisions of Article 12, paragraphs (3) through paragraph (5) of the Administrative Case Litigation Act (Act No. 139 of 1962) do not apply to this action.

使用者は、第二十七条の十五第一項の規定により中央労働委員会に再審査の申立てをしたときは、その申立てに対する中央労働委員会の救済命令等に対してのみ、取消しの訴えを提起することができる。この訴えについては、行政事件訴訟法(昭和三十七年法律第百三十九号)第十二条第三項から第五項までの規定は、適用しない。

The provisions of the preceding paragraph apply mutatis mutandis to actions for rescission filed by labor unions or workers, pursuant to the Administrative Case Litigation Act.

前項の規定は、労働組合又は労働者が行政事件訴訟法の定めるところにより提起する取消しの訴えについて準用する。

Article 27-20Emergency Order

第二十七条の二十(緊急命令)

In the case where an employer has filed an action to a court pursuant to the provisions of paragraph (1) of the preceding Article, the court in charge of the case, at the request of the Labour Relations Commission which has issued the order for relief, etc., may order the employer to comply with the whole or part of the order for relief, etc. in accordance with a ruling until the judgment becomes final and binding, or rescind or modify this ruling upon the request from the parties or by its authority.

前条第一項の規定により使用者が裁判所に訴えを提起した場合において、受訴裁判所は、救済命令等を発した労働委員会の申立てにより、決定をもつて、使用者に対し判決の確定に至るまで救済命令等の全部又は一部に従うべき旨を命じ、又は当事者の申立てにより、若しくは職権でこの決定を取り消し、若しくは変更することができる。

Article 27-21Restrictions on Offer of Evidences

第二十七条の二十一(証拠の申出の制限)

A person who has not submitted an object notwithstanding the order to submit objects by the Labour Relations Commission (excluding persons who are not the party to the procedure for examination) may not offer evidence for the object to the court to prove facts which could be certified by the object specified in the order to submit objects; provided, however, that this does not apply when it is found that there are legitimate grounds for not submitting the object.

労働委員会が物件提出命令をしたにもかかわらず物件を提出しなかつた者(審査の手続において当事者でなかつた者を除く。)は、裁判所に対し、当該物件提出命令に係る物件により認定すべき事実を証明するためには、当該物件に係る証拠の申出をすることができない。ただし、物件を提出しなかつたことについて正当な理由があると認められる場合は、この限りでない。

Article 27-22Recommendations of the Central Labour Relations Commission

第二十七条の二十二(中央労働委員会の勧告等)

The Central Labour Relations Commission may request a Prefectural Labour Relations Commission to report on administrative affairs conducted by the Prefectural Labour Relations Commission pursuant to the provisions of this Act, or make recommendations, give advice, provide training of members and staff members of the secretariat, or provide any other assistance necessary for the application of laws and regulations and for conducting those administrative affairs.

中央労働委員会は、都道府県労働委員会に対し、この法律の規定により都道府県労働委員会が処理する事務について、報告を求め、又は法令の適用その他当該事務の処理に関して必要な勧告、助言若しくはその委員若しくは事務局職員の研修その他の援助を行うことができる。

Article 27-23Handling of Action for Judicial Review of Administrative Disposition

第二十七条の二十三(抗告訴訟の取扱い等)

In a lawsuit in which a prefecture is the defendant pursuant to the provisions of Article 11, paragraph (1) of the Administrative Case Litigation Act (including as applied mutatis mutandis pursuant to Article 38, paragraph (1) of the same Act; the same applies in the following paragraph) related to the disposition (meaning dispositions pursuant to the provisions of Article 3, paragraph (2) of the same Act and including dispositions imposed by public interest members pursuant to the provisions of Article 24-2, paragraph (4) and dispositions imposed by local members for adjustment representing public interests pursuant to the provisions of paragraph (5) of the same Article; the same applies in the following paragraph), the Prefectural Labour Relations Commission represents the prefecture.

都道府県労働委員会は、その処分(行政事件訴訟法第三条第二項に規定する処分をいい、第二十四条の二第四項の規定により公益委員がした処分及び同条第五項の規定により公益を代表する地方調整委員がした処分を含む。次項において同じ。)に係る行政事件訴訟法第十一条第一項(同法第三十八条第一項において準用する場合を含む。次項において同じ。)の規定による都道府県を被告とする訴訟について、当該都道府県を代表する。

The Prefectural Labour Relations Commission may designate persons from among its public interest members, directors-general or staff members of its secretariat, and have them file an action regarding the disposition of Prefectural Labour Relations Commission pursuant to the provisions of Article 11, paragraph (1) of the Administrative Case Litigation Act in which a prefecture is the defendant, or file an action in which the Prefectural Labour Relations Commission is a party.

都道府県労働委員会は、公益委員、事務局長又は事務局の職員でその指定するものに都道府県労働委員会の処分に係る行政事件訴訟法第十一条第一項の規定による都道府県を被告とする訴訟又は都道府県労働委員会を当事者とする訴訟を行わせることができる。

Article 27-24Reimbursement of Expenses

第二十七条の二十四(費用弁償)

A person who has been required to appear pursuant to the provisions of Article 22, paragraph (1) or a witness pursuant to Article 27-7, paragraph (1), item (i) (including as applied mutatis mutandis pursuant to Article 27-17), may be compensated for the expenses as specified by Cabinet Order.

第二十二条第一項の規定により出頭を求められた者又は第二十七条の七第一項第一号(第二十七条の十七の規定により準用する場合を含む。)の証人は、政令の定めるところにより、費用の弁償を受けることができる。

Article 27-25Exclusion from Application of the Administrative Procedure Act

第二十七条の二十五(行政手続法の適用除外)

The provisions of Chapter 2 and Chapter 3 of the Administrative Procedure Act (Act No. 88 of 1993) do not apply to dispositions imposed by a Labour Relations Commission (including dispositions imposed by public interest members pursuant to the provisions of Article 24-2, paragraph (4) of this Act and dispositions imposed by local members for adjustment representing public interests pursuant to the provisions of paragraph (5) of the same Article).

労働委員会がする処分(第二十四条の二第四項の規定により公益委員がする処分及び同条第五項の規定により公益を代表する地方調整委員がする処分を含む。)については、行政手続法(平成五年法律第八十八号)第二章及び第三章の規定は、適用しない。

Article 27-26Limitation on Requests for Review

第二十七条の二十六(審査請求の制限)

No request for review may be made against the dispositions imposed by a Labour Relations Commission (including dispositions imposed by public interest members pursuant to the provisions of Article 24-2, paragraph (4) of this Act and dispositions imposed by local members for adjustment representing public interests pursuant to the provisions of paragraph (5) of the same Article) or against its inaction.

労働委員会がする処分(第二十四条の二第四項の規定により公益委員がする処分及び同条第五項の規定により公益を代表する地方調整委員がする処分を含む。)又はその不作為については、審査請求をすることができない。

Chapter V Penal Provisions

第五章 罰則

Article 28

第二十八条

In the case that the whole or a part of the order for relief, etc. has been supported by final and binding judgment, and the order is violated, the offender is punished by imprisonment not exceeding one year or a fine not exceeding one million yen, or both.

救済命令等の全部又は一部が確定判決によつて支持された場合において、その違反があつたときは、その行為をした者は、一年以下の拘禁刑若しくは百万円以下の罰金に処し、又はこれを併科する。

Article 28-2

第二十八条の二

In the case that a witness who has sworn pursuant to the provisions of Article 27-8, paragraph (1) (including as applied mutatis mutandis pursuant to Article 27-17) has made a false statement, the witness is punished by imprisonment of not less than three months and not exceeding ten years.

第二十七条の八第一項(第二十七条の十七の規定により準用する場合を含む。)の規定により宣誓した証人が虚偽の陳述をしたときは、三月以上十年以下の拘禁刑に処する。

Article 29

第二十九条

A person who violates the provisions of Article 23 is to be punished by imprisonment not exceeding one year or by a fine not exceeding 300,000 yen.

第二十三条の規定に違反した者は、一年以下の拘禁刑又は三十万円以下の罰金に処する。

Article 30

第三十条

A person who, in violation of the provisions of Article 22, has failed to report, made false reports, or failed to submit books and documents; and a person who, in violation of the same Article, has failed to appear or has escaped, obstructed, or refused inspection pursuant to the provisions of the same Article is punished by a fine not more than 300,000 yen.

第二十二条の規定に違反して報告をせず、若しくは虚偽の報告をし、若しくは帳簿書類の提出をせず、又は同条の規定に違反して出頭をせず、若しくは同条の規定による検査を拒み、妨げ、若しくは忌避した者は、三十万円以下の罰金に処する。

Article 31

第三十一条

When a representative of a corporation, or an agent or employee of a person or corporation has committed a violation set forth in the provisions of the preceding Article with regard to the business of the person or corporation, not only the offender, but also the person or the corporation is punished, as prescribed in the same Article.

法人の代表者又は法人若しくは人の代理人、使用人その他の従業者が、その法人又は人の業務に関して前条の違反行為をしたときは、行為者を罰するほか、その法人又は人に対しても同条の刑を科する。

Article 32

第三十二条

When an employer has violated an order of the court pursuant to the provisions of Article 27-20, the employer is punished by a civil fine not exceeding 500,000 yen (in cases where the order demands physical action, and where the number of the nonperformance days from the day following the date of order exceeds five days, the amount obtained by multiplying 100,000 yen by the number of days exceeding five is added). The same applies to cases in which an employer has violated an order for relief, etc. which has become final and binding pursuant to the provisions of Article 27-13, paragraph (1) (including as applied mutatis mutandis pursuant to Article 27-17).

使用者が第二十七条の二十の規定による裁判所の命令に違反したときは、五十万円(当該命令が作為を命ずるものであるときは、その命令の日の翌日から起算して不履行の日数が五日を超える場合にはその超える日数一日につき十万円の割合で算定した金額を加えた金額)以下の過料に処する。第二十七条の十三第一項(第二十七条の十七の規定により準用する場合を含む。)の規定により確定した救済命令等に違反した場合も、同様とする。

Article 32-2

第三十二条の二

A person falling under any of the following items is punished by a civil fine not exceeding 300,000 yen:

次の各号のいずれかに該当する者は、三十万円以下の過料に処する。

a person who, in violation of the disposition pursuant to the provisions of Article 27-7, paragraph (1), item (i) (including as applied mutatis mutandis pursuant to Article 27-17), has failed to appear or give a statement without legitimate grounds;

正当な理由がないのに、第二十七条の七第一項第一号(第二十七条の十七の規定により準用する場合を含む。)の規定による処分に違反して出頭せず、又は陳述をしない者

a person who, in violation of the disposition pursuant to the provisions of Article 27-7, paragraph (1), item (ii) (including as applied mutatis mutandis pursuant to Article 27-17), has failed to submit an object without legitimate grounds;

正当な理由がないのに、第二十七条の七第一項第二号(第二十七条の十七の規定により準用する場合を含む。)の規定による処分に違反して物件を提出しない者

a person who, in violation of the disposition pursuant to the provisions of Article 27-8 (including as applied mutatis mutandis pursuant to Article 27-17), has failed to take an oath without legitimate grounds.

正当な理由がないのに、第二十七条の八(第二十七条の十七の規定により準用する場合を含む。)の規定による処分に違反して宣誓をしない者

Article 32-3

第三十二条の三

When a party who has sworn an oath pursuant to the provisions of Article 27-8, paragraph (2) (including as applied mutatis mutandis pursuant to Article 27-17) has made a false statement, the party is punished by a civil fine not exceeding 300,000 yen.

第二十七条の八第二項(第二十七条の十七の規定により準用する場合を含む。)の規定により宣誓した当事者が虚偽の陳述をしたときは、三十万円以下の過料に処する。

Article 32-4

第三十二条の四

A person who, in violation of the disposition pursuant to the provisions of Article 27-11 (including as applied mutatis mutandis pursuant to Article 27-17), has interfered in the hearing is punished by a civil fine not exceeding 100,000 yen.

第二十七条の十一(第二十七条の十七の規定により準用する場合を含む。)の規定による処分に違反して審問を妨げた者は、十万円以下の過料に処する。

Article 33

第三十三条

A liquidator of a labor union that is a corporation is punished by a civil fine not exceeding 500,000 yen in any of the following cases:

法人である労働組合の清算人は、次の各号のいずれかに該当する場合には、五十万円以下の過料に処する。

when the liquidator has failed to make the registration provided for in Article 13-5;

第十三条の五に規定する登記を怠つたとき。

when the liquidator has failed to give the public notice under Article 13-7, paragraph (1) or Article 13-9, paragraph (1), or has given an improper public notice;

第十三条の七第一項又は第十三条の九第一項の公告を怠り、又は不正の公告をしたとき。

when the liquidator has failed to file a petition for commencement of bankruptcy proceedings pursuant to the provisions of Article 13-9, paragraph (1); or

第十三条の九第一項の規定による破産手続開始の申立てを怠つたとき。

when the liquidator has made a false statement to a government agency or the general assembly meeting, or has concealed facts.

官庁又は総会に対し、不実の申立てをし、又は事実を隠ぺいしたとき。

The provisions of the preceding paragraph apply mutatis mutandis to the representative of a labor union that is a corporation when the representative has failed to make a registration of the changes in the registered information, as provided for in Cabinet Order issued based on the provisions of Article 11, paragraph (2) of this Act.

前項の規定は、法人である労働組合の代表者が第十一条第二項の規定に基いて発する政令で定められた登記事項の変更の登記をすることを怠つた場合において、その代表者につき準用する。
