Supplementary Provisions, Article 5Transitional Measures Concerning the Duty of Confidentiality
第五条（秘密保持義務に関する経過措置）
With regard to a person who has been entrusted with conducting the training set forth in Article 108-2, paragraph (1), item (xii) of the Road Traffic Act pursuant to Article 108-2, paragraph (3) of the Road Traffic Act before its amendment by this Act (hereinafter in this Article referred to as the "Former Act") (limited to training conducted on the basis of the results of a cognitive assessment pursuant to Article 97-2, paragraph (1), item (iii), (a), Article 101-4, paragraph (2) or Article 101-7, paragraph (4) of the Former Act), or a person who has been entrusted with conducting the training set forth in Article 108-2, paragraph (1), item (xii) of the Road Traffic Act pursuant to Article 108-2, paragraph (3) of the New Act (limited to training conducted on the basis of the results of a cognitive assessment pursuant to Article 97-2, paragraph (1), item (iii), (a) or Article 101-4, paragraph (2) of the Former Act in the case where, pursuant to paragraph (1) or (2) of the preceding Article, the provisions then in force continue to govern) (or, where such a person is a corporation, its officers), or the employees of those persons or persons who were any of those persons, Article 108-2, paragraph (4) of the Former Act remains in force even after this Act comes into effect.
この法律による改正前の道路交通法（以下この条において「旧法」という。）第百八条の二第三項の規定により道路交通法第百八条の二第一項第十二号に掲げる講習（旧法第九十七条の二第一項第三号イ、第百一条の四第二項又は第百一条の七第四項の規定により認知機能検査の結果に基づいて行うものに限る。）の実施の委託を受けた者若しくは新法第百八条の二第三項の規定により道路交通法第百八条の二第一項第十二号に掲げる講習（前条第一項又は第二項の規定によりなお従前の例によることとされる場合における旧法第九十七条の二第一項第三号イ又は第百一条の四第二項の規定により認知機能検査の結果に基づいて行うものに限る。）の実施の委託を受けた者（これらの者が法人である場合にあっては、その役員）若しくはこれらの職員又はこれらの者であった者については、旧法第百八条の二第四項の規定は、この法律の施行後も、なおその効力を有する。
