Article 75-12Permission for Specified Automated Operation
第七十五条の十二（特定自動運行の許可）
A person who intends to engage in specified automated operation must obtain permission from the public safety commission with jurisdiction over the place where the person intends to engage in specified automated operation.
A person seeking the permission under the preceding paragraph must submit to the public safety commission a written application stating the following matters:
the name and address of the person who is to engage in specified automated operation and, if it is a corporation, the name of its representative and the names and addresses of its officers;
特定自動運行を行う者の氏名又は名称及び住所並びに法人にあつては、その代表者の氏名並びにその役員の氏名及び住所
a plan concerning specified automated operation (hereinafter referred to as a "specified automated operation plan") stating the following matters:
次に掲げる事項を記載した特定自動運行に関する計画（以下「特定自動運行計画」という。）
the model, motor vehicle registration number or vehicle number and chassis number of the motor vehicle used for specified automated operation (hereinafter referred to as a "motor vehicle for specified automated operation"), the conditions of use for the automated operation device, and other matters concerning the motor vehicle for specified automated operation that Cabinet Office Order prescribes;
the following matters concerning specified automated operation:
特定自動運行に関する次に掲げる事項
the route of specified automated operation;
特定自動運行の経路
the days and times of day on which specified automated operation is to be carried out;
特定自動運行を行う日及び時間帯
the persons or goods to be transported by specified automated operation;
特定自動運行により運送される人又は物
in addition to what is set forth in (1) through (3), matters that Cabinet Office Order prescribes;
（１）から（３）までに掲げるもののほか、内閣府令で定める事項
the location and contact information of the place that manages specified automated operation;
特定自動運行を管理する場所の所在地及び連絡先
the following matters concerning measures that a specified automated operation provider (meaning a specified automated operation provider prescribed in Article 75-16, paragraph (1); the same applies in paragraph (1), item (iii) of the following Article) or a specified automated operation worker (meaning a specified automated operation worker prescribed in Article 75-19, paragraph (1); the same applies in paragraph (1), item (iii) of the following Article) must implement under the provisions of this Act, the provisions of orders under this Act, and dispositions under the provisions of this Act:
この法律及びこの法律に基づく命令の規定並びにこの法律の規定に基づく処分により特定自動運行実施者（第七十五条の十六第一項に規定する特定自動運行実施者をいう。次条第一項第三号において同じ。）又は特定自動運行業務従事者（第七十五条の十九第一項に規定する特定自動運行業務従事者をいう。次条第一項第三号において同じ。）が実施しなければならない措置に関する次に掲げる事項
the specific content of the education prescribed in Article 75-19, paragraph (1) and the method of implementing it;
第七十五条の十九第一項に規定する教育の具体的内容及びその実施方法
the method of designating the specified automated operation supervisor under Article 75-19, paragraph (2) and the person in charge of on-site measures under paragraph (3) of that Article;
第七十五条の十九第二項の規定による特定自動運行主任者の指定及び同条第三項の規定による現場措置業務実施者の指定の方法
the method of implementing the measures prescribed in Article 75-20, paragraph (1) and the equipment, personnel, and other arrangements for taking those measures;
第七十五条の二十第一項に規定する措置の実施方法及び当該措置を講ずるための装置、人員その他の体制
the specific method of the display under Article 75-20, paragraph (2);
第七十五条の二十第二項の規定による表示の具体的方法
the facilities, personnel, and other arrangements for taking the measures under Article 75-21, Article 75-22, and Article 75-23, paragraphs (1) through (3), and the procedures for those measures;
第七十五条の二十一、第七十五条の二十二及び第七十五条の二十三第一項から第三項までの規定による措置を講ずるための設備、人員その他の体制及び当該措置の手順
in addition to what is set forth in (1) through (5), matters that Cabinet Office Order prescribes.
（１）から（５）までに掲げるもののほか、内閣府令で定める事項
A document stating the recorded matters of the motor vehicle inspection certificate of the motor vehicle for specified automated operation (meaning the recorded matters of the motor vehicle inspection certificate prescribed in Article 58, paragraph (2) of the Road Transport Vehicle Act) and other documents prescribed by Cabinet Office Order must be attached to the written application under the preceding paragraph.
前項の申請書には、特定自動運行用自動車の自動車検査証記録事項（道路運送車両法第五十八条第二項に規定する自動車検査証記録事項をいう。）が記載された書面その他の内閣府令で定める書類を添付しなければならない。
When the public safety commission intends to grant the permission under paragraph (1) of the preceding Article, it must do so after examining whether the specified automated operation plan stated in the written application submitted under paragraph (2) of that Article conforms to the following standards:
the motor vehicle for specified automated operation under the specified automated operation plan is capable of engaging in specified automated operation;
特定自動運行計画に係る特定自動運行用自動車が特定自動運行を行うことができるものであること。
specified automated operation carried out in accordance with the specified automated operation plan satisfies the conditions of use for the automated operation device of that motor vehicle for specified automated operation;
特定自動運行計画に従つて行われる特定自動運行が当該特定自動運行用自動車の自動運行装置に係る使用条件を満たすものであること。
the smooth and reliable implementation is anticipated of the measures that a specified automated operation provider or specified automated operation worker must implement under the provisions of this Act, the provisions of orders under this Act, and dispositions under the provisions of this Act, including the measures under Articles 75-19 through 75-22 and Article 75-23, paragraphs (1) through (3);
第七十五条の十九から第七十五条の二十二まで及び第七十五条の二十三第一項から第三項までの規定による措置その他のこの法律及びこの法律に基づく命令の規定並びにこの法律の規定に基づく処分により特定自動運行実施者又は特定自動運行業務従事者が実施しなければならない措置の円滑かつ確実な実施が見込まれるものであること。
it is found that specified automated operation carried out in accordance with the specified automated operation plan (including the case where that specified automated operation ends on a road) is not likely to seriously hinder other traffic;
specified automated operation carried out in accordance with the specified automated operation plan is for the purpose of transporting persons or goods, and that transport is found to contribute to improving the convenience or welfare of local residents.
When the public safety commission intends to grant the permission under paragraph (1) of the preceding Article, it must, for each of the matters set forth in the following items, hear the opinion of the person specified in the relevant item concerning that matter.
the matters set forth in items (i) and (ii) of the preceding paragraph: the Minister of Land, Infrastructure, Transport and Tourism or other relevant authority;
the matter set forth in item (v) of the preceding paragraph: the head of the municipality (including a special ward; the same applies in Article 106-4, paragraph (1)) whose area includes the route prescribed in Article 75-12, paragraph (2), item (ii), (b), (1).
Article 75-14Ineligibility for Permission
第七十五条の十四（欠格事由）
The public safety commission must not grant the permission under Article 75-12, paragraph (1) if the person seeking it falls under any of the following items:
公安委員会は、第七十五条の十二第一項の許可を受けようとする者が次の各号のいずれかに該当する場合には、その許可をしてはならない。
when the person has had permission revoked pursuant to Article 75-27, paragraph (1) and five years have not passed since the date of the revocation (including, where the person whose permission was revoked is a corporation, a person who was actually serving as a corporate officer of the corporation at the time when the matters that caused the corporation to receive that disposition occurred and for whom five years have not passed since the date of the revocation);
第七十五条の二十七第一項の規定により許可を取り消され、その取消しの日から五年を経過していない者（当該許可を取り消された者が法人である場合においては、当該取消しを受けた法人のその処分を受ける原因となつた事項が発生した当時現にその法人の役員として在任した者で当該取消しの日から五年を経過していないものを含む。）であるとき。
when the person is a corporation and a corporate officer of the corporation is a person who falls under the preceding item.
Article 75-15License Conditions
第七十五条の十五（許可の条件）
When granting the permission under Article 75-12, paragraph (1), the public safety commission may, if it finds it necessary, attach to the permission the conditions necessary to prevent hazards on roads and otherwise ensure the safety and fluidity of traffic.
公安委員会は、第七十五条の十二第一項の許可をする場合において、必要があると認めるときは、当該許可に道路における危険を防止し、その他交通の安全と円滑を図るため必要な条件を付することができる。
When a special need arises to prevent hazards on roads and otherwise ensure the safety and fluidity of traffic, the public safety commission may change the conditions attached under the preceding paragraph or attach new conditions.
Article 75-16Changes to Permitted Matters
第七十五条の十六（許可事項の変更）
A person who has obtained the permission under Article 75-12, paragraph (1) (hereinafter referred to as a "specified automated operation provider") must, when intending to change the specified automated operation plan, obtain permission from the public safety commission pursuant to Cabinet Office Order; provided, however, that this does not apply to minor changes prescribed by Cabinet Office Order.
第七十五条の十二第一項の許可を受けた者（以下「特定自動運行実施者」という。）は、特定自動運行計画を変更しようとするときは、内閣府令で定めるところにより、公安委員会の許可を受けなければならない。ただし、内閣府令で定める軽微な変更については、この限りでない。
The provisions of Article 75-13 and the preceding Article apply mutatis mutandis to the permission under the preceding paragraph.
When a specified automated operation provider intends to make a minor change prescribed by Cabinet Office Order as referred to in the proviso to paragraph (1), the provider must notify the public safety commission to that effect pursuant to Cabinet Office Order.
When a specified automated operation provider has changed the matters set forth in Article 75-12, paragraph (2), item (i), the provider must notify the public safety commission within 30 days from the date of the change, pursuant to Cabinet Office Order.
特定自動運行実施者は、第七十五条の十二第二項第一号に掲げる事項を変更したときは、内閣府令で定めるところにより、変更の日から三十日以内に、公安委員会に届け出なければならない。
第七十五条の十七（公示）
When the public safety commission has granted the permission under Article 75-12, paragraph (1) or paragraph (1) of the preceding Article, it must give public notice to that effect pursuant to Cabinet Office Order.
公安委員会は、第七十五条の十二第一項又は前条第一項の許可をしたときは、内閣府令で定めるところにより、その旨を公示しなければならない。
Specified automated operation must be carried out in accordance with the specified automated operation plan for which permission was obtained under Article 75-12, paragraph (1) (or, where a change has been permitted or notified under Article 75-16, paragraph (1) or (3), the plan as changed; the same applies in Article 75-27, paragraph (1), item (ii)) and the conditions attached under Article 75-15, paragraph (1) (including as applied mutatis mutandis pursuant to Article 75-16, paragraph (2)) (including conditions changed or newly attached under Article 75-15, paragraph (2) (including as applied mutatis mutandis pursuant to Article 75-16, paragraph (2))).
特定自動運行は、第七十五条の十二第一項の許可を受けた特定自動運行計画（第七十五条の十六第一項又は第三項の規定による変更の許可又は届出があつたときは、その変更後のもの。第七十五条の二十七第一項第二号において同じ。）及び第七十五条の十五第一項（第七十五条の十六第二項において準用する場合を含む。）の規定により付された条件（第七十五条の十五第二項（第七十五条の十六第二項において準用する場合を含む。）の規定により変更され、又は新たに付された条件を含む。）に従わなければならない。
