Supplementary Provisions, Article 33
第三十三条
If a financial instruments business operator first receives, after the enforcement of this Act, an application for a financial instruments transaction contract (meaning a financial instruments transaction contract prescribed in Article 34 of the New Financial Instruments and Exchange Act; the same applies hereinafter) from a customer (limited to a person set forth in Article 2, paragraph (31), item (iv) of the New Financial Instruments and Exchange Act), and, before the enforcement of this Act, has notified that customer, in the manner provided for in Article 34 of the New Financial Instruments and Exchange Act, that after the enforcement of this Act the customer may make a request under Article 34-2, paragraph (1) of the New Financial Instruments and Exchange Act, the operator is deemed to have given that customer the notice prescribed in that Article.
金融商品取引業者は、この法律の施行後最初に金融商品取引契約（新金融商品取引法第三十四条に規定する金融商品取引契約をいう。以下同じ。）の申込みを顧客（新金融商品取引法第二条第三十一項第四号に掲げる者に限る。）から受けた場合であって、この法律の施行前に、当該顧客に対し、この法律の施行後に当該顧客が新金融商品取引法第三十四条の二第一項の規定による申出ができる旨を新金融商品取引法第三十四条の例により告知しているときには、当該顧客に対し、同条に規定する告知をしたものとみなす。

investor protection funds prescribed in Article 79-21 and other corporations specified by Cabinet Office Order beyond those set forth in the preceding three items.
