A performer has the exclusive right to make that performer's performance available for transmission.
The provisions of the preceding paragraph do not apply to any of the following performances:
a performance whose visuals have been recorded with the authorization of the owner of the right provided for in Article 91, paragraph (1);
a performance referred to in Article 91, paragraph (2) whose sound or visuals have been recorded other than as a sound recording referred to in that paragraph.
録音権及び録画権
前項の規定は、同項に規定する権利を有する者の許諾を得て映画の著作物において録音され、又は録画された実演については、これを録音物（音を専ら影像とともに再生することを目的とするものを除く。）に録音する場合を除き、適用しない。

著作物を、演劇的に演じ、舞い、演奏し、歌い、口演し、朗詠し、又はその他の方法により演ずること（これらに類する行為で、著作物を演じないが芸能的な性質を有するものを含む。）

次のいずれかに掲げる行為により自動公衆送信し得るようにすること

公衆の用に供されている電気通信回線に接続した自動公衆送信装置の記録媒体に情報を記録し、又は装置に情報を入力することや、情報が記録・入力された装置を回線に接続することなどによって、自動公衆送信できる状態にすることです。
