Supplementary Provisions, Article 35Partial Amendment of the Securities and Exchange Act
第三十五条（証券取引法の一部改正）
With regard to the application of the provisions of Article 2, paragraph (1), items (iv), (viii), (xix), and (xx) of the Financial Instruments and Exchange Act as amended by Article 3 of the Act Partially Amending the Securities and Exchange Act, etc. (Act No. 65 of 2006), the specified corporate bonds and preferred equity securities pertaining to a former special purpose company prescribed in Article 229 of the Act on Arrangement of Relevant Acts Incidental to Enforcement of the Companies Act (Act No. 87 of 2005) are deemed to be the specified corporate bonds and preferred equity securities, respectively, pertaining to a special purpose company established pursuant to the provisions of the Act on the Securitization of Assets (Act No. 105 of 1998).
証券取引法等の一部を改正する法律（平成十八年法律第六十五号）第三条の規定による改正後の金融商品取引法第二条第一項第四号、第八号、第十九号及び第二十号の規定の適用については、会社法の施行に伴う関係法律の整備等に関する法律（平成十七年法律第八十七号）第二百二十九条に規定する旧特定目的会社に係る特定社債券及び優先出資証券は、それぞれ資産の流動化に関する法律（平成十年法律第百五号）の規定により設立された特定目的会社に係る特定社債券及び優先出資証券とみなす。
