Supplementary Provisions, Article 1Effective Date
第一条（施行期日）
This Cabinet Order comes into effect on January 1, 2022.
この政令は、令和四年一月一日から施行する。

第二条（障害基礎年金の支給及び額の改定に関する経過措置）
The provisions of the Appended Table of the Order for Enforcement of the National Pension Act as amended by the provisions of Article 1 (hereinafter referred to as the "New National Pension Order") apply to the payment of the disability basic pension for a month on or after the month following the month that includes the date of enforcement of this Cabinet Order (hereinafter referred to as the "Effective Date"), and the provisions then in force continue to govern the payment of the disability basic pension for a month on or before the month that includes the Effective Date.
第一条の規定による改正後の国民年金法施行令（以下「新国年令」という。）別表の規定は、この政令の施行の日（以下「施行日」という。）の属する月の翌月以後の月分の障害基礎年金の支給について適用し、施行日の属する月以前の月分の障害基礎年金の支給については、なお従前の例による。
A person entitled to receive the disability basic pension whose right to receive it arose before the Effective Date (limited to a person whose degree of disability falls under the state of disability of grade 2 prescribed in the Appended Table of the Order for Enforcement of the National Pension Act prior to amendment by the provisions of Article 1 (hereinafter referred to as the "Former National Pension Order")) and whose degree of disability comes to fall under the state of disability of grade 1 prescribed in the Appended Table of the New National Pension Order as a result of the enforcement of this Cabinet Order may request the Minister of Health, Labour and Welfare to revise the amount of that disability basic pension.
The Minister of Health, Labour and Welfare may revise the amount of the disability basic pension when a request under the preceding paragraph is made.
厚生労働大臣は、前項の規定による請求があったときは、障害基礎年金の額を改定することができる。

第三条（障害厚生年金等の支給及び額の改定等に関する経過措置）
The provisions of the Appended Table of the New National Pension Order and Appended Table I of the Order for Enforcement of the Employees' Pension Insurance Act as amended by the provisions of Article 2 (referred to as the "New Employees' Pension Order" in the following paragraph and paragraph (6)) apply to the payment of the disability employees' pension, etc. (meaning the disability employees' pension and other benefits that are pensions paid according to a degree of disability falling under a disability grade prescribed in Article 47, paragraph (2) of the Employees' Pension Insurance Act; hereinafter the same in this Article) for a month on or after the month following the month that includes the Effective Date, and the provisions then in force continue to govern the payment of the disability employees' pension, etc. for a month on or before the month that includes the Effective Date.
新国年令別表及び第二条の規定による改正後の厚生年金保険法施行令（次項及び第六項において「新厚年令」という。）別表第一の規定は、施行日の属する月の翌月以後の月分の障害厚生年金等（障害厚生年金その他の厚生年金保険法第四十七条第二項に規定する障害等級に該当する障害の程度に応じて支給される年金たる給付をいう。以下この条において同じ。）の支給について適用し、施行日の属する月以前の月分の障害厚生年金等の支給については、なお従前の例による。
A person entitled to receive the disability employees' pension, etc. whose right to receive it arose before the Effective Date (limited to a person whose degree of disability falls under the state of disability of grade 2 prescribed in the Appended Table of the Former National Pension Order) and whose degree of disability comes to fall under the state of disability of grade 1 prescribed in the Appended Table of the New National Pension Order as a result of the enforcement of this Cabinet Order, or a person entitled to receive the disability employees' pension, etc. whose right to receive it arose before the Effective Date (limited to a person whose degree of disability falls under the state of disability prescribed in Appended Table I of the Order for Enforcement of the Employees' Pension Insurance Act prior to amendment by the provisions of Article 2) and whose degree of disability comes to fall under the state of disability of grade 2 prescribed in the Appended Table of the New National Pension Order as a result of the enforcement of this Cabinet Order, may request the administering body of the system relating to benefits of the disability employees' pension, etc. to revise the amount of that disability employees' pension, etc.
施行日前に受給権が発生した障害厚生年金等の受給権者（その障害の程度が旧国年令別表に定める二級の障害の状態に該当する者に限る。）であって、この政令の施行によりその障害の程度が新国年令別表に定める一級の障害の状態に該当することとなったもの又は施行日前に受給権が発生した障害厚生年金等の受給権者（その障害の程度が第二条の規定による改正前の厚生年金保険法施行令別表第一に定める障害の状態に該当する者に限る。）であって、この政令の施行によりその障害の程度が新国年令別表に定める二級の障害の状態に該当することとなったものは、障害厚生年金等の給付に係る制度の管掌機関に対し、当該障害厚生年金等の額の改定を請求することができる。
The administering body of the system relating to benefits of the disability employees' pension, etc. may revise the amount of the disability employees' pension, etc. when a request under the preceding paragraph is made.
障害厚生年金等の給付に係る制度の管掌機関は、前項の規定による請求があったときは、障害厚生年金等の額を改定することができる。
The provisions of paragraph (3) do not apply to a person aged 65 or over who is a person entitled to receive the disability employees' pension, etc. (limited to a person who does not hold the right to receive the disability basic pension based on the same ground for payment as that disability employees' pension, etc.).
第三項の規定は、六十五歳以上の者であって、かつ、障害厚生年金等の受給権者（当該障害厚生年金等と同一の支給事由に基づく障害基礎年金の受給権を有しない者に限る。）については、適用しない。
Supplementary Provisions, Article 7Transitional Measures Concerning Revision of the Amount of the Special Disability Benefit
第七条（特別障害給付金の額の改定に関する経過措置）
In the case of a person receiving the special disability benefit under the Act on Provision of Special Disability Benefit to Specified Persons with Disabilities (Act No. 166 of 2004; referred to as the "Special Disability Benefit Act" in the following paragraph) (limited to a person who falls under the state of disability of grade 2 prescribed in the Appended Table of the Former National Pension Order) whose degree of disability comes to fall under the state of disability of grade 1 prescribed in the Appended Table of the New National Pension Order as a result of the enforcement of this Cabinet Order, the revision of the amount of the special disability benefit is to be made from the month following the month that includes the day on which that person requested certification of the revised amount.
The provisions of Article 7, paragraph (2) of the Special Disability Benefit Act apply mutatis mutandis to the revision under the preceding paragraph. In this case, the phrase "the preceding paragraph" in paragraph (2) of that Article is deemed to be replaced with "Article 7, paragraph (1) of the Supplementary Provisions of the Cabinet Order Partially Amending the Order for Enforcement of the National Pension Act, etc.".
特別障害給付金法第七条第二項の規定は、前項の改定について準用する。この場合において、同条第二項中「前項」とあるのは、「国民年金法施行令等の一部を改正する政令附則第七条第一項」と読み替えるものとする。
Supplementary Provisions, Article 8Transitional Measures Concerning Revision of the Amount of the Supplementing Allowance for Disability Pension Recipients
第八条（障害年金生活者支援給付金の額の改定に関する経過措置）
In the case of a person receiving the supplementing allowance for disability pension recipients under the Act on the Payment of Supplementing Allowance for Pensioners (Act No. 102 of 2012) (limited to a person who falls under the state of disability of grade 2 prescribed in the Appended Table of the Former National Pension Order) whose amount of the disability basic pension has been revised because the degree of disability has come to fall under the state of disability of grade 1 prescribed in the Appended Table of the New National Pension Order as a result of the enforcement of this Cabinet Order, the revision of the amount of the supplementing allowance for disability pension recipients is to be made from the month following the month that includes the day on which the amount of that disability basic pension was revised.
