Supplementary Provisions, Article 7

第七条

A securities company that actually holds a license under Article 28, paragraph (2), item (i) or (ii) of the Former Act at the time this Act comes into effect is deemed to have obtained a license under Article 28, paragraph (2), item (i) or (ii) of the New Act at that time. In this case, the conditions under Article 29, paragraph (1) of the Former Act pertaining to the license under Article 28, paragraph (2), item (i) or (ii) of the Former Act are deemed to be the conditions under Article 29, paragraph (1) of the New Act pertaining to the license under Article 28, paragraph (2), item (i) or (ii) of the New Act.

この法律の施行の際現に旧法第二十八条第二項第一号又は第二号の免許を受けている証券会社は、この法律の施行の際新法第二十八条第二項第一号又は第二号の免許を受けたものとみなす。この場合において、旧法第二十八条第二項第一号又は第二号の免許に係る旧法第二十九条第一項の条件は、新法第二十八条第二項第一号又は第二号の免許に係る新法第二十九条第一項の条件とみなす。

A financial institution that actually holds, at the time this Act comes into effect, the authorization referred to in Article 28, paragraph (2), item (i) or (ii) of the Former Act as applied mutatis mutandis in paragraph (2) of Article 65-2 of the Former Act pursuant to the provisions of paragraph (1) of that Article is deemed to have obtained, at the time this Act comes into effect, the authorization referred to in Article 28, paragraph (2), item (i) or (ii) of the New Act as applied mutatis mutandis in paragraph (2) of Article 65-2 of the New Act pursuant to the provisions of paragraph (1) of that Article. In this case, the conditions referred to in Article 29, paragraph (1) of the Former Act as applied mutatis mutandis in Article 65-2, paragraph (2) of the Former Act, pertaining to the authorization under Article 28, paragraph (2), item (i) or (ii) of the Former Act as applied mutatis mutandis in paragraph (2) of Article 65-2 of the Former Act pursuant to the provisions of paragraph (1) of that Article, are deemed to be the conditions referred to in Article 29, paragraph (1) of the New Act as applied mutatis mutandis in Article 65-2, paragraph (2) of the New Act, pertaining to the authorization under Article 28, paragraph (2), item (i) or (ii) of the New Act as applied mutatis mutandis in paragraph (2) of Article 65-2 of the New Act pursuant to the provisions of paragraph (1) of that Article.

この法律の施行の際現に旧法第六十五条の二第一項の規定により同条第二項において準用する旧法第二十八条第二項第一号又は第二号の認可を受けている金融機関は、この法律の施行の際新法第六十五条の二第一項の規定により同条第二項において準用する新法第二十八条第二項第一号又は第二号の認可を受けたものとみなす。この場合において、旧法第六十五条の二第一項の規定による同条第二項において準用する旧法第二十八条第二項第一号又は第二号の認可に係る旧法第六十五条の二第二項において準用する旧法第二十九条第一項の条件は、新法第六十五条の二第一項の規定による同条第二項において準用する新法第二十八条第二項第一号又は第二号の認可に係る新法第六十五条の二第二項において準用する新法第二十九条第一項の条件とみなす。
