Supplementary Provisions

附　則

This Act comes into effect as of the date of promulgation; provided, however, that Article 191-2 and the provisions on penalties for acts in violation of that Article come into effect as of the day on which six months have elapsed from the date of promulgation.

この法律は、公布の日から施行する。但し、第百九十一条の二及び同条の規定に違反する行為に対する罰則の規定は、公布の日から起算して六月を経過した日から施行する。

With regard to the application of the provisions of Article 39, paragraph (1) of the Act to a person that is a securities dealer at the time this Act comes into effect, the provisions then in force continue to govern; provided, however, that this does not apply if that person falls under any of the following items:

この法律施行の際現に証券業者である者に対する法第三十九条第一項の規定の適用については、なお従前の例による。但し、その者が左の各号の一に該当する場合は、この限りでない。

when the person newly comes to fall under the provisions amending Article 31, item (iii)-2, item (iii)-3, item (vii), or item (viii) of the Act, or the provisions of item (vi) of that Article (limited to the part related to the provisions amending items (iii)-2 and (iii)-3 of that Article; hereinafter the same applies in this paragraph), after this Act comes into effect; or

この法律施行後新たに法第三十一条第三号の二、第三号の三、第七号若しくは第八号の改正規定又は同条第六号の規定（但し、同条第三号の二及び第三号の三の改正規定に関連する部分に限る。以下本項において同じ。）に該当することとなつたとき。

when six months have elapsed from the day this Act comes into effect, in the case where the person falls under the provisions amending Article 31, item (iii)-2 or (iii)-3 of the Act or the provisions of item (vi) of that Article at the time this Act comes into effect; provided, however, that this excludes the case where, within that period, the person has ceased to fall under the provisions of Article 31, item (vi) of the Act.

この法律施行の際現に法第三十一条第三号の二、第三号の三の改正規定又は同条第六号の規定に該当する場合で、この法律施行の日から六月を経過したとき。但し、当該期間内において、法第三十一条第六号の規定に該当しないこととなつた場合を除く。

The provisions amending Article 41-2, paragraph (1) of the Act do not apply to a person that is a securities dealer at the time this Act comes into effect; provided, however, that this does not apply if the person intends to change the trade name in use at the time this Act comes into effect.

法第四十一条の二第一項の改正規定は、この法律施行の際現に証券業者である者については適用しない。但し、この法律施行の際現に使用する商号を変更しようとする場合は、この限りでない。

The provisions amending Article 41-2, paragraph (2) of the Act do not apply, for six months from the day this Act comes into effect, to a person that is not a securities dealer at the time this Act comes into effect and that uses in its trade name characters likely to cause it to be mistaken for a securities dealer.

法第四十一条の二第二項の改正規定は、この法律施行の際現に証券業者でない者であつて、その商号のうちに証券業者であると誤認される虞のある文字を用いているものについては、この法律施行の日から六月を限り適用しない。

The provisions amending Article 52 of the Act apply from the business year beginning in October 1949.

法第五十二条の改正規定は、昭和二十四年十月に始まる営業年度から適用する。

A person who holds the position of chairperson or member of the securities and Exchange Commission at the time this Act comes into effect is to retain that position until the chairperson and members of the securities and Exchange Commission are appointed under the provisions amending Article 166, paragraph (2) of the Act.

この法律施行の際現に証券取引委員会の委員長及び委員の職にある者は、法第百六十六条第二項の改正規定による証券取引委員会の委員長及び委員の任命があるまでは、なおその地位を有するものとする。

The provisions amending Article 191-2 of the Act do not apply to an act that is in violation of the provisions of that Article at the time those provisions come into effect.

法第百九十一条の二の改正規定は、この規定施行の際現に同条の規定に違反している行為については適用しない。

The provisions of paragraph (15) of the Supplementary Provisions apply beginning with the chairperson and members of the securities and Exchange Commission first appointed under the provisions amending Article 166, paragraph (2) of the Act.

附則第十五項の規定は、法第百六十六条第二項の改正規定により最初に任命される証券取引委員会の委員長及び委員から適用する。

With regard to the application of penal provisions to acts committed before this Act comes into effect, the provisions then in force continue to govern.

この法律施行前にした行為に対する罰則の適用については、なお従前の例による。

Supplementary Provisions
