第五条（調整規定）
If the date on which the Penal Code Amendment Act comes into effect falls after the date on which this Act comes into effect, with regard to the application of the provisions of (n) of item (ii) of Appended Table 3 of the new Act on Punishment of Organized Crimes during the period until the day before the date on which the Penal Code Amendment Act comes into effect, the phrase ", forcible sexual intercourse" in (n) of that item is deemed to be replaced with ", rape", and the phrase "constructive forcible sexual intercourse" with "constructive rape".
刑法一部改正法の施行の日がこの法律の施行の日後となる場合には、刑法一部改正法の施行の日の前日までの間における新組織的犯罪処罰法別表第三第二号カの規定の適用については、同号カ中「、強制性交等」とあるのは「、強姦」と、「準強制性交等」とあるのは「準強姦」とする。
In the case referred to in the preceding paragraph, in the provisions amending Article 3 of the Penal Code in the Penal Code Amendment Act, the phrase "item (xii) of that Article" is deemed to be replaced with "item (xiii) of that Article", and the phrase "item (xiii) of that Article" with "item (xiv) of that Article", and the provisions of Article 6 of the Supplementary Provisions of the Penal Code Amendment Act do not apply.
前項の場合においては、刑法一部改正法のうち刑法第三条の改正規定中「同条第十二号」とあるのは「同条第十三号」と、「同条第十三号」とあるのは「同条第十四号」とし、刑法一部改正法附則第六条の規定は、適用しない。
