第五条の三（法第三十六条の二第五項の政令で定める給付等）
The benefits specified by Cabinet Order prescribed in Article 36-2, paragraph (5) of the Act are as follows:
法第三十六条の二第五項に規定する政令で定める給付は、次のとおりとする。
An injury and illness pension paid pursuant to Article 3 or Article 22, paragraph (1) of the Supplementary Provisions of the Act Partially Amending the Public Officers Pension Act (Act No. 155 of 1953; hereinafter referred to as "Act No. 155"), and a special injury and illness pension paid pursuant to Article 13, paragraph (1) of the Supplementary Provisions of the Act Partially Amending the Public Officers Pension Act, etc. (Act No. 81 of 1971; hereinafter referred to as "Act No. 81");
恩給法の一部を改正する法律（昭和二十八年法律第百五十五号。以下「法律第百五十五号」という。）附則第三条又は附則第二十二条第一項の規定により支給される傷病年金及び恩給法等の一部を改正する法律（昭和四十六年法律第八十一号。以下「法律第八十一号」という。）附則第十三条第一項の規定により支給される特例傷病恩給

Among benefits that are pensions paid by the Federation of National Public Service Personnel Mutual Aid Associations or that are pensions which the government as the implementer of Employees' Pension Insurance is to pay pursuant to Article 16, paragraph (3) of the Supplementary Provisions of the Act Partially Amending the Employees' Pension Insurance Act, etc. (Act No. 82 of 1996; hereinafter referred to as the "1996 Amendment Act"), those for which the ground for payment is disability or death due to official duty.
国家公務員共済組合連合会が支給する年金たる給付又は厚生年金保険法等の一部を改正する法律（平成八年法律第八十二号。以下「平成八年改正法」という。）附則第十六条第三項の規定により厚生年金保険の実施者たる政府が支給するものとされた年金たる給付のうち、公務による障害又は死亡を支給事由とするもの
The persons specified by Cabinet Order prescribed in Article 36-2, paragraph (5) of the Act are, according to the type of benefit, as provided for in the right-hand column of the following table.

| (i) | An increased pension under the Public Officers Pension Act, and the injury and illness pension and special injury and illness pension prescribed in item (i) of the preceding paragraph | A person who receives the benefit for disability due to an injury or illness prescribed in the following items (where an ordinary pension is paid concurrently with the benefit, limited to a person whose rank at the time of being injured or contracting the illness was captain or equivalent or lower): (i) Injury or illness due to official duty as a military person or quasi-military person prescribed in Article 21 of the Public Officers Pension Act prior to its amendment by the Act Partially Amending the Public Officers Pension Act (Act No. 31 of 1946); (ii) Injury or illness falling under Article 23, item (i) of the Order for Enforcement of the Public Officers Pension Act (Imperial Ordinance No. 367 of 1923) prior to its amendment by the Imperial Ordinance Partially Amending the Order for Enforcement of the Public Officers Pension Act (Imperial Ordinance No. 504 of 1946) (including that item prior to its amendment by Imperial Ordinance No. 244 of 1942); (iii) Injury or illness deemed to be due to official duty during service pursuant to Article 29-2 or Article 30, paragraph (4) of the Supplementary Provisions of Act No. 155; (iv) Injury or illness prescribed in Article 13, paragraph (1) of the Supplementary Provisions of Act No. 81. |
| (ii) | The family pension prescribed in Article 75, paragraph (1), item (ii) of the Public Officers Pension Act and the family pension prescribed in item (ii) of the preceding paragraph | A person who receives the benefit by reason of being a surviving family member of a person who died of an injury or illness prescribed in the items in the right-hand column of row (i) of this table (limited to a person whose rank at the time of being injured or contracting the illness was captain or equivalent or lower), or a surviving family member falling under Article 35-3, paragraph (1) of the Supplementary Provisions of Act No. 155 (limited to a surviving family member of a person whose rank at the time of death was captain or equivalent or lower) |

| (v) | Among the benefits prescribed in item (v) of the preceding paragraph, those for which the ground for payment is disability | (i) A person who was a civilian military employee prescribed in Article 2, paragraph (1), item (ii) of the War Victims Relief Act and who receives the benefit for disability due to an injury or illness incurred through official duty during the period of service prescribed in Article 3, paragraph (1), item (ii) of that Act; (ii) A person who was a quasi-military civilian employee prescribed in Article 2, paragraph (3), item (i) of the War Victims Relief Act and who receives the benefit for disability due to an injury or illness deemed to be due to official duty under Article 4, paragraph (4), item (ii) of that Act; (iii) A person who was a quasi-military civilian employee prescribed in Article 2, paragraph (3), item (vi) of the War Victims Relief Act and who receives the benefit for disability due to an injury or illness due to official duty. |
| (vi) | Among the benefits prescribed in item (v) of the preceding paragraph, those for which the ground for payment is death | A person who receives the benefit by reason of being a surviving family member of a person who died of an injury or illness prescribed in the items in the right-hand column of row (v) of this table |

法第三十六条の二第五項に規定する政令で定める者は、給付の種類に応じて、それぞれ次の表の下欄に定めるとおりとする。
